limiting parking in front of the Prince Ice Cream Castle.

summoned to appear at the next regular meeting of the Council.

The meeting was called to order by Mayor George
',.Kinder, with Aldermen Ahbe, Pflughaupt, Fulle, Bishop,
Frederick, Neal and Schwanbeck responding to the roll call.
Aldermen Carroll, Huxmann and Meinshausen arrived shortly
after the roll call.

The Judiciary and Assessment Committee had no report
to offer.
The Police and License Committee: Alderman Huxmann,
Chairman of the committee reported that Motorcycle officer,
Edwin Leyer is convalescing nicely.
Alderman Huxmann, chairman of the Police -and. License
Committee further reported that the committee recommends that Desk
Sergeants B.C.Foote and John Grindley continue serving 12 hours
per day at the rate of X125.00 per month, up to and including
July 31,1934. The motion was made by Alderman Huxmann and
seconded by Meinshausen that the Police Committee's recommendation
be concurred in. The roll was called on the motion with the
following result: Ayes; Aldermen Carroll, xflughaupt°, Huxmann,
Bishop, Frederick, Schwanbeck and Meinshausen. Nays; Aldermen
Ahbe, Tulle, and meal. The Mayor thereupon declared the motion
carried and the recommendation concurred in.
The motion was then made by Alderman Huxmann and
seconded by Frederick to add to to -night's resolution appro-
ving bilis and salaries the amount of X17.50 for B.C.Foote,
and $17.50 for John Grindley for back salary earned during
the first half of June,1034 but which was disallowed in
the meeting held June 18,1034. The roll was called on the
motion with the following result: Ayes; Aldermen Carroll,
Pflughaupt, Huxrriann,Bishop, Frederick, Schwanbeck andeins-
hause.n. Nays; Aldermen Ahbe, Fulle, and. Neal. .... The

The Streets and Sidewalks Committee had no report

The Committee on Public Yorks, Buildings and Plats
had no report to offer.
The Fire Committee had no report to offer.
The Sewer, Drainage and Sanitation Committee had
no report to offer.
The Water Committee through its chairman, Alderman
Bishop reported that the I1 inois Municipal League has offered
to defend the City in court against the State Finance Depart-
ment in the 2% Water Revenue Tax matter for the sum of -10;'
of last year's tax would have amounted to(which would have
been about V85.00). The motion was made by Alderman Huxmann
and seconded by Frederick to refer this matter to City Attorney
Meyer for investigation and report. The motion was voted upon
by acclamation, whereupon the Mayor declared the motion carried.

The 'WATER COMMITTEE recommends that the City Clerk
be instructed to communicate with Wm.Cater in response

Gentlemen:
In accordance with your request for an opinion
on the right of the City of Des Plaines to enforce payment
of the 2% foreign insurance tax, I wish to advise that the
statute very clearly gives the City the right to sue not
only the insurance company but the agent who writes the
insurance in the City. The statute and the City Ordinance
passed under the statute requires the agent to furnish
the city clerk with a sworn account of all insurance
written and that the report shall specify the amounts
received for fire insurance. Under the statute and city
.ordinance these sworn reports should be .filed with the
City Clerk on or before July 16th. If a report were not
filed within the specified time, the City has the right
to mandamus the agent or the insurance company or both
to file such a report. I wish to draw to your attention
also that the statute provides that the agent shall pay
the treasurer at the time of rendering the report the
amount of the rate fixed by the ordinance.
I have one suggestion to make, however, and
that is in respect to the ordinance creating the fire de-
partment. The statute with regard to foreign insurance
provides that the city council shall pass an ordinance
creating the fire department and provide by the ordinance
for the election of the officers of the fire department
by the fire department, one of which must be the treasurer,
and the treasurer must give a bond payable to the city.
The present ordinance has no rpovision in it
for the election of officers of the fire department and
has no provision for the treasurer of the fire department
giving a bond. Accordingly I am. submitting with this
opinion an amendment to the City Code affecting the fire
department.

Be it ordained by the City Council of the
City of Des Plaines, Cook County, Illinois.
SECTION 1. That Section 122 of Article.2
entitled "hire Department" of Charter 4 of the Iviunicipal
Code of the City of Des Plaines of 1928, be and the same
is hereby amended to read as follows:
"SECTION 122. CREATION OF FIRE DEPART1; T -
There is hereby created a fire department of
the City of Des Plaines which shall consist of
a fire marshal, an assistant Fire Marshal,
secretary, treasurer and such fire engine men,
hose men, hook and ladder men, ax and saw men
as may from time to time be provided by the
mayor and city council; and when so approved
of they shall be enrolled as members of the
Fire Department by the Secretary of the Fire
Department, in a book to be kept for that pur-
pose.
"The said Fire0Department is hereby empowered
and authorized to elect a treasurer and such
other officers as may be deemed necessary to
the department. The said treasurer is auth-
orized to receive the "foreign fire insurance
license fees" and such other sums properly
payable to the treasurer of the Fire Depart:rent.
"The treasurer of the Fire Department shall give
a sufficient bond, payable to the City of Des
Plaines, to be approved by the mayor and the
City Council, conditioned for the faithful per-
formance of his duties as treasurer of the Fire
Department."
SECIION 2. All Ordinances and parts of Ordi-
nances conflicting. with the provisions of this Ordinance
are hereby repealed so far as they conflict herewith.
SECTIOI; 3. This Ordinance shall be in force
and effect from and after its passage and approval.

WHEREAS, by reason of the general taxes levied
by this City for the year 1934, not having yet been
collected, and by reason of previous years' taxes not
having been fully collected by this City, there is not
sufficient money in the treasury of this City to meet
and defray the ordinary and necessaryexpenses thereof.
THEREFORE, BE IT RESOLVED by the City Council
of the City of Des Plaines, that this City issue tax
anticipation warrants, payable out of taxes, when collect-
ed, heretofore levied by said City for general corporate
purposes for the year 1934, and that said warrants,
after being executed by the Mayor, City Clerk, as required
by law, be sold at par or delivered- to such employees
and officials to whom this City may be indebted, as
may. be willing to accept same in payment of salaries.
BE IT FURTHER RESOLVED that such w arrants shall
not be issued in excess of seventy-five percent .75%)
of the taxes levied for general corporate purposes for
the year 134; said. warrants shall bear interest not
exceeding: six per cent (65) per annum from their date
until paid, or until notice shall be given by publi-
cation, as provided by law, that money for their pay-
ment is available and that they will be paid on pres-
entation; said *warrants shall shot upon their face that
they are payable solely from such taxes when collected,
and shall be received by any collector of taxes in
payment of the tax against which they are issued.
BE IT FURTHER RESOLVED that said warrants
shall be payable in the order of their issuance, when

such taxes have been collected and received by the City
Treasurer of this City.

ence to men "working off" water bills by labour on
the streets.
Cases were mentioned at our meeting of
men being employed who had members of their families
employed, others having other sources of income.
Again some seem to have a perpetual bill as they are
constantly employed.
'e consider it most unjust to allow this
condition of affairs, and that those whose careless-
ness and indifference are responsible for this state
of affairs should be censured and if not competent
should be replaced by others, who will see that the
public's money is not wasted and that a fair return
in labour is returned for every dollar spent.

LeRoy Stockdale, Secretary of the Cook-DuPage County Bee -
Keepers Ass'n., Palos Park, Illinois protesting; to the
promiscuous mowing of weeds at the roadsides. This proposed
resolution was also referred to the Sever,Drainage and Sani-
tation Committee by the Mayor.
The motion was made by Alderman Ahbe and seconded
by Meinshausen to authorize the Clerk to publish the 1934
Tax Levy Ordinance, as adopted at the Council eeting of
June 18,1934. The motion was voted upon by acclamation,
whereupon theriayor declared the motion carried.
The motion was made by Alderman Frederick and
seconded by t'flughaupt to instruct the City Clerk to pub-
lish the 19',34 Tax Levy in the Des Plaines Suburban Times.
The motion was voted upon by acclamation, whereupon the
Mayor declared the motion carried.
Alderman Bishop, chairman of the Vater Committee,
reported that the power has been disconnected from the
Riverside Pumping Station, and that this will result in a
considerable saving to the Water Department.

by'leinshausen to instruct the City Clerk to issue an order
to the Public Service Company of lyorthern Illinois instruct-
ing it to move the light on River Street from its present
location to the extreme East end of River Street. The motion
