CALL TO ORDER: The meeting was called to
order by Mayor George W.Kinder, presiding, with Aldermen
Carroll, Pflughaupt, Fulle, Bishop, MacLuckie, Frederick-,
Lemke, Schwanbeck and Campagna responding to the roll call.
Alderman Ahbe was absent during this roll call but arrived
shortly thereafter.
REPORTS OF OFFICERS: The Clerk then handed
to each member of the Council a copy of the report for
September of Otto W.J.Henrich, City Treasurer.

THE JUDICIARY AND ASSESSMENT COMMITTEE had no
report to offer.
THE POLICE AND LICENSE COMMITTEE: through its
chairman Alderman Carroll submitted the following report:
To chairman Carroll, Police and License Committee, at:
the meeting of the City Council held October 2,1935
the following matter was referred to your committee:
The matter of providing means of apprehending such
dogs as may be at large.

The Police and License committee has investigated
the above and has found that the conditions in Des Plaines
regarding loose and stray dogs, and the recent breaking
out of the "rabies" is very serious, requiring immediate
and possitive action.
'e -therefore recommend that we employ Mr. Fred
Hewn as Dog Catcher for the city of Des Plaines. The
fee to "be $1.50 per dog,' and also that Mr. Fred Wettin
be appointed Master of the pound. We further recommend
payment of :1..50 per dar7 fee be paid from the contingent
fund.

The motion was made by Alderman Frederick and seconded by Lemke
to concur in this report. The Mayor put the question and the
Clerk called the roll with the following result$ Ayes; Alderman

THE STREETS A.ND SIDEWALKS COMIITT +' +' : The Clerk
read the following report:

Hon.Mayor and. City Council
Gentlemen:.
In order to get immediate action on an
ordinance relative to bicycles I am herewith sub-
mitting the following resolution for consideration
by your honorable body.
Referring you to page 169 Sec.1074 to 1076
in our ordinance book be it resolved that our City
Attorney be instructed to draft and include the
following paragraphs.
1.All bicycles owned by residents or agencies of
this municipality be compelled to register same
at our Police Headquarters quoting some particular
mark by which it could be identified if stolen, the
registration fee to be ten cents for each bicycle.
2.All bicycles be equipped with a light attached
to the front and a reflector on the rear.
3.It shall be unlawful for any person to ride a
bicycle on any sidewalk in the business or resi-
dential section of this Municipality.
• Would also suggest that the Police be
instructed to enforce Sec.1074 of which I quote
part of paragraph as follows;
It shall be unlawful for more than one person to
ride upon any bicycle propelled by human power on
any street.
As to penalties for these offences would
suggest disaussion on the floor in order to deter-
mine definite action at once.

The Motion was made by Alderman Carroll and seconded by Lemke to
refer this report to the City Attorney with instructions to
prepareaniAmedding Ordinance embodying the provisions suggested
in this letter. The motion was voted upon by acclamation,
whereupon the Mayor declared the motion carried.
The motion was made by Alderman Frederick and seconded
by MacLuckie to instruct the City Attorney to prepare an ordi—
nance amending the ordinances of the City so as to permit theatres
to set the customary portable sign boards upon public sidewalks
in front of the theatre entrance. The Mayor put the question and
the Clerk called the roll with the following result: Ayes; Alder-
men Pflughaupt, Fulle, MacLuckie, Frederick, Lemke, Schwanbeck,
and Campagna. Nays; Aldermen Ahbe, Carroll, and Bishop. Mayor
Kinder thereupon declared the motion carried.
The Clerk then read the following report:
To City Clerk jointly with Streets Committee at the
meeting of the City Council, held September 16,1935 the
following matter was referred to your committee:
The matter of contacting the State Highway
Dept. asking that the department provide a guard
rail on Des Plaines Ave. at Weller Creek flume.

1 wish to report that I have notified Mr. Claproth
of the State Highway Department requesting that a guard
rail be provided on Des Plaines Avenue at Weller Creek.
Claproth promised to so instruct the district repair
and maintenance crew.

sidewalk near the corner of Walter and Second Avenues.

THE COMMITTEE ON PUBLIC WORKS, BUILDINGS AND PLATS:
had no report to offer. The motion was however made by Alderman
MacLuckie, chairman of the Committee, that the committee be
authorized to proceed to further negotiate to lease -the lot
east of the -present City Hall and to report its vrogress to
the Council. The motion "was voted upon by acclamation, whereupon
theI.ayor declared the motion carried.
THE SEWER DRAINAGE AND SANITATION COMMITTEE submitted
the following report which was read by the Clerk:
To chairman Lemke, Sewer Drainage and Sanitation Committee,
at the meeting of the City Council, held Sept. 30,1935,
the following matter was referred to your committee:
The letter from W.H.Allen, City Engineer, dated
Sept. 30,1935 asking the Council whether or not to
proceed to prepare a W.P.A.project application
for the construction of storm sewers. Copy of the
letter is attached hereto.

We, your committee have investigated the above and have
found: That we are anxious and glad to take advantage
of any governmental grant that will improve our City and
create employment for the unemployed of the town. How-
ever, we do know that all these projects take expense to
be born to the City. Our inquiry into the funds has
failed to reveal where we can obtain any money for the
cost of a survey or estimate on this work.
We therefore recommend that for the present the Council
as a whole take the matter under discussion.

The motion was made by Alderman Lemke and seconded by Carroll

acclamation, whereupon the Mayor declared the motion

The motion was then made by Alderman Ahbe and
seconded by Lemke to authorize and instruct W.K.Allen,
City Engineer, to prepare on a contingent basis the
necessary plans,estimates and application forms for a
W.P.A. project :for the construction of storm sewers,
and to file said application with the W.P.A. Mayor
Kinder put the question and the Clerk called the roll
with the following result: Ayes; Aldermen Ahbe, Carroll,
Pflughaupt, Fulle, Bishop, MacLuckiel Frederick, Lemke,
Schwanbeck and Campagna. Nays; None. The Mayor there-
upon declared the motion carried.
THE WATER COMMITTEE through its chairman Alder-
man Bishop reported that the City has its final bill for
Water fremliiM.Cater, the final reading having been taken
at midnight on the night of September 17,1935.

Gentlemen:
• The matter of the water main to be laid
on Lee Street having been referred to me, I
beg to report as follows:
The cost of the improvement is
$36,280.00 and the Works Progress Administration
of the United States has accepted my application
for 031,324.00 for labor and material, so that
the net cost to the property is '4,956.00.
I have prepared the Resolution and Estimate
to be submitted to the Board of Local Improvements
for this amount, plus the required six percent,
making a total of 05,250.00.
,There is 6,670 feet of assessable frontage
in this improvement, so that the cost will be less
than 0.80 per front foot.
I recommend that the Resolution be referred
to the Board of Local Improvements.

The motion was Made by AlderMan Bishop and seconded by
Frederick to concur in this report and refer the said re-
port to the Board of Local Improvements-. The motion was
voted -upon by acclamation, whereupon the Mayor declared
the motion carried.
The motion was made by Alderman Bishop and
seconded by Pflughaupt to instruct the City Attorney,
Kenneth G.Meyer to prepare an ordinance WhiCh will enable
the City to place liens against such properties as have
large past dUe water bills. The motion was voted upon
by acclamation whereupon the Mayor declared the motion
carried.

THE FIRE COT JIITT...r; through its chairman, Alder -
Campagna reminded the Council of National Fire Pre-
vention Week, October 6th to October l2th inclusive. The
motion was made by Alderman Campagna and seconded by
Fulle that the Mayor issue a proclamation declaring the
week of October 6th to October l2th as Des Plaines Fire
Prevention Week. The motion w as voted upon by acclamation,
whereupon the Mayor declared the motion carried.
POLICE COMMITTEE vs POLICE COMMISSION: Alderman
Carroll then read the following proposed resolution:
A RESOLUTION
Since the ordinances of the City of Des
Plaines and the statutes of the State of Illinois,
invest the City Council with the power to create
the offices of Policemen and Firemen and definitely
to prescribe the duties of such office and further-
more, since the creation of an office of policeman
or fireman by an ordinance, is a condition precedent
to the making of an appointment to fill it, it
necessarily follows, that the Board of Fire and Police
Commissioners have no power whatever to appoint
anyone to such office unless the office has been
created by the City Council.
Therefore, be it resolved, that all legis-
lative powers affecting the fire and police depart-
ments of the City of Des Plaines, in creating the
office of police—an or fireman, and in prescribing
the duties and regulations of such office, shhll be
exercised by the Fire and Police committees of the
City Council respectively.
Be it further resolved, that a copy of
this resolution be sent immediately to the Secretary
of the Board of Fire and Police Commissioners of
the City of Des Plaines.

The motion was made by Alderman Carroll and seconded by Lemke
to adopt this proposed resolution. A motion was however
made by Alderman Bishop and seconded by Fulle to table this
proposed resolution until the next regular meeting of the
Council. Mayor Kinder put the question and the Clerk
called the roll with the following result: Ayes; Pflughaupt,
Fulle, Bishop and Frederick. Nays; Aldermen Ahbe, Carroll,
MacLuckie, Lemke, Schwanbeck and Campagna. The Mayor
thereupon declared the motion "to table" defeated.
The motion was then made by Alderman Bishop and
seconded by Fulle to refer this proposed resolution to the
Police and License Committee for study and recommendation.
The Mayor put the question and the Clerk called the roll
with the following result: Ayes; Aldermen Pflughaupt, Fulle,
Bishop and Frederick. Nays; Aldermen Ahbe, Carroll, MacLuckie,
Lemke, Schwanbeck and Campagna. The Mayor thereupon declared
the motion to "refer to committee" defeated.
Mayor Kinder then put the question on the main
motion "to adopt", and the Clerk called the roll with the
following result: Ayes; Aldermen Ahbe, Carroll, MacLuckie,
Lemke, Schwanbeck and Campagna. Nays; }aldermen Pflughaupt,
Fulle, Bishop and Frederick. Mayor thereupon declared the
motion "to adopt" carried and the resoleition adopted.
COUNTERSIGNING CHECKS: Recent State legislation
requires that all documents of payment made by the City
Treasurer be countersigned by some officer designated
by the Council. The City Attorney therefore submitted
the following proposed ordinance which was read by the
Clerk for first reading:

BE IT ORDAINED by the City Council of the City
of Des Plaines, Cook County, Illinois:
Section 1. That no funds, moneys or other
things of value in the hands of the City Treasurer
of Des Plaines, Illinois, shall be paid out, dis-
bursed or delivered except by warrant, draft, check
voucher or order.
Section 2. That each and every warrant, draft,
check,voucher or order shall ble,Sgped by the Treas-
urer and countersigned by the /(_,...ut,„.11 of
this City.
Section 3. That the City. Treasurer is hereby auth-
orized to sign and the is hereby
authoriaed to countersign dach and every warrant,
draft, check, voucher and order of this City.
Section 4. Any warrant, draft, check, voucher
or order issued subsequent to the passage and
approval of this ordinance, not signed and counter-
signed as herein provided, shall be null and void
and of no force and effect.
Section 5. All ordinances or parts &f ordinances
in conflict herewith are hereby repealed.
Section 6. This Ordinance shall be in full force
and-effebt from and after its passage and approval
according'to law.

erick to amend this proposed ordinance by inserting the
words "City Clerk" into the spaces left blank for the
purpose of inserting the title of the officer to be desig-
nated to counter -sign said papers. The Mayor put the
Question on the motion "to amend" and the Clerk called
the roll with the following result: Ayes; Aldermen Ahbe,
Carroll, Pflughaupt, Fulle, Bishop, MacLuckie, Frederick,
Lemke, Schwanbeck and Campagna. Nays; None. The Mayor
thereupon declared the motion carried and the proposed
ordinance so amended.

The motion was then made by Alderman Ahbe and
seconded by Frederick to suspend such rules of the Council
as might prevent the passage of this proposed ordinance
at this meeting, for the purpose of finally passing the
said ordinance as amended. The Mayor put the question and

Aldermen Ahbe, Carroll, Pflughaupt, Fulle, Bishop, Lac-

The motion was then made by Alderman Fulle and
seconded by Pflughaupt to finally pass and adopt this
proposed ordinance as amended. The Mayor put the question

ASH DISPOSAL: The Clerk then read the following
proposed resolution:
A RESOLUTION FIXING THE REGULATION
FOR THE HAULING AND DISPOSING OF
ASHES, AND FIXING THE FEES THEREFOR.
BE IT RESOLVED by the City Council of the City of
Des Plaines,Illinois, that:
Any person, firm or corporation desiring the City
of Des Plaines to dispose of its, his, her or their
ashes shall place said ashes in suitable containers
as hereinafter provided:
That ashes to be disposed from single residences
or two-aprtment buildings, shall be placed in containers
placed in the street in front of such residence or
apartment building;
That ashes to be disposed of from commercial"
and industrial establishments, churches, schools and
buildings containing three (3) or more a_prtments
shall be placed in containers in the alley in the rear
of such places;
That the Supterintendent of Public Works be and
is authorized to make such changes relative to the
foregoing provision affecting commercial and industrial
establishments, churches, schools three -apartment
buildings as will expedite the disposal of said ashes.
BE IT FURTHER RESOLVED that the pickup for ashes
shall be on the same schedule as is now in effect for
the pick-up of tin cans, and tin cans and ashes may be
placed in the same container.

of- for those persons, firms or corporations who pay in
advance the fees herein provided for.
BE IT FURTHER RESOLVED that the fees for ash dis-
posal shall be as follows:

For commercial and industrial establish-

BE IT RESOLVED By the Mayor and City Council of the
City of Des Plaines, Cook County, Illinois, that the
plat showing dedication of the proposed State Bond Issue
Route 58 as submitted by the County Superintendent of
Highways to the Mayor and City Council of the City of
Des Plaines, be and the same is hereby in all respects
approved, and

ROUTE #58 MOTOR FUEL TAX: The Clerk then read
the following proposed resolution:
RESOLUTION FOR IMPROVEMITTBY MUNICIPALITY
UNDER THE MOTOR FUEL TAX LAW
BE IT RESOLVED by the Mayor and City Council of the
City of Des Plaines,Illinois that the following
described improvement be constructed under the Motor
Fuel Tax Lau:
GOLF ROAD ,which is also known as Extension to S.B.I. Rt.#58
from C & N W Railway Co. R.O.W. vest to Seeger
a distance of 490 feet, more or less; as shown on the
attached municipal map.
BE IT FURTHER RESOLVED:(1)That the proposed improve-
ment shall be by condemnation xx proceedings in order
to acquire the right of way for S.B.I.#58; and that a
sum be appropriated from this city's allotment of
Motor Fuel Tax to cover value of land taken, damage to
property not taken, court costs, legal fees, and
witness fees. (2)That there is hereby appro-
priated the sum of Six thousand five hundred dollars
(;6,500.00) for the improvement of said section from
the municipality's allotment of Motor Fuel Tax funds.
AND BE IT FURTHER RESOLVED, that the City Clerk is
hereby directed to transmit two certified copies of
this resolution to the Department of Public Works and
buildings, Division of Highways, Springfield, Illinois,
through its District Engineer.

Dear Sir:
Section 91, of the new Uniform Traffic Act
passed by the last session of the General Assembly,
provides that all vehicles shall be parked parallel
to the curb on State Highways.
I have just received an opinion from the
Attorney General's office to the effect that munici-
palities are jointly liable with the driver of a
vehicle involved in an accident while backing out
of a marked diagonal parking lane in instances where
such diagonal parking lanes had been painted on the
pavement by the municipality in violation of Section
91 of the Traffic Act.
If diagonal parking is now permitted on anY
State Highway in your community, the department would
appreciate an immediate consideration of this matter and
compliance with the provisions of Section 91 of the
Uniform Traffic Act.

2% Foreign Insurance is $1648.55. The bond premium
paid by us was ;6.25.

LEDGSR CONTROLS FOR CITY 01110ES: Alderman Pflughaupt
chairman of the Finance Committee reported that the audit of
the corporate accounts of the City recently made by Allen R.Smart
and "Company contains a recommendation that more adequate control
accounts be set up. He further reported that Alien R.Srnart and
Company estimatese cost of such controls to be about ►300.00.
The motion was made by Alderman Pflughaupt and seconded by
Frederick to refer this matter to the Finance Committee for study_
and recommendation. The motion was voted upon by acclimation,
whereupon the Mayor decla:ted the motion carried.
PRESENTATION OF AUDIT: Alderman Pflughaupt,
chairman of the Finance Committee then presented a copy
of the audit of the City's corporate funds for the two-
year period beginning May 1,1933 and ending April 30,135
as made by Allen R.Smart & Co.
The motion was made by Alderman MacLuckie and
seconded by Ahbe to ask the Clerk to read approximately the
first ten pages of the said audit report. The motion was
voted upon by acclamation, whereupon the Mayor declared the
motion lost. Alderman Ahbe objected to the Mayors decision
however, whereupon the Clerk called the roll with the follow-
ing result: Ayes; Alderman Ahbe, Carroll, MacLuckie, Freder-
ick, Lemke, Schwanbeck and Campagna. Nays; Alderman Pflug-
haupt, Fulle and Bishop. The Mayor thereupon declared the
motion carried.
The Clerk then proceeded to read the said audit
report.
APPROVING BILIS: Alderman Pflughaupt, chairman
of the Finance Committee then read the following proposed
resolution, of which each member of the Council had been
supplied with a copy:
RESOLVED THAT THE FOLLOWING BILLS ARE DUE
AND PAYABLE AND THAT THE MAYOR AND CITY CLERK
BE INSTRUCTED TO ISSUE PROPER VOUCHER -WARRANTS
IN PAYMENT OF SANE. SAID WARRANTS TO BE
RELEASED UPON ORDER OF THE FINANCE COMMITTEE
WHEN FUNDS ARE AVAILABLE.

The motion was made by Alderman Pflughaupt and seconded by
Fulle to ado,�tt this proposed resolution. The Mayor put the
question and the Clerk called the roll with the following
result: Ayes; Aldermen Ahbe, Carroll, Pflughaupt, Fulle,
Bishop, MacLuckie, Frederick, Lemke, Schwanbeck, and Campagna.
Nays; None. The mayor thereupon declared the motion carried
and the resolution adopted.
