MINUTES OF THE REGULAR MELTING OF THE CITY
COUNCIL OF THE CITY OF DES PLAINES HELD IN
THE COUNCIL CHA1 KERS ON THE 4th DAY OF

CALL TO ORDER: The meeting was called to order
by Nayor George .Kinder, presiding with Aldermen Ahbe,
Carroll, Pflugha.upt, 2ulle, Bishop, i1:acL•uckie, Frederick, Lemke,
Schwanbeck and Campagna responding to the roll call.
SALE OF WATER REVENUE BONDS: Mayor Kinder then
stated that C.W.Mc11enr L Company has offered to purchase
the 08,000.00 in Water Revenue Bonds for the construction
of the eater Reservoir and Softening plant originally intended
for the Federal Government. The Clerk then read the following
proposal:

both principal and interest to be payable at the
City Treasurer's office, and maturing as follows:

for prompt delivery of the above bonds to us., and is
made with -the -Understanding that there "has been no
default nor is there any -default inrninent in the
payment of principal and interest on any of your
outstanding obligations. -his proposal is made
subject to the unqualified approval of our attorneys
as to the legality of the bonds and the proceedings
leading up to their issuance, and you are to furnish
us promptly- with a Auil and complete certified trans-
cril:t of all proceedings leading up to the issuance
of these bonds; also to take such further action and
furnish such further papers as these attorneys may
consider necessary to establish the legality of the
bonds to their entire satisfaction.

Consistent with good banking practice, time
shall be regarded as the essence of this proposal,
and if the above bonds have not been delivered to
us by January 1,1955, we reserve the privilege or
option of withdrawing from our obligations and under-
takings hereunder at anytime after that date,
in which event:said certified check is to be returned
to us forthwith.
It is mutually understood and agreed that your
acceptance of this proposal by resolution shall consti-
tute a contract for the purchase and sale of the bonds
above described, subject to the above conditions.

was distributed to each member of the Council.
Mayor Kinder thereupon referred these reports
to the Finance Committees.
The JUDICIARY AND ASSE3SI ENT COENIETTEE had no
report to offer.
T'rE POLICE AND LICENSE COMMITTEE through -
its chairman Alderman Carroll then submitted the follow-
ing report which was read by the Clerk:

traffic situation as thorough and briefly as possible.

AD PROVIDING PENALTIES 1{'OR THE VIOL-
ATION THEREOF.
The motion was made by Alderman Bishop and seconded by Pflug -h
haupt to finally pass and adopt this proposed ordinance, and to
instruct the City Clerk to advertise for bids for the leg=al
p 'lica'_ti.on of the same, and authorize the Clerk to let the
said Publication to the lowest responsible bidder. The Mayor
put the question ad the Clerk called the roll with the follow-
ing result: Ayes; Alderman Pflughaupt, :r'ulle, Bishop and
Frederica. Nays; Aldermen Ahbe, Carroll, IFacLuckie, Lemke,
Schwanbeck and Campagna. Mayor Kinder thereupon declared the
motion lost and the Dropposed ordinance defeated.
The motion was made by Alderman Carroll and seconded
by Abbe to refer this ordinance to the Police and License Com-
mittee for report at the next regular Council meeting. The
motion was voted upon by acclamation, whereupon the Mayor
declared the motion carried, and the "Traffic Code" referred
to the Police and License Committee.
THE STREETS AND SIDEWALKS CCWITTEE: The Clerk
read the following proposed ordinance for second reading;
AN ORDINANCE REGULATING THE USE 0'r' BICYCLES J
'IITHIN THE CITY OF DES PLAINLS, COOK COUNTY,
ILLINOIS.
BE IT ORDAI3ED by the -City Council, City of
Des l Ines, Cook County, Illinois:
SECTI0N. 1. It shall be unlawful for any person to
ride a bicycle within the City of Des Plaines, between
sunset and sunrise unless such bicycle shall carry one
lighted lamp in front of such bicycle, showing a white
light, visible at least 300 feet in the direction toward
which such bicycle is traveling, and also a red reflector
at least two inches in diameter attached on the rear of
such bicycle.
SECTION 2. It shall be unlawful for any person propelling

a bicycle to permit another person to ride upon
the frame work, handle bars or luggage carrier of
such bicycle.
SECTION 3. It shall be unlawful for any person to
ride a bicycle upon any of the side -walks within the
City of Des Plaines.
SECTION 4. Any person violating any provision of this
Ordinance shall be fined a sum not to exceed 425.00.
SECTION 5. This Ordinance shall t .ke effect and be
in full force and effect from and after its passage,
approval and publication, according to law.

I have -read in the Suburban Titres of your plan
to sell the City Hall property. I note that the pre-
mises are to be listed with local b rokers, but 1 feel -
certain that while your council is desirous of favoring
local brokers that you would sell to the party making
the best offer for cash.
I have a party who is willing to purchase- this
property and has authorized me to make an offer of =;36,000.
all cash, out of which I would receive a sales commission
as established by the Chicago Real Estate Board. I
rill at your request deposit a certified check with you
for any fair proportion of this figure as earnest
money assuring you that the offer is made in good faith.
The last sale that I know of in the same block
was made by me on the Imig property, which I sold last
winter. The property is 30 feet and it brought in a
total of X10.000.00 at X333.331/3 per front foot. My
people are offering you at the rate of $400,00 per
so you will see that the offer is fair.

The motion was made by Alderman Pflughaupt and seconded by
Frederick to adopt this proposed. resolution. The motion
was however made by Alderman Carroll 2nd seconded by
MacLuckie to amend tis proposed resolution by striking
from the list of payees the two invoices of Jonathan
Coak & Co., one in the sum of ii2016.20 and the other
in the sum of 853.80. The Mavor put the question on the
amendment and the Clerk called the roll with the

meeting of the City Council held. October 21,1935 the
following matter was referred to your committee:
The recommendation of the Zoning Board of
APPEALS regarding the Leng application for re -zoning.
Also Mrs.Sengts petition for re -consideration.

considered the above and it was the unanimous opinion
of those present that the decision of the Zoning Board
of Appeals be sustained.

presented by Lrs. Seng together with pertinent correspondence
to the Zoning Board of Appeals for further consideration.

Anse=ering your letter of the 26th instant con-
cerning power contract under rate P for Cater :and
Norma Wells.
This contract is perfectly satisfactory in all
respects and is the one around which the designs of
the new improvements have been made by ;pie. Since
1'_rch this year, a change for the better has been
made in this contract and I recommend that you
sign it without further delay because it represent s
approximately X250.00 per month saving.
There is only one point on which I would like to
caution you, and that is, that the Norma Station
should not be operated co incidently with the Cater
Station because if these two stations are operated
at the same time, the net rate for energy will be
higher and as a result, the total cost of power will
be higher.

Frederick approve the "PI' Power contract and instruct the
Mayor and City Clerk to execute the same in the name and
in behalf of the City. The Mayor put the question and

CCNDRI TATION .FOR WOLF -GOLF UNDi w. PASS : The Clerk
then read the following letter:

Gentlemen:
Pursuant to the resolution heretofore passed
by the City Council I offered on behalf of the 'Ci ty for
the right of way of Golf Road, the sura of r,?5,692.00.
This offer was reused today by Otto Grosse
representing Lr. and Mrs. Seegers, and I was informed
that the owner mould settle out of court for X8,000.00.
In determining whether or not it is best
to settle out of court and pay the ov ner of the land
more than w as formerly "offered to them for the land,
the Council should consider the various possibilities
that might arise upon a trial of this case.
The jury might believe and determine that
the owner of the property were entitled -to less than
the amount heretofore offered the land owners, but
on the other hand the jury is just as likely to allow
the land owners more.
I am informed that the Seeger's property was
physically taken possession of by the State sometime in
1930 and a considerable amount of dirt was removed from
the Property in order to make the under -pass. This
Also, we mere given definite assurance that we
would receive approximately y 11,000.00 which the
property was ap>iraised for three years ago and uaon
that assurance and considering the great unemployment
situation, we let the State go in and build the
subvaau and this amount -is only one-half of what the former
as raisals are.
I` Pr.Seegers is suffering great damage to His
holdings in that he has no access to the station except
through the subway and up the steles and we have lost
several sales because it is com.ietely ruined by cutting
out and putting a subway throught the center thereof.
1r. Seegers offered to dedicate the aruperty for nothing
if they Vao ild make a level crossing, in preference to
taking :,10,000.00 or 415,000.00 and having it cut
and gouged to pieces. :`.s he owns `p_roxim-.tel 55
acres south of the railroad, dam-ges of 4200.00 per acre
would be several times the amount we are asking.
'e have several lawyers mho are willing to
handle this on a percentage basis above :410,000.00,
but considering that this is the only gap left on Wolf
Road and that we would receive the immediate payment
thereof, also that this road mould be paved immediately,
me hereby agree to accept 48,000.00 in full payment
of all land taken and in full payment for damages to
land not taken lying south of the Chicago and Northwestern
Railway owned by Herman Seegers and Mary Seegers.

Tr. Grosse then orally offered settlement. for .7500.00 upon
which the aotion was made by Alderman MacLuckie and seconded
by E.acLuckie to accept 1r. Grosse's offer and settle for
0500.00 subject to the a_ uroval of the State Hif;hvay Depart-
ment. The iayor put the auestion and the Clerk called the

The motion vas then made by Alderman Frederick
and seconded by Lemke to instruct the City Attorney to pre-
pare an appropriate resolution request ng the required
additional funds from the State Highway Department. The
motion was voted upon by acclamation, whereupon the 1ayor
declared the motion carried.

Whereas a neva set of traffic rules and regu-
lations have been adopted by the City of Des Plaines,
and whereas there now prevails in this community an
almost total disregard of traffic and other regulations
which re intended to promote order and to protect
life and public propertj,
Therefore Be It Resolved that the ::.iayor, the
members of the Council, the members of the 3oaru of
Fire and Police Commission, the Attorney, the Clerk,
the Treasurer -Collector, the Superintendent of Public
Works,the entire membership of the Police force,
the Magistrate and the Le .lth officer, all officers
of the'City of Des Plaines, and a representative from
each of the loc7'I newspapers be invited and earnestly
requested to attend at a suitable time and place,
hereafter to be designated, for the purpose of dis-
cussing earnestly and dispassionately, as well as
suggesting steps and remedies, for the improvement
and correction of the alarming and deplorable
conditions now prevailing in our City.
The motion was made by Alderman "Frederick and seconded by
Campagna to adopt this prowsed resolution. The Mayor put

acclamation whereupon the Mayor declared the motion carried
