wish to advise that the above -entitled'
case came on for trial before Judge Kelley of the Super-
ior Court on April 8,1935. xou Will recall that this
was a case whereby Ir. Cuneo filed suit to mandamus
the City of Des Plaines to pay him ;2,006.00 due upon
two special assessment bonds for said amount, drawn
against the sixth installment of special assessment
No. 60.
The court, after hearing all the testimony,
informed the plaintiff that under the facts and the law,
he could not order a mandamus to issue, although he
indicated to the plaintiff that he would permit the
plaintiff to amend his cause of action, so that he
could proceed along some other theory of law. 1 ob—
jected to the court permitting the plaintiff to amend
his cause of action, in view of the fact that the court
had heard all the testimony and both sides had. Closed
their case, and the court was then obliged to render a
decision either by granting the writ or declining the
writ.
The plaintiff did not see fit to amend his
cause of action, but asked the court to continue the
case so that the mandamus action could remain pending
and thus act as a safety measure in that the City
would be more cautious and would properly apply any
money received in the future applicable to the 6th
installment. also thbjected most etrenously to this
being done for the same reason, namely, that the
case had been heard on its merits and the court was
obliged to render a decision, however, the court over-
ruled my objections and continued the case until September
23,1935.

I engaged a court reporter for this case. and
Should.yoU wish the evidence written up to preserve
the record in the event this case is to be tried at
any future date, the cost of writing up the desti-
mony will be 425.00, and the attendance fee is 4)5.25.
In the event you do not see fit to have the
testimony written up at this time, the only expense
of the reporter will be 4,5.25. May 1 be advised as
to your wishes in the matter?

At a recent meeting of the newly formed Cook
County Suburban Firemen's Association, of which
we are members along with other firemen in our
neighboring cities, the question was raised as to
whether or not, Firemen were covered by the liability
insurance, when fighting fires outside the City limits.
Will you kindly investigate and obtain in writing,
a ruling on this coverage, from both companies in
whichwe are insured.
Another subject of importance, brought up at
our last meeting, was the purchase of the new Fire
Truck. We believe it will be for the better interest
of our community to aim to reduce our fire insurance
rates, if possible, and the way in which this new
truck is to be equipped, may greatly influence the
insuance underwriters, in meeting our demands. We
therefore recommend, with this thought in mine, that
you write the underwriters for their specifications
or recommendation in equiping this new truck. They
may wish to have us obtain a certain size pump, or
a given quantity of hose to carry, or iatters, etc.

Dear Sir:
I am nclosing herewith original vouchers
issued by the City of Des Plaines against special
assessments numbers 104, 130 and 134 and listed in de-
tail on the attached schedule.
These vouchers were held by the Central Re-
public Trust Company as collateral to a loan of the
Hanchett Bond Company which went into the hands of a
receiver. Subsequently an order was entered in the
United States District Court in the District of New
Jersey authorizing the Central Republic Trust Company
to return said vourbhers to its possession for the pur-
pose of wiping out the debt of the Hanchett Bond Com-
pany to the Central Republic Trust Company.
William L.0,Connell, Receiver for the Central
Republic Trust Company, has requested that the vouchers
in question be canceled and new vouchers issued payable
to Camp and Company in lieu thereof..
While the vouchers in question have not been
assigned by the Hanchett Bond. Company, 1 have satisfied
myself by investigation directly with the officials now
in charge with the Central Republic Trust Company at
134 S.LaSalle Street, that said bank, through the receiver
is the true and lawful owner of said vouchers and they
wish the same transferred to Camp & Company, who is
their nominee.
I am enclosing a letter from William L.O'Oonnell
Receiver of the Central Republic Trust Company dated April
11,1935 which is your authority to issue new vouchers in
the name of Camp and Company. I suggest that you mark
across the face and at one side of the new vouchers the
words "Issued in lieu of original voucher of the same
date and number issued to Hanchett Bond Company.
You will notice that the Central Republic Trust
Company has furnished the forms for the new vouchers and
this was done for the reason that I was informed by you
that the City of Des Plaines did not have on hand any
blank vouchers.

with instructions to insist upon a good and sufficient indem-

CANVASS OF ELECTION OF Aril 16 1935; The motion was made
by Alderman Bishop and seconded by FUlle that the rules of
the Council be suspended in order to permit the canvassing
of the General City Election held April 16 1935. The question
was put by the Mayor, and the roll was called with the follow-
ing result: Ayes; Aldermen Ahbe, Carroll, Pflughaupt, Pulle,
Bishop, Frederick, Neal, Schwanbeck and 'ieinshausen. Nays;
None. ( Alderman H uxmann was absent during this roll call and
for the remainder of the meeting.) The Mayor thereupon de-
clared the motion carried and the rules so suspended.
Mayor Kinder then appointed Alderman Pflughaupt,
Ahbe and Bishop to serve as the canvassing board to canvass
the returns of the election held April 16 1935, and declared
a recess to permit conducting the said canvass.

issuance of $10,000.00 City of Des Plaines
Fire Department Bonds, and providing for the
collection of a direct annual tax for the
payment of the principal of and interest
on said bonds, at a general election to be
held in and for said City April 16th,1935.
and
WHEREAS, such election was duly held on April 16th,
1935; and
WHEREAS, the ballots cast at said election were re-
turned to the City Clerk and duly canvassed by this City
Council ,and
WHEREAS, it is found that there were 2275 votes
cast in approval of said bond issue, and 1583 votes
cast against the said bond issue;
THEREFORE BE IT RESOLVED by the City Council of
the City of Des Plaines that the proposition to issue
$10,000.00 Fire Department Equipment Bonds is hereby
declared approved; and the ordinance authorizing the
issue of the said bonds passed by the City Council on
February 25th,1935 is hereby declared to be approved
by the voters of the City of Des Plaines, and to be
in full force and effect.

The motion was made by Alderman Pflughaupt and seconded by Ilea'
to adopt this proposed resolution. The Mayor put the question and
the Clerk called the roll with the following result: Ayes; Aldermen
Ahbe, Carroll, Pflughaupt, Fulle, Bishop, Yrederick, Neal, Schwan-
beck and Meinshausen. Nayes; None. The mayor thereupon declared
the motion carried and the resolution passed and adopted.
PROTEST OF HOUSE BILL #209: Mayor Kinder reported that Ir. Morris
Houser, chairman of the Board of School District fi62 requested the
Council to join in protesting against the passage of House Bill
#209 in the State Legislature. The motion was made by Alderman
Frederick and seconded by Pflughaupt to direct the Clerk to
send a telegram of protest against House Bill #209 to the chairman
of the Revenue Committee of the legislature. The motion was voted
upon by acclamation whereupon the Mayor declared the motion carried
LIGHTS FOR KENEICOTT CT: Alderman Bishop, reported that he has
a letter from a Mr. li.W.Matteson,1889 Kenniaott Court asking that
lights be provided on Kennicott Court. Mayor Kinder referred the
matter to the Streets and Sidewalks Committee.

PETITION TO CONTEST ELECTION.
Your petitioners, W.J.Cleary and S.Roy Koehler,
respectfully represent unto the City Council of the City of Des
Plaines, Cook County, Illinois that they are residents and legal
voters of the City of Des Plaines; having resided at 70 Ardmore
Road and 1348 $efferson Street respectively, for more than
five years.
That on the 16th day of April 1935 they were quali-
fied voters in and for the First Ward in Des Plaines, Illinois.
Your petitioners further allege that the eledtion
held in the first precinct of the First Ward in the City of Des
Plaines on the 16th day of April 1935 was not held in accordance
with the law.
That the judges and clerks of election in said
precinct conducted themselves and permitted others to conduct
themselves, contrary to law, in said polling place, during the
hours of voting and after the polls were closed,and the votes
were being counted.
That the ballots, after the polls were closed,
were not canvassed by the judge to ascertain whether the number
of ballots exceeded the number of names on the poll books.
That the judges of election did not read aloud
from each ballot, the names of the candidates receiving a vote,
so that the clerks could enter upon the poll lists the votes
as called by the judges.
That the judges permitted others to handle the
ballots.

That certain judge entered the polling booths with
voters, without first examining said voters to ascertain
whether they were unable to read the English language
or were physically disabled and without requiring said
voters to sign an affadavit as required by law.
That your petitioners believe that a recount of
the ballots cast ins aid First Ward will reveal that
they were not properly counted and that Hobart Ahbe
and James Carroll Jr, did not receive the greatest
number of votes for Aldermen in said First Ward.
Wherefore your petitioners pray that Hobart Ahbe
and James Carroll be notified to appear before the
City Council of the City of Des Plaines, and that the
City Council hear testimony of witnesses, and that the
ballots be recounted.

The motion was made by Alderman fleal and seconded by Meins-
hausen to have a hearing on this petition on May 13,1935,
and to direct the Clerk to notify Mr. Hobart Ahbe, Mr. James
J.Carroll, Mr. J.Roy Koehler and Mr. W.J.Cleary of this
hearing. The Mayor put the question, and the Clerk called

RAILROAD PARKWAY: Mayor Kinder referred the matter of filling
and seeding the parkway on Ellinwood Street between Graceland
Avenue and Lee Street on the south side of the C & N W railroad
track to the Streets and Sidewalks Committee.
ADJOURNMENT: The motion was made by Alderman Falle and seconded
by Meinshausen to adjourn. The motion was voted upon by accla-
mation whereupon the Mayor declared the motion carried and the
Council regularly a dj ourned.
