MINUTES OF THE REGULAR LUTING OF THE
CITY COUNCIL OF THE CITY OF DES PLAINES
HELD IN THE COUNCIL CHALMERS ON THE 1st
DAY OF JULY, A.D.1935 AT THE HOUR OF
8:00 P.M.
ROLL CALL:
The Meeting was called to order by Mayor George
\V.Xinder, presiding, with Aldermen Ahbe, Carroll, 12f1Ug-
haupt, Bishop, Maatiokie, Schbanbeckand Campagna respond-
ing to the roll Call. Aldermen Frederick and. Lemke were
absent during this roll call, but arrived shortly thereafter.
Alderman Pulle was absent during the entire meeting.
APPROVAL OF BILLS:
Alderman Pflughaupt, chairman of the Finance
Committee then presented a proposed resolution aaDroving
the bills, and salaries presented for approval as of
July 1,1935, of which each member of the Council had re-
ceived a copy in advance. The motion was made by Alderman
Pflughaupt and seconded by MacLuckie that the proposed
resolution be adopted. A motion was then made by Alderman
Bishop and seconded by MacLuckie that the proposed Grdi-
nan7ce be amended by changing the item "Gustave Vendt-labbrer
78 hrs .50 per hr. -$39.00", voucher #3469, so as to read
"Gustave Wendt -laborer 78 hrs C .45. per hour - $35.10".
The roll was called on the motion to amend, with, the
following result: Ayes; Alaermen Ahbe, Carroll, -rflughaupt,
Bishop,MacLuckie, 3chwanbeck and. Campagna. Nays; iione.
The Mayor thereupon declared the motion carried and proposed
resolution so amended. The Clerk then called the roll on
the motion to adopt the resolution as amended with the follow
ing result: Ayes; Aldermen Ahbe, Carroll, Pflughaupt, Bishop
MacLuckie, Schwanbeck and Campagna. Nays; ilone. The Mayor
thereupon declared the -otion carried and the resolution

Ahbe and seconded by Lemke to instruct the Clerk to apply the idea
of a brief explanation, as given for some invoices, to all items
carried on the invoice register. The Mayor put the question

REPORTS OF OFFICIALS:
The Clerk then read the report of Edgar J.Friedrich,
City Clerk, for the calendar month of June,1935.
A copy of the report of Cash on hand of Utto W. J .henrich,
City Treasurer, as of June 30,1935, was then distributed to
each member of the Council.
THE JUDICIARY AND ASSESSMENT COMMITTEE had no report to offer.

reading, which had been referred to the Judiciary and assessment
committee:
ORDINANCE
BE IT ORDAINED by the Mayor and City Council
of the City of Des Plaines, Cook County, Illinois;
Sections That W.H.Allen be and he is hereby
employed and retained as engineer for the City of Des
Plaines under and subject to the conditions of a contract,
copy of which is hereto attached and made a part of this

ordinance.
Section 2: That the Mayor and City Clerk of
the City of Des Plaines be and they are hereby authorized
and eipowered to execute contract to the said l+.H.Allen,
copy of which is hereto attached.
Section 3. That all ordinances or parts of ordi-
nances in conflict herewith, be, and the same are
hereby repealed.
Section 4. That this ordinance shall be in full
force and effect from and after its passage and the
approval according to law.

The Mayor put the question and the roll was called by the Clerk

hauy t, Bishop, MacLuckie, Frederick, Lemke, Schwanbeck and Cam-
pagna. Nays; None. The Mayor thereupon declared the motion
carried and the ordinance passed.
THE POLICE A:A LICENSE CO1MITTEE: reported through its chairman,
Alderman Carroll, that `matter of controlling and disposing of
stray dogs proves to be a difficult problem, principally because
there is no appropriation for such a purpose. The motion was
made by Alderman Frederick and seconded by rflughaupt to
re -commit this matter to the Police and. License Committee. The
motion vas out to a vote by acclamation, whereupon the Mayor
declared the motion carried.
THE STREETS AND SIDEWALKS COMMITTEE reported through its
chairman Alderman Frederick, that an attempt is being made to
keep the downtown streets clean, and asked that all business
houses on these streets cooperate by refraining from sweeping
paper and rubbish upon the streets.
He further reported that the matter of providing
danger signals at dead-end streets has been turned over to
the Superintendent of Public Works.
Regarding the chec:-up to determine whether all such
street lights, as are contracted for, are burning, Alderman
Frederick reported that he has taken the matter up with the Public
Service Company of •Northern lllinbis.
He reported nothing done to date regarding the matter
of trimming tall shrubs in parkways to prevent auto accidents.
Alderman Frederick, chairman of the Streets and Sidewalks
Committee also expressed the opinion that a 30 -minute parking rule
as petitioned by a group of Lee Street merchants, and referred
to the Streets and Sidewalks Committee, could not be enforced
with the present number of policemen. The motion was made by

Alderman Carroll and seconded by Schwanbeck to re -commit this
tatter to the Streets and Sidewalks Committee. The motion
was voted upon by acclamation, whereupon the Mayor declared the
motion carried. it
THE COMMITTEE ON PUBLIC WORKS, BUILDIT_uGS AND PLATS through
its chairman, Alderman MacLuckie that the request of Ben F.
Eidamiller to lease the lot just east of the City Hall is
being given thorough study.
THE WATER COMMITTEE through its chairman, Alderman Bishop,
reported that $635.00 worth of repair parts have been ordered for
the repair of the Norma well, and requested the Clerk to
confirm this telephone order by letter. -ie also briefly dis-
cussed the problem of "shooting" the veil. the motion was
made by Alderman Bishop and seconded by Frederick that W.L.
Thorne Co. be authorized and instructed to "shoot" the Norma
Well. The Mayor put the question and the roll was called by the
Clerk with the following result: Ayes; Aldermen Pflughaupt,
Bishop, MacLuckie and Frederick. -Nays; Aldermen Ahbe, Carroll,
Lemke, Schwanbeck and (.campagna. The Mayor thereupon d eclared
the motion defeated.
The motion was then made by Alderman Bishop and
seconded by Carroll that the Water Committeers action of ex-
pending 4?635.00 for repair parts for the Norma `well be sanctioned
and approved by the Council. The Mayor put the question and
the roll was called by the Clerk with the following result: Ayes;
Aldermen Ahbe, Carroll, Pflughaupt, Bishop, MacLuckie, Frederick
Lemke, Schwanbeck and Campagna. Nays; None. The Mayor thereupon
declared the motion carried.
THE FIRE COMMITTEE: through its chai rman , Alderman Campagna,
suggested that each tavern be supplied with a copy of such
fire prevention rules as are necessary. The motion was made
by Alderman Frederick and seconded by Ahbe to re -commit this
matter to the Fire Committee for more definite recommendations.
The motion was voted upon by acclamation, whereupon the Mayor
declared the motion carried.
Alderman Campagna further reported that in as
much as there seems to be no possibility of getting a favorable
legal opinion on the proposed Fire Equipment Bond issue, and
therefore no possibility of finding a market for these bonds,
a new fire truck seems to be out of the question at the present
time.
CREATING BOARD OF LOCAL IMPROVEMENTS: The Clerk then read
the following proposed ordinance for second reading:

AGES FOR POLICING CITY DULfl?: The Clerk then read the
following letter:
To the Mayor and City Council
Two years ago 1 presented a bill for 450.00
for special police service from the year 1929 to 1933 for
the Des Plaines incinerator and dumping grounds. It was
put in the hands of the chairman of Police but nothing
ever came of it. 1 still tell the people to dump in the
proper place when they bring their rubbish, to dump, in
the evening (or on Sunday).
You have six years of my service for 450.00
and 1 would more than appreciate it if the City of Des
plains would pay this bill at the present time.

use of the City Hall folding chairs for these meetings.
These meetings will be conducted in a dignified, orderly
manner, - will consist of a short sacred band concert
and brief serzrronettes. As in the past, all speakers

The Illinois State Employment Service
is going through a process of reorganization at the
present time, and we are unable to make a definite

commitment as to the placing of an employment
office in Des Plaines. However, it is our
hope that a permanent office may be established
_there in the near future.

Dear Sir:
We represent Mr. Warren Garland, who
holds tti;o assignments of claims against the Village
of Des Plaines for X405. and $315., respectively
given by Charles A.Johnson, trading as Johnson's
lectric Shop, to lir. Garland, the assignments bang
dated February 14,1934. The accounts assigned
appear to be for the purchase price of 9 cast
bronze electric lanterns for mounting on street
lighting standards and for 9 re -enforced ornamental
electric light standards.
These assignments were taken by lir.Garland
in good faith upon the understanding that the amounts
covered by same were actually owed by the Village to
Mr. Johnson.
The assigbments were presented last year
and we were not able to learn just what action was
taken by the Village. inasmuch as Mr. Garland took
the assignments in good faith and they represent real
money to him, we should like to have some definite
ruling by the Village as to whether they rill be
paid without suit, or whether it will be necessary
for us to commence suit upon same.

Dear Sir::
Being indebted to the City of Des Plaines, I ask
your opinion of the following proposition.
1 owe a water bill of about 416.50, and l have no
money to buy vehicle or dog tags.
I have 12 Muller's new style Buffalo stop boxes
that can be used by the water dept., and during
C.W.A. work i furnished one length of 18 inch sewer
pipe for Ravens meter pit at 's'eller's creek, solder
and furnace to wipe joints with 3/4 inch unions,
nippels and'fittings.
Knowing conditions of the city at that time i did
not ask to be paid for this C.W.A. material, but
now I would like to know if it would be possible to
receive credit on my bills in exchange for the
material i furnished.
Mr. Wells can verify the furnishing of this material.

On May 18th, we wrote the City Clerk of Des Plaines
advising that D.F.Moore and Company no longer re-
presented our Company, and requested that all
future payments in connection with the above
numbered policies be.made direct to us, or by
them direct to you.
By reason of the City of Des Plaines' compliance
with that request, we agree to protect the City
of Des Plaines against any claim that may be made
against it by the agency of D.F.Moore and Company.

The motion was made by Alderman Frederick and seconded by

IacLuckie to authorize and direct the Mayor, City Clerk and City
Treasurer to cancel all such vouchers, warrants and/or checks
now held by the City drawn in favor of D.F.00re and Company
and issue in place thereof vouchers, warrants and/or thetics
in identical amounts drawn in favor of the United States
Casualty Company. The Mayor put the motion to a vote by
acclamation. All voted "Aye", none voting "Nay". The Mayor
thereupon declared the motion carried.
RENS AL CF INSURANCE POLICIES: The Clerk then read the
following letter:

Dear Sir:
I am enclosing herewith the above numbered policies,
which are renewals of policies No.U.S. .C.43259 and
AP -36299.
The automobile policy is written at the same rate and
premium as last year. the compensation policy is
written with a deposit premium of ;500,00. This is
due to the fact that,the manual rules require a deposit
of 50,E of the total yearly premium when the policy is
written on a quarterly premium basis. This is a deposit
premium only and is credited to the assured's account
when the final audit has been made.
You will note that the actual rates are less this year
than last year due to the fact that the experience debit
is 16.09% while last year the experience debit was 23%.
I hope that you will find the policies entirely satisfactory
and assuring you of my desire to be of service to you at

covering same to the Judiciary and Assessment committee for

BOND OF GLADYS LERETTE: The Clerk then presented Continental
Casualty Company's Surety Bond #158,445 in the penal sum of
$5,000.00, with Gladys LeRette, Assistant Collector as principal.
The motion was made by Alderman Ahbe and seconded by Carroll
toxefer this said bond to the Judiciary and Assessment Committee
for examination and report. The motion was voted upon by
.acclamation whereupon the Mayor declared the motion carried.
FIREMEN'S INSURANCE:

Dear Mr. Friedrich:
RE: USWC-432b9 City of Des Plaines
In further reply to your letter of may 1st, regarding
firemen's protection under the above policy, it- is
our opinion that voluntary firemen, as well as regular,
ordinary firemen tand in the relation of employer and
employee with the town or city for which they perform
the fire fighting service and that the duties they
perform come within the Subdivision One of or Subdivision
Eight of Section Three of the Act. under Subdivision One
of Section Three, it would seem that firemen are main-
taining buildings while they are endeavoring to put out
a fire and under Subdivision Eight they are operating
under a municipal ordinance in placing mactnery and
appliances for the protection and safeguarding of employees
and the public therein.
There are no decisions on the point in Illinois, but
there are decisions in other states bearing on the
question raised in your letter there it has been held
that voluntary firemen, ander the direction of the Fire
Department of one city being -sent by the Department of
which he was a member, was covered under the act.
Since the question has beensaised, we believe it advisable
to endorse the policy to provide for the collection of
premium on the remineration of voluntary firemen, which
according to the manual for premium computation purposes

shall not be less than 100,00 per annum and 1 am today
sending such an endorsement to -r. Reitz with request
that he deliver it to you for attachment to your policy.
I trust t:o.is fully answers the question raised in your
letter of May 1st. If not, however, i will be glad to
hear further from you.

refer this letter to the Judiciary and Assessment Committee for
examination and report. The motion was voted upon by acclamation,
whereupon the Mayor declared the motion carried.
APPROVAL OP MINUTES: The motion was made by Alderman Pflughaupt
ands econded by Mactuckie that the Council approve the minutes
of the regular Council meeting held June 3rd,1935 as well as
the minutes of the special Council meeting held 'une 11,1935
as written. The Mayor put the motion, to a vote by acclamation.
A.11 voted "Aye", none voting "Nay". The Mayor thereupon de-
clared the motion carried and the said minutes approved as
presented.
ADJOURI NT : The motion was then made by Alderman Lemke and
seconded by Frederick that the Council adjourn to Monday even-
ing July 8,1935, at 8:00 PM. The motion was voted upon by
acclamation, whereupon the Mayor declared the motion carried
