10/21/1935650 .MINUTES OF THE REGULAR 1,17F.TING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES HELD IN THE COUNCIL CHAMBERS ON THE 21st DAY OF OCTORP,R,A.D.1935 AT THE HOUR OF 8400 CALL TO ORDER: The meeting was called to order b -y Mayor George W.Kinder, with Aldermen Ahbe, Pflughaupt, Fulle, -BiShop,-MacLuckie, Frederick, Lemke, Schwanbeck and Campagna responding to the roll call. Alderman Carroll was absent during this roll call but arrived shortly there- after. THE JUDICIARY AND ASSESS:ENT COJ17ITTEE had no report to offer. THE POLICE AND LICENSE COMMITTT7 had no report to offer. THE CO ` ITT ON PUBLIC WOR :S , BUILDINGS AND PLATS through its chairman, Alderman MacLuckie, submitted the following report: To CbArman MacLuckie, Public Works,Buildings and Plats Committee, at the meeting of the City Council,held October 7 1935 the following matter was referred to your committee: The matter of further negotiating to lease out the lot east of the City Hall. EL DRICH,City Clerk Your Committee on Public B1dgs.Plats has investigated the above and has found; That the applicant for the space to the east of the City Hall, is again in the market for this ground, on which to build a building, but asks for more time. TB FINANCE COMEITTEE through its chairman, Alderman Pflughaupt reported that the bill of Jonathan Cook and Company,in the sum Uf 32,016.20 for auditing Special Assessment 4t75 and the bill in the sum of $853.80 for auditing Special Assessment 477 have been discussed with representatives of Jonathan Cook and Company. The motion was made by Alderman Pflughaupt and Reconded by guile to instruct the City Clerk to list the said bills on the invoice register to be submitted to the Council for approval at its next regular meeting. The motion was voted upon by acclamation, whereupon the Mayor declared the motion carried. SANITARY DISTRICT INTERCEPTOR SEWER: The Clerk then read the following letter: THE SANITARY DISTRICT OF CHICAGO October 3 1935 Mr .Edgar J.Friedrich City Clerk - City of Des Plaines Des Plaines,Illinois Dear Mr.Friedrich, I am enclosing herewith the executed copy of the ordinance passed by_the City of Des Plaines in connection with the construction of the Upper Des Plaines Intercepting Sewer, together with the certificate of our Clerk attesting the acceptance of the ordinance by our Board. L.p. 653 Mayor Kinder supplemented this letter by reporting that formal bids for construction of the Proposed interceptor have been received by the Sanitary District and that, no doubt, contracts will be amarded in the near future. Vh,HICLE LICENSE FEES: 21derman Lemke then submitted the following proposed resolution; Resolved: That section 1045, page 164, of the City Ordinance be amended by striking out the license amounts of 45.00 and ',8.00 on all privately owned motor passenger Vehicles and substituting therefor the license amounts of 43.00 and %?6.00 respectively. JOHN LEMKE Mavor Kinder ruled that is Proposed resolution is not adequate to affect a chane in vehicle license fees, but that an amending ordi- nance is recjuired to affect the change. The motion was made by Alderman Lemke and seconded by 6chwanbeck to instruct the City Attorney to prepare an amendinL ordinance embodying the provisions of the proposed resolution. The motion was voted upon by accla- mation, whereupon the Mayor declared the motion carried. BICYCLES: The Clerk then read the following proposed ordinance for first reading: AN ORDINANCE REGULATING THE USE OF BICYCLES WITHIN THE CITY OF DES PLAINES, COOK COUNTY, ILLINOIS Be it Ordained by the City Council, City of Des Plaines Cook County, Illinois. Section 1. It shall be unlawful for any person to ride a bicycle within the City of Des Plaines, between sun set and sun rise unless such bicycle shall carry one lighted lam:,-) in front of such bicycle, showing a white light, visible at least 300 feet in the dir- ection toward which such bicycle is traveling, and also a red reflector at least two inches in diamdter attached on the rear of such bicycle. Section 2. It shall be unlawfulfor any person propelling a bicycle to permit another person to ride ubon the frate work, handle bars, or luggage carrier of such bicycle. Section 3. Any person violating any provision of this Ordinance shall be fined a sum not to exceed Section 4. This' Ordinance shall take effect and be in full f6rbe-and-effebt-frot-and diteb its passage, approval and publication, according to law. Passed this day of 1935. Mayor Mayor Kinder ordered this Proposed ordinance filed for second reading. 9 654 PARKING REGULATIONS: The Clerk then read the follow- ing proposed ordinance for first reading: AN ORDINANCE PRESCRIBING PARKINGREGUL.ATIONS ON CERTAIN STREET WITHIN THE CITY OF DE PLAINES, AND PROVIDING THE PENALTIES FOR THE VIOLATION THEREOF. The motion was made by Alderman Frederick and seconded by Pflugh,l.unt-to suspend such rules of the Council as may prevent the final oasSage of this proposed ordinance at this meetingic for the purpose of finally passing and adopting the said ordi- nance at this meeting. The Mayor put the question and the Clerk called the roll with the following result: Ayes; Aldermen Ahbe, Carroll, Pflughaupt, Palle, Bishon, MacLuckie, Frederick, Lemke, Schwanbeck and Calm)aEna. Nays; Hone. The Mayor there- upon declared the motion carried and such rules suspended. The motion was then made by Alderman Fulle and seconded by Frederick to finally pass and adopt this proposed ordinance. The Mayor put the -question, and the Clerk called the roll with the following result: Ayes; Aldermen Ahbe, Carroll, Pflug - haunt, TnIle, Bishon, MacLuckie, Frederick, Lemke, Schwanbeck and. Campagna. Nays; None. The Mayor thereupon declared the ordinance finally nassed and adonted. TRAFFIC CODE: The Clerk then read the following proposed ordinance for first reading,: AN ORDINANCE REGULATING TRAFFIC ON STREETS AND ALLEYS IN THE CITY OF DES PLAINS, COOK COUNTY, ILLINOIS'', } AND PROVIDING PENALTIES FOR THE VIOLA- TION THEREOF. The motion was made by Alderman Frederick and seconded by Lemke that this proposed ordinance be referred to the Police and License Committee for study and report. The motion was voted upon by acclamation, whereupon the Mayor declared the motion carried. RE -ZONING AT DES PLAINES AVE. AND KEENEY AVENUE: The Clerk then read the following letter: October 21 1935 To the Honorable Council of the City of Des Plaines,I11. In re Zoning the Four Corners located at the Intersection of Des Plaines Ave. and Keeney Ave., in the City of Des Plaines. Gentlemen: Your Petitioner, 1:rs. Anna S.Seng, respect- fully shows that she presented a petition to this Hon- orable Body to zone the four corners located at the intersection of Des Plaines Ave. and .-Leeney Ave., in the City of Des Plaines, for Business; that the said petition was referred by this body to the zoning board, and a public hearing was had, due advertising of such hearing being given according to law; that the petitioner was present at said hearing and heard for the first time that a petition had been filed with the zoning board objecting to the petition heretofore filed by your petitioner. That the zoning board and your petitioner had no time to look over and study said petition; that a Mr. Kenneth ideyer, the attorney for the City, and r. 655 Stewart, an EX -Mayor, apoeared and argued against the Said petition; `'that your petitioner Was present -and re- presented by counsel, and without having time to study said petition, presented their arguements for the zoning of said corner for business; that your petitioner's request was refused and -the zoning board recommended that your peti- tioner's petition be refused. Your Petitioner desires at this time that the City Council of Des Plaines over rule the zoning board and Zone the above mentioned corner for business, or the alter- native, re-refer the matter to the zoning board with the re- commendation that -the zoning board re -consider said petition and reports its finding to the City Council at the earliest possible moment. Your petitioner shows- to this body that said objecting oetition should not receive any serious wtight or consideration for the following reasons: 1.Said petition was signed by one Herbert Maske who stated he resided nt 1710 Keeney ;"oven., and owned 2144 ft.of ground, which the granting of your petitioner's request Isould ha.rrc. Whereas it is common knowledge that the said Herbert Maske does not own 2144 ft. adjacent to or that could be injured by the granting of your }petitioner's request. 2. Said Petition was signed by one Vincent Sladek, who stated he resided at 1623 Keeney Ave., and owned 120 ft. But 1r. Vincent Sladek failed to shoe that he operated a business at that address with signs on said premises advertising his bus iness. 3. Said petition was signed by one Pearl S.Holman, who stated she resides at 1173 Des Plaines Ave., and owns 50 ft. but fsiled to state that she operates a business at said address and carries an ad. in the local paper advertising said business. 4. Said petition vas signed by one Grace Meyers, who stated she resided at 1059 Des Plaines Ave., adn is the owner of 100 ft., but Failed to state, show or point outvhy she should object to the proposed zoning of the corner in question when she lives approximately three blocks away and almost directly across the street from residence it is zoned for business and a business is actually conducted on those ()remises. 5.Kenneth Meyers, the- attorney for the'City, and his wifeY Ruth; signed:Said petition, and state that they- own 160 ft. but failed to state or shot Why -they should object to request asked for by your petitioner -While they reside approx- imately three blocks a'ay, and directly across the street from this property it is zoned for butiiness and a business actually is operating there, while a scant few feet to the north of r. Meyers the City of Des Plaines operates its water and pumping station. Your petitioner is led to suspect that the zoning board was influenced by the fact that Mr. - Meyers is the attorney for the City of Des Plaines, although your petition- er cannot understand the logic of Mr.lieyers' stand, who objects to business three blocks away and tolerates it across the street. "Consistency thou art a jewel." 6.Said petition was signed by Wesley J.Lessing, 'who stated he resided et 1647 Campbell and• owned 40 feet, but failed to show, why Nary Lessingalso living at 1647 Campbell Ave., should sign the petition and state that she owns 50 ft; that Siad proposed zaing of the intersection of Des Plaines AVe. and Keeney A7-6.9- is not on the street said signers re- side, and they have no valid reason to object. 7. Said petition was signed by W.B.Galdsviorthy, Who stated he resided at 1726 Van Buren, and owned 60 feet, but 656 failed to show why Mrs. W.C.Gadlsworthv signed said Petition and stated she lived et 1726 Van Buren St. and owned 60 feet; that neither she nor he are on either of the streets that would be affected by said proposed re -zoning., and they have no valid reason to object. 8. That said petition was signed by Mrs.E.A.Gram,1277 Des Plaines Ave. 54 ft. Anna Schwreisaw, 220 Des Plaines Ave. Samuel G.Beiner,1255 Des Plaines Ave Minnie K.Beiner,1255 Des Plaines Ave. All of whom your petitioner shows signed her petition and apparently are good neighbors and want to be friendly with all, and therefore their names should be stricken from said petition and no serious consid- eration attached to their signatures. O.That said petition was signed by A.H.Lenz, 1732 Van Buren, 78 ft. Fr -ed A.Lessing 1675 Campbell Ave. 75 ft: Chester G.Tash,1650 Cambell Ave. 150 ft. That -none of these objectors live on the streets co#- ternpi ted in the proposed re -zoning matter. 1C.That said Robert Meushausen signed said petition and is in business within a Teti: blocks of this corner. 11. That Mrs. Anna L.Seng has conducted a business on her property for the past eight years. 12. That Des Plaines is now a business street; that in approximately every block there is a place of business. 13. That Keeney Ave. near the intersection of Des Plaines Ave. has several business places. 14. That Des Plaines Ave. is a natural high,_ay is not residential, and at present has everything on it from coal yards to millinery shops excepting trains and street cars. 15. That the State of Illinois made it a business street; that the State granted a permit to run bussess on said street. 16. That Mr. Steward, one of the objectors, said he realized that Des Plaines Ave., would some day be business, and t that time he would be in favor of re- zoning, but he did not believe the time was ripe 11EREFORJ your Petitioner begs that her grayer in the first part of said petition be granted. PARKING ON STATE BOND ISSUE ROUTES: Alderman Frederick then read the following proposed resolution: RESOLUTION YIHEREAS it is provided in the Illinois Traffic Code that rhotor vehicles parking NAthin the limits of a municipality, on a street, forming a part of the State Highray system, shall -park parallel to and adjacent to the riEht hand curb and WHEREAS parallel parking on such streets within the City of Des Plaines is detrimental to the interests of the business men of this City and WHEREAS the citizens of this City have paid -for the original pavenent on streets in this city now comprising certain State Highway, and the full use of said streets is nor being materially diminished, THEREFORE BE IT RESOLVED by the City Council of the City of Des Plaines that it is opposed to the provisions of the Illinois Traffic Code relative to parallel parking. BE IT -FURTHER RESOLVED that this City Council is of the opinion that the best interests of its citizens will be served if diagonal parking is permitted on streets in this City forming a part of a State Highway system, BE IT FURTHER RESOLVED that the City Council does hereby request that the Illinois Traffic Code be amended in accordance with the 'vi ews expressed herein. BE IT FURTHER RESOLVED THAT the City Clerk send a copy of this resolution to the proper State Senators and Representatives. RESERVOIR AND SOFTENER PROTECT.i�.Allen, City Engineer, then read the following proposed reso- lution: ARES ©LUT ION WHEREAS the City Council of this City has pre- viously applied to the Federal Administrator of Public 5 'orks for a loan and grant in connection with the construction of a Water Reservoir and Softening Plant, and WE_REAS said app licat©n included an amount to cover "legal and engineering fees to be paid from said loan and grant and WHEREAS the rules and regulations of the Public Works Admirntra:tor requires thay have in their files a contract between the City and the City Engineer and City Attorney, authorizing said fees to be paid from said loan and grant, THEREFORE BE IT RESOLVED that the City Council authorize the Mayor and City Clerk to execute a contract with the City engineer and City Attorney to pay themfor their services in said project the amount set forth in the application for loan and grant, out of moneys received from said loan and grant.
