MINUTES OF THE ADJOURNED REGULAR MEETING
OF THE CITY COUNCIL OF THE CITY OF DES
PLAINS HELD IN THE COUNCIL CHA13E2,S ON
THE 13th DAY OF APRIL,A.D.1936 AT THE
HOUR OF 8:00 P.M.
CALL TO ORDER: The meeting was called to
order by Mayor George W..Kinder, presiding, with Aldermen
Ahbe, Carroll, Pflughaupt, Fulle, Bishop, 1t]acLuckie,
Frederick, 'Lemke and Campagna responding to the roll
call. Alderman Schwanbeck was absent during the entire
meeting on account of illness.
Mayor Kinder then announced that this is an
adjourned meeting held principally for the purpose of
opening bids, for the Reservoir and Softening Project,
r.W.A.Project 7270 based on the advertisement for
the completion of Section "A" only; also for the receiving
of bids for the sale of 1936 Tax Warrants.
'.1.A.RO _��CT #7270: Kenneth G.Meyer, City
Attorney, then presented the following proposed resolution
which was read by the Clerk:.
RESOLUTION
WHEREAS, this City heretofore caused notice
to be served on B -W Construction Company, notifying
the said B -W Construction Company that their contract
with this city would be cancelled unless they T)roceeded
with construction within ten days from receipt of
said notice, and
WHEREAS, said notice was received by the B -w
Construction Company April 2,136 and ten days have
elapsed from receipt of saicl notice, and they have
failed to proceed with construction,
THuE'FORE BE IT RESOLVED That the Contract
of B -W Construction Company with this city relative
to City of Des Plaines Water Works xiWA Project ;-;-7270
be and is hereby terminated.
BE IT FURTHER RESOLVED that notice of said
termination be served on the said B -W Construction
Company and the American Surety Company of idew York,
in accordance with the terms of said contract.
The motion was made by Alderman Bishop and seconded by
Lemke to adopt this proposed resolution. The Mayor put
the question and the Clerk called the roll with the
following result: Ayes; Aldermen Ahbe, Carroll, Pflughaupt,
Pulle, Bishop, MacLuckie, Frederick, Lemke and Campagna.
Nays: None. The Mayor thereupon declared the motion
carried and the resolution adopted.
OPENING OF BIDS-P.W.A.PROJECT #7270: The Clerk
then reported that three bids have been received for the
completion of Section "A" of P.W.A.Project rt7270.
The motion was made by Alderman MacLuc ie and
seconded by Lemke to instruct the Clerk to now open and
read aloud such bids as have been received for the
completion of Section "A" of P.W.A.Project #7270. The
motion was voted upon by acclamation, whereupon the Mayor
declared the motion carried. Mayor Kinder thereupon
instructed the Clerk to open and read the said bids,
whereupon the Clerk opened the said bids and read them
aloud as follows:

labor, pay all expenses and complete the work a s specified

PLANT, IT, RESERVOIRS AND PUMPING STATION", including
face. and smooth brick valued at X26..00 per thousand
delivered; all. exposed smooth and face brick to
be cleaned with dilute solution of muttic acid, washed
with clean water and left free from acid and smeared
motar. $73,890.00
Construction will be completed within120 calendar days
after your instructions to proceed.
4`850.00 included in bid for Performance & Labor Bond Premiums.
We will promptly replace any material furnished or work done
by us if proven defective within one year from date of

the construction of the Softening Plant, Reservoir
and Pumping Station, at Des Plaines,Illinois, for
the sum of SIXTY-THREE THOUSAND, SEVEN HUNDRED
DOLLARS . . . . . . . . . . . . . . . . ;$'63,700.00,
less the amount which has already been received by
us, under the following conditions which is substan-
tially the proposal made at a meeting held in Chicago
at which your Honorable Mayor and your City Attorney,
Mr.Kenneth Meyer, waere-presei t i - - -
That we will do the above-mentioned work at
actual cost of labor and material, tools and
equipment and supervision, cost of insurance,
cost of bond premium for surety bond which
has already been furnished to you, sales tax
and any other taxes which may be levied against
this project, at a maximum cost of 63,700.00.
Since the approved surety bond is already in your
possession, we do not deem it necessary to qualify
further as bidders.
It is understood that this proposal is tendered
without prejudice to or waiving of our rights
contained in our former contract.

The Mayor then referred these bids to the City Attorney
for examination after which the City Attorney submitted
the following proposed resolution which was read by the
Clerk:
RESOLUTION
-t REAS: This City did heretofore advertise
for bids for the completion of construction of Section A
of a certain contract of this City known as City of Des
Plaines Water Works - P.W.A.Project 07270, and
WHEREAS: The City Council has received a
bid from R.C.`,ieboldt and Company and A.L.Jackson Company
which bids are in conformity with the said advertisement
for bids, and
\,HERlAS: A bid was received from B -W Construction
Comiany, which bid is not in conformity with the advertise-
ment for bids:
THEREFORE BE IT RESOLVED: by the City Council
of the City of Des Plaines,Illinois, that the bid of
R.C.Wieboldt and Company and the bid of A.L.Jackson and
Com>any be referred to the City Engineer and the State
Director-P.W.A. for consideration.
BE IT FURTHER RESOLVED: that the bid of B -W
Construction Company, which is not in conformity with
the advertisement for bids, be not considered.

The motion was made by Alderman Ahbe and seconded by Frederick
toadopt this proposed resolution as read. The Mayor put the
question and the Clerk called the roll with the following
result: Ayes; Aldermen Ahbe, Carroll, Pflugh:,upt, Bishop,
MacLuckie, Frederick, Lemke and Campagna. Nays;'bone.(Alderman
Fulle and „Ichwanbeck were absent during this roll call.) The
Mayor thereupon declared the motion carried and the resolution
adopted.
The motion was then made by Alderman Ahbe and seconded
by Carroll to -postpone action regarding the bids of R.C.Wieboldt
Company and A.L.Jackson Company until the next regular meeting
of the Council. The 'mayor put the question and the Clerk called
the roll with the fDllowing result: Ayes; Aldermen Ahbe and
Carroll. Nays; Aldermen Pflughaupt, Bishop, MacLuckie,
Frederick, Lemke and Campagna. (Aldermen 2ulle and Schwanbeck
were absent during this roll call.) TheMayorthereupon de-
clared the motion defeated.
The motion was then made by Alderman Bishop and
seconded by Frederick to further consider the bids of R.C.-
Wieboldt Co. and A.L.Jackson Co. in an adjourned meeting of
the Council to be held in the Clerk's office at 8:00 P.M.
Tuesday April 14,W66. 56. The Mayor put the question and the Clerk
called the roll with the following result: Ayes; Aldermen
Carroll, i fiughaupt, Bishop, Frederick and Lemke. bays; Aldermen
Ahbe, "acLuckie and Campagna. (Aldermen Pulle and Schwanbeck
were absent during this roll call.) The Mayor thereupon de-
clared the motion carried.

BIDS ON 1936 TAX:WARRANTS: The Clerk announced
that there are three bidders present ready to bid for the
sale of the City's 1936 Tax Warrants.
The motion was made by Alderman Bishop and seconded
by Ahbe to. proceed with oral bidding on, not to exceed
430,000.0O of the City's 19"36 Tax Anticipation Varraits.
The motion was voted upon by acclamation, whereupon the .;:payor
declared the motion carried. The oral bidding then proceeded,
the bidders being:

Angell -Simpson Co., Chicago,lllinois.
During the course of the bidding_ the motion was made by
Alderman Campagna and seconded by MacLuckie to permit each
bidder to offer only one more bid and close the bidding.
The Mayor put the question and the Clerk called the rGll
with the following result: Ayes; Aldermen Pflughaupt,
ac7Luckie, Lemke, Campagna. Nays; Aldermen Ahbe, Carroll,
'ulle ,Bishop and Frederick. The Mayor thereupon declared
the motion defeated.
(Alderman Fulle excused himself and left the meeting)
The motion was then made by Alderman Ahbe and
seconded by Bishop to limit the bidding to 9:15 P.M.
The Mayor put the question and the Clerk called the roll with
the following result: Ayes; Aldermen Ahbe, Carroll, Pflughaupt,
Bishop, MacLuckie, Frederick, Lemke and Campagna. bays; lvone.
The Mayor thereupon declared the motion carried.
:t 9:15 P.M. Mayor Kinder declared the bidding closed.

Tax levy against the general corporate, garbage, fire and
public library funds, all the warrants to lie within the
first 557 of said tax levy, each series to be numbered
from one upward and to be all in the denomination of
X1,000.00 each so far as possible except that where
necessary there may be one 4500. piece in each series,
bearing interest at the rate of three and one half per
centum (3L`0) per annum, all of said warrants to be due and
when said taxes have been collected and to be paid out of
the first taxes collected from the 1936 tax levy, said
warrants to be dated on or about April 15th,1936, we will
pay you the par value thereof, accrued interest from the

The motion was made by Alderman Ahbe and seconded by Lemke to refer
this letter and copies of letters attached thereto to the Streets
and Sidewalks Committee for study and report. The motion was voted
upon by acclamation, whereupon the Mayor declared the motion carried.
PURCH:LSE OF STREET SWEEPER: Alderman Lemke then
reported that the Village of Hinsdale has a used Austin -Western
Motor Sweeper originally purchased new at a price of approximately
X7,000.00 which has been offered to the City of Des Plaines for
41480.00. He reported further that he has inspected this sweeper
and has found it to be a good buy. The motion was then made by
Alderman Lemke and seconded by Frederick to authorize the purchase
of this s�:eeper from the Village of Hinsdale at a price not to
exceed X480.00 and to instruct the Clerk to issue a purchase order
for the same. The Mayor put the question, a nd the Clerk called
the roll with the following result: Ayes; Aldermen Ahbe, Carroll,
Pflughaupt, Bishop, M ,cLuckie, Frederick, Lemke and Campagna.

the Council
Dear Sirs
I hereby petition for a license tocperate a waste
material yard on the Sigwalt property at Harding
and Western Ave., Des Plaines.
The business I have in mind will be conducted so as
not to be a nusiance to the neighbors in the neigh-
borhood. It will be 600 feet from Harding Avenue
in the rear of the property in a brick building. I
also would like to hear just why. my last petition

CRUSHED STONE FOR RIVE ;VIEW STREETS: Alderman Campagna
then requested that on effort be made to spread crushed, stone,
which is being hauled from the Lee Street widening project
upon the unpaved streets in Riverview. Mayor r'l.inder referred
this request to the S4_reets and Sidewals Committee for investi-
gation and report.

ENGINEER'S REPORT ON BIDS: ' .H.Allen, City
Engineer, then reported that the lowest bid received was the
bid of R.C.Wieboldt co. for the sum of '73,890.00. He further
reported that he has investigated R.C.kieboldt Co.. with res
pect to reliability and ability to successfully complete the
project and has found them reliable and competent, and
recommended that the contract for the completion of Section "A"
of P.W.A.Project #7270 be awarded to R.C.Wieboldt.Co.
AWARD OF CONTRACT: The motion was made by Alderman
Bishop and seconded by Frederick to award the contract for the
completion of Section "A" of P.W.A.Project #7270 to z .C., ieboldt
Co. for the contract price of 473,890.00, said award to be made
subject to the approval of the late Director of the Public
Works Administration; and that the Mayor and City Clerk be
instructed and directed to execute the said contract for and in
the name of the City of Des Plaines, subsequent to approval by
the State Director of the Public Works Administration. The Mayor
put the question and the Clerk called the roll with the following
