11/19/1934*436 to operVT_ MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES H7T,D IN THE COUNCIL CHAMBERS ON THE 19th DAY OF NOVEMBERIA.D.I934 at 8:00 P.M. um TO ORDER: the meeting was called to order by Mayor George .Kinder with Aldermen Ahbe, Fulle, Huxmann, Bishop, Frederick, Neal, Schwanbeck and Meinshausen responding to the roll call. Alderman Carroll arrived later during the meeting, while Alderman Pflughaupt was absent from the entire meeting. OPENING BIDS FOR WIDENING NORTH T.FF STREET: The Clerk announced that four bids have been received on the widening of Lee Street from the alley north of the Masonic Temple to Perry Street. Mayor Kinder' then asked that anyone else wishing to submit a bid do so at this time. There being no other persons in the room to submit a bid the motion was made by Alderman Bishop and seconded by Frederick to declare the time for receivingbi.d$ bids at hand. The motion was voted upon by acclamation, whereupon the Mayor declared the motion carried. The bids were opened by the Clerk and read as follows, each bid being accompanied by a cashier's check in the proper amount: Johnson & Anderson 0 & W Construction Co E.11.Melahn Const.0o. Kilburn Bros.,Inc. $6,643.35 6,303.35 6,250.42 6,188.00 The motion was made by Alderman .Bishop and seconded by Meinshausen to refer the above bids to W.H.Allen, City Engineer for tabulation and report. The motion was voted upon by acclamation, whereupon the Mayor declared the motion carried. (At this point Alderman Carroll, who had been absent, arrived at the meeting.) Mr. 'm.aensen then delivered to the Clerk an envelope which Mr. Jensen said contained a bid on the Lee Street widening project. The motion was made by Alderman Huxmann and seconded by Neal to instruct the Clerk to open the envelope and read such bid as it may contain. The roll was called on the motion with the following result: Ayes; Aldermen Huxmann, Neal and Meinshausen. Nays; Aldermen Ahbe, Carroll, Fulle, Bishop, Frederick and Schwanbeck. The Mayor thereupon declared the motion defeated and bid was not opened. After some time, W.H.Allen reported that he had tabulated the bids and found that Milburn Bros.,lnc. is the low bidder. He reported further however that Milburn Bros., Inc., had omitted an item of seven (7) inlets from their bid, thus making it irregular. The motion was made by Alder- man Bishop and seconded by Frederick to award the contract for the widening of Lee Street from the alley first north of Miner Street to Perry Street to the 0 & W Construction Company for the sum of(( 6,303.35)Sixty-three hundred three dollars and thirty-five cents, subject to the approval of the Highway Department of the State of Illinois, and that the Mayor and City Clerk be authorized and directed to exe- cute said contract subject to the approval of the said State closed) and 437 Highway Department. The roll was called on the motion with the following result: Ayes; Aldermen Ahbe, Carroll, Fulle, Huxmann, Bishop, Frederick, Meinshausen, Schwanbeck, and Neal. Nays; None. The Mayor thereupon declared the motion carried. The motion was made by Alderman Bishop and seconded by Frederick to instruct the City Clerk to return to Milburn Brothers,inc., their cashier's check in the sump- of Seven Hundred Dollars (3700.00) and get a receipt therefor . The motion was voted upon by acclamation, whereupon the Mayor declared the motion carried. THE JUDICIARY AND ASSESSMENT COMMITTEE had no report to offer. THE POLICE AND LICENSE COMMITTEE through its chairman., Alderman Huxmann, reported that li.A.Becker, Chief of Police, is going on a week's leave without pay, and that during his absence Sergeant Hammerl will be in charge of the Police Department. THE STREETS AND SIDEWALKS COM,M.MITTEE had no report to offer. THE FIRE COMMITTEE had no report to offer. THE SEWER, DRAINAGE AND SANITATION COMMITTEE had no report to offer. THE WATER COMMITTEE through its chairman Alder- man Bishop, reported that the committee met with George W.Kinder, Mayor; W.H. Allen, City i i ineer; J.Albert M. Robinson, Consulting .Engineer; and M.D.Wells, Superinten- dent of Public works, on the afternoon of November 5th. He further reported that Mr. Allen and Mr. Robinson submitted partially completed plans of the Reservoir and Softener project, and promised to have the plans and speci- fications completed so that the P.W.A. State Bngineer will have his plans by about Jovember 26th,1S34 thus making it possible for the Council to consider an ordinance re- garding this pro,ct by December 3, 1934. DESIGNATING BANKS AS DEPOSITORIES: The Clerk informed the Council that the Continental Casualty Company is not satisfied with the form of the resolution adopted by the Council on November 5,1534 designating the First National Bank of Des Plaines and the Northern Trust Company of Chicago as depositories of the city's funds. he read two proposed resolutions suggested by the casualty company. The motion was made by Alderman Huxmann and seconded by Fulle to refer these resolutions to the City Attorney for an opinion. The motion was voted upon by acclamation, where- upon the Mayor declared the motion carried. APPROVAL OF PLAT OF DEDICATION: The Clerk then read the following proposed resolution: RESOLUTI 0 N A RESOLUTION APPROVING PLAT OF Wolf Road BE IT RESOLVED, BY THE MAYOR ATTD CITY COUNCIL OF THE CITY OF Des Plaines, COOK COUNTY, ILLINOIS, that the 438 plat showing dedication of the proposed Wolf Road, Plat 206-C, as submitted by the County Superintendent of Highways to the Mayor and City Council of the City of Des Plaines, and the same is hereby in all respects approved, and BE IT FURTHER RESOLVED, That a copy of this reso- lution signed and certified be forthwith forwarded to the County Superintendent of Highways and the Board of Commissioners of Cook County. MOTOR FUEL TAX ALLOTMENT: The Clerk then read the following communication: STATE OF ILLINOIS Department of Public Works and Buildings Division of Highways ROTOR FUEL TAX ALLOTMENT City Clerk: Your allotment of Motor Fuel Tax for the month of October,1934 is $807.16. ERNST LIEBERMAN Chief Highway Engineer. The communication was ordered placed on file by the Mayor. APPROVAL OF MINUTES: The motion was made by Alderman Meinshausen and seconded by Fulle that the minutes of the regular Council Meeting of November 5th,1c34 and the minutes of the special Council meeting of November 13,1934 be approved as written. The motion was voted upon by accla- mation, whereupon the Mayor declared the motion carried and the minutes approved. RELIEF: Mr.Lawrence Starrett of the Des Plaines Benefit Association thenaddressed the Council asking the Council to take action to remedy certain alleged irregularities in the distribution of relief and submitted the following communication whichvsas read by the Clerk: DES PLAINES BENEFIT ASSOCIATION A resolution passed by the "'Des Plaine _benefit Association" Friday November 16th,1c34. To the Mayor and City Council of the City of Des Plaines: To the Mayor and City C 439 Whereas, The "Des Plaines Benefit Association* through complaints of its members have discovered discrepencies between the budget allowances of relief clients and amounts charged by the I.F.E.R. in this district. This difference being between the amounts of the wholesale and retail prices of ration box and coal, Whereas, There bd.ng a difference between wholesale and retail prices approximately 3570 we believe this differ- ence of amount should be given the relief client, Whereas, the amounts received on work relief or direct relief as disclosed by complaints of the relief clients are less than Budget amounts shown on the record card of case worker. Whereas, We believe the members of this organization and other families on relief have been unjustly and unfairly treated by case workers in their duties of administering to the needs of the relief clients, as provided for by the I.F.E.R. Whereas, the burden of relief rests upon the tax payer, and business men of this city, Be it Resolved, that the full amount of budget be given the Relief client, and the client be given the full benefit of all monies saved through the purchase of commodities at wholesale prices and not be charged re- tail. SIDEWALK .APRONS ALONG WOLF ROAD: The motion was made by Alderman Frederick and seconded by Neal to instruct the Clerk to write the County Superintendent of Highways asking that proper aprons be provided at the crossings of Wolf Road at Thacker Street, Prairie Avenue and Greenview Avenue, a.slo that the curbing at these inter- sections be properly replaced. The motion was voted upon by acclamation, whereupon the Mayor declared the motion carried. APPROVAL OF BILLS: The Clerk then read the following proposed resolution: RESOLVED THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THAT THE MAYOR AND CITY CLERK BE INSTRUCTED TO ISSUE PROPER VOUCH:`R WARRANTS IN PAYMENT T O F SAME. SAID WARRANTS TO BE RELEASED UPON ORDER OF THE FINANCE COMMITTEE WHEN FUNDS ARE AVAILABLE. The motion was then made by Alderman Ahbe and seconded by Carroll to amend the motion so as to strike from the proposed resolution the invoice of the Police Department in the sum of 432.50. The roll was called on the amendment with the following result: Ayes; Aldermen Ahbe, Carroll, Fulle, and Schwanbeck. Nays; Aldermen Huxmann, Bishop, Frederick, £deal and iileinshausen. The Mayor thereupon declared the amendment defeated. The roll was then called on the main motion in its original form with the following result; Ayes; Aldermen Ahbe, Carroll, Fulle, Huxmann, Bishop, Frederick, Neal, Schwanbeck and Meinshausen. The Mayor thereupon declared the motion carried, and the resolution adopted. STATE OCCUPATIONAL TAX ON WATER SALES: The motion was made by Alderman Bishop and seconded by jreuerick to instruct the Clerk to compute the amount due the State for the "2% Occupa- tional Tax* on Water Sales in case this tax is upheld by the courts, and to further instruct the Clerk and the Treasurer to hold in reserve a sum sufficient to at all times satisfy said 2% Occupational State Tax until further orders from the Council. The motion was voted upon by aclamation, whereupon the Mayor declared the motion carried. ADJOURNMENT: The motion was made by Alderman Fulle and seconded by Frederick to adjourn.
