HELD IN THE COUNCIL CHAMBERS ON THE 17th

CALL TO ORDER: The meeting was called to order by
Mayor George W. Kinder, presiding, with Aldermen, UIL
Pflughaupt, Fulle, Bishop, MacLuckie, Frederick, Lemke, Sch-
wanbeck, and Campagna responding to the roll call. Alderman
Carroll arrived later during the meeting while Alderman Ahbe
was absent during the entire meeting.
THE JUDICIARY AND ASSESSMENT COMMITTEE had no report
to offer.
THE POLICE AND LICENSE COMMITTEE through its chair-
man, Alderman Fulle, submitted the following report:
To Chairman ,Tulle: POLICE & LICENSE Committee, at the
meeting of the City Council, held August 3, 1936, 'the
following matter was referred to your committee:
The letter from the Retail Liquor Dealers Assn
asking that they be not required to pay any business
license fees in addition to the $250.00 Retail Liquor
Dealers fee, was referred back to your committee.

above and has found: Insofar as the Retail Liquor
Dealers Assn request for a hearing has been set to

THE STREETS AND SIDEWALKS COMMIT'1i submitted the
following letter which was read by the Clerk:

Gentlemen:
As discussed with your Mr. Frederick and Mr. Veils,
we have worked with Mr. Perkins in developing a satisfactory
traffic control layout for the Northwest highway through your
City, and we are submitting the following data, blueprints and
specifications.
We believe that Desplaines should install a full
flexible control system which, of course, will be in accord
with the State Highway specifications of Illinois. This system
to be responsive to a manually operated switch in the watchman's
shanty to cause the system, on the approach of a train, to be
turned to green on the Northwest Highway, and red to any cross
streets. This will give you protection on any thru trains.

However, a train that stops at the station would not hold
up cross traffic as the gateman would throw the system as
soon as the train stops and a train starting from that point
would not be a hazard.
The location of signals is rather a problem. How-
ever, we suggest that the signal on the south side of the
Northwest Highway intersections is shown to on comming
traffic from the near side of the track, and have located a
signal on both sides of the track to give proper indications.
'We estimate the cost of this system completely in-
stalled and turned over to the City as a operating unit, for
the sum of approximately $5500.00. This figure, of course,
is purely approximate and would be perfectly safe for an
.estimate of cost should you care to set up funds in an
ordinance.

Mr. Perkins of the Eagle Signal Corporation also submitted
a proposed set of plans and specifications to supplement
the above letter. The Bouncil examined and discussed the
plans and specifications informally.
The motion was made by Alderman Fulle, seconded by Frederick,
to instruct the Streets and Sidewalks Committee to have plans
and specifications prepared, submit the same to the State
Highway Department and the Chicago & Northwestern Railroad
for approval, and report its progress to the Council at the
next regular Counoil meeting. The motion was voted upon by
acclamation whereupon the 'Mayor declared the motion carried.
THE COMIMITTEE ON PUBLIC WORKS, BUILDINGS AND PLATS
had no report to offer. '

CANOPIES FOR I-THACKER PEDESTRIAN UNDERPASS: The
Clerk then read the following report:
To the Mayor and City Clerk: At the meeting of the City
Council, held August 10, 1936, the following matter was re-
ferred to you:
The matter of conferring. with the State Highway Department,
to ascertain whether the State will approve the application
of Motor Fuel Tax funds toward the construction of the pro-
posed canopies over the entrances of the Lee -Thacker Ped-
estrian Underpass: also whether the construction of the said
canopies can be done under. the contract of Milburn Bros. Inc.
as an extra.

informed that the State will approve the construction of the
said canopies with Motor Fuel Tax Funds and that this work
can be done by Milburn Bros. Inc., as an extra to their con-
tract subject to the approval of the State Highway Dept.

Mayor Kinder further reported that Milburn Bros. Inc. is
preparing plans and specifications on vatious designs of can-
opies and will submit the same as soon as possible. The motion
was made by Alderman Frederick, seconded by Lemke, to accept
this report. The motion was voted upon by acclamation where-
upon the Mayor declared the motion carried.
THE DANCE COMVITTRR through its chatrman, Alder-
man Pflughaupt,introduced the following proposed resolution:

The motion was made by Alderman Pflughaupt, seconded by
Frederick to adopt this proposed resolution. The Mayor put the
question and the Clerk called the roll with the following result:

ment of Agriculture under "An Act to Prevent the Spread of
Rabies," approved July 8, 1927, in force July 8, 1927:

Because of the prevalence of rabies in the County
of Cook, including the City of Chicago and all other towns
and villages located in Cook County, State of Illinois, it
is hereby ordered that all dogs within the above area be
either
1. Kept confined within an enclosure from which
escape is impossible, or
2. Kept restrained by a leash composed of chain
or other indestructible material.
This order effective July 27, 1936, and until notice
of release.

You are hereby notified and informed that you have
successfully passed the examination for the office of sergeant
of the Police force of the City of Des Plaines, and by reason
therefore you are hereby officially appointed to the rank of
Sergeant on the Police force of the City of Des Plaines, and
entitled to compensation provided by the City of Des Plaines for
such office.
You are instructed to appear before the Mayor or City
Clerk and be sworn into the office of Sergeant.
The proper City Officials have been notified of

The motion was made by Alderman Frederick, seconded by Pflug-
haupt, to re -commit this matter together with the bids received
to the Streets and Sidewalks Committee with full power to act.
However, the motion was made by Alderman Bishop, seconded by
Carroll, to amend this motion by striking therefrom the words
"with full power to act" and adding thereto the words "for tab-
ulation and recommendation at the next regular meeting of the
Council". The amendment was voted upon by acclamation whereupon
the Mayor declared the amendment carried. The motion as amended
was then voted upon by acclamation whereupon the Mayor declared

BE IT RESOLVED by the City Council of the City of
Des Plaines that the Mayor and City Clerk be and they are hereby
authorized to execute on behalf of the City of Des Plaines, the
following agreement with Divane Brothers, to wit: -
AGREEMENT
THIS AGREEMENT made
by and between the CITY OF DES
hereinafter called "the City",
DIVANS, JR., WILLIAM T. DIVANE
inafter called "DIVANE BROS.",
this 17th day of August, 1936,
PLAINES, a municipal corporation,
and SOHN J. DIVANE, DANIEL J.
, trading as DIVANE BROS., here -
witnesseth:
WHEREAS heretofore on October 25, 1935, a certain con-
tract was entered into between the parties hereto, whereby the
said DIVANE BROS. agreed to perform certain labor and furnish
certain materials to the. CITY OF DES PLAINES for the sum of
Four Thousand Six Hundred Twenty- Five Dollars ($4,625.00) in
connection with the construction of a water softening plant and
reservoirs, known as City of Des Plaines Water Works, P W A Pro-
ject #7270, hereinafter called "the project": and
WHEREAS, it was provided in said contract that the
work to be performed,thereunder by DIVANS BROS. should be com-
menced on or before November 1, 1935, and completed on or before
July 1, 1936; and
WHEREAS,after the making of said contract, certain
delays in construction took place, by reason whereof DIVANE BROS.
were prevented from starting and completing their work within the
time specified, and in consequence claim that to proceed with
said contract as of this date would increase their costs and
charges and subject them to damages that they cannot rightfully
be called upon to pay or sustain; and
WHEREAS, the City of Des Plaines denies any respon-
sibility for said delays and denies any liability to the said
DIVANE BROS. for extra compensation as claimed by the said
DIVANE BROS; and
WHEREAS, the parties hereto are desirous of amicably
settling their differences;
NOW, THEREFORE, IT IS AGREED by And between the parties
hereto, as follows:
(1) That the extra cost of construction is hereby fixed
at a sum not exceeding Nine Hundred Fifty Dollars ($950.00),
which is in addition to the price stated in said contract dated
October 25, 1935.
(2) That DIVANE BROS. will proceed with the per-
Xormance of their contract dated October 25, 1935, promptly upon
being notified by the City's Superintendent of Construction, or
the City Clerk that the project has reached the stage of completion
necessitating performance by DIVANE BROS.
(3) That DIVANE BROS. will tarnish J. ALBERT M. ROBIN-
SON, Consulting Engineer, with details of all equipment to be
furnished within fifteen (15) days from this date.
(4) That for proceeding with said contract as of this
date, and completing their work thereunder within a reasonable
time, the said DIVANE BROS. shall receive the sum of Forty Six
Hundred Twenty-five Dollars $(4,625.00) the original contract
price, and in addition thereto, the further and additional sum
of Nine Hundred Fifty Dollars ($950.00), making a total of Five
Thousand Five Hundred Seventy Five Dollars ($5,575.00) which amount
is and hereby is declared as the new contract price; that said new
contract price shallbe paid as in the said original contract pro-
vided, excepting only as special provision is herein and hereby made
for the payment of said additional sum of Nine Hundred Fifty Dollars

(4950.00)•, that as to the payment of said additional sum of Nine
Hundred Fifty Dollars ($950.00), the provisions of this agreement
shall control.
(5) That the City will pay unto DIVANS' BROS. the sum
of Four Hundred Dollars 0400.00) on account of said Nine Hundred
Fifty Dollars ($950.99) mettioned in paragraphs #1 and #4, as follows:
One Hundred Dollars (y100.00) when DIVANE BROS. first requisition
for payments under their contract is approved; and Three
Hundred Dollars($300.00) when DIVANE BROS. final requisition for
payment under their contract is approved.
(6) That the balance of said Nind Hundred Fifty
Dollars ($950.00), to -wit, Five Hundred Fifty Dollars ($550.00),
is to be paid to said DIVANS BROS. out of and only. from any moneys
collected from the B -W CONSTRUCTION COMPANY or the AMERICAN SURETY
COMPANY, surety on the completion bond of E -W CONSTRUCTION COMPANY,
and the CITY OF DES PLAINES does hereby assign unto DIVANE BROS.
Five Hundred. Fifty Dollars ($550.00) of whatever sum is received
from B -W CONSTRUCTION COMPANY or AMERICAN SURETY COMPANY, by way
of judgment, settlement, or otherwise.
(7) The City Agrees to file suit against the B -W
CONSTRUCTION COMPANY and the AMERICAN SURETY COMPANY within a
reasonable time after the completion of said project, it being
the contention of the City that the B -W CONSTRUCTION COMPANY default-
ed on their contract, without just cause and thereby created the
delay in the construction of said project.
(8) It is expressly agreed between the parties here-
to that said contract dated October 25, 1935, be and is hereby
modified in that said DIVANE BROS. shall commence work at the time
provided in paragraph #2 of this agreement (the condition of laid
project permitting), and shall proceed with all due eiligence to
fully perform said contract dated October 25, 1935.
(9) It is expressly agreed between the parties hereto
that the terms and conditions of the contract between the parties
hereto dated October 25, 1935, remain unchanged, except as to time
of completion and the amount to be paid DIVANS BROS., which amount
is reduced by the sum of Two Hundred Thirty -One Dollars and Forty -
Four Cents ($231.44) by reason of certain materials which the
City was obliged to purchase and which would have been furnished
bir DIVANE BROS. before this date. Said material will be delivered
to DIVANE BROS. for installation in said project. In the event
the Clark Controller Company, the seller of said materials, will
accept DIVANE BROS. as the purchaser of said materials and release
the City from all liability for said purchase, then said contract
of October 25, 1935 will not be reduced by the sum of Two Hundred
Thirty -One Dollars and Forty -Four Cents ($23.1.44).

APPROVAL OF MINUTES: Each member of the Council
had been supplied with a copy of the minutes of the Regular
Council meeting of August 3, 1936, as well as a copy of the
minutes of the Special Counci& meeting held August 10, 1936.
The motion was made by Alderman Bishop, seconded by Lemke, to
approve the said minutes as written. The motion was voted upon
by acclamation, whereupon the Mayor declared the motion carried
and the said minutes approved.

Police and Fire Commissioners for a 3 year term ending April
30, 1939, The motion was made by Alderman Frederick, seconded
by Lemke to confirm this appointment. The motion was voted
upon by acclamation whereupon the Mayor declared the motion
carried and the appointment confirmed.
Mayor Kinder then announced the appointment of
FRITZ WETTIN to the office of Poundmaster for a term ending
April 30, 1937. The motion was made by Alderman Frederick,
seconded by Lemke to confirm this appointment. The motion was
voted upon by acclamation whereupon the Mayor declared the
motion carried and the appointment confirmed.

AUDIT -SPECIAL ASSESSMENT #80: Kenneth G. Meyer, City
Attorney, reported that he requires about three days services
of an auditor to tabulate certain information necessary in
setting up his defense in a diversion suit regarding Special
Assessment #80. The motion was made by Alderman Fulle, seconded
by MacLuckie, to refer this matter to the Finance Committee with
power to act. The motion was voted upon by acclamation, whereupon
the Mayor declared the motion carried.
