CITY COUNCIL OF THE CITY OF DES PLLAINES
HELD IN THE COUNCIL CHAMBERS ON THE 1st
DAY OF APRIL,A.D.1935 AT THE HOUR OF 8:00 P.M.
CALL TO ORDER:
The meeting was called to order by Mayor George-.
Kinder, presiding. The roll was called by the Clerk with
Aldermen Ahbe, Carroll, Pflughaupt, Fulle, Huxmann, Bishop,
Frederick, Neal, Schwanbeck and Meinshausen responding to the
roll call.
REPORTS OF CITY OFFICERS: The Clerk then presented the
following reports:
1.Report of H.A.Becker, Captain of Police for March 1935.
2.Report of Edgar J.Friedriaz,Qity Clerk for larch 1935.
3.Report of Chasail.Larson, City Treasurer for March 1935.(A
copy of this report was distributed to each member_of the
Council.)
These reports were ordered placed on file by the Mayor.
THE JUDICIARY AND ASSESSMENT COMMITTEE had no report to offer.
THE POLICE AND LICENSE COMMITTEE through its chairman Alderman
Luxmann stated that he has an itemized report from the captain
of Police, H.A.Becker, showing that Mr. Becker has driven his
privately owned automobile 9600 miles for City business. The
motion was made by. Alderman Huxmann and seconded by Pflughaupt
to refer this report to the Police Committee for further study.
The motion was voted upon by acclamation whereupon the Mayor
declared the motion carried.
THE STREETS AND SIDEWALKS COMdITTEE
Alderman Frederick reported that the

TRAFFIC CODE: Alderman Frederick, chairman of the Streets and
Sidewalks Committee reported further that a traffic code similar
to the one recently adopted by Park Ridge could be printed almost
verbatim from the type which was set for Park Ridge and which
is being held by the printers for the benefit of the City. The
cost, he reported, would be ,700.00 for the printing and 4160.00
for publication or a total of about '1210.00. The motion was made
by Alderman Huxmann and seconded by Pflughaupt to furnish each
alderman with a copy of the Park Ridge traffic code and to ask
the printer to hold the type until further notice. The motion
was voted upon by acclamation, whereupon the Mayor declared the
motion carried.
THE COMMITTRF, ON PUBLIC WORKS, BUILDINGS AND PLATS had no report
to offer.
THE FIRE COMMITTEE had no report to offer.
THE SEWER DRAINAGE AND SANITATION COMMITTEE through its chairman
Alderman. Meinshausen recommended a free "Clean-up week." The
motion was made by Alderman Meinshausen and seconded by Huxmann
to arrange a '''lean -up week" during the week beginning April
22 and ending April 28,1935. The motion was voted upon by accla-
mation whereupon the Mayor declared the motion carried.
THE WATER COTRIITT ;H; through its chairman, Alderman Bishop,
reported the necessity of overhauling the pump on the Norma. Well.
The motion was made by Alderman Bishop and seconded by Fulle
to authorize the Water Committee to get bids on overhauling the
pump on the Norma Well and report to the Council at its next
meeting. The motion was voted upon by acclamation whereupon the
Mayor declared the motion unanimously carried.

letter:

Gentlemen:
The undersigned has been retained as attorney to
enforee the collection of principal and past due
interest on bonds No.86 arAi 10, each in the sum of
500.00, same being improvement bonds for the 7th
installment of special assessment No.66, levied for
the purpose of constructing a system of sewers for
Keeney Avenue and other streets and avenues. These
bonds came due December 31,1928. Since that time my
client has received no interest and absolutely nothing
an account of the payment of princi-:gal. Late last fall
I secured permission from 1r..Kenneth G..Leyer, your
City Attorney, to make an examination and audit of the
books of the Village Treasurer, concerning the collection
and disbursement of funds in connection with this parti-
cular installment of assessment No.66. As a result of
this examination, in the making of which, Mr.Larson,
your present City Treasurer, cooperated quite. fully
with my auditor, we found that a number of discrepancies
occur in the books, which are hereinafter listed, and
concerning which I feel the Village, the former treasurers
and their sureties, are jointly and severally liable
because of the following:
Prior to the maturity of the issue, the sura of
.2,500.00 was paid in the retirement of said bond*,
whether to a favored few or not, I am unable to say,
but clearly these transfers were a diversion of funds:

On December 31,1928, B.Lagerhausen received;1,000.00
and on January 5,1929, five days after the maturity of
the issue, the Des Plaines State Bank received 41,500.00
of principal. This was also a diversion, because o -f the
fact that none of the principal should be paid to :any
particular bondholders, but the entire sum available should
have been distributed pro rata among all bondholders.
An additional sum of ,1,393.30, was collected as prin-
cipal from the property owners, which was the total principal

paid by then during the seven year period. During that
time only the sum of $1,489.62 was received as interest
from the property owners. There is a sum of 4149.92 which
has not been segregated into principal and interest, and
there appears to be some question in the mind of the book-.
keeper as to just what this surae comprises. At any rate,
your books show a total payment of interest of 42,650.34,
Which was actually 41,160.72 more than was paid in by the
property owners for interest. Clearly this was a diversion
of principal funds to eieet interest, entirely, wrong, and,
for which the Village, all treasurers connected therewith,
and their sureties are liable.
inasmuch as the total of 46,393.30, was actually paid in
to be applied on principal by the property owners, we feel
that we are entitled to one-seventh of that sum, or the sum
of 4913.33. had we received our pro rata distribution on
December 31,1928, assuming that there had been no wrongful
diversion of principal to meet interest and to pay up said
bondholders before and at maturity, this sum should have been
available on December 31, 1928. interest at 5 on this sum
from December 31,1928, to date, amounts to 4282.23, which
couJled with the expenses of our audit amounting to 487.10,
brings a total of 41,282.66 due us as of this date. There is
a small credit due you by vittue of the fact that we received
our proportionate shore of the interest which was paid from
the funds wrongfully withdrawn from the principal account
to meet the interest account. The sura amounted to 41,010.80,
and the proportionate credit due us for our one-seventh of the
sum so received amounts to 4144.40, making a net sum due us as
of the present date, of 41,138..26.
In the event, the city, together with the Treasurer and
sureties are willing to compromise this debt in the principal
sum of 41,000.00 at this time, we will accept same and execute
a full release therefor. Othervise 1 feel it will be necessary
to go to suit, and 1 trust you will cooperate in the saving
of this additional court costs and ex-oenses.

BOYS SIX-DAY BICYCLE RACE: The Clerk then read the following letter;
City Council of Des Plaines
Dear Sirs:
April 1,1935
We would like to have permission to use the
Avenues Walter, first, Greenview and Second to hold a
six-day bike race .commencing April -21 and ending on
April 27, starting 9 P.M.on the -21 and ending. on 12
r.M. on the 27. There Willie eight contestants and the
only time all riders will be on the field will be
during the sprints which are from 9 A.M. to 7 P.M. each
day. There will be adults supervising the race. We
promise to keep on the inside -of the street also watch
out for the -cars. There will be no sprinting after
dark, we will also have lights on our bicycles.

Mayor Kinder referred this letter jointly to the Streets and
Sidewalks Committee and the Police Committee and instructed the
Clerk to write the parents of the boys who signed the above request.
REGISTRATION OF BICYCLES: The Clerk then reported that he has
received sever4I inquiries from parents, asking that some arrange-
ments be made by the Police Department for registration of bicycles.
This matter was referred to the Po1ice Committee by the Mayor.
APPROVAL OF MINUTES: The Motion was made by Alderman Meinshausen
and seconded by Deal to approve t1'.minutes of the regular Council
meeting held March 18,1935 as written. The motion was voted upon
by acclamation, whereupon the Mayor declared the motion carried
and the minutes approved.
APPROVAL OF BILLS: The Clerk then presented the following proposed
resolution, a copy of which was in the hands of each member of
the Councils
RESOLVED THAT THE FOLLOWING BILLS ARE DUE AND
PAYABLE AND THAT THE MAYOR AND CITY CLERK BE

The motion was made by Alderman Pflughaupt and seconded by
Meinshausen to adopt this proposed resolution. The Mayor
put the question, and the roll was called with the following
result: ayes; Aldermen Ahbe, Carroll, Pflughaupt, Tulle,
Nuxmann, Bishop, Frederick, meal, Schwanbeck and Meinshausen.
Nays; one. The Mayor thereupon declared the motion carried
and the resolution adopted.
FINANCE COMMITTEE: Alderman Pflughaupt, chairman fo the
:inance Committee stated that he will report at the next
Gouncil Meeting regarding the letter from Paul B.Fischer, attorney
for the bondholders of Special Assessment ±o.95.
ADJOURNMENT: The motion was made by Alderman Fulle and seconded by
Neal to adjourn. .The motion was voted upon by acclamation, whereupon
the Mayor declared the motion carried and the Council regularly

Mayor Kinder called the meeting to orter. The Clerk
called the roll with only Aldermen Pflughaupt, .Valle and Frederick
responding. The Clerk reported only three aldermen present,
whereupon Mayor Kinder declared the meeting adjourned for want
of a quorum, and instructed the Clerk to call a special Council
Meeting for Monday, April 22,1935.

CALL TO ORDER:
The meeting was called to order by Mayor George W.
Kinder presiding, with Aldermen Ahbe, Carroll, Pflughaupt,
Huxmann, Bishop, Frederick, Neal, Schwanbeck and Meinshausen
responding to the roll call. Alderman 'ulle arrived shortly
after the roll call.
The Clerk then read the following call of the meeting
which had been delivered by messenger to the Mayor and each Alder-
man more than twenty-four hours before the time of the meeting:
