HELD IN THE COUNCIL CHAT 3ERS ON THE
2nd DAY OF MARCH,A.D.1936 AT THE HOUR
OF 8:00 P.M.
CALL TO ORDER: The meeting was called to order
by Mayor George W.Kinder, presiding, with Aldermen Ahbe, Carroll,
rflughaupt, hulle,. Bishop, MacLuckie, Frederick, Lemke, Schwanbeck
and Campagna -responding to the roll call. The Clerk thereupon
reported all members of Council present. -9

1.The report of H.A.Becker, Captain of Police for the Calendar
month of February 1936.
2.The report of Edgar J.Friedrich,City Clerk for the month of
February 1936.
The Mayor adered these reports placed on file.

THE COMMITTEE ON PUBLIC WORKS, BUILDINGS AND PLATS through
its chairman, Alderman iiacLuckie, presented the following report:
To chairman MacLuckie,Public Works, Buildings & Plats Committee,
at the meeting of the City Council, held February 17 1936 the
following matter was referred to your committee:
The request of those in charge of the City's W.P.A.
Recreation Project, asking that the Council provide
office space in the Council Chamber by partitioning
off a part thereof.
This matter was referred to your committee with power to
act.

To the Mayor and City Council:
Your committee on Public Works, Buildings and Plats,
has investigated the above and has found: That it seems
reasonable and right to set aside space for the members of
the City's C.P.A. This space to be conveniently located in
the City Hall.
We recommend: That a space 14x15' at the left of
the entrace to the hall be designated for this purpose. We
further recommend that this space be enclosed in a neat, plain
railing, sufficiently wide and strong, to be used as seats when
the Council is crowded.

The motion was made by Alderman Pflughaupt and seconded by 1'ulie to
adopt this proposed resolution. The Mayor put the question and the
Clerk called the roll with the following result: Ayes; Aldermen Ahbe,

the motion carried and the resolution adopted.
Alderman Pflughaupt, chairman of the Finance Committee,
then read the following proposed resolution, of which each member
of the Council had a copy:
RESOLVED THAT THE FOLLOWING COMMERCIAL BILLS ARE
DUE AND PAYABLE AND THAT THE MAYOR AND CITY CLERK BE
INSTRUCTED TO ISSUE PROPER VOUCHER -WARRANTS IN

The motion was made by Alderman Pflughaupt and seconded by Fulle to
adopt this proposed resolution. The Mayor put the qeustion and
the Clerk called the roll with the following result: Ayes; Aldermen
Ahbe, Carroll, Pflughaupt, Fulle, Bishop, LacLuckie, Frederick, .Lemke,
Schwanbeck and Campagna. Nays; None. The Mayor thereupon dalared

RECONSIDERATION OF BILLS: Alderman Bishop called
the Council's attention to the fact that the bill of B -W Con-
struction Co. for $440.00 for work done on P.W.A.Project , 7270
should have been approved subiect to the approval of the P.W.A.
Resident Engineer. The motion was made by Alderman Bishop
and seconded by MacLuckie to reconsider the resolution approving
the commercial bills for payment. The Mayor put the question
on the motion to reconsider, and the Clerk called the roll
with the following result: Ayes; Aldermen Ahbe, Carroll, Pflug-
haupt, Fulle, Bishop, MacLuckie, Frederick, Lemke, Schwanbeck
and Campagna. Nays; None. The Mayor thereupon declared the
motion to reconsider carried.
The motion was then made by Alderman Bishop and
seconded by Ahbe to strike from the original resolution "voucher
B -W Construction Co. for labor and material on P.W.A.
Project #7270 - Engineer's estimate 2/29/38 - 4440.21", and
to adopt the proposed resolution as amended and reading as
follows:

The Mayor put the question and the Clerk called the roll with
the following result: Ayes; Aldermen Ahbe, Carroll, Pflughaupt,
Fulle, Bishop, MacLuckie, Frederick, Lemke, Schwanbeck and
Campagna. Nays; None The Mayor thereupon declared the motion
carried and the resolution adopted.
The motion was then made by Alderman Bishop and seconded
by Ahbe to approve the engineer's estimate of B -W Construction
Company for labor and taterial furnished for Project #7270 up to
February 29 1937 in a sum to be determined and regularly approved
by the P.W.A.resident engineer before payment. The Mayor
put the question and the Clerk called the roll with the following
result: Ayes; Aldermen Ahbe, Carroll, Pflughaupt, Fulle, Bishop,
MacLuckie, Frederick, Lemke, Schwanbeck and Campagna. iNays; iNone.
The Mayor thereupon declared the motion carried and the said
estimate approved for payment subject to approval of the P.W.A.
Resident Engineer on P.W.A.Project #7270.
TERMINATION OF CONTRACT, B -W CONTRUCTION CO. The
Clerk then read the following letter:

dated October 18 1935, but delivered subsequently
thereto, and which became effective in accordance
with Article 8 thereof on November 26 1935, have
elected to terminate said contract and recover
from you payment for all work executed and the loss
sustained on plant and materials and reasonable
profit and damages, said termination to take place
seven days from the date on which this notice is
received by you.

your letter of February 26 1936 advising -us that you
have elected to terminate your contract with the City
under the above captioned project.
Your action is without right and forces the
City to look to you and the surety on your construction
bond for any and all loss or damage sustained by your
improper and unlawful conduct.
Your present action together with your past
conduct in this matter clearly convinces the members
of the City Council and myself that you have little
regard for your contract obligations.'
Please be further advised that the City of
Des Plaines denies any liability to you in anynamner
or form.

The motion was made by Alderman IacLuckie and seconded by Frederick
that the Council approve and endorse the Mayor's reply to the
B -W Construction Co. as read. The motion was voted upon by
acclamation, whereupon the Mayor declared the motion carried,
The Clerk then read the follow ing ?apposed resolution:
RESOLUTION
WHEREAS the 1374 Construction Company has notified
the City of Des Plaines that it, the B -W Construction
Company,has terminated their contract for certain
construction work under what is known as "City of
Des Plaines Water Works -PWA Project x`7270", and
WHEREAS this City Council is of the opinion that
the action of the said B -W Construction Company is
without right:
THEREFORE BE IT RESOLVED by the City Council of
the City of Des Plaines,Illinois, that notice is given
to the American Surety Company of New York, surety on
the construction bond of the B -W Construction Company,
advising the said American Surety Company of the
breach of contract by the b -W Construction Company,
and making demand upon the American Surety Company to
protect the City of Des Plaines, Illinois, from loss
and damage to be sustained by the action of the B -W
Construction Company.
BE IT FURTHER RESOLVED that said notice and demand
be signed by the Mayor of this City and be in substantially
the following form:

Gentlemen: Contracttr
This is to advise you that the City of Des Plaines
received notice under date of February 26 136 from the
B -W Construction Company to the City of Des Plaines that
they have "elected to terminate" their contract with this
City for construction work, under what is known as City
of Des Plaines Water Works P.W.A.rroject 07270.
The notice from the B -W Construction Company does not
give any reason for breaking their contract and their
action amounts to a refusal to proceed any further.
The action taken by the 13-W Construction Company is
without moral right of legal basis and the City is compel-
led to look to you for protection as surety on the
construction bond of the B -W Construction Co.
The state of facts will make it necessary for the City
to proceed at'once to receive new bids unless you as
surety intend to take over the construction and thus
protect the City under your contract of indemnity.
You understand that the City can only engage a new
contractor after complying with the law requiring ad-
vertisement for bids, which will mean further delay. we
also wish to draw to your attention the fact that part
of the money (approximately ,r31,000.) to complete this
project is to be received from the u.S.Government as
a grant, and if the contruction is delayed unreasonably
the government may withdraw its grant and thus increase
the damages to the City.
This letter is to formally advise you of the
brdach of contract on the part of the B -W Construct-
ion Company, and to formally demand of you to take
the necessary action to protect the City.
The City must be advised within five days from
receipt of this letter, whether you intend to take
over the construction of the work contracted for by
the B -W Construction Company, and upon failure to be
so advised, the City will re -advertise for bids
and let a new contract and hold you responsible
under your indemnifying bond dated October 18 1935.

SUPERSEDING GRANT AGR 1 1T P.W.A. #7270; Alder-
man Bishop, chairman of the Water Committee then introduced
the following proposed ordinance which was read by the
Clerk for first reading:
AN ORDINANCE APPROVING A SUPERSEDING GRANT
AGREEMENT BETWEEN THE CITY OF DES PLAIN.ES,
COOK COUNTY, ILLINOIS, AND THE UNITED STATES
OF A ERIC LN, AND AUTHORIZING THE EXECUTION
OF SAID AGREEMENT.
BE IT ORDAINED by the City Council of the City
of Des Plaines, Cook County, Illinois:
Section 1. That the Superseding Grant Agreement
between the City of Des Plaines, Cook County, Illinois,
and the United States of America, under and subject
to the terms of which the United States will grant
not exceeding in the aggregate the sum of .33,500.00
aid, said City of Des Plaines in financing the
construction of improvements to the Water Works
system of said City of Des Plaines., comprising the
purchase of a privately owned well, pumping plant
and equipment, construction of filtration and treat-
ment plant, and erection of two 500,000 gallon con-
crete reservoirs and extensions to distribution
system, a copy of which Superseding Grant Agreement
is filed among the public records of said City of
Des Plaines in the office of the City Clerk of the
City of Des Plaines, and which said Superseding
Grant Agreement is hereby made a part hereof, be
and the same is hereby in all respects approved.
Section 2. That the Mayor of said City of Des
Plaines be and he is hereby authorized and directed
to execute such Superseding Grant Agreement in tripli-
cate on behalf of the City of Des Plaines, and the

City Clerk of said City of Des Plaines be and he is
hereby authorized and directed to impress or affix the
official seal of said City to each of said three copies
of said Superseding grant Agreement and to attest such seal.
Section 3. That said City Clerk be and he is hereby
authorized and directed to forthwith forward three copies
of said Superseding Urant Agreement as executed on behalf
of said City of Pes Plaines to the FederalEmergency Adminis-
tration of Public Works, Washington, D.C.
Section 4. That the Mayor and City Clerk of said City
of Des Plaines, be and they are hereby authorized and empowered
on behalf of said City in the same manner as said Superseding
Grant Agreement, and further instruments that may be found
desireable in connection with any modifications or changes,
in connection with or under said Superseding Grant Agreement.
Section 5. That said City Clerk of the City of Des Plaines
be and he is hereby authorized and directed to forthwith send
to said Federal emergency Administration of Public Works two
certified copies of this Ordinance and two certified copies
of the proceedings of the City Council of the City of Des -
Plaines in connection with the adoption of this Ordinance,
and such further documents or proofs in connection with the
approval and execution of said Superseding Grant Agreement
as may be requested by said Federal Emergency Administration
of Public Works.

The motion was made by Alderman Bishop and seconded by Ahbe
that all rules of the Council which might prevent, unless
suspended, the final passage and adoption of the said pro-
posed ordinance at this meeting be and the same are hereby
suspended for the purpose of permitting the final passage
and adoption of the said proposed ordinance at this meeting.
The Mayor put the question on the motion and the suspension
of such rules, and the Clerk called the roll with the follow-
ing result: Ayes; Aldermen Ahbe, Carroll, Pflughaupt, Tulle,
Bishop, MacLuckie, Frederick, Lemke, Schwanbeck and Campagna.
Nays; None. The Mayor thereupon declared the motion carried
and such rules suspended.
The motion was then made by Alderman Bishop and
seconded by Ahbe that the proposed ordinance be now placed
upon its final passage. The Mayor put the question and the
Clerk called the roll with the following result: Ayes;
Aldermen Ahbe, Carroll, Pflughaupt, Fulle, bishop, MacLuckie,
Frederick, Lemke, Schwanbeck ad Campagna. Nays; JNone. The
Mayor thereupon declared the motion unanimously carried.
The motion was then made by Alderman Ahbe and seconded
by Frederick that the said proposed ordinance be finally
passed and adopted as introduced and read. The Mayor put
the question on the motion to finally pass and adopt, and
the Clerk called the roll with the following result: Ayes;
Aldermen Ahbe, Carroll, Pflughaupt , Fulle, Bishop, MacLuckie,

The Mayor thereupon declared the motion carried and the
said ordinance finally passed and adopted. Mayor George
W.Kinder then signed the original of the said ordinance
in approval thereof, whereupon the City Clerk, Edgar J.
Friedrich, impressed thereon the corporate seal of the
City of Des Plaines and attested the same by his signature.

the motion carried.
APPLICATION FOR JUNK YARD LICEN3E: The Clerk
then read the following letter:

The Honorable, the Mayor, and the City Council
of the City of Des Plaines,Illinois
Dear airs;
We have acquired a piece of property in the
City of Des Plaines which is located in the fourth
ward at 1st Avenue Prairie and Thacker Streets. The
lot is 200 x 125 feet.
We understand that this vicinity is zoned for
industrial uses and intend using it for such with the
consent and approval of the council members.
This business will be known as the Des Plaines
Waste Disposal Center; accepting in sales, iron, metals,
bags, paper and bottles, and all articles that may be
classified as waste materials.
We have in regard the safety and beautification
of Des Plaines and therefore will build an eight foot
fence encircling the property to keep the neighborhood
clean and safe and uphold the real estate value. We also
will remodel and repair the block house to the extent
where it will be suitable and safe for business purposes.
For your consideration may 1 add that if we are
permitted in your city we will abide by all requirements
and we will be open at all times for inspection.

Hon. Mayor o1 City Council
Gentlemen:
During the past ten days we have learned that Harry Felson
and Herbert S.Lissman partners selecting the trade name
of "Des Plaines Waste & Disposal Station" have leased
ground space 200 x 140 including cement block house on
First Ave. opposite Rose Ave for the purpose of conducting
a Junk business, this space to be surrounded by an
eight foot fence.
As this particular location is of special interest to
the residents of the Fourth Ward, we the undersigned,
believe they should be given first consideration in
voicing their opinion as to the acceptance or the re-
jection of such type of business in their community.
Therefore we the aldermen of the 11ourth Ward after con-
sulting various residents of the ward find their attitude
very unfavorable on this issue and in justice to them
we protest the granting of a permit to the above to
conduct this type of business in said ward.

Frederick to concur in the recommendations contained in
the letter from Aldermen Lemke and Frederick. The motion
was vated upon by acclamation, whereupon the Mayor declared

PETITION ON DOWNTOWN PARKING: The Clerk then
read the following petition;
PETITION
To the Mayor and Aldermen
of the City of Des Plaines
We, the Undersigned business men doing business on
Miner Street (Northwest High ay) in the City of
Des Plaineo,Illinois, do hereby petition your
honorable body to provide, by ordinance, 90 minute
parking along the north side of Miner Street, between
Pearson Street and Graceland Avenue (except th4t
portion of the street not now occupied by business
buildings) between the hours of 7 A.M. and 9:30 r.M. ;
believing that by so doing you are best providing for
traffic regulation along this U.S.xightivay and also
best serving the interests of the shopping public and
citizens, and the merchants and businessmen of our cir.
We further pray and protest against the proposed section
of the contemplated parking ordinance which provides
only one hour parking along this street between the
hours of 7 A.M. and 7 P M; believing, after proper
study and consideration, that the.best interests of the
City ae not served by this proposal.

The motion was made by Alderman MacLuckie and seconded by
Carroll to refer this petition to the Council to sit as a
committee of the whole in the City Clerk's office after the
close of this meeting. The motion was voted upon by
acclamation, whereupon the Mayor declared the motion carried
and the petition so referred.
PROTEST OF BUSINESS FEN'S ASSCCATION: The Clerk
read the following:
DES PLAINES BUSINESS MEN'S ASSOCIATION
March 2 1936
To the Honorable Mayor and City Council of Des Plaines
As an organization of one hundred Des Plaines busi-
ness men we are not in accord with the present so called
"safety drive" of the local police department. Our associ-
ation was organized to make Des Plaines a buying center
and we are spending money to bring neighboring people
here to shop. The present police tactics are defeating
our purpose by driving the shopper elsewhere to buy.
The tactics of arresting shoppers for technicalities
of the parking ordinance are causing business houses in
Des ?laines to lose a noticeable amount of business. ie
approve all safety measures but do not approve wholesale
arrests under the cloak of safety.
Cur resent two day sale was affected'by these "racket"
methods of your cafeteria court. We were forbidden the
privelege of distributing our circulars in Arlington
Heights because, to quote their officials," Tell your
business men when your police get some brains about
the treatment of visiting motorists we will welcome your
business circulars in our town.'*
A local car dealer lost the sale of a new automobile
because of local police tactics. Many visiting buyers
during our two days sale, whom we told in our circular
would be welcomed and given parking considerations, were
arrested and will never return to shop.
We recommend immediate action by the council at their
meeting tonight, March 2nd, to investigate and remedy this
situation.

The motion was made by Alderman MacLuckie and seconded by
Lemke to offer the business men present an opportunity to ex-
press their views regarding this letter. j2he motion was
voted upon by acclamation, whereupon the Mayor declared the
motion carried.
Mr. C.W.M.Brown,Jr. then addressed the Council in
behalf of the Des Plaines Business Men's Association and
referred a letter recently received from Arlington Heights
regarding arrests in Des Plaines. The motion was made by
Alderman Fulle and seconded by Ahbe to instruct the Clerk
to get the facts concerning the Arlington Heights incident
and to write an explanatory letter to all such as received
a copy of the letter of complaint from Arlington Heights.
The Mayor put the ggtestion and the Clerk called the roll

with the following result: Ayes; Aldermen Ahbe and Tulle.
Nays; "aldermen Carroll, Pflughaupt, Bishop, MacLuckie,
Frederick, Lemke, Schwanbeck and Campagna. The. Mayor there-
upon declared the motion lost.
The motion was then made by Alderman MacLuckie
and seconded by Campagna to ask the Des Plaines Business
Men's Association to appoint a committee of thtee to
discuss this matter with a committee representing the City,
composed of the Police and License Committee, the Mayor
and the Captain of Police. The motion was voted upon by
acclamation, whereupon the Mayor declared the motion carried.
STOKER FOR CITY HALL: The Clerk then read the

I have taken upon myself to submit a proposal
to install a Link Belt Stoker in your City Hall
Building. i have carefully checked your plant and
heating costs, and find that by the installation
of this Link Belt Stoker, I find that this stoker
will pay fhr itself within three years and give you
even automatic heat. This is done thru the saving
in fuel consumption and fuel costs. if possible,
1 would like an audience with your building committee
at some future date.

Frederick to refer this letter to the Committee on Public
t.'orLs, Buildings and Plats for study and report. The motion
was voted upon by acclamation, whereupon the Mayor declared
the motion carried.
APPROVAL OF IINUTES: The motion was made by
Alderman Bishop and seconded by Lemke to approve the minutes
of the regular Counil meeting hela February 17 1936 as sub-
mitted by the Clerk. The motion was voted upon by accla-
mation, whereupon the Mayor declared the motion carried
and the said minutes unanimously approved.
