MINUTES QF THE REGULAR MRETING OF
THE CITY COUNCIL OF THE CITY OF
DES PLAINES HELD IN THE COUNCIL
CHAMBERS ON THE 4th DAY OF JANUARY
A.D.19a7 AT THE HOUR OF 8:00 P.M.
CALL TO ORDER: The meeting was called to order
by Mayor George W.Einder, presiding, with Aldermen Ahbe,
Carroll, dune, Bishop, Frederick, Lemke, Schwanbecic and.
Campagna responding to the roll call. Aldermen Pflughaupt
and MacLuckie were absent during the entire meeting.
REQUEST FOR ANEND1NG ZONING ORDINANCE: Upon
permission of the Council, Mr. McDermott of the Borden -
Wieland Co. again addressed the Council in an attempt to
get the Council's reaction to his request for amending
the Zoning Ordinance so as to permit 25 employees in Clean-
ing and Dyeing plants located on commercial property.
REPORTS OF OFFICERS: The Clerk then read the
reports for December 1936 submitted by Edgar J.Friedrich,
City Clerk and Howard A.Becker, Chief of Police respectively.
THE JUDICIARY AND ASSESSMENT COMMITTEE: had no
report to offer.
THE POLICE AND LICENSE COMMITTEE: The Clerk
then read the following report:
To Tulle -Chairman Police & License Committee at the
meeting of the City Council held Dec.7,1936 the
following matter was referred to your committee;
The matter of stationing an officer at the intersection
of Ellinwood & Lee Streets from 4:30 to 630 PM on
all week -days.

Your Committee on Police License report: This matter
has been taken care of. Mater referred to.Police
Captain Becker with instructions to place proper pro-
tection at this crossing at time specified.

To Chairman Fulle-Police & License Committeq at the
meeting of the City Council, held i4ovember 16,1936
the following matter was referred to your committee:
The matter of co-operating with the k,ity Attorney by
furnishing him such information as he may require for
the presentation of the case asking for better crossing
protection at the Des Plaines Avenue crossing before
the Illinois Commerce Commission.

We, your committee on Police & License, have investi-
gated and have found: that a drawing of River Rd(Des
Plaines Ave.) was necessary for a full presentation
to the commission showing obstructions etc(plan attached
hereto)costing 425.00. Also check taken by 3 men to
determineviolations on signals. A very fine detailed
report has been prepared to present at this hearing on
Ian 13 and credit is due to Sergt.Drexier for his fine

work for safety at this crossing.

by our Supt.of Public Works,Marvin 'Wells, to determine
the proper type of Snow plow equipment adaptable to
our needs, and receiving bids for same which are attached
hereto, we your eom.on Streets and Sidewalks, suggest the
purchase of the following:
1 Frink V Type Sidewalk Snow Plow installed $26b.00
1 set of skid chains to fit tractor 25.00
I set of 6 wheel weights (100 lbs each) 41.b0

Wt further suggest that the City Clerk be in-
structed to draw up the necessary purchase order for the
above at his earliest convenience.

The motion was made by Alderman Frederick and seconded by
Lemke to concur in this report and instruct the Clerk to issue
a formal purchase order for one Prink V Type Sidewalk snow
plow. The Mayor put the question and the Clerk called the
roil with the following result: Ayes; Aldermen Ahbe, Carroll,
Fulle, .i3ishop, Frederick, Lemke, Schwanbeck and Campagna. :Ways;
None. The Mayor thereupon declared the motion carried.
THE COMMITTEE ON PUBLIC WORKS BUILDINGS AND PLATS
had no report to offer.
THE SEWER,DRAINAGE AND SANITATION COMMITTZ had no
report to offer.
THE WATER COMMITTEE had no report to offer.
THE FIRE COMBdITT. : through its chairman,Alderman Cam-
pagna, reported that delivery of the new Fire Truck may be ex-
pected about March 1,197.
THE FINANCE COMMITTEE: In the absence of Alderman
Pflughaupt, chairman of the Finance Committee, Alderman Ahbe,
introduced the following proposed resolution:

The motion was made by Alderman Ahbe and seconded by Carroll to adopt
this proposed resolutionl The Mayor put the question and the Clerk
called the roll with the following result: Ayes; Aldermen Ahbe,
Carroll, Arlie, Bishop, Frederick, Lemke, Schwanbeck and Campagna.
Nays; NCne. The Mayor thereupon declared the motion carried and
the resolution adopted.
APPROVAL OF MINUTES: Each member of the Council having
at hand a copy of the minutes of the regular Council meeting held
December 21,1936, the motion was made by Alderman Bishop and seconded
by Lemke that the Council approve the said minutes of the meeting
of the City Council held December 21,1936. The motion was voted upon
by acclamation whereupon the Mayor declared the motion carried and
the said minutes approved.
ESTABLISHMWNT OF POLICE DEPARTMENT: The Clerk then
read the following proposed ordinance for second reading:

AN ORDINANCE ESTABLISHING THE
DEPARTMENT OF POLICE FOR THE
_CITY QF DES PLAINES
BE IT ORDAINED by the City Council of the City of
Des Plaines, Cook County,, .111ino is
Section 1. There is hereby established a Depart-
ment of Police in and for the City of Des Plaines,l,llinois.
Section 2. That there is hereby created in and fo r
the City of Des Plaines Police Department, the office of
Captain,Lieutenant, Sergeant and patrolmen.
Section 3. The Department of Police shall be composed
of the following officers, to -wit; one (1} Captain, one(1)
Lieutenant, one (1) Sergeant, eight (8) patrolmen.
Section 4. All appointments to the office of Captain,
Lieutenant, Sergeant and patrolmen shall be by appointment
in accordance with the provisions of an act entitled "An •
Act to provide for the appointment of a board of Fire_and
Police Commissioners in all cities, villages and incorporated
towna of this State, having a population of not less than
seven thousand (7000 nor more than two hundred thousand
(200,000 1, and prescribing the powers and duties of such
board. (Approved April 2,1903, as amended.)!
Section 5. All ordinances or resolutions in conflict
herewith are hereby expressly repealed.
Section 6. This Ordinance shall take effect upon its
passage and approval, according to law.
Passed this day of December A.D.1936.

The motion was mde by Alderman Ahbe and seconded by Frederick
to finally pass and adopt this proposed ordinance. The Mayor
put the question and the Clerk called the roll with the
following result: Ayes; Aldermen Ahbe, Carroll, Fulle, Bishop,
Frederick, Lemke, Schwanbeck and Campagan. Nays; None. The
Mayor thereupon declared the motion carried and the said
ordinance passed.
Mayor Kinder then signed the said ordinance in approval
thereof, which signature was attested by Edgar J.Friedrich,
City Clerk.
LAKE4COOK FARM SUPPLY COr The Clerk then r ead the
following letters.

Gentlemen:
In connection with the proposed application
of the Lake -Cook Farm Supply Company to erect storage
tanks for the storage of gasoline and oils within a
certain commercial district of the City of Des Planes,
I wish to advise you with respect to the powers. of the
City to regulate the type, nature, and character of the
storage facilities of gasoline and oils;
"In July 1919, an act was passed entitledMAn
Act to Regulate the 4torage, Transportation and lise_of
Gasoline and Volatile Oils"-, and the 6upreme Court of
illinois, in the case of idzer Vs. City of Mattoon,332_
Illinois Supreme 54b, has held that any city or village
that did not have in full force and effect on July 1,1919,
an ordinance regulating the storage and sale of gasolines,
lost the power to regulate the storage and sale of gasoline
and volatile oils upon the enactment of the act hereinbefore
referred to.
in 1918 the City of Des Plaines passed an ordinance
licensing persons and corporations storing and s elling
gasolines, but said ordinance did not contain any regulatory
provisions with regard thereto, and in 1928 the General
City Code was passed,mthich repealed the 1918 ordinance.
Therefore, in view of the decision handed down in
case of Kizer Vs. City of Mattoon, the City of Des Plaines
does not have the power to compel the Lake -Cook Farm Supply
Company to install underground storage tanks as is provided
in the 1928 ordinance, and the Lake -Cook PA= Supply Company
will have to comply with the rules and regulations established
and provided for under the act of 1919.
