MINUTES OF THE SPECIAL MEETING OF THE CITY

JANUARY,A.D.1935 AT THE HOUR OF 71,3C P.M.
CALL TO ORDER:
The meeting was called to order by Mayor George
W.Kinder presiding.
READING GF CALL OF THE MEETING:
The Clerk then read the following call of the
meeting which was delivered by messenger to each member
of the City Council more than twenty-four hours before
the time set for the meeting:
January 29 1935
NOTICE OF SPECIAL MEETING
Upon call of Mayor George W.Kinder, there will
be a Special Meeting of the City C-uncil of the City
of Des Plaines on Thursday, Januar-; 31,1935 at 7:30
P.M. at the City Hall.
The purpose of the said meeting is to take further
action regarding refunding and such other matters as
may need attention.
The meeting is called for 7:30 in order that the
meeting may be adjourned at an early hour.

ROLL CALL:
The Clerk then called the roll. Those responding
to the roll call were Aldermen Ahbe, Carroll, Pflughaupt,
Fulle, Huxmann, Bishop, Frederic, Neal, Jchwanbeck and Meins-
hausen. The Clerk r eported all aldermen present.
t23,00C.00 REFUNDING BONDS:
The Clerk then read the following proposed ordi-
nance in full for first reading:
AN ORDINANCE PROVIDING FOR THE
ISSUANCE CF $23,00C.00 REFUNDING
BONDS OF THE CITY OF DES PLAINES
COOK COUNTY, ILLINOIS AND PROVIDING
FOR THE COLLECTION OF A DIRECT ANNUAL
TAX FOR THE PAYMENT OF THE PRINCIPAL
OF AND INTEREST ON SAID BONDS.
The motion was made by Alderman Hu4mann and seconded by Bishop
that any rules of the City Council which might prevent,
unless suspended, the final adoption and passage of this
proposed ordinance, be and are hereby suspended. The
question was put on this motion and the roll was called
with the following result: Ayes; Aldermen Ahbe, Carroll,
Pflughaupt, Palle, Huxmann, Bishop, Frederick, Neal, Schwanbeck
and Neinshausen. Nays; None. The Mayor thereupon declared
the motion carried and such rules suspended.

The motion was then made by Alderman H.uxmann and
seconded by Bishop to put this proposed ordinance authorizing
a 23,O0O.00 refunding bond issue on passage. The Mayor
put the question and the Clerk called the roll with the following
result: Ayes; Aldermen Ahbe, Carroll, Pflughaupt, Fulle,
auxmann, Bishop, Frederick, Neal, Schwanbeck and Meinshausen.
Nays; None. The Mayor thereupon declared the motion "to put
on passage" carried, and the proposed ordinance before the
Council for passage.
The motion vias then made by Alderman Bishop and
seconded by Huxmann to finally pass and adopt this proposed
ordinance authorizing a 423,CCC.CC refunding bond issue.
The Mayor put the question and the Clerk called the roll
with the following result: Ayes; Aldermen Ahbe, Carroll,
Pflughaupt, Fulle, Huxmann, Bishop, Frederick, Neal, Schwanbeck
and Meinshausen. Nays; None. The Mayor thereupon declared
the motion carried and the ordinance finally passed and adopted.
Mayor Kinder then affixed his signature thereto
in approval thereof, which signature was attested by Edgar J.
Friedrich, City Clerk who thereupon also impressed the corporate
seal of the City of Des Plaines upon the original ordinance
as passed.
The motion was made by Alderman Neal and seconded
by Ahbe to authorize and instruct the City Clerk to cause this
423,000.OG Refunding Ordinance to be published in the January
25,1535 issue of the Des Plaines Journal. The Mayor put the
question, and the Clerk called the roll with the following
result: Ayes; Aldermen Ahbe, Carroll, Pflughaupt, Tulle,
Huxmann, Bishop, Frederick, Neal, Schwanbeck and Meinshausen.
Nays; None. The Mayor thereupon declared the motion carried.

Dear Sir:
1 am in receipt of four copies of the
contract for Section 1 -CS, awareded to the 0 & W.
Contruction Company.
The tabulation of bids received on the
letting for this section shows that the 0 & W.Construction
Company was third low bidder. The law requires that
bids be awarded to the low responsible bidder. 'here-
fore, we are unable to approve this contract
and the four copies are being returned to you under
separate cover.
There was an error in the proposal received
by Milburn Brothers so that instead of seven inlets
as was on the plans and on the other proposals, there
was instead on Milburn Brothers' proposal seven feet
of curb and cutter. Milburn Brothers bid fifty cents per
line.1 foot for this curb ard g!?tter, which made the
total of that item 43.50. this, of course,made their
total bid low, however, 1 feel that E.M.11elahn is
the truly low bidder and that the contract should be

awarded to him. I feel that he is the low bidder
for the following reasons;
1.Mdlburn brothers would have had to
bid an unreasonably low price on
inlets to have made their bid lower
than that of E.k.elahn.
2.If the whole item of inlets were stricken
out of all proposals and a comparison made,
E.11.111elahn would be the low bidder.

The motion was made by Alderman Huxmann and seconded by
Pflughaupt to refer this letter to Kenneth Meyer, City Attorney,
with instructions to prepare and present to the Council a
resoltuion withdrawing the aforementioned award to the 0 & w
Construction Company. The Mayor put the motion to vote by
acclamation, whereupon the Mayor declared the motion carried.
The Mayor then read the following letter:

Dear Sir:
We have been endeavoring for some time to
complete the pavement on our Route b8 where it passes
under the .Northwest Highway in your city. We have
been delayed in this work due to the fact that we
have been unable to negotiate for Lhe necessary
right of way on the west side of the Chicago &
Northwestern Railroad.
We have had the property appriased by
an independent appraiser and have made an offer to
the owner, based an this appraisal, to purchase the
property. The offer has been refused, and we are
blocked in proceeding oneccount of the fact that
this department has no legal authority to condemn
inside of the corporation limits.
This method of qcquiring property seems
to be the only one on which we can proceed now.
In view of the fact that the city is the
only agency that has legal authority to condemn
property for highway purposes inside of the cor-
poration, I would be glad to know if it will be
passible for your city to undertake this condemnation
and pay the cost of the property from your Rotor
Fuel Tax Funds.

The motion was made by Alderman Huxmann and seconded
by Frederick to refer the matter of re -paving and widening
Lee_Street from. Perry Street southward to the Soo Line
Railroad tracks, as well as the matter of condemning the
right of way of Route h,58 for the State Highway Department,
to the Streets and Sidewalks Committee and the City Attorney
for investigation and report. The motion was voted upon by
acclamation, whereupon the Mayor declared the motion carried.
REPAIR OF SIDNVALKS t
At the request of Mayor Kinder, the Clerk read a
form of notice used by the City of Park Ridge notifying pro-
perty owners of a plan to repair sidewalks with the aid of
the Illinois Emergency The motion was made by
Frederick and seconded by meinshausen to refer this matter
to Myor Kinder for further investigation and report. The
motion was voted upon by acclamation, whereupon the Mayor
declared the motion carried.
ADJC URNMENT :
The motion was made by Alderman Meinshausen and
seconded by Fulle to adjourn. The motion was voted upon
by acclamation, whereupon the Ma v declared the motion
