THE JUDICIARY AND ASSESSMENT COMMITTEE had no

THE COMMITTEE ON PUBLIC WORKS,BUILDINGS AND PLATS,
through its chairman, Alderman Schwanbeck, reported that the
Lister Products Co. has moved from its address at 925 'hacker
Street thus making it unnecessary to take further action
regarding the complaint recently received charging that this
company is putting these premises to a non -conforming use.
THE SEWER, DRAINAGE AND SANITATION COMMITTEE had
no report to offer.
THE WATER COMMITTEE had no report to offer.
THE FIRE COMMITTEE through its chairman, Alderman
Campagna, reported that a committee of Volunteer Firemen is
still busy preparing a thorough and well planned set of Fire
Truck Specifications, and hope to- Submit the complete specifi-
cations to the Council at its next regular meeting.

WRECKING BUILDING -FIRST & PRAIRIE AVENUES: The
Clerk reported that subsequent to advertising for bids for
wrecking the dilapidated cement block building at First
Afenue and Prairie Avenue, several bids have been submitted.
The motion was made by Alderman Pflughaupt and seconded by
Lemke to instruct the Clerk to now open the said bids. The
motion was voted upon by acclamation, whereupon the Mayor
declared the motion carried.
The Clerk then opened the bids and read them aloud,

the adjourned regular Council meeting held September 28,
1936) that the council reconsider the vote on the matter
of engaging an architect for the construction of the
proposed new Municipal building. The motion was seconded
by Alderman Frederick. The Mayor put the question on the
motion to reconsider and the Clerk called the roll with
the following result: Ayes; Aldermen Ahbe, Carroll,
Pflughaupt, rune, Bishop, MacLuckie, Frederick, Lemke,
Schwanbeck and Campagna. Nays; None. The Mayor thereupon
declared the motion to reconsider carried and the matter

AGREEMENT
THIS AGREEMENT made the day of September
in the year Ninetten Hundred and Thirty-six by and
between the City of Des Plaines,Illinois, a munici-
pal corporation hereinafter called the Owner, and
Thielbar and J'ugard, a copartnership hereinafter
called the Architect, WITNESSETH, that whereas the
owner intends to erect a building to house various
departments of the municipality as well as the public
library, on the premises of the Owner at Miner Street
and Graceland Avenue, Des Plaines,
NOW, THEREFORE, the Owner and the Architect,for
the considerations hereinafter named, agree as follows;
The Architect agrees to perform professional
services consisting of the necessary conferences, 1
preparation of preliminary studies, working drawings,
specifications, large scale and full size detail
drawings; the drafting of forms of proposals and con-
tracts; the issuance of certificates of payment; the
keeping of accounts, the general administration of
the business and supervision of the work,
The Owner agrees to pay the Architect at the
rate of six per cent of the cost of the work as evi-
denced by the contracts 1st or materials purchased,
such payment to be made on the following schedule;
Sixty (60) per cent of the fee on any portion
or portions of the work shall be due and payable on
the letting of contracts for such portion or portions.
The balance of the fee shall be due and payable f rom
time to time, proportionally as certificates for
payments are issued by the Architect. mo payments
to contractors or others shall be made except upon

certificates of the Architect.
In the event that the project shall be abandoned
previous to the completion of the work, the Arehi
tect shall be reimbursed by the owner on the follow-
ing schedule:
For completion of sketches, such sketches to
show assignment of space and general arrangement of
building accompanied by an approximate estimate of
cost, the sum of Three Hundred and no/100(4300.00)
Dollars.
For completion of sketches as defined above
and working drawings and specifications, the sum
of One Thousand Five Hundred and no/100 (41,50040)
Dollars.
for the completion of sketches, working draw-
ings, and specifications, drafting of forms for
proposals and contracts, receiving of bids, letting
of contracts, general supervision of the work and
issuance of certificates, if any, a sum equal to
three and six -tenths (3.6) per cent of the aount
of such contracts plus two and four -tenths (2.4)
per cent of the value of the work completed at the
time of such abandonment.
The Owner agrees to furnish to the Architect
all necessary surveys of the site, date as to
utilities,e tc, as may be required.
The Owner and the Architect hereby agree to
the full performance of the covenants contained herein,

I am a resident and tax -payer of Des Plaines,
residing at 1133 Algonquin Road, in Lagethausen's,sub-
division, which is zoned for residential purposes, but
is being violated by A.Bade and Son, conducting a whole-
sale paper business at 1129 Algonquin Road.
The business conducted by the .Bades is done
in a frame garage which constitutes a fire hazard danger-
ous to the adjoining property and is an annoyance to
the neighbors on this Street.

subdivision and location is in violation of the Dity of
Des Plaines zoning Ordinances, 1 hereby voice a protest
against this violatin and request that your honorable
body take immediate action to stop this nuisance.

The motion was made by Alderman MacLuckie and seconded by
Campagna to instruct the Clerk to read that portion of the
City Code prescribing the duties of the Mayor. The Mayor put
the question and the Clerk called the roll with the following
result: Ayes; Alderman MacLuckie. Bays; Ahbe, Carroll, Pflug-
haupt, Fulle, bishop, Frederick, Lemke, Schwanbeck and Campagna.
The Mayor thereupon declared the motion lost.
Mayor Kinder ordered the letter from Mr.Brezinske
referred to the Police Department.
CLAIM FOR DAMAGES /EOM BLOCKED SEWER:

To the Honorable Mayor
and City Council
Des Plaines,Illinois
Gentlemen:
The Clerk
Through the negligence of some one of your agents, or
employees, the tile just East of the Belt Line Railway
on Thacker Street, was filled up by rubbish and dirt,
so that when the recent heavy rains occurred my farmwas
flooded and a lot of my truck and farm crops were destroyed.
As soon as I discovered that this tile was not functioning
myself, opened it up and proceed to let the water off,
but a great deal of damage had been done before that time.
I have gone over the loss and very carefully computed same,
giving the City the benefit of any doubt. say loss reaches
the sum of 41433.00.
I ask that you investigate this loss of mine and
make arrangements to pay same. i will be glad
to confer with any agent or committee in connection
with the matter, and show them just what constitutes
the above damage.

The motion was made by Alderman Pflughaupt and seconded by
Campagna to refer this letter together with the statement
of claim be referred to the City Attorney together with
the Sever, Drainage and sanitation Committee. The motion
was voted upon by acclamation whereupon the Mayor declared
the motion carried.
APPROVAL OF MINUTES: Each member of the Council
had a copy of the minutes of the regular Council meeting
held September 21,1936 as well as those of the adjourned
regular Council meeting held September 2.8th,1936. 'ihe motion
was voted upon by acclamation, whereupon the Mayor declared
the motion carried and the said minutes approved as written.
CLEANING STREETS IN FIRST WARD: the motion was
made by Alderman Qarroll and seconded by Ahbe that inasmuch
as several streets in the First Ward need cleaning the matter
of cleaning the said streets in the First Ward to the Streets
and Sidewalks Committee. The motion was voted upon by accla-
mation whereupon the Mayor declared the motion carried.
RE -LOCATING STRAET LIGHTS: The motion was made
by Alderman Carroll and seconded by Ahbe to refer the matter
of studying the possibility of relocating and revising the
location of street lights to the Committee on Streets, Bide -
walks and Municipal Lighting jointly with the Finance Committee.
The motion was voted upon by acclamation whereupon the Mayor
declaredthe_ motion carried.
RETIREMENT TO CITY CLERK'S OFFICE: Mayor Kinder
then asked the Council, to retire to the City Clerk's office
in order to discuss several matters under consideration. The
Council re -convened in the City Clerk's office with all Aldermen
present.
AUDITING BILLS-TONATHAN COOK & CO. Kenneth G.ileyer
'reported some progress in the suit of Jonathan Cook & Co vs.
the City of Des Plaines, and in an informal manner received
suggestions from various Council members regarding the case.
PROPOSED THACKER STREET STORM SEWER: Mayor Kinder
reported that the recent rains indicated the necessity of
providing storm sewers. He submitted to the Council plans,
specifications and estimates, prepared several years ago,
for the construction of a storm sewer on Thacker Street,
with the request that each Council member give the matter of
storm severs some thought.
ADJOURNMENT: The motion was made by Alderman
Lemke and seconded by Pflughaupt to adjourn. The motion w as
voted upon by acclamation, whereupon the Mayor declared.the
