B.ishop to refer this note to the Streets and Sidewalks Committee
with full power to act. The motion was voted upon by acclamation.

APPROVAL OF MINUTES: lath member of the Council
having at band a copy of the minutes of the Council meetings
held November 16,19, 20 and 30t11,1936, the motion was made by
Alderman Bishop and seconded by Ahbe to correct the minutes of the
meeting of November 30,i936 -by striking therefrom the words
"and providing a $600.00 penalty if the City occupies the premises
until July 1,1937", and adding in place thereof the words "and
giving .the Gity the option of remaining in possession of the
premises during the month of Jurt,1937 at a rental of 000.00.*
The motion to correct the minutes was voted upon by acclamation
whereupon the Mayor declared the motion carried and the minutes

The motion was then made by Alderman Bishop and
seconded by Ahbe to approve the minutes of the Council meetings
of November 16th,1936, November 19th, and .►ovember 20th,1936
as written, and to approve the minutes of the Council meeting
of November 30th,1956 as corrected. The motion to approve was
voted upon by acclamation whereupon the Mayor declared the
motion carried and the said minutes approved.
FLOODING CUMBERLAND SKATING POND: The motion was
made by Alderman Ahbe and seconded by $flughaupt to instruct
the Supt. of Public Works to flood the skating pond of the
Cumberland Improvement Association I. Cumberland. the motion
was voted upon by acclamation whereupon the Mayor declared the
motion carried.
R.J.GUSE: BUILDING PERMIT APPLICATION: The Clerk then
presented anepplication, submitted by R..1.Guse, for a permit to
build a residence on Lot 42, Block 11, Des Plaines Villas. The
motion was made by Alderman MacLuckie and seconded by Frederick
that this application be referred to the Committee on Buildings
and Plats for study and report. The motion was voted upon by
acclamation whereupon the Mayor declared the motion carried.
PATROLING CORNER OF LEE AND ELLINWOOD STREETS: The
motion was made by- Alderman MacLuckie and seconded by :Frederick
to refer to the Police and License Committee the matter of
placing an officer at the corner of Lee and Ellinwood Streets
between the hours of 4:30 and 6:30 P.M. The motion was voted upon
by acclamation whereupon the Mayor declared the motion carried.
NEW MUNICIPAL BUILDING: The Clerk then reported that
several minor changes have been suggested in the construction of
the new Municipal ±uilding. He then read the following estimate
for the proposed changes as submitted by the architect:

CALL TO ORDER: The meeting was called to order
by Mayor George W.Kinder, presiding with Aldermen Ahbe,
Carroll, Pflughaupt, Fulle, ,ddshop, Frederick, Lemke, Schwan-
beck and Campagna, responding to the roll call._ Alderman
MacLuckie was absent on account of illness.
THE JUDICIARY AND ASSESSMENT COMMITTEE had no
report to offer.
THE POLICE AND LICENSE COMMIT11R. through its chairman,
Alderman Yulle, recommended that space of 60 feet be marked off
infront of 1500 Miner Street and designated as a abus
stand": for the purpose of eliminating the double parking
hazard when busses stop at this point to load and unload
passengers. The motion was made by Alderman lune and
seconded by Campagna to create this "bus stand", by
police order and to direct the ouperintendent of streets to
mark off 50 feet for a "bus stand" in front of 1500 Miner
Street and to provide the proper signs designating the said
space as a "bus Stand". The motion was voted upon by
acclamation whereupon the Mayor declared the motion carried.
Alderman Fulle, chairman of the Police and License
Committee then reported that the Committee recommends that
the United Motor Coach Company route its busses going north
west on Miner Street so as to go north on Graceland Avenue to Je
Jefferson Street and then south on Lee Street where they again
turn south east on Miner Street, thus reversing their
direction without makingthe hazardous U-turn at diner Street
and. Graceland. Avenue as has been done heretofore. The Mayor
re -committed this question to the Police and License
Committee for further study and report.

the property located at the Northeast corner of Lee and
Oakwood S reets in your city. This property vas formerly
occupied t)y the Bowman Milk Company.
Our understanding is that this section of your city
is zoned under the classification of commercial district,
and upon reading your revised ordinances of the City of
Des Plaines, we have discovered under Section 4 of the
ordinance on zoning that no building or premises shall be
used for dyeing and cleaning works and for laundries
which employ more than five persons.
Insofar as my client, if he purchases this property, will
employ approximately twenty-five or more persons, it will
be a mistake for us to purchase it unless we can su-
cessfully induce you to amend the ordinance or to rezone
this district.

My client will also purchase a home next to the
p;ant in which he will love. He will employ most, if
not all of his employees, from the residents of Des Plaines.
Insofar as the devices now used in this business are
so vastly improved, there is no more danger with a plant
employing twenty-five or more persons, than there is with
one employing five. There is nothing noxious from fumes
or odors to permeate the immediate vicinity, and also as
this plant is already built and a nice appearing structure,
I. can see no practical reason wny your Honorable body should
nat grant our request. Ilay understanding of the law is
that you have the right and authority to amend your ordinance
or rezone as you so desire.

Dear Sir:
1 am taking the liberty of writing to you regarding your
bakery distributors license. There are certain features
of the license which we feel are actively discriminatory
to our business.
With your permittion i would like to call to your attention
the similarity of the methods of distribution and business
of the modern baker and the modern milk companies.
Both of them have established routes, Both of them have
gone to quite an expense to establish these routes. both
of them furnish the drivers on these routes with a route
book containing a list of the customers upon which the
driver is required to call daily.
Both of their customers, I.e. the milk man's and the bakers,
have standing orders for certain items, but both of them

also occasionally want extra items. From the milk man
they may require extra cream, milk, butter milk, butter,
eggs, chees etc. From the baker they may require an
extra loaf of bread, extra rolls, cake, or pie. Both
the milk man and the baker carry some extra items_ to suy
the extra wants of their customers.
Bath of them, in case they have misjudged the amount
of extra goods that their customers would require will, when
they see that they have too much goods on their trucks, en-
deavor to dispose of this extra amount of goods through
the solicitation of new customers.
Both the milk man and the baker are carrying food items
which are perishable. Both of them are subject to the inppect-
ion of the state and local boards of health, and to the rules
of such boards of health regarding the sanitary manufacture
and handling of their products. Both are subject to the same
heavy penalties for violation of these rules and regulations.
Yet the city of Des Plaines makes a charge of only pb.OQ
per year to the milk distributor, and a charge of 47b.OQ
per year to the baker.
Hathaway Bakeries Inc. is not a fly by night concern with
nothing back of them. 3t is, on the otherkand, a reputable
business house, doing business in many cities from here to
New England. it is licensed to do business in the State
of Illinois and pays without any objection all fair licenses
imposed by the various towns and villages in Illinois in which
it has the pleasure of operating one of its trucks.
Hathaway Bakeries, Inc. enjoy a nice business in your
fair city. We want to continue doing business there. We
are willing to pay any reasonable license to your city. How-
ever,
ow-ever, we feel, and we are sure that you are fair minded enough
to agree with us, that a license of *75.00 per year per truck
is exorbitant and confiscatory, as well as being extremely un-
fair. We feel, and are sure that you are fair minded enough
to agree with us, that we should not be required to furnish
any higher license than the milk distributors are required to
PAY -
We do not use your streets any more than the milk trucks
use them. We put your Board of Health to no more expense in
the way of regulation and inspection than the milk trucks put
them to.
The only fundemental difference between our business and
that of the milk distributor is that the milk distributor
sells both wholesale and retail, while Hathaway Bakeries Inc.
sells only retail, or house to house.
By selling his product to the store and then going next
door and selling- to the private home the milk distributor
enters into direct competetion with the local merchant, whereas
Hathaway Bakeries Inc. does not enter into competition with
the local merchants because we do not sell to them. When a
housewife buys our baked goods she does so on account of her
discriminating taste, because she likes the quality of our
goods and our courteous service.
We use only the very best of ingredients in all our baked
goods, the finest flours, the freshest of eggs, the purest of
butter, the best brands of shortening, yeast, spices, sugar,
salt, milk etc. Every item which our salesmen sell is given to
the salesman wrapped or packaged in such manner that
it is unnecessary for him to at any time handle the same.
This gives the item to the housewife fresh, clean and
sanitary.
The majority of the cities and villages of Illinois
in which we have the pleasure of operating our routes
have agreed with us that the license fee as regards the
bakery and milk distributors should be the same and have
altered their license laws to this effect.
I feel sure that if you will bring this letter t
the attention of the Mayor and the board of aldermen
that they will after reading it agree with us that your
present license is discriminatory and will grant us a

The committee on Police and License hereby recom-
mends to the City Council of the City of Des
Plaines that due to the fact that the above
company is an out-of-town establishment and
therefore for the protection of our local bakeries
the $75.00 yearly license fee not be changed.

AN ORDINANCE ESTABLISHING THE
DEPARTMENT OF POLICE FOR THE
CITY OF DES PLAINES.
BE IT ORDAINED BY THE City Council of the City of
Des Plaines, Cook County, Illinois;
SECTION 1. There is hereby established a Department
of Police in and for the City of Des Plaines,Illinois.
sEcriox 2. That there is hereby created in and for
the City of Des Plaines Police Department, the Office of
Captain, Lieutenant, Sergeant and patrolmen.
SECTION 3. The Department of Police shall be composed
of the following officers, to-mit:one(1) Captain, one(1)
Lieutenant, one (1) Sergeant, eight (8) patrolmen.
SECTION 4. All appointments to the office of Captain,
Lieutenant, Sergeant and patrolmen shall be by appointment
in accordance with the provisions of an act entitled "An
Act to provide for the appointment of a board of Fire -and
Police Commissioners in all cities, villages and incorporated
towns of this State, having a population of not less than
seven thousand (7000.) nor more than two hundred thousand
(200,.0001, and prescribing the powers and duties of such
board. (approved April 2,1903, as amended.1"
SECTION 5. All ordinances or resolutions in conflict
herewith. are hereby expressly repealed.
SECTION 6. This ordinance shall take effect upon its
passage and approval, according to law.

The motion was made by Aicerman Bishop and seeonded by rederic_k
to authorize the Mayor and City Clerk to draw warrants on the
1st and 16th'of each month for the payroll of the City, without
previous approval of the payrolls by the Council. The Mayor
put the question and the Cierk called the roll with the following
result: Ayes; :aldermen Pflughaupt, Fulle, Bishop and Frederick.
Nays; AidermenAhbe, Carroll, Lemke, Schwanbeck and Campagna.
Mayor Kinder thereupon declared the motion lost.
The motion was then made by Alderman Ahbe and seconded
by Carroll to direct the City Attorney to prepare a payroll ordi-
nance designating the 1st and 16th of each month as pay days
for the City payroll, and authorizing the payment thereof. The
Mayor put the question and the Cierk called the roll with the
following result: Ayes; Aldermen Ahbe, Carroll, rflughaupt,
Fulle, Bishop, Frederick, Lemke, Schwanbeck and Campagna. Mays;
None. The Mayor thereupon declared the motion carried.
LEE-THACKER PEDESTRIAN UNDERPASS: Alderman kfiughaupt
called attention to the untidy condition of the Lee -Thacker
Pedestrian Underpass and asked that steps be taken to maintain
the same in a more presentable condition..
MESSAGE TO ALDERMAN ! CLUCKIE: The motion was made
by Alderman Carroll and seconded by Frederick to instruct the
Clerk to write Alderman iacLuckie, who is ill in the 1ibrthwestern
Hospital, conveying to him the Councilfs greetings and wishes
for a speedy and complete recovery. The mdtion was voted upon by
acclamation whereupon the Mayor declared the motion carried.

CALL TO ORDER: The meeting was called to order
by Mayor George )6-.1i:index, presiding, with Aldermen Ahbe,
Carroll, dune, Bishop, Frederick,. Lemke, Schwanbecic and
Campagna responding to the roll caIi. Aldermen Pflughaupt
and MacLuckie were absent during the entire meeting.
REQUEST FOR AMENDiNG ZONING ORDINANCE: Upon
permission of the Council, Mr. McDermott of the Borden -
Wieland Co. again addressed the Council in an attempt to
get the Council's reaction to his request for amending
the Zoning Ordinance so as to permit 25 employees in Clean-
ing and Dyeing plants located on commercial property.
REPORTS OF OFFICERS: The Clerk then read the
reports for December 1936 submitted by Edgar jariedrich,
City Clerk and Howard A.Becker, Chief of Police respective]y.
THE JUDICIARY AND ASSESS= COMMITTEE: had no
report to offer.
THE POLICE AND LICENSE COMMITTEE: The Clerk
then read the following report:
To Fulle -Chairman Police & License Committee at the
meeting of the City Council held Dec.7,1936 the
following matter was referred to your committee:
The matter of stationing an officer at the intersection
of :halinwood & Lee Streets from 4:30 to 630 PM on
all week -days.
