CITY COUNCIL OF THE CITY OF DES PLAINES
HELD IN THE COUNCIL CHAMBERS ON THE 4th
DAY OF JUNE,A.D.1934 AT THE HOUR OF 8:OC P.M.
The meeting was called to order by Mayor George
W.Kinder , with Aldermen Ahbe, Carroll, Pflughaupt, Fulle,
Bishop, Frederick, Neal, Schwanbeck and 1"einshausen res-
ponding to the roll call. Alderman Huxmann arrived shortly
after the roll call.
The Clerk then submitted the following reports:

Alderman Neal, chairman of the Judiciary Committee
then submitted the following report:
Matter referred to the Judiciary Committee: The
surety bonds of George W.Kinder, Mayor and City
Attorney,henneth G.''`eyer (bonds No.73858 and 73859
respectively.)
The Judiciary Committee has investigated the
above and found that the above bonds are in proper
form and therefore recommend that same be approved
by the Council.

The motion was made by Alderman Neal, and seconded by
Meinshausen to concur in this report. The motion was
voted upon by acclamation, whereupon the Mayor declared
the motion unanimously carried and the bonds approved.
Alderman Neal, chairman of the Judiciary Committee
then submitted the following report:
Matter referred to the judiciary Committee: The
ordinance and agreement seeking to employ W.H.Allen
as City Engineer.
The Judiciary Committee has investigated and has
found that the ordinance and contract appear to be
similar to that heretofore in force, with respect
to the City Engineer for the year endingay Ist,1934.
We therefore recommend that if W.H.Allen be appointed
City Engineer and the ordinance and contract be approved
by the city attorney, the ordinance be passed and the
Mayor and City Clerk be authorized to execute the
contract.

BE IT ORDAINED by the Mayor and City Council of the
City of Des Plaines, Cook County, Illinois;
SECTION 1: That W.H.Allen be and he is hereby employed
and retained as engineer for the City of Des Plaines under
and subject to the conditions of a contract, copy of which
is hereto attached and made a part of this ordinance.

SECTION 2: That the Mayor and City Clerk of
.the City of Des Plaines be and they are hereby authorized
and empowered to execute contract to the said V.H.
Allen, copy of which is hereto attached.
SeCTION 3: That all ordinances or parts of
ordinances in conflict herewith, be, and the same are
hereby repealed.
SECTION 4: That this ordinance shall be in full -
force and effeot from and after its passage and the
approval according to law.

The motion was made by Alderman Frederick and seconded
by Meinshausen to put this proposed ordinance on passage.
The roll was called on the motion with the following re-
sult: Ayes; Alderman Ahbe, Carroll, Pflughaupt, Fulle,
Huxmann, Bishop, Frederick, Neal, Schwanbeck and Meins-
hausen. Nays; None. The Mayor therefore declared the
motion carried and the ordinance ready for passage. The
motion was made by Alderman r'rederick and seconded by.
Meinshausen that this ordinance be passed. The roll
was called on the motion with the following result:
Ayes; Aldermen Ahbe, Carroll, Pflughaupt, Fulle, Huxmann,
Bishop, Frederick, Neal, Schwanbeck and Meinshausen.
I4ays;; None. The Mayor thereupon declared the motion un-
animously carried, and the ordinance passed.
Alderman Huxmann, chairman of the Police Com-
mittee on the limiting of parking in front of the Prince
Ice Cream Castle on Lee Street. The motion was made by
Alderman Huxmann and seconded by Meinshausen to provide
the proper signs and try out a 30 -minute parking limit
for this region for thirty days. The motion was voted
upon by acclamation, whereupon the Mayor declared the
motion carried.
Alderman Frederick, chairman of the Streets
Committee reported on the need of stop lights on Miner
Street. The motion was made by Alderman Ahbe and seconded
by Frederick to permit the State Highway Department to
install the "flasher'r type stop signs along Mirer Street
as suggested namely;
1. 0n northwest corner of Pearson and Miner Street
stopping southbound traffic on Pearson St. at Miner St.
2. On northwest corner of Lee and Miner Streets stopping
southbound traffic on Lee Street at Miner Street.
'3. On northeast corner of Finer and Lee Streets, stop-
ping westbound traffic on Miner Street at Lee Street.
4. On southwest corner of Miner and Lee Streets, stop-
ping eastbound traffic on Miner Street at Lee St.
The motion was voted upon by acclamation, whereupon the
Mayor declared the motion unanimously carried.
The motion was made by Alderman Ahbe and seconded
by Frederick to request the State Highway Police to assist
the City in directing traffic on Miner Street at its inter-
sections with Des Plaines Avenue, Pearson Street and Lee
Street, during the summer months,eepecially during the
Arlington Park racing season. The motion was voted upon by
acclamation, whereupon the Mayor declared the motion/carried
unanimously.
The committee on Public Works, Buildings and Plats
had no report to offer.
Alderman Meinshausen, chairman of the Sewer, Drain-
age and Sanitation Committee submitted the following proposed
resolution, which was made by the Clerk:
RES O LUT I O N
WHEREAS, owing to lack of rain, the Des Plaines
River within the "ity of Des Plaines has become extremely
stagnated and foul odors from said river are causing
great discomfort to residents of this city, and
WHEREAS , it has come to the attention of this
Council that water of the Des Plaines River is being
impounded at Dam No. 2 for the pleasure of persons visit-
ing the Forest Preserve at Dam 1No.2, and
WHEREAS it has also come to the attention of the
Council that Dam No. 4 has never been repaired so that a
more substantial volume of water can be maintained in the
vicinity of Des Plaines and thus minimize foul odors.
THEREFORE BE IT RESOLVED by the City Council of
the City of Des Plaines that the Forest Preserve District
of Cook County be requested to take such action immediately
with respect to Dam No. 2 and Dam No. 4, as will most
quickly and efficiently alleviate the distressing conditions
now prevailing in the Des Plaines River.
BE IT FURTHER RESOLVED that the disgraceful con-
dition of said river be brought to the attention of the
Sanitary District of Cook County and the Division of Water-
ways of the State of Illinois.
BE IT FURTHER RESOLVED THAT a copy of this reso-
lution be forthwith forwarded to the Forest Preserve Dis-
trict of Cook County, the Sanitary District of Cook County
and the Division of Waterways of the State of Illinois.

The motion was made by Alderman Frederick and seconded by
Meinshausen to adopt this proposed resolution. The roll was
called on the motion with the following result: Ayes; Alder-
men Ahbe, Collet, Pflughaupt, Fulle, H uyanann, Bishop, Frederick,
Neal, Schwanbeck and Meinshausen. Nays; bone. The Mayor there-
upon declared the motion unanimously carried and the resolution
adopted.
Alderman Ijishop, chairman of the Water Committee,
reported that the City has delivered 5,300,OCC more gallons
of water for the year just past than for the previous year.
The motion was made by Alderman Meinshausen and
seconded by rflughaupt, to approve the minutes of the regular
Council Meeting held May 21,1934 as written. the motion was

voted upon by acclamation, whereupon the Mayor declared the
motion unanimously carried and the minutes approved.
Alderman Pflughaupt, chairman of the Finance Com-
mittee then submitted the following resolution of which_the
Mayor and each Alderman had been supplied a copy:

The motion was made by Alderman Pflughaupt and seconded
by 1einshausen to adopt this proposed resolution. The
roll was called on the motion, with the following result:
_Ayes; Aldermen Ahbe, Carroll, Pflughaupt, 1"ulle, Huxmann,
Bishop, Frederick, l+eal, ,Schwanbeck and Iveinshaus.en. Nays;
None. The Mayor thereupon declared the motion unanimously
carried and the resolution adopted.
Alderman huxmann, chairman of the Police and License
Committee then reported the request of a lir. Riess who wishes
to operate several "Good riumor" vending trucks in Des Plaines.
Inasmuch as his trucks will be stationary at Manheim and Touhy
Avenue, atanheim and Des Plaines Avenue, and at Oakton and
Meinheim Road, and because this does not constitute peddling
and because there is no other licensing rate which would speci-
fically apply, Mr. Riess has agreed to pay a 'p25.00 license fee
per truck, or a total of ° 75.CO. The motion was made by Alderman
Huxmann, and seconded by kflughaupt to grant Mr. Riess a license
for each of three "Good humor" trucks as described for a total
of $75.0C. The roll was called on the motion with the following
result: Ayes; Aldermen nhbe,Carfo11, Pflughaupt, Tulle, Huxmann,
Bishop, Frederick, Neal, achwanbeck and Meinshausen. Days;
None. The Mayor thereupon declared the motion carried and the
license granted.
Referring to a resolution pertaining to the unsanitary
condition of the Des Plaines River adopted earlier during this
meeting:, Alderman Huxmann suggested that the City of Des Plaines
withdraw from the Sanitary District of Chicago. The motion was
therefore made by Alderman Huxmann and seconded by Ahbe to
instruct the City Attorney to investigate the matter and advise
the Council how, and under what conditions the City can with-
draw from the Sanitary District of Chicago. The motion was voted
upon by acclamation, whereupon the Mayor declared the motion
carried. Mayor hinder then addressed a word of caution to the
Council regarding this matter, cautioning each and every Alder-
man to weigh the matter carefully, and to take into consideration
the ultimate results to which such withdrawal may lead.

home for childred at Lake Bluee, Illinois is the only organi-
!ation who have taggers in Des Plaines.

STATE OF ILLINOIS
WHEREAS, the undersigned dealers in retail beverages
have certain grievances which can or may be remedied by
the action of the above City Council, therefore we peti-
tion you herewith:
WHEREAS, the outlying Taverns just outside the City limits
of the City of Des Plaines, may keep open until the' -closing
hour of Two o'clock on Saturday nights, and
WHEREAS, it is necessary for us to close our places of
business at the hour of One O'Clock on Saturday nights
under our present City Ordinance, we respectfully petition
that this Council will revise the ordinance in Des Plaines
governing said closing hour, so that the citizens of this
City, paying license fees to this City, may be on an equal
footing with outside competition insofar as the closing
hour on Saturday nights is concerned.
THEREFORE, we respectfully ask that the ordinance now in
force be changed and that the Saturday closing hour be
changed to some hour between Two O'clock and 3 O'Clock
on Saturday nights.

Schwanbeck to instruct the City Attorney to draft an
ordinance seeking to amend the present liquor ordinance
by changing the closing time from 1:00 A.14. to 2:00 A.M.
on Sunday mornings (Saturday nights." The motion was
voted upon by acclamation, whereupon the Mayor declared
the motion carried.

WHEREAS, the City of Des Plaines is made a defend-
ant in the following cases, to -wit:
Bankers Life Insurance Co., Vs City of Des Plaines,
Superior Court No. 574905
Carleton D.Beh, Trustee, Vs. City of Des Plaines,
Superior Court No.574SC4
Equitable Life Insurance Co. Vs City of Des Plaines,
United States District Court No.13461 and
WHEREAS in said suits it is sought to obtain a
judgment against the City by reason of certain alleged
diversions of Special Assessment funds, alleged to have
been made by MARTIN H.BEHRENS, Ex -City Treasurer, and
WHEREAS the AETNA CASUALTY & SURETY COMPANY, a
corporation, is surety on the official bond of said
MARTIN H.BEHRENS, and it is the opinion of this council
that official notice from. this City should be given to
the AETNA CASUALTY & SURETY COMPANY of said pending
actions;
THEREFORE, BE IT RESOLVED by the City Council of
the CITY OF DES PL&INES, that the City Clerk forthwith
notify the local agent of said surety company, by personal
service of said pending suits, and by letter to the
Homeoffice of said surety company informing said Surety
Company to take whatever steps it deems advisable to pro-
tect their interests in the matter.
The motion was made by Alderman Huxmann and seconded by
Bishop to adopt this resolution. The roll was called on
the motion with. the following result: Ayes; Aldermen Ahbe,
Carroll, Pflughaupt, Pulle, Huxmann, Bishop, Frederick, Neal,
Schwanbeck and keinshausen. Nays; None. The Mayor thereupon
declared the motion carried and the resolution adopted.
The motion was made by Alderman Pflnghaupt, chairman
of the r'inance Committee that the City Treasurer be instructed
to engage Mr.Feldnann on a basis of a 2% (two percent) fee
for collecting some *2,000.00 of Special Assessment moneys
which are reported as being in the hands of the County
Clerk. The roll was called on the motion with the following
result: Ayes; Aldermen Ahbe, Carroll, Pflughaupt, r'ulle,
Huxmann, Bishop, Frederick, Neal, Schwanbeck and Meinshausen.
Nays; None. The Mayor thereupon declared the motion carried.
Alderman Huxmann, chairman of the Police Committee
then r eported that Motorcycle Officer Edwin Meyer, was seri-
ously injured when he collided with Mr.Lee R.Hoster's auto-
mobile on Tuesday, May 29, 1934. He.reported Officer Meyer's
leg broken above the knee, and said he is being cared for
at the Des Plaines Emergency Hospital.
The clerk then read the following proposed reso-

CDITY OF DES PLAINES )
duly passed a�subsequentlyydulyGapp5 roved,here waas
certain ordinance authorizing the construction,
operation and maintenance of a gas distributing
system in the street's, alleys and public places of
this Municipality, on this date a "City* but on the
date of passage of ordinance a "Village', which ordinance
duly accepted by the grantee thereof and the rights
of such grantee are now owned and held by Public
Service Company of Aorthern Illinois; and
WHEREAS, under the terms of Section 6
of said ordinance there has heretofore been filed
with the Clerk of this Municipality a bond dated
January 12,19C5 with the surety of National Surety
Company for the performance of the obligations of
the grantee under said ordinance; and
WHEREAS, said National Surety Company
has recently been dissolved and said bond in its
present form is no longer of value; and
WHEREAS, said Public Service Company of
Northern Illinois now desires to substitute for
said bond, and has presented to this Munisipality
for acceptance, a nev; bond with corporate surety
as hereinafter stated, and this Municipality is
willing to accept said new bond in lieu of the
bonds or bond heretofore filed:
NOW, THEREFORE, BE IT RESOLVED by the
Mayor and City Council of the City of Des Plaines,
that this Municipality does hereby accept that
certain bond No.26769-12-125-34 dated January 25,
1934 executed by said Public Service Company of
Northern Illinois, as principal, and United States
Fidelity and Guaranty Company, as surety, as and
for the bond to be filed under the provisions of
the min= ordinance above mentioned in lieu of the
bond heretofore filed under said ordinance; and
from and after the date of this acceptance any
and every such previous bond or bonds shall be
and the same is or are hereby held, deemed and de-
clared to be null, void and of no effect; and
RESOLVED FURTHER, that the Clerk of this
Municipality be and he is authorized and directed
to redeive and place on file such new bond and to
deliver up for cancellation any and every such
previous bond in so far as any such previous bond
may now be in his possession or in the possession
of this Municipality.

The meeting was called to order by mayor George
l .Kinder, with Aldermen Ahbe, Carroll, rflughaupt, Fulle,
Huxmann, Bishop, Frederick, Neal, Schwanbeck and Meinshausen
responding to the roll call.
'ihe Judiciary and Assessment committee had no
report to offer.
The Police Committee -Alderman Huxmann, chairman
of the Police Committee reported that £otorcycle Officer
Edwin Meyer, who recently broke his leg while on duty, is
improving as well as can be expected.
He further reported that the Des Plaines Lion's
Club is devoting its regular meeting of June 19,1c34 to the
discussion of civil service for City employees and invites the
members of the Council to attend. 1n order to reserve the
proper number of plates the roll was called and the Mayor,
Clerk,City Attorney and all aldermen signified their inten-
tion to be present.

The Committee on Public Works, Buildings and Plats
had no report to offer.
The Sewer, Drainage and Sanitation Committee had
no report to offer.
The Committee on Water and Water Mains- Alderman
i3ishop, chairman of the later Committee, reported that water
samples from three or four wells in Riverview have been
analyzed by the State Health Department. Reports from the
State Health Department show all of these wells to be contam-
inated, and owners are advised against using water from these
private wells.
