MINUTES OF THE REGULAR MEETING OF THE CITY
COUNCIL OF THE CITY OF DES PLAINES RELD IN
THE COUNCIL CHAFERS ON THE l6th DAY OF
SEPTEFER,A.D.1935 AT THE HOUR OF 8:OO P.M.
CALL TO ORDER: Mayor George Wjiinder was absent.
The meeting was therefore called to order by Edgar J.Friedrich,
City Clerk, who also called the roll. Aldermen Ahbe,.Carroll,
£flughaupt, Fulle, Bishop, MacLuckie, Frederick,_Lerake, Schwan-
beck and Campagna responded to the roll call. The Clerk there-
upon declared all aldermen present.
DESIGNATING MAYOR PRO tern: The motion was made by
Alderman Lemke and seconded by Frederick that Alderman Ahbe be
designated to preside as Mayor pro tem, because of the absence
of George li.lander, Mayor. The Clerk put the question to a
vote by acclamation, whereupon the Clerk declared the motion
carried. Alderman Ahbe thereupon took the chair and presided
during the remainder of the meeting.
THE JUDICIARY AND ASSESSMENT COMMITTEE had no report
to offer.
THE POLICE AND LICENSE COMMITTEE offered no report.
THE. STREETS AND SIDEWALKS COMMITTEE had no report to
offer..
THE COMMITTEE ON PUBLIC ;wOB1 ,. BUILDINGS AND PLATS
reported through its chairman, Alderman MacLuckie, that the
matter of leasing the lot east of the City Hall is being held
in committee pending the outcome of the proposed new City Hall
project.
He also stated that nothing further has been done
regarding the application for a building permit filed by Mr.
R.J.Guse.
THE SEWER DRAINAGE AND SANITATION COMMITTEE had no
report to offer.
THE WATER COMMITTEE through its chairman, Alderman
Bishop, submitted the following proposed resolution:
RESOLUTION
WHEREAS the 'City of Des Plaines is about to complete
final negotiations for the purchase of the so-called Cater
Well, and
WHEREAS the City Council has been advised by the
City Attorney that when settlement is made with William II..
Cater for water rental due him, a release of all claims
and demands will be made to the City by William H.Cater, and
the said William H.Cater will demand a release from the City.
THEREFORE BE IT RESOLVED by the City Council of the
City of Des Plaines, Cook County, Illinois, that the Mayor
and City Clerk be and are hereby authorized to execute an
behalf of the City of Des Plaines, a release of all claims
and demands against William H.Cater as of the date final
settlement is made with William H.Cater of all rentals due
The motion was made by Alderman Bishop and seconded by Lemke
to adopt this proposed resolution as read. The motion was
voted upon by Acclamation, whereupon the Mayor pro tem declared
the motion unanimously carried and the resolution unanimously
adopted.

City Attorney, Kenneth G.Meyer, then reported that
all documents necessary for the consumation of the purchase
of the Cater Well were deposited in escrow with the Chicago
Title and Trust Company on Friday, September 13,1935, and
that he expects all matters to be finally settled tomorrow,
Tuesday, September 17,1935 so that the City will get title
to the Cater Well at once.
THE FII] COMMITTEEt The motion was made by Alder-
man Campagna, chairman of the Fire Committee, and seconded
by Frederick to refer the matter of installing a 10a water main
in Lee Street, from Miner Street to Algonquin. Road,_to the
Water Committee and the City Engineer for study and report. The
motion was voted upon by acclamation, whereupon the Mayor pro, -
tem declared the motion carried.
THE FINANCE COMMITTEE; through its chairman, Alder-
man Pflughaupt ;, presented the following -proposed resolution:
RESOLVED THAT THE FOLLOWING BILLS ARE DUE AND
PAYABLE AND THAT THE MAYOR AND CITY CLERK BE.
INSTRUCTED TO ISSUE PROPER VOUCHER -WARRANTS IN

The motion was made by Alderman Pflughaupt and seconded by Mac-
Luckie to pass and adopt this proposed resolution. The Mayor
pro tem put the question and the Clerk called the roll with
the following result: Ayes; Aldermen Ahbe, Carroll, Pflughaupt,
Pulle,, Bishop, MacLuckie, Frederick, Lemke, Schwanbeck and Campagna.
Nays; None. The Mayor pro tem thereupon declared the motion carried
and the resolution adopted.
BUILDING INSPECTOR: Kenneth G.Meyer, City Attorney,
then read the following proposed ordinance for first reading:
AN ORDINANCE AMENDING ARTICLE
1X of Chapter 3 of the Munici-
pal Code of 1928 entitled "Build-
ing Inspector".
The Mayor pro tern ordered this proposed ordinance filed
second reading.

SANITARY DISTRICT INTERCEPTOR SEWER: The Clerk then
read the following letter:

Gentlemen:
I have studied the proposed ordinance for the
construction of an intercepting sewer on River Road, as
submitted by the sanitary District of Chicago and offer
the following report and comment: the ordinance gives the
Sanitary District the right to construct an intercepting
sewer, the District bearing the entire cost and provides
for the construction of the interceptor from Thacker Street
south, thereby intercepting and keeping out of the river
practically all of the sewage from Des Plaines. However,
this interceptor does not extend north of Thacker Street
and therefore can not pick up the sewage now concentrated
at Rand and River Roads, which the City is now pumping
through a force main into the north side sewers.
The Sanitary District is building this sewer
with Federal funds, and I am informed that the money
alloted for this purpose will not construct the intercep-
tor any further north than Thacker Street, and in order
to secure its construction up to Rand Road or further,
it will be necessary for the Sanitary District to make
an appropriation of it s own funds for the purpose.
I suggest that the sewer committee take this matter up

with the Trustees of the District and endeavor to secure such
an extension, underaa separate contract.
In conference with Mr. Pearse, I went over one or two
"of the objectionable clauses in the ordinance and,
`with his consent, re -Wrote 2 pages in order to make the
ordinance acceptable. One of these clauses was the provision
that the City furnish f ree of cost to the District all water
needed for construction of said work. This has been modi-
fied to read, "not to exceed a total amount of 100,000 gall-
ons".
Another objectionalbe paragraph was that the City
agreed that any new sewage. systems will be of a separate type.
This has been modified to read, "that the City agrees when
"constructing any new sewerage systems which are connected
to new outlets in the Des Plaines -River or its tributaries
will be of a separate type," which clause does not prevent
extensions of existing combined sewers.
The agreement on the part of the, City to make such
alterations in the location of water mains, as many be
necessary, does, I find, entail very little or no expense
on the part of the City, primarily because the sewer to be
constructed is from 23 to 30 feet below the street level
and the only adjustment of water mains that could be nec-
essary would be due to the construction of a man hole
which might come directly through the water main, and in
most of these cases can be adjusted on the ground.
I believe, from an examination .of the plan, which
Mr.. Pearse furnished me, that there will be no alterations
necessary. i am attaching this set of plans to the ordi-.
nance and recommend that it be kept attached to the ordi-
nance in the City files.
With the amendments as mentioned herein, i recommend
prompt passage of the ordinance, in order not to dalay the
construction of this interceptor. •

NEW MUNICIPAL BUILDING: The Clerk then read the
following letter:

Gentlemen:
Confirming my statement to your honor-
able body regarding the construction of a new
City Hall, I have prepared the necessary estimates,
together with application to the Public Works
Administration for a grant to enable us to build,
and your Attorney, Kr. Meyer, has filed this appli-
cation with the Federal Government.
I have made arrangements for achitectural
services and these are as follows: payment for
these services is entirely contingent on the sec-
uring of a Federal Grant and the sale of the City.
property for not less than $b0,000.00. if either
one, or both of these operations fail and it there-
fore becomes impossible to construct a City Hall,
there will be no charge on my part or on the part
of any of my associates against the City.
If we are able to bring these operations
to a conclusion, thereby securing the money with
which to build a City Hall, the total charges
for architectural and structural engineering
services will be six percent of the contract price.

Kenneth G.Meyer, City Attorney, suplemented this letter with
the statement that he has examined the title of the present
City Hall site and has found no restriction in the said
title which would prevent the.. sale of the said site. He
stated'however, that the title does contain a restriction
Which prevents the said site to be used for the purpose of
selling alcoholic liquors.
WIDENING AND REPAVING OF LEE STREET: The Clerk
read the following letter:

Dear Sir:
I am returning herewith, the plans for the
proposed improvement on Lee Stfteet in the City of
Des Plaines, from Rand and River Roads to the Soo
Line Railroad, as submitted by the State Highway
Department.
I note, and desire to call to your attention
the street widths, face to face of curbs, which is;
north of the alley, first north Miner Street, the
width will be 40 feet. From this point to Prairie
Avenue, the roadway will be 48 feet, which is two
feet wider than the present pavement. From Prairie
Avenue to the Soo Line Tracks, the width will be 42 feet.
It is my understanding that the grades of
sidewalks will not be affected by this improvement.
Ito action on the part of the Council is nec-

read the following proposed ordinance in its entirety for

The motion was made by Alderman Fulle and seconded by Pflug-
haupt to suspend such rules of the Council as might prevent
the final passage of this proposed ordinance at this meet-
ing for the purpose of finally passing and adopting this
ordinance at this meeting. The Mayor pro tem put the question
on the suspension of the rules, and the Clerk called the roll
with the following result: Ayes; Aldermen Ahbe, Carroll,
Pflughaupt, F ulle, Bishop, MacLuckie, Frederick, Lemke, Schwan
beck and Campagna. Nays; None. The Mayor pro tem thereupon
declared the motion carried and the said rules suspended.
The motion was then made by Alderman Pflughaupt
and seconded by Frederick to finally pass and adopt this pro-
posed ordinance as read. The Mayor pro tem put the question
on the final passage of the said proposed ordinance, and the

3[r.WIlliam H.Cater is selling you his
water supply system. This deal did not include
the steam boiler and hoist which was not part of
the plant or equipment.
It will be necessary for Yr. Cater to
take this away with him, but before doing so he
requests us to offer to sell it to the City at
a price of $490.00.
As it is necessary to move this hoist
immediately,: if you do not care to purchase it,
we request that you take the matter up at the
meeting to -night and advise us promptly.

LIGHTS ON BICYCLES: The Clerk then read the
following letters

Gentlemen:
I am of the opinion that something should
be done relative to the safety of those who operate
automobiles and bicycles upon the streets of the City
of Des Plaines. It is very hazardous for the cyclist
to ride upon streets after dark without having lights
attached to front and rear of bicycle, as well as
hazardous to motorists.
I recommend the passage of an ordinance re-
quiring that the owner of a, bicycle equip his vehicle
with both a front and rear light and that these lights
be used when upon the streets after :nightfall.
This is recommended purely as a safety measure
for the protection of cyclists and motorists.

nance of said City, which real estate is described

The notion was made by Alderman MacLuckie and seconded by
Schwanbeck to refer this petition to the Zoning Board of
Appeals. The motion was voted upon by acclamation, whereupon
the layor pro tern declared the motion carried.
AUDITING SPECIAL ASSESSMENTS: Alderman Pflug-
haupt, chairman of the Finance Committee then reported that
it has been found necessary to determine the Special Assess-
ment diversions in order to establish the city's liability
as the result of such ddversions. The motion was made by
Alderman Pflughaupt and seconded by Frederick that the firm
of Allen R.Smart & Co. be engaged to make an audit of the
Special Assessment Accounts. The Mayor pro tem put the
question and the Clerk called the roll with the following
result: Ayes; Aldermen Ahbe, Carroll, Pflughaupt, Pullet
Bishop, MacLuckie, Frederick, Lemke, Schwanbeck and Campagna.
Nays; None. The Mayor/thereupon declared the motion carried.

GENERAL AUDIT REPORT: The motion was made by
Alderman MacLuckie and seconded by Carroll to submit, the
report of the general audit recently completed by Allen
R.Smart & Company at the next Council meeting. The motion
was voted upon by acclamation, whereupon the Mayor pro
tem declared the motion carried.
GUARD-RAIL ON DES PLAINES AVENUE: The motion
was made by Alderman Carroll and seconded by MacLuckie to
refer to the Streets and Sidewalks Committee the_matter of
providing a suitable guard-rail on Des Plaines Avenue at
Weller Creek. The motion vas voted upon by acclamation
whereupon the Mayor pro tem declared the motion carried.
The motion was Bien made by Alderman Frederick,
chairman of the Streets add Sidewalks Committee to instruct
the City Clerk to request the State Highway Department to
provide this gmard-rail. The motion_ was voted upon by
acclamation, whereupon the Mayor pro tem declared the motion
carried.
FEPAIR OF SIDEWALK: The motion was made by
Alderman Lemke and seconded by MacLuckie to refer to the
Streets and Sidewalks Committee the matter of repairing
two squares of concrete sidewalk which have raised up
about six inches, near the corner of Walter Avenue and
Second Avenue. The motion was voted/pon by acclamation,
whereupon the Mayor pro tem declared the motion carried.
APPROVAL OF MINUTES: The motion was rude by
Alderman Pflughaupt and seconded by Fulle to approve the
minutes of the regular Council meeting held septerzfoer 5,
1935 as written. The motion was voted upon by acclamation
whereupon the Mayor pro tem declared the Motion carried
and the said minutes approved as written.
APPOINTLOENT OF DELEGATES: The Mayor pro tem
then read the following:
I hereby appoint the following to represent
the City of Des Plaines at the annual
convention of the Illinois Municipal League
to be held at aiiincy on aeptember,19,20 and 21,
1935: Aldermen Fulle and Bishop, and the City
Clerk.

The motion was made by Alderman Frederick and seconded by
MacLuckie to confirm these appointments. The Mayor pro tem
put the question and the Clerk called the roll with the
following result: Ayes; Aldermen Carroll, Bishop and Frederick.
Nays; Aldermen Aline, Pflughaupt, Fulle, MacLuckie, Lemke,
Schwanbeck and Campagaa. The Mayor pro tem thereupon de-
clared the motion defeated.
ADJOURNMENT: The mot ion was made by Alderman
Fulle and seconded by .iflughaupt that the Council adjourn.
