03/18/1935489 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAID'S HELD IN THE COUNCIL CHAMBERS ON THE 18th DAY OF MARCH,A.D.1935 AT THE HOUR OF 8:00 PK CALL TO ORDER: The meeting was called to order by Mayor George W.Kinder, with Aldermen Ahbe, Carroll, Pflughaupt, Fulle, Iiuxmann, Bishop, Frederick, Neal, Schwanbeck and 1,,einshausen responding to the roll call. THE JUDICIARY AND ASSESSMENT COMMITTEE through its chairman Alderman Neal resubmitted the following proposed resolution which had been referred to his Committee: RESOLUTION MEMORIALIZING THE CONGRESS OF THE UNITED. STATES TO PASS, AND THE PRESIDENT 011 THE UNITED STATES TO APPROVE, IF PASSED THE "General Pulaski's Memorial Day" RESOLUTION NOW PENDING IN CONGRESS. WHEREAS: A Resolution providing for the President of the United States of American to proclaim October llth of each year as "General Pulaski's Memorial Day" for the observance and commemoration of the death of Brigadire General Casimir Pulaski, is now pending in the present session of the United States Congress; and WHEREAS: the filth day of October, 1779, is the date in American history of the heroic death of Brigadier General Casimir Pulaski, who died from wounds re- ceived on October 9th, 1779, at the siege of Savannah, Georgia; and WHEREAS, the State3 of Arkansas, California, Connecticut, Delaware, Illinois, Indiana, i-entucky, Louisiana, Maryland, Kansas, Massachusetts,ichigan, Minnesota, Missouri, Nebraska, New Hampshire, New Jersey, New York, Nevada, Ohio, Pennsylvania, South Carolina, Tennessee, Texas, West Virginia, Wisconsin, and other states of the Union, through legislative enactment designated October llth of each year as "General .ulaski's Memorial Day"; and WHEREAS, it is fitting that the recurring anniversary of this day be commemorated with suitable patriotic and public exercises in observing and commeorating the heroic death of this great American hero of the revolutionary War; and WHEREAS, the Congress of the United States of American has by legislative enactment designated October 11,1929, October 11, 1931, October 11,1932 and October 11,1934 to be "General Pulaskits Memorial Day", in the United States of America; Now therefore be it RESOLVED BY THE COMMON COUNCIL OF THE CITY OF DES PLAINES and the STATE OF ILLINOIS IN SESSION ASS i LED-- Sectionl. That we hereby memorialize and petition the Congress of the United States, to pass, and the President of the United States to approve, if passed, the il General Pualski's erorial Day Resolution now pending in the United States Gongress. Section 2.That certified copies of this Resolution, properly authenticated, be sent forthwith to the President of the United States, the Vice -President of the United States, the Speaker of the House of Representatives of the United States, and each of the united States Senators and Representatives from Illinois. The motion was made by Alderman Neal and seconded by Meins- hausen that this proposed resolution be adopted. The Mayor put the question, and the Clerk called the roll wit t the following result: Ayes; Aldermen Ahbe, Carroll, Pflughaupt, Fulle, Huxmann, Bishop, Frederick, Neal, Schwanbeck and Meins- hausen. Nays; None. The Mayor thereupon declared the motion carried and the resolution adopted. THE POLICE AND LICENSE COMMITTEE had no report to offer. THE STREETS AND SIDEWALKS COMMITTEE suggested, through its chairman Alderman J.1rederick, that a "Traffic Cade" be adopted similar to -the traffic code recently adopted by the City of Park Ridge. The motion was made by Alderman Hux- mann and seconded by Bishop to refer the matter of a traffic code to the Streets and Sidewalks committee for investi- gation and recommendation. The matter was voted upon by acclamation, whereupon the Mayor declared the motion carried. THE COMMITTEE ON PUBLIC WORKS, BUILDINGS AND PLATS: had no report to offer. THE FIRE COMMITTEE had no report to offer. THE SEWER DRAINAGE AND SANITATION COLfIITTEE had no report to offer. THE WATER COMMITTEE had no report to offer. SALARY OF CITY TREASURER -COLLECTOR: The Clezi_ Shen read the following proposed ordinance for second reading: AN ORDINANCE ESTABLISHING THE SALARY OF THE CITY TREASURER OF THE CITY OF DES PLAINES, AND ESTABLISHING THE SAL- ARY OF THE ASSISTANTS TO THE TREASURER, AND ESTABLISHING THE FUND FROM WHICH SAID SALARIES 'ARE TO BE PAID. The motion was made by Alderman Ahbe and seconded by Bishop to pass and adopt this proposed ordinance. The Mayor put the question and the roll was called with -the foliating result: Ahbe, Carroll, Pflughaupt, Fulle, Huxmann, Bishop, Frederick, Neal, Schwanbeck and Meinshausen. Nays; None. The Mayor thereupon declared the motion carried and the ordinance passed and adopted. The Mayor then signed this ordinance in approval thereof, which signature was attested by the Clerk. S.A.95 DECREE: The Clerk then read the following letter: PAUL B. FIS HER March 12 193b Mr .Chas .M .La r s o n City Treasurer-Lity of Des Plaines City Hall Des Plaines, Illinois Dear Mr. Larson: This acknowledges receipt of Des Plaines General Fund check No.2778 in the amount of 4;63.37, payable to the Gary -Wheaton Bank, Trustee. i have forwarded the check to the Bank, and -thank you for it. Recently the City of Chicago enacted an ordinance providing that all funds available for the retirement of judments should be kept in a sep- 491 arate fund, and that judgments should be paid in the order in which they were obtained. This was done prior to tine enactment of statute at the third • special session of the Illinois Legislature in 1934 requiring this form of procedure in case of cities having a population of 150,000 or more inhabitants. It seems to me that the City of Des Plaines should adopt..a similar procedure in addition to making some definite provision by special tax levy for the retire- ment of .the judgments against the City. There is no use going on indefinitely without handling these matters in a business -like manner, and sooner or later the expenses of mandamus proceedings, or other legal pro- ceedings to force collection, will make it very expensive for the City to ignore its judgment indebtednesses. If you think best, 1 will be glad if you will show this letter to Mayor hinder. 1 have as yet received no acknowledgment of my letter to him dated February 28th,1935. Very truly yours, PAUL B. POPPY DAY PERMIT: The Clerk then read the following letter: Des Plaines,lllinois March 18 1935 Hon.Mayor & City Council City of Des Plaines Gentlemen: The American Legion Des Plaines Post 136 respectfully requests permission to conduct its annual Poppy Day Sale in Des Plaines on May 27, and in case of rain on May 28th. The boys sincerely hope that this request be granted and that our citizens generously support this charitable endeavor. The motion was voted upon by acclamation, whereupon the Mayor declared the motion carried and the request granted. 1935 APPROPRIATION ORDINANCE: The Clerk then read the following in full for second reading: AN ORDINANCE MAKING APPROPRIATIONS TO DEFRAY THE EXPENSES OF THE CITY OF DES PLAINES FOR MUNICIPAL PURPOSES, DESIGNATED THE "AA UAL APPROPRIATION BILL" FOR THE FISCAL YEAR C0 'ENCING JANUARY 1, 1935 and ENDING DECEMBER 31, 1935. The motion vas made by Alderman Huxmann and seconded by Pflughaupt to pass and adopt this proposed 1935 Appro- priation Ordinance as read. The motion was made. by Alder- man Ahbe and seconded by Schwanbeck to amend the motion by striking from the appropriation ordinance "Item £o..8 Automobile expense of Caption of Police ---4480.00". .The Mayor put the question on the amendment and the Clerk called the roll with the following result: Ayes; Aldermen Ahbe, Carroll, and Schwanbeck. flays; Aldermen Pflughaupt, Fulle, Huxmann, Bishop, Frederick, Neal and Meinshausen. The Mayor thereupon declared the motion lost and the amendment defeated. The Mayor then :put the question on the main motion to pass and adopt the ordinance as origi- nally read, and the Clerk called the roll with the following result: Ayes; Aldermen Ahbe, Carroll, Pflughaupt, Fulle, Huxmann, Bishop, Frederick, Neal, Schwanbeck and - Meinshausen. Nays; None. The Mayor thereupon declared the motion carried and the 1935 Appropriation Ordinance passed and adopted. Mayor Kinder then signed the ordi- nance in approval thereof, which signature was attested by Edgar J.Friedrich, City Clerk. The motion was made by Alderman Huxmann and seconded by Pflughaupt to authorize and direct the Clerk to cause this 1935 Appropriation Ordinance to be published in one issue of the Des Plaines Suburban Times. The Mayor put the question, and the Clerk called the roll with the following result: Ayes; Aldermen Ahbe, Carroll, Pflughaupt, .'ulle, Huxmann, Bishop, Frederick, Neal, Schwan- beck and Meinshausen. slays; :one. SALE OF CONTRACEPTIVES: Kenneth G.Meyer, City Attorney, then presented the following proposed ordinance, which he stated had been revised and changed in several respects: AN ORDINANCE REGULATING THE DISTRIBUJTION AND SALE OF CONTRACEPTIVES WITHIN THE CITY OF DES PLAINES,ILLINOIS The motion was made by Alderman Frederick and seconded by Neal that this proposed ordinance be passed and adopted. The Mayor put the question and the Clerk called the roll with the following result: Ayes; Aldermen Ahbe, Carroll, Pflughaupt, r'ulle, Huxmann, -Bishop, Frederick, Neal, Schwan- beck and Meinshausen. Nays; -None. The Mayor thereupon declared the motion carried and the ordinance passed and adopted. Mayor Kinder then signed theordinance in approval thereof, which signature was attested by the Clerk. The motion was made by Alderman i4eal and seconded by Bishop to authorize and direct the Clerk to cause this ordinance to be published in one issue of the Des Plaines Journal. The Mayor put thequestion and the Clerk called the roll with the following result: Ayes; Aldermen: Ahbe, Carroll, Pflughaupt, Fulle, Huxmann, Bishop, Frederick, Neal, Schwanbeck and Meinshausen. Nays; None. The Mayor thereupon declared the motion carried. GENERAL G ARBAGE COLLECTION: The Clerk then read the following proposed ordinance in full for first reading: AN ORDINANCE AMENDING SECTION 1 AND SECTION 7 OF ORDINANCE ENTITLED "AN ORDINANCE RELATING TO THE DISPOSAL OF GARBAGE, ASHES AND IISCELLANEOUS WASTE AND PROVIDING PENALTIES FOR THE -VIOLATIONS THEREOF." APPROVED AUGUST 6th, 1928. The motion was made by Alderman Huxmann and seconded by Meinshausen to suspend the rules and put this imposed ordi- nance on passage. The Mayor put the question on the motion to suspend the rules, and the Clerk called the roll with the following result: Ayes; Aldermen Ahbe, Carroll, Pflug- haupt, Fulle, Huxmann, Bishop, Frederick, weal, Schwanbeck and Meinshausen. Nays; None. The Mayor thereupon declared the motion carried and the rules suspended. -The :notion was then made by Alderman Ahbe and seconded by.Huxmann to finally -pass and adopt this proposed ordinance. The Mayor put the question ori the final passage and the Clerk called the roll with the following result: Ayes; Aldermen Ahbe, Carroll, Pflughaupt, Fulle, Huxmann, i3ishop, Frederick, Neal,' Schwanbeck and Meinshausen. Nays; None. The Mayor thereupon declared the motion carried and ordinance finally passed and adopted. Mayor Kinder then signed this ordinance in approval thereof, which signature was attested by the Clerk. APPROVAL OF MINUTES: The motion was made by Alderman Bishop and seconded by Neal to approve both the minutes of the regular Council Meeting held March 4th,1935 as well as the minutes of the Adjourned Council meeting held March 11,1935 as written. The motion vas voted upon bya-cclamation whereupon the Mayor declared the motion unanimously carried and the minutes approved. The motion was voted upon by accla- mation, whereupon the Mayor declared the motion unanimously carried and the appointments confirmed. STREET SIGNS FOR RIVERVIEv : Alderman lleinshausen displayed a sample siren post with street names carved upon it, and recommended that such street sign -posts be installed with relief labor on all street intersections south of Oakton Street. The motion was made by Alderman Meinshausen and seconded by Fulle to refer this matter to the Streets and Sidewalks Committee for investiEation and recommendation. The motion was voted upon by acclamation whereupon the Mayor declared the motion c arried. SANITARY DISTRICT:.H.Allen, City Engineer, reported that the surveys for the pro-rosed Irnhofi Tanks to be built at each sewerage outlet have been completed. He reported further that the Sanitary District expects to complete the installation of these tanks before Summer. The tanks, he said, will be of brick and will be built by means of relief labor. ,ADJOURNMENT: The motion was made and seconded to adjourh.
