12/17/1934446 MINUTES OF THE REGULAR MFETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES HELD IN THE COUNCIL CHAIRS ON THE 17th DAY OF DECEMBER,A .D. 1C34 AT THE HOUR' OF 8:CC P.M. The meeting was celled to order by Mayor George W.Kirider, w ith Aldermen Ahbe, Carroll, Pflughaupt, Fulle, Huxmann, Bishop, Frederick, Neal, Schwanbeck and leinshausen res -ponding to the roll call. The Judiciary and Assessment Committee had no report to offer. The Police and License Committee had no report to offer, although the Clerk reported that Motorcycle Edwin Meyer had received a :6CG.CC settlement from the Associated Indemnity Corporation as a final settlement of his claim for permanent injury caused by fracturing his leg while on duty, May 2Sth,1c34. The Streets and Sidewalks Committee had no report to offer. The Fire Committee through its chairman, Alderman Fulle, reported that the Volunteer Fire Department had its annual meeting on Tuesday, December 11?1C34, at which the following ' officers were elected: President & Chief, Axel Petterson; Assistant Chief, Al. Kuhlman; Secretary, Victor L. -Spiegler; Treasurer, Wallace Kinder. he also submitted the annual report of V.L.Spiegler, secretary of the Volunteer Fire Department which was read by the Clerk. The outstanding item of the report was the loss of 45,83C.CC, which represents a fire loss in the City Limits for the year of 1c334 of only 2.51% of the property involved. The motion was made by Alderman Huxmann and seconded by Frederick to place this - report on file. The motion was voted upon by acclamation, whereupon the Mayor declared the motion carried. The motion was made by Alderman Frederick and seconded by Fulle to instruct the Clerk to write a letter to the Fire Department, expressing the Council's appreciation of the effective work done by the -Department during 1C34, and thanking the Chief-Petterson and the volunteers especially for keeping the fire lows for the year at such a low percentage. The motion*wa s voted upon by acclamation, whereupon the Mayor declared the motion carried. The Seer, Drainage and Sanitation Committee had no report to offer. The Water Committee through its chairman Alderman Bishop presented the following pro p� esu agreement between the Cite arid' the ChicaFo and Northwestern Railroad, which w as read by the Clerk: AGREEMENT THIS AGREEMENT. made and entered into this I day of ,1034, by and between the j CITY OF DES PLAINES,ILLINC'IS (hereinafter called "City" and CHICAGO AND NORTHWESTERN RAILWAY COMPANY (hereinafter called "Railway Company".) W I T NES SETH: 447 WHEREAS, under date of August 15,1925, the parties hereto entered into an agreement whereby the Railway Company permitted the City to take water from the Railway Company's Norma Well, located in the North- east Quarter (NEi) of Section Nineteen (19), Township Forty-one North (41N) , Range Twelve East (12E) , in Cook County, Illinois, whichsaid agreement was modified by a written agreement between t'. -e parties hereto under date of August 15,1926; and WHEREAS, the parties at this time desire to further modify said agreement of August 15,1925, NOW, THEREFORE, it is hereby mutually agreed that, effective November 1,1534, the said agreement of August 15,1925, as modified by said agreement of August 15,1:26, is hereby further modified to provide that for all Water taken by the City from said well the City shall Pay the Railway Company at the rate of Two Cents -per 1,OOC gallons, and for all water primped by the City into the Railway Company's tank the Railway Company shall pay the City at the rate of Six Cents per 1,OCC gallons, the City at its own expense to furnish power for operation of the pumps. In the event the pumps in the Railway Company's well shall at any time fail, the City agrees to furnish water to the Railway CompanY's tank from the City's well until such time as the City shall have repaird the said pumps and shall again supply water from the Railway Company's well. 'Except as hereby modified the said agreement of August 15,1925, as modified by said agreement of August 15,1926, and all the terms and conditions thereof shall be and remain in full force and effect subject to termination as therein provided. IN WITNF'1S WHEREOF the City has caused this agreement to be executed by its Mayor and attested by its Clerk, pursuant to a resolutionadopted by its Common Council en the 17th day of December,1934, and the Railway Company has caused same to be executed by its officers thereunto duly authorized. The Special Committee on Relief reported through its chairman, Alderman Bishop, that the Committee together with Mr. Lawrence Starrett, president and Mr. J.C.Graham, treasurer of the Des Plaines Benefit Association had a. conference with Mr. Jose'oh L.Loss, Director crf the Cook County Bureau of Public Welfare on Friday, December 7,1c34. He reported further that all the coniulaintes submitted by the local unemployed pertaining cu relief matters have been settled to the satisfaction of Mr. Starrett and Mr. Graham, as well as to the satisfaction of the members of the committee. Revising Business<License Ordinances: The Clerk then read the following proposed ordinance for second reading: AN ORDINANCE AMENDING CERTAIN ORDINANCES RELATING TO LICENSES. AMIDING SECTIONS 410,421,470, 480 and 642 of the Municipal Code of 1028. The motion was made by Alderman Huxmann and seconded by Pflughsupt to pass and adopt this proposed ordinance. A motion was then made by Alderman Huxmann and seconded by Frederick to amend this proposed ordinance by adding to Section 480 the following phrase: "nor betreen the hours of 1:00 A.M. and 1:00 P.M, on Sundays". The roll was called on the amendment with the following result,: Ayes; Aldermen Ahbe, Carroll, Pflughaupt, Fulle, Huxmann, Bishop, Frederick, Neal, Schwanbeck and Meinshausen. mays; None. Amending Sections 404 to 400 inclusive and Section 604 of the Municipal Code of 1e28. The motion was made by Alderman Meinshausen and seconded by Frederick to pass and adopt this proposed ordinance. BE IT RESOLVED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF Des Plaines, Cook County, Illinois, that the plat showing- dedication of the proposed S.B.I.Route 60, Plat 1-B, as submitted by the Juur.ty Superintendent of Highways to the Mayor and City Council of the City of Des Plaines, and the same is hereby in all respects approved, and BE IT FURTHER RESOLVED, that a copy of this resolution signed and certified be forthwith for- warded to the County Superintendent of Highways and the Board of Commissioners of Cook County. City Engineer, W.H.Allen, then submitted a plat of survey identified as Chicago Guarantee Survey Company's Order No.,3,41C,007 which is a survey of Wolf Road. M. Allen recommended approval of the same. The motion was made by Alderman Ahbe and seconded by Huxmann to approve this plat and instruct the Mayor and City Clerk to affix their signature of approval thereto in the name of the City. COFF° `A.N COAL YARD: Mr. Q,uillici, representing a group of property owners was then g ranted permission, by general consent of the members of the Council, to address the Council. He pointed out that according to Section 524 of the City Code it is the City's duty to deny the Coffman Coal Yard the right to locate on the triangular plot of ground bounded by Western Avenue, Northwestern Highway and the northern boundary of the S.VJ.quarter of Section 17, because this plot is zoned for commercial Purposes, which according to Section 744 of the City Code automatically includes this said plot in the Fire Limits. Trie motion was made by Alderman 450 Ahbe and seconded by Carroll to instruct the City Clerk to write Mr. Homer Coffman, owner of the Coffman Coal Yards, notifying him that he cannot locate upon the premises in question; and ordering him further to remove such materials as he may have stored upon the premises before January 1,1935. The motion was voted upon by acclamation, whereupon the,Mayor declared the motion carried. APPROVAI OF MINUTES: The motion was made by Alderman Bishop and seconded by Fulle to approve the minutes of the regular Council meeting of December 17,1934 as written. The motion was voted upon by acclamation, whereupon the Mayor declared the motion carried. 451 REQUEST TO FLOOD AREA FOR SEATING: Mr. J.Valsh then addressed the Council requesting that the City flood a slightly depressed area just south of Rand Road and \vest of Lee Street in order to provide safe skating for Des Plaines people. No action was taken regarding Mr. Walsh's request. APPROVAL OF BILLS: Alderman Pflughaupt, chairman of the Finance Committee then submitted the following proposed resolution, of which each member of the Council had been supplied with a copy: RESOLVED THAT THE FOLLOWING_ BILLS ARE DUE AND PAYABLE AND THAT THE MAYOR AND CITY CLERK BE INSTRUCTED TC ISSUE PROPER VOUCHER -WARRANTS IN PAYMENT OF SAME. . He reported further that he would have to check them carefully with the State P.W.A.Engineer, and that no doubt the plans would be filed in time to present the ordinance authorizing the Bond issue at the second Council meeting in January 1935.
