MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF DES PLAINES
HELD IN THE COUNCIL CHAMBERS ON THE 18th
DAY OF MAY.A.D.1936 AT THE HOUR OF 8:00 P.M.
CALL TO ORDER: The meeting was called to order
by Mayor GeorgelLEinder, presiding, with Aldermen Ahbe,
Pflughaupt, Fulle, Frederick, Lemke, Schwanbeck and_Campagna
responding to the roll call. Aldermen Carroll and Bishop
were absent during the entire meeting, while Alderman Mac-
Luckie arrived later during the course of the_meeting._
REPORTS OF OFFICERS: Edgar jariedrich,City
Clerk then read his report of receipts for the month of
Apri1,1936.
The Clerk then distributed to each member of the
Council a copy of the Clerk's report for the first quarter
of 1936, including a report of the City Treasurer's cash
on hand 0 of March 30,1936.
Mayor Kinder ordered these reports placed on file.
LER-TRACKER PETIRSTRIAN UNDERPASS: The motion
was made by Alderman Pflughaupt and seconded by Frederick
to instruct the Clerk to proceed at this time toopen bids
for the construction of the proposed Lee -Thacker Underpass.
The motion was voted upon by accclamation whereupon the Mayor
declared the motion carried.
The Clerk then reported that only one bid has been
received, and, opening the same read the bid as follows:

Gentlemen:
Having examined the plans and specifications
on file with the City Clerk, for the construction of
the Pedestrian Subwayatthe intersection of Lee Street
and Thacker Street; having examined the site of the
work and being familiar with all the conditions
under which the work is to be done, the undersigned
proposes to furnish all materials, tools, labor, pay
all expenses and complete the work as specified for
the lump sum of 49,475.00.

Seventy-five and no/100 DOLLARS.
The undersigned agrees to do extra or add-
itional work for the invoice price of materials plus
labor at the Union Scale prevailing in this City plus -20%
for overhead which percentage is to inclUde all super-
vision, time keeping, forming and profit.
If it is necessary to construct pavement
after the completion of the Subway the undersigned agrees
to build approximately 335 sq. yds. of reinforced concrete
pavement according to the specifications of the State
Highway Department of the State of Illinois as revised
and amended. May Ist,1936 for the sum per sq. yd.

In accordance with the requirements for bid-
ding there is attached hereto a certified check in the

The motion was made by Alderman Ahbe and seconded to Lemke
to refer this bid to the City Engineer and the Streets and
Sidewalks Committee for examination and report. The motion
was voted upon by acclamation whereupon the Mayor declared
the motion carried.
After a brief conference of the City Engineer and
the 4treets and Sidewalks Committee, with Mr. Walls, repre-
senting the District sngineer of the State Highway Department,
the motion was made by Alderman Frederick and seconded by
Schwanbeck that since only one bid has been received, the
Council reject the bid of the Suburban Paving and Improvement
Co., and instruct the City Clerk to return its bidders check.
The Mayor put the question and the clerk called the roll
with the following result: Ayes; Aldermen Ahbe, Pflughaupt,
Tulle, MacLuckie, Frederick, Lemke, Schwanbeck and Campagna.
Nays; None. The Mayor theereupon declared the motion carried.
The motion was then made by Alderman Frederick and
seconded by Campagna to direct the Clerk to re -advertise for
bids for the construction of the proposed Lee -Thacker Under-
pass, said bids to be returnable 8:00 P.M. June 1,1936. The
Mayor put the question and the Clerk called the roll with
the following result Ayes; Aldermen Ahbe, Pflughaupt, Fulle,
MacLuckie, Frederick, Lemke, Schwanbeck and Campagna. Nays;
None. The Mayor therelupon declared the motion carried.
The Clerk then read the following proposed resolutions
RESOLUTION FOR IMPROVEMENT BY MUNICIPALITY
UNDER THE MOTOR FUEL TAX I
BE IT RESOLVED by the Mayor and City Council of the
City of Des Plaines,Illinois that the following described
improvement be constructed under the Motor Fuel Tax Law;
A Pedestrian Underpass located at Lee and Thacker
Streets which is also known as ; Extension to S.B.I.
Rt. Na. 46.
BE IT FURTHER RESOLVED: (1) That the proposed improvement
shall be the construction of a Pedestrian underpass
located across Lee Street (S.B.I. Rt.#46) and Thacker
Street and shall be designated as Section 2 C.S. (2)That
there is hereby appropriated the sum of Twelve Thousand
and no/100 DOLLARS ($12,000.00) for the improvement of
said section from the municipality's allotment of motor
Fuel Tax funds. (3) That said work shall be built by
contract.
AND BE IT FURTHER RESOLVED that the City Clerk is
hereby directed to transmit two certified copies of this
resolution to the Department of Public Works and Buildings,
Division of Highways, Springfield, Illinois, through its
District Engineer.
The motion was made by Alderman Pflughaupt and seconded by
Fulle to adopt this proposed resolution. The Mayor put the
question and the Clerk called the roll with the following
result: Ayes; Aldermen Ahbe, Pflughaupt, Fulle, MacLuckie,
Frederick, Lemke,Schwanbeck and Campagna. Nays; None. The
Mayor thereupon declared the motion carried and the resolution
adopted.

The American Brotherhood for the Blind requests permis-
sion to hold its annual *Flower Sale" in Des Plaines op
Saturday, June 6, similar to those being held in other
Illinois communities. The Sale will be sponsored by a
Committee of Clergymen, club women and other prominent
citizens, and organized by our lirs.Grace
Devoted solely to the service of the sightless, the
American Brotherhood is a national, non-profit, non-
sectarian organization, embossing and publishing books
and magazines in Braille, and donating them to institu-
tions for the blind throughout the country.
We also render assistance to the blind in many personal
ways not covered by any other organization. Such help
as we give brings brightness and cheer into their dark
and dreary lives. All our services, as well as our
publications, are available. free.
The work of the Brotherhood is supported entirely by
friendly contributions and by the proceeds. of "Flower
"Sales". - the flowers used being made by the blind.
We believe the citizens of Des Plaines will welcome the
opportunity to give support to this worthy cause; and
we trust you will grant our request.

C&NW RAILROAD CROSSING PROTECTION: The Clerk then
read the following letter:

Dear Sir:
In regard the matter of change in highway crossing pro-
tection at Des Plaines,:Lllinois:
Noting the write-up in the Des Plaines Journal of May 1st,
it appears that the C.& N.W.Ry. is convicted of bad faith
for not appearing at a Safety Council meeting held Wednes-
day night, April 29th.
We accepted the invitation of the Safety Council and the
City Council to discuss this matter with them on April 15th
and left the meeting with the definite idea that the next
meeting would be held May 13th. We are sorrty that there was
a mix-up in the dates. However, it would appear that the Safety
Council has already decided that gate protection is the right
type of protection and have already taken the matter up with
the Illinois Commerce Commission, therefore nothing would have
been accomplished had we attended the meeting.
We explained at the first meeting that in our opinion, the
present flag protection provided at G raceland, Lee and Pearson
Streets was really the best type of Protection for these streets
because of the presence of the passenger station and the probabi-
lity that gate protection at these streets would only cause con-
fusion by trapping the pedestrians on the tracks between the
gates and would result in needless delay to automobile traffic.
We also explained that with the present curb arrangement of the
streets, it would be difficult to install gates and that probably
the City would have to make some changes in the paving to pre -
vide a proper place to install the gates. it was also brought
out that the installation of gates would probably reduce the
present employment.
As to the River Road crossing (Des Plaines Ave.) we explained
that the present 24 hour flagging protection supplemented by
illuminated flashing light and stop signals were installed
after a conference with the city authorities and at the time
installed,w ere considered the best for the purpose. It is to
be recalled that at one time this crossing was equipped with
gated, and they were removed because they were frequently torn
out by automobile drivers and because they interfered with the
widening of this street. clothing that could be installed at
this crossing would be any more effective in preventing acci-
dents due to high speed and slippery streets or failure of high-
way traffic to properly observe signal indications. We assured
the Safety Council that if anything more effective than the
present protection was developed, we would join them in recom-
mending the installation at this street.

We practically agreed that if it was considered
necessary we would provide improved signals for the
flagmen, such as brighter lanterns and would provide
the flagmen with uniforms or other clothing to make
them more conspicuous if the same would be considered
of any value and suggested that the Safety Council
endeavor to secure more police supervision of the
proper operation of highway traffic across these
intersections.
We also explained that the crossings were now well
lighted and there was no need or any expensive
floodlighting, although it would be possible with
a little- re-arrangment of the existing lighting
fixtures, particularly the globes, to secure much
improved lighting of these crossings.
As before stated, the Safety Council has taken the
matter up with the illinois Commerce Commission
through juir.Faulkner of the Chicago motor Club, as
outlined in the article appearing in the Des Plaines
.Tournal and it appears that there is nothing further
that we can do to satisfy the demands of the Safety
Council. however, we certainly do not want to close
the door to a fair and reasonable adjustment of
the complaint as we.are just as much interested in
providing practical protection for these crossings
as anyone could be.

Dear Sir:
The plans for the proposed pavement imprvemsnt on Lee Street
in the City of Des Plaines provide for the proposed pave-
ment to be constructed at the same grade as the existing
pavement.
The proposed grade in general conforms to the parkway and
the grade of the sidewalks throughout this improvement.
Except however for a short distance from approvimately
300 feet south of Prairie Avenue to approximately 300 feet
north of Thacker Street where the sidewalk on the westerly
side of Lee Street has a rather pronounced hump.
At this location the top of the curb is proposed to be con-
structed at an elevation just below the easterly sidewalk
which will provide a minimum pitch across the parkway.
Also, at this location, we did not think it advisable to
rock the pavement that is to construct one side higher than
the other in an endeavor to overcome the difference in the
sidewalk elevations, since the sidewalk on the westerly
side appears apparently to be too high. To overcome this
difference in elevation ad to permit a grade for driveway
approaches which would not be excessive, we are proposing

to lower'the sidewalk as a part of our improvement with-
in the above limits.
In addition to lowering the grade of this sidewalk, we
propose to regrade the parkway, plant new trees to
replace any trees destroyed, and to terrace back the lawn
to a reasonable distance. I trust that the work as here-
in outlined meets with your approval.
May I receive a reply from you in order that I may instruct
our Resident Engineer and Contractor accordingly.

Gentlemen:
Now that the warm weather is again with us and dogs are
very plentiful on our City streets without license or
muzzles I am presenting herewith the following resolutions
for your considerations

lahereas our Municipal ordinance states that all dog
licenses Should be purchased annually within 30 days
after the first of January as quoted in Sec.1134 of
our revised ordinances and
2.Whereas it is now May 18,1936 and sufficient time
has been allowed every one to obtain said license, and
3.Whereas in the past year we have had considerable diffi-
culty with mad dogs that were not muzzled,
Be it resolved that the Police and License Committee
be instructed to take iOmediate drastic action in
this matter by publishing a notice in our local papers
to the effect that the Police Dept. will issue arrest
slips to all those not having these tags by 'lune 1,1936.
Be it further hesolved: that in order to avoid a
repitition of last years made dog episode the Mayor
be instructed to issue a proclamation in the local
papers that starting June lst and continueing through
until Oct 1 1936 no dogs will be permitted on the streets
in the corp. limits without being muzzled or on a leach
as per Sec.1132 City vrdinance and that any dog found
on the streets without said equipment should be impounded
immediately.
Let as eliminate these possible hazards by arranging for
proper supervision.
Let us also arrange at once for engaging an impartial Dog
Catcher who will do everything possible to enforce the law
in his particular phase of duties.

WATER WORKS-P.W.A.PROJECT NO.7270: Kenneth G.Meyer
City Attorney then submitted the following proposed resolution

PERTAINING TO CITY OF DES PLAINES WATER WORKS
P .W.A. PROJECT N0 ° 7270.
WHEREAS the City of Des Plaines has heretofore
entered into a contract with R.C.Wieboldt Company for the
completion of Section .10 of the improvement known as "City
of Des Plaines Water Works, P.W.A.Project No 7270*, and
WHEREAS the specifications, whch are a part of the
said contract, provide that "all steel re-inforcement shall
be deformed bars made from new billet stock" t and
WHEREAS the said specifications further provide
that a charge be made by the contractor for steel detailing,
and
WHEREAS the City of Des Plaines Desires to substitute
"rerollcd steel" in lieu of the s:id "new billet" steel, and
desires the omission of the steel detailing by the contractor
and
WHEREAS the said substitution of *re-rolleesteel for
new billet* steel will result in a financial saving to
the said City of $421.00, and the omission of steel de-
tailing
by the contractor willmsult in a further saving
to the City of $800.00 and
WHEREAS the said changes have been approved by the
City Engineer of the City of Des Plaines,
THEREFORE BE IT RESOLVED by the City Council of
the City of Des Plaines that the substitution of "re -rolled*
steel for "new billet" steelllas well as the omission
of steel detailing by the contractor be, and the same
are hereby approved; and
BE IT FURTHER RESOLVED that the City Clerk be and
he is hereby instructed to forward five copies of this
resolution to the State Director of the Federal Emergency
Administration of Public Works.

Alderman Pflughaupt, chairman of the Finance Com-
mittee reported that in order to make it possible to comply
with P.W.A. regulations it is advisable to pay Mr. Carl
Riegert, the City's inspector for P.W.A.Project #7270, weekly
instead of semi-monthly. The motion was made by Alderman
MacLuckie and seconded by Campagna to authorize and direct
the Mayor and. City Clerk to draw at the end of each week a
weekly pay voucher in the sum of $60.00 In favor ofCarl
Riegert, inspector on P.W.A.Project #7270, and to subse-
quently submit such vouchers for approval at the regular Council
meeting next following. The motion was voted upon by
acclamation, whereupon the Mayor declared the motion carried.
APPROVAL OF PAYROLL: Alderman Pflughaupt, chairman
of the Finance Commitee, then introduced and read the following
proposed resolution of which each member of the Council had
received a copy:
RESOLVED THAT THE FOLLOWING PAYROLLS ARE DUE
AND PAYABLE AND THAT THE MAYOR AND CITY CLERK
BE INSTRUCTED TO ISSUE PROPER VOUCHER -WARRANTS
