The meeting was called to order by Mayor -George
W.Kinder, with Aldermen Ahbe, Collet, Dean, Huxmann, Bishop,
Friott and Frederick responding to the roll call. Aldermen
Pfiughaupt and Meinshausen arrived shortly after the roll
call.
Alderman Frederick, chairman of the Fire Committee
reported that the Fire Department is badly in need of 3C0
(three hundred) feet of chemical hose, which he stated would
cost about 35 (thirty-five) cents per foot. The motion was
made by Alderman Huxmann and seconded by Friott to authorize
the Fire Committee to get bids and ;ur.chase not to exceed
three hundred feet of chemical hose. The roll was called
on the motion with the following result: Ayes; Aldermen
Collet, Pflughaupt, Dean, Huxmann, Bishop, Friott, Frederick,
and Meinshausen. Nays; None. The Mayor thereupon declared
the motion carried.
The motion was made by Alderman Huxmann and
seconded by Collet that the Council adjourn until 8:CC P.M.
Monday April 23, 15'34. The motionv. as voted upon by accla-

The meeting was called to order by Mayor George
W.Kinder, with Aldermen Ahbe, Collet, Pflughaupt, Dean,
Huxmann, Bishop, Friott, Frederick and Meinshausen respond-
ing to the roll call. Alderman Enzenbacher arrived later
during the meeting.
The Judiciary and Assessment Committee had no
report to offer.
The Police and License Committee had no report
to offer.
Alderman Collet, chairman of the Streets and Side-
walks Committee complained that several store awnings are
too low, and asked that action be taken to raise them so as
to permit pedestrians to use the sidewalks on business streets
without interference from these awnings. The Mayor referred
this complaint to the Police Committee.
Alderman Ahbe, chairman of the Public -zuildings and
Plats Committee asked the Council's opinion on the possibility
of completing the Sewer Atlas and giving the two men doing
thework $160.00 worth of 1933 Tax Warrants therefor. A dis-
cussion seemed to indicate that no further 1933 Tax Warrants
should be issued. The Mayor thereupon recommitted the matter
to the Committee on Public Works, Buildings, and Plats for
further investigation and report.
Alderman lteinshausen, chairman of the Sewer, Drainage
and Sanitation Committee reported that the "clean-up Week"
is in progress and that it may become necessary to hire an
additional truck to complete the work within one week.
The Water Committee had no report to offer.
The Clerk then read the following proposed resolution:

The motion was made by Alderman Huxmann and seconded by
Ahbe to refer this proposed resolution to the Finance Com-
mittee for study and report. The motion was voted upon by
acclamation, whereupon the Mayor declared the motion carried.
The resolution was promptly handed to the Finance Committee
and after some study Alderman Pflughaupt, chairman of the
Finance Committee re -submitted the foregoing proposed reso-
lution and made the motion, which was seconded by Huxmann
to adopt this proposed resolution. The roll was called on the
motion with the following result: Ayes; Aldermen Ahbe, Collet,
Pflughaupt, Dean, Huxmann, Bishop, Friott, Frederick and Meins-
hausen. Days; None. The Mayor thereupon declared the motion

the municipality of Des Plaines is engaged in the
business of selling or furnishing water, gas or
electricity to consumers. We advise that under
Special Rule No.27 issued by this department, copy
of which is herewith enclosed, water gas or electrical
energy is deemed to be tangible personal property and
sellers at retail thereof are liable for the payment
of Retailers -Occupation Tax at the rate of two per
cent of their gross receipts from sales.
A review of our records does not disclose that
any Return or Returns have been f iled by the munictal-
ity of Des Plaines under this law.
Will you kindly communicate with the Department
without delay indicating whether these facts are as
stated, and if so, your reason or reasons for not
having filed Returns and made the payments of tax re-
quired by law.

SPECIAL RULE NO.27
SALE OF ELECTRICITY, GAS AND WATER
Persons engaged in the business of providing
electricity, gas and water to persons for use or
consumption are deemed to be making sales of tangible
personal property at retell the gross receipts from
which are within the Illinois Retailers' Occupation
Tax Act. The word "persons" includes corporations,
public as well as private, who are engaged in this
business. These substances fall within that class
referred to in Article No. 15 of the Rules and Regul-
ations issued by the Department of Finance pursuant
to the Act, which may be taken out of the ground and
reduced to possession and conveyed by pipe lines,
conduits, or other means, measured and sold, and whidh
may be produced mechanically, chemically or otherwise,
or so conveyed and sold.
The motion was made by Alderman Huxmann and seconded by Meins-
hausen to refer this letter to the Fater Committee and the
City Attorney for study and report. The motion was voted
upon by acclamation, whereupon the Ilayor.delcared the motion

Mayor and City Council
Gentlemen:
I am instructed by the above organization to
write with regard to the condition of the property
along the Soo Line Railway between Thacker St. &
Prairie Ave. The particular piece complained about
is that which is used by Rees and Sons to a storage
yard. This yard is and always has been a most un-
sightly mess, full of thistles, ragweed and every
other weed growing, plus piles of old tiles, lumber
etc. This is by no means the only unsightly piece
of property on the West Side for practically every
vacant lot is nothing but a mass of weeds "and all
over the city as well".
There is no reason why this condition should
exist. A little intelligent planning on the part
of the City Council and a little faithful service
and cooperation by city employees and relief workers
who could be obtained would clean out these "eye sores"
not only on the "West Side" but all over the City.
A systematic culling of these vacant lots would
not only help to beatify the town but would be a
boon to those who suffer from that distressing ailment
(hay fever) .

STATE OF ILLINOIS
COUNTY OF COOK SS.
DES PLAINES
WHEREAS, on January 3,1905 there was duly passed

and subsequently duly approved, a. certain ordinance
authorizing the construction, operation and maintenance
of a gas distributing system in the streets, alleys
and public places of this Municipality, on this date
a "City“ but on the date of passage of ordinance a
"Village", which ordinance was duly accepted by the
grantee thereof and the rights of such grantee are now
owned and held by rublic Service Company of Northern
Illinois; and
WHEREAS, under the terms of Section 6 of said
ordinance there has heretofore been filed with the
Clerk of this Municipality a bond dated January 12,
1905 with the surety of relational Surety Company for
the performance of the obligations of the grantee
under said ordinance; and
WHEREAS, said National Surety Company has recently
been dissolved and said bond in its present form is
no longer of value; and
WHEREAS, s aid Public Service Company of Northern
Illinois now desires to substitute for said bond, and
has presented to this Municipality for acceptance, a
new bond with corporate surety as hereinafter stated,
and this Municipality is willing to accept said new
bond in lieu of the bond or bonds heretofore filed:
NOW, THEREFORE, BE IT RESOLVED by the Mayor and
City Council of the City of Des Plaines, that this
Municipality does hereby accept that certain bond
No.26769-12-125-34 dated January 25,1934, executed
by said Public Service Company of Northern Illinois,
as principal, and United States Fidelity and Livaranty
Company, as surety, as and for the bond to be filed
under the provisions of the ordinance above mentioned
in lieu of the bond hereto fore filed under said
ordinance; and from and after the date of this accept-
ance any and every such previous bond or bonds shall
be and the same is or are hereby held, deemed and
declared to be null, void and of no effect; and
RESOLVED FURTHER, that the Clerk of this Munici-
pality be and he is authorized and directed to receive
and place on file such new bond and to deliver up for
cancellation any and every such previous bond in so
far as any such previous bond may now be in his poss-
ession or in the possession of this launictality.

cipality may proceed with the ward of contract, the
cost of such Right of gay may be advanced to the
Municipality.
It is, of course understood that the price at
which the Municipality acquires such Right of Way
must be just and reasonable and subject to the appro-
val of this Department.

The motion was made by Alderman Ahbe and seconded
by Meinshausen to approve the minutes of the regular Council
meeting of April 2,1934 as written. The motion was voted upon

Alderman Collet called the Council's attention to
the fact that many cars parked on a lot on Center Street
just south of the auilici Building are as a rule driven over
the walk and curb. He asked that this be stopped. He further
reported a car parked every night, all through the night at
Arlington and Prairie Avenues.
Alderman Pflughaupt, chairman of the Finance Com-
mittee then submitted the following proposed resolution, a
copy of which had been supplied to the Mayor and each Alder-
man:

in behalf of the local post of the American Legion.

Alderman Huxmann, chairman of the Police and License
Committee reported that while increased patrolling by the
police squad car has somewhat increased the total gasoline con-
sumption, yet the increase is less than would ordinarily, be
expected.
Alderman Euxmann, chairman of the Police Committee,
further reported that the police have been instructed to order
all such as have awnings lower than 7 (seven) feet to raise
them to at least 7 (seven) feet above the walk level.
