Gentlemen:
In cooperation with the various water plant Operators'
Associations in the State of Illinois, the State Department
of Public Health is sponsoring its fourth annual meeting
of all operator s of water purification and treatment plants
in the State of Springfield on October 27 and 28.
Realizing the decided trend toward water softening and iron
removal, we are arranging to have a session devoted entirely
to the problems involved in water softening and iron removal.
We have been very fortunate in securing Mr.Charles H.Spaulding,
a recognized authority on this subject, of Springfield, to
take charge of this session.
With many towns experiencing a decrease in water revenue, it is
especially important that the operating efficiency be main-
tained without reducing the good quality of the supply in a

water softening plant, proper operation is particu-
larly necessary if efficient operation is to be
maintained.
We are, therefore, inviting your superintendent of
water to attend this conference. 't would be ad-
vantageous for him to attend the entire two-day
session, but if this is, not possible, attendance
on the first day w 111 prove very profitable to you
and to the superintendent.
On the other side is a program of the conference
and we urge that you authorize your water superin-
tendent to attend, because no commodity in your
community is more necessary than a clean, safe
water supply.

THE POLICE MD LICENSE COMMITTEE through its
chairman, Alderman .'u1Le, reported that Officers Drexler
and Cheever :ere sent to the Police Training School at
Northwestern University. The total cost of the course
plus expenses is X30.00; ten dollars each for registration fees,
and five dollars for transportation and miscellaneous expenses.
The motion was made by Alderman MacLuckie and seconded by
Lemke to approve the action of the Police and License Committee
in sending these two officers to the Police School. The motion
was voted upon by acclamation whereupon the Mayor declared

study" be made by State on Min.:3r Street and Lee Street
in the business district.
This study would cost the City nothing and mould give the
City definite factual data regarding parking demand.
No doubt our merchants also would find this study of value.
When completed the facts of the study are assembled in a
complete statistical report with graphs, charts and
anlysis showing parking demand at various ppints.

damages to his crops because of a blocked City Sewer.

Your committee on Sewer, Drainage & Sanitation has investi-
gated the above and has found: The rainfall was so exceed-
ingly heavy that the entire West portion of Des Plaines
was under water. Since Thacker St. was under "water
far beyond the boundaries of Mr.Boeckhnhauerts farm
and also since Wolf Road was under water while Sellar
Creek was far beyond its banks for over two days, we,
your committee, feel that the city of Des Plaines was
in no way responsible for the flooded condition of
Mr.Boeckenhauer's farm.
We therefore recommend: that the above mentioned matter
be referred to the City Attorney to prepare adbfence
in the event that a court suit is taken.

DOWNTOWN PARKING ORDINANCE: The Clerk then
read the fof'lowing proposed ordinance for first reading.
AN ORDINANCE PRESCRIBING PACKING
REGULATIONS ON CERTAIN STREETS
WITHIN THE CITY OF DES PLAINES
AND PROVIDING PENALTIES FOR THE
VIOLATION THEREOF.
Mayor Kinder ordered this proposed ordinance filed for
second reading.
APPROVAL OF MINUTES: Each member of the Council
having at hand a copy of the minutes of the Regular Council
Meeting of October 5,1936 and of the Special Council
Meeting of October 12,1936, the motion vas made by Alderman
Ahbe and seconded by Frederick to approve the said minutes
as written. The motion was voted upon by acclamation
whereupon the Mayor declared the motion carried and the
said minutes approved.
DANGEROUS UNFINISHED BUILDING: Alderman Carroll
called the Council's attention to several dangerous and un-
sightly unfinished buildings on Willow Avenue, and made
a motion which was seconded by Alderman Frederick that
the Clerk and City Attorney be requested to take steps
toward having these buildings wrecked. The motion
was voted upon by acclamation whereupon the Mayor declared
the motion carried.
RETIREMENT TO CLERK'S OFFICE: Upon request of
City Attorney, Kenneth G.Meyer, the Mayor asked the Council
to retire to the City Clerk's office for the consideration
of several important matters. After a few minutes the
Mavnr called the Council to order in the Clerk's office
with all aldermen present.

has been made in the joint case of the Bankers Life Co.
vs. The City of Des Plaines, and Carlton D.Beh vs The
City of Des Plaines, the terms of settlement being as
set forth in the following agreement:

Moines, Iowa, A corporation duly organized and existing
under and by virtue of the Laws of the State of Iowa,
and CARLETON D. BEET, of Des Moines, Iowa, hereinafter
referred to as Parties of the First part, and CITY OF
DES PLAINS, Cook County, Illinois, a Municipal Corpor-
ation duly organized and existing under and by virtue
of the Laws of the State of Illinois, hereinafter re-
ferred to as Party of the Second Part, WITNESSETH:
WHEREAS, the Party of the Second Part issued" bonds
commonly known and described as special assessment bonds
to anticipate the collection of the special assessment

known as Des Plaines General Docket No.62694 in the County
Court of Cook County) , and
WHEREAS, Parties of the First Part now hold and ov n
all of the outstanding bonds and interest coupons issued
by the City of Des Plaines to anticipate the collection
of Des Plaines Special Assessment No.62694, and
WHEREAS, BANKERS LIFE COMPANY, a Corporation, Party
of the First Part filed a Bill for an Accounting of moneys
collected applicable to the payment of its said bonds
in the cause entitled: "Bankers Life Company v. City of

Superior Court of Cook County, and
WHEREAS, CARLETON D. BEH, Party of the First Part
filed a Bill for an Accounting of moneys collected

amoungst all of the outstanding bonds and coupons in
each of the second to tenth installments, both inclusive;
that the Parties of the first Part and the Party of
the Second Part shall thereupon enter into a Stipu-
lation to dismiss the pending actions, being the suits
entitled: "Bankers Life Company V. City of Des Plaines"
being General Docket No.574905 in the Superior Court
of Cook County and "Carleton D.Beh v. City of Des Plainest',
being General Docket No. 574904 in the Superior Court of Cook
County; without costs, all costs having been paid.
Section 2: That the Parties of the First part
hereby covenant and agree, upon receipt of the amount set
out in Section 1 above to waive and release any claims
against the City of Des Plaines or the officials thereof
for apportioning the cash in Warrant No.62694 in the manner
set out in Section 1 above and said Parties of the First
Part further covenant and agree not to sell or dispose
of any of the securities in said Special Assessment
Warrant No.62694 without first notifying the purchaser
or purchasers in writing of this Agreement, and serving a
copy of this Agreement upon such purchaser or purchasers.

Vs. City of Des Plaines.
In connection with the above case, I wish to advise
that I had a conference with the attorney for the
plaintiff, and it is agreeable to him to take judgment
for the sum of 4853.80, the charge made for auditing
special assessment No.77, and it was suggested that
the City admit the sum of 4550.00 as the just amount
for the cost of auditing secial assessment No.75,
and that the remainder of the claim of 41467.00
be permitted to stand until tried by court.
Frankly, 'believe that if the City offers to pay by
way of judgment, the sum of 4550.00, which is the amount
that the City claims it contracted to pay for auditing
special assessment No.75, it will put us in a favorable
position with the court upon the trial.
It is therefore my recommendation that I be authorized
to file an amended answer on behalf of the City. admit-
ting that the charge of 4853.80 for auditing special
No.77 is just and reasonable, and alleging that it
contracted to pay and is willing to have judgment
entered against it for the sum of 41550.00 as the cost
of auditing special assessment No.75, but denying the
reasonableness of the claim made byJonathan Cook for
the sum of 20I6.20 for auditing No.75.

P.W.A.PROJECT #7270 - CHECK VALVES: Kenneth
G.Meyer, City Attorney, thensxplained that checkvalves
have been delivered by the Koppers Construction Co. for
P.V.A.Project 7270, which were rejected by Carl Riegert,
Supt. of Construction, because they are not constructed
according to specifications. He explained further that
the Koppers Construction Co. fefuses to replace them with
valves constructed according to specifications.

seconded by MacLuckie to direct the Clerk to write the
Koppers Construction Co. notifying; them that unless the proper
valves are delivered within three days, the City will purchase
the valves --as specified and deduct the cost of the same
from payments due them. The Mayor put the question and the

Dear Sirs:
I note from an article printed in last week's issue
of the Des Plaines Journal and from the legal notice
and description of the property, that your Council
Body seriously considers selling the land now
occupied by the present City Hall, and in this
description I find no building line restrictions.
No one knows at this time, who the purchaser may be,
or what size building they may plan to erect.
The front line on Elliriwood Street is very well
established and there should be no fear about a
building being erected in front of the present
store fronts facing Ellinwood Street, but I wish to
call your attention to that portion facing Lee Street.
Some twenty years ago, an agreement was signed by Mr.
A.H.Kuhlman, and the Tate Mr. P.A.Prsons, and L.C.
Spiegler, and recorded, establishing a five foot
building line on this street, from the alley inter-
section south to Prairie Avenue.
To keep this block uniform and to prevent any possible
thought of erecting a ninety foot building in place
of eighty-five feet, I suggest that you dddicate
five feet facing Lee Street, for sidewalk purposes,
and have it recorded on the property deed. By doing
this, the City would have a unifrom building line
established on the east side of Lee Street, running
from Ellinwood St. to Prairie Avenue.

Frederick to refer this letter to the City Attorney with
instructions to prepare an ordinance E8tablishing the building
line as reouested in this letter. The motion was voted
upon by acclamation whereupon the Mayor decl red the
motion carried.
C. & N `. R.R. CONNECTION TO CITY SEWER: The
motion was made by Alderman: Lemke and seconded by Pflughauot
to instruct the Clerk to =trite the Chicago and Northwestern
Railroad Company notifying them that the Railroad has drained
its eaters from its coach yards into the City's North Avenue
sewer without authority, and that the City will either block
or disconnect the same unless the Railroad Company itnelf
does so at once. The motion was voted upon by acclamation,

P.W.A.2ROJECT NO.7270-CHECK VALVES: The Clerk
reported that the Koppers Construction Co. has again indi-
cated that it does not intend to replace the check valves

Dear Sir:
With reference to your letter of October 20th in which
you state that the City Council has ordered that we
replace the seven (7) 8' and two (2) 6" check valves which
we furnished in accordance with our bid to the city, with
Chapman Non -Slam Type check valves.
Referring back to the files on this contract, we wish to
call to your attention the correspondence in regards to
the check valves previous to the signing of the contract
on October 23rd,1935.
Mr.Allen's letter of September 22nd,1935, called our
attention to the fact that we neglected to furnish
drawings of the check valve with our bid.
On September 27th and October 7th,1935, we mailed the
drwing of the check valve to r. Robinson and the City
Clerk.
Ontober 8th,1935, Mr.Robinson advised us that our checks
were not in accordance with specifications and that he
specified ChaPman's Non -Slam type or equal. but also
added "there is no equal."
