03/09/19366 MINUTES OF THE ADJOURNED DIETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES HELD IIT THE COUNCIL CHAMBERS ON THE 9th DAY OF MARCH,A.D.1936 AT THE HOUR OF 8:00 P.M. CALL TO ORDER: The meeting was called to order by Mayor George W..hinder, presiding, with AldernenAhbe, Carroll, Pflughaupt, Bishop, MacLuckie, Frederick, Lemke, Schwanbeck and Campagna responding to the roll call.Alder- man Fulle was absent during this roll call but arrived, shortly thereafter. The Clerk reported a quorum present. T,Iiayor Kinder then announced that this is an adjourned meeting fot the purpose of discussing the down- town parking situation, ad to deliberate upon such other Council business as may need attention. DO r:'ITTOWN PARKING PROBLEMS: There being no objection, Mr.Frank Svoboda, representing a group of Ruiner Street business men, then addressed the Council in support of the petition submitted by the said business men to the Council at its meeting of -March 2,19x6 and reading as follows: Petition To the Mayor and Aldermen of the City of Des Plaines,Illinois ewe, the undersigned business men doing business on Miner Street (Northwest night ay) in the City of Des Plaines,Iilinois, do hereby petition your honor- able body to provide, by ordinance 90 minute parking along the north side of Miner Street, between rearson Street and Graceland Avenue (except that portion of the street not now occupied by business buildings) between the hours of 7 A.M. and 9:30 P.M.; believing that by so doing you are best providing for traffic regulation along this U.S.Highway and also best serving the in- terests of the shopping public and citizens, and the merchants and business men of our City. We further pray and protest against the proposed section of the contemplated parking ordinance which provides only one hour parking along this street between the hours of 7 A.M. and 7 P.M.; believing,a&ter proper study and consideration, that the best interests of the city are not served by this proposal. Signed by: 20 Miner Street merchants. A counter -petition signed by a large number of citizens was then submitted by Mr. J.Faulner, manager of the Des Plaines Theatre which was read by the Clerk as follows: Petition We, the undersigned citizens and taxpayers of the City of Des Plaines do vigorously protest the 7 A.M. to 9 P.M. one hour parking restrictions, and are heartily in favor of the proposed 7 A.M. to 7 P.M. one-hour parking ordinance. (180 Signatures) The Council thereupon heard arguments for and against both of these petitions. Alderman Carroll then submitted the following proposed ordinance which was read by the Clerk: 6 5 AN ORDINANCE REPEALING AN -ORDINANCE ENTITLED "AN ORDINANCE PRESCRIBING PARKING REGULATIONS ON CERTAIN STREETS 'WITHIN THE CITY OF DES PLAINES AND PROVIDING PENALTIES FOR THE VIOLATIONS THEREOF" passed October 18 1935. BE IT ORDAINED by the City Council of the City of Des Plaines, Cook County, Illinois: Section 1. That an Ordinance entitled "An Ordinance prescribing parking regulations on certain streets within the City of Des Plaines and providing penalties for the violations thereof" passed October 18,1935, be and the same is hereby repealed. Section 2. That all ordinances or parts of Ordinances in conflict herewith are hereby repealed. Section 3. That this ordinance shall be in full force and effect from and after its passage and approval accord- ing to law. Ayes; Passed this day of A.D.1936 Nays; CITY CLERK Approved this day of 1956. MAYOR The motion was made by Alderman Carroll and seconded by Bishop to suspend the rules and put this proposed ordinance upon its final passage. The Mayor put the question and the Clerk called the r:11 with the following result: Ayes; Alderman Ahbe, Carroll, Pflughaupt, Pulle, Bishop, MacLuckie, Frederick, Lemke, Schwanbeck and Campagna. Nays; None. The Mayor thereupon declared the motion carried and the proposed ordinance before the Council for final disposition. The motion was then made by Alderman Carroll, and seconded by .Tulle to finally pass and adopt this proposed ordinance. The Mayor put the question and the Clerk called the roll with the fllowing result: Ayes; Aldermen Ahbe, Carroll, Pflughaupt, Fulle, Bishop, MacLuckie, Frederick, Lemke, Schwanbeck and Campagna. Nays; :None. The Mayor thereupon declared the motion carried and the ordinance finally passed and adopted. The motion was then made by Alderman Bishop and seconded by Pulle to instruct the Streets and Sidewalks Com- mittee to cause all "one hour" parking signs within the business district to be removed. The motion was voted upon by acclamation, whereupon the Mayor declared the motion unanimously carried. The motion was made by Alderman Frederick and seconded by Ahbe to refer the downtown parking problem and all petitions pertaining thereto to the Police and License Committee for study and report. The motion was voted upon by acclamation, whereupon the Mayor declared the motion unanimously carried. ESTABLISH',`^, T OF HIGHWAY SPEED ZONES: The Clerk then read the following letter: STATE OF ILLINOIS DEPARTMENT OF PUBLIC WORKS AND BUILDINGS Division of highways February 26 1936 Mr.E.J.Friedrich City Clerk Des Plaines,Illinois Dear Sir: I am forwarding herewith two copies of a resolution for the establishment of speed zones on State Highways within your municipality. the speed zones described in the resolutioh and shown on the attached map have been designated after consulta- tion with the Chief of Police or with other officials of your community. After the resolution has been passed by the municipality, arrangements will be made for the erection of the necessary speed limit signs along the routes designated. Will you please bring this matter to the attention of the City Council or to the village or Town Board of Trustees at your first opportunity? One copy of the resolution may be retained for your files. The second copy should be returned to this office when proper signatures have been affixed. WHEREAS, there are certain streets or highways within the limits of the city of Des Plaines, Illinois, which are designated as State Highways and which are under the jurisdiction of the State of Illinois, Department of Public Works and Buildings, Division of Highways, and WHEREAS, the Department of Public Works and Buildings, Division of Highways, in accordance with the provisions of article 111; Section 29 of an Act in Relation to the Regu- lation of Traffic approved July 9 1935, is empowered to place and maintain such traffic control devises as it shall deem necessary to regulate traffic on such high ways, and WHEREAS, the act in Relation to the Regulation of Traffic provides for certain speed restrictions as pres cribed in Article V1, Section 49, of said Act and for the adjustment of such speed restrictions upon such highways in accordance withthe provisions of Paragraph (d) of Article V1, Section 49, of said Act, therefore, BE IT RESOLVED, by the City Council of the City of Des Plaines,Illinois, that such state highways located within the municipality be zoned for speeds as herein- after described and as further indicated on the attached map of the municipality in accordance with the provisions of Act in relation to the Regulation of Traffic approved July 9,1935. Tag day money is available for use in your community or in any part of Illinois for destitute families of prisoners. Because of Mrs. Booth's 41 years of voluntary service in the penal institutions of the United States many of such relief cases come to us through Wardens or Chaplains, Protestant or Catholic. Our tag day prxblicity through this "once a year" appeal is valuable in keeping the organization before the public, and we hope for your continued kindly co-operation. PROPOSED PEDESTRIAN UNDERPASS: Alderman Frederick reported that a traffic count was being made at the inter- section of Lee and Thacker Streets as part of the study for the proposed pedestrian underpass on Thacker Street under Lee Street. AUDITING BILLS: The motion was made by Alderman Carroll and :seconded by Pflughaupt to instruct the finance Committee to cause the auditing bills of Allen R.Smart & Co.., which were recently disallowed, to be entered upon the invoice register for the next regular Council meeting. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. ADTOURNIEENT TO CLERK'S OFFICE: The motion was then made by Alderman Pflughaupt and seconded by Fulle that the Council adjourn to the Clerk's office in order to discuss the 1936 Tax Levy Ordinance as well as the proposed funding program. The motion was voted upon by acclamation, whereupon the Mayor declared the motion carried. The Council thereupon adjourned to the Clerk's office where Mayor Kinder again called the Council to order, with all members of the Council present. REQUEST FOR JUNK YARD LICENSE: There being no objection, stir. Harry C.Nelson and Mr. Herbert Lissner addressed the Council asking for license to operate a junk yard on Harding Avenue near Western Avenue, and asking further that the Council to require a license fee high enough to protect them from "outsideH competition. The motion was made by Alderman Mac- Luckie and seconded by Lemke to refer this request to the Aldermen of the First Ward (where the proposed junk yard would be located.) for study, and report at the next regular Council meeting. The motion was voted upon by acclamation, whereupon the Mayor declared the motion carried. 19� 6 TAX LEVY ORDINANCE: The Clerk then read and explained the proposed 1936 Tax tevy Ordinance, which was then deliberated upon by the Council. The motion was made by Alderman Frederick and seconded by Lemke to instruct the Clerk to prepare the finished draft of the said Ordinance detailed as per the draft presented, and submit the same to the Council at its next regular meeting for second reading. The motion was Toted upon by acclamation, whereupon the Mayor declared the motion unanimously carried. SUIT TO RECOVER FUNDS FROM COUNTY: Kenneth G. Meyer, City Attorney, then reported that the case of Joseph L.Gill, County Treasurer vs. --the City of Des Plaines and Others, is a suit in which the County Treasurer requires the City to establish what portion of forfeiture taxes held by the County are due the City of Des Plaines. The motion was made by Alderman Frederick and seconded by MacLuckie to instruct the City Attorney to contact a number of auditing firms and report to the Council whether or not it will be possible to conduct the necessary audit of the County's books on a contingent or percentage basis. The motion was voted upon by acclamation, whereupon the Mayor declared the motion unanimously carried. PROPOSED FUNDING PROGRAM: Kenneth .U.Meyer, City Attorney, then reported that Chapman & Cutler, bonding attorneys, have agreed to render a favorable opinion on the City's proposed funding bonds and that therefore the Council may proceed with the proposed program for funding all of the City's past due vouchers payable and judgments. Mayor Kinder instructed r.enneth G.Meyer, City Attorney, to deal with the various judgment holders with a view toward getting concessions from them if possible. The Mayor also appointed a special committee consisting of the members of the Finance Committee and Alderman Lemke, for the purpose of dealing with the :public Service Co. of Northern Illinois in an effort to get a concession in settlement of its judgment against the City. INVITATION TO LION'S CLUB: Alderman Bishop extended to the members of the Council an invitation to be guests at the next meeting of the Lion's Club, Marc 17 1936. THE POLICE AN LICENSE COMMITTEE: through its chairman, Alderman Carroll, that his committee expects to present a pro- posed parking ordinance to the Council at its next regular meeting. The motion. was made by Alderman Carroll and seconded by Lemke to instruct the City Attorney to prepare a draft of such parking ordinance under the direction and counsel of the Police and License Committee'and submit the said draft to the Council when completed. THE STREETS AND SIDEWALKS COMMITTEE: The Oprk then read the following report: To Chairman Frederick,Streets and Sidewalks Committee, at the meeting of the City Council, held February 3 1936 the following matter was referred to your committee: The letter regarding house numbers from Hester h.Bennett dated January 26 1936. Copy of which is attached hereto. EDGAR J.FRIEDRICH Your committee on Streets and Sidewalks has investigated the above and with the help of the Supt.of r'ublic Wks made the correction as per request in the attached letter and according to ordinance dated Aug 1 1932.
