CITY COUNCIL OF THE CITY OF DES PLAINES
HELD IN THE COUNCIL CHAMBERS ON THE 2nd
DAY OF APRIL,A.D:1534 AT THE HOUR OF
8:00 P.M.
The meeting was called to order by Mayor George
Y.Kinder with Aldermen Ahbe, Collet, Pflughaupt, Dean,
Huxmann, Bishop, Friott, Frederick and Meinshausen responding
to the roll call. Alderman Enzenbacher arrived shortly after
the roll call.
The Clerk then submitted the following reports:
I.The report of H.A.Becker,Chief of r'olice for the calendar
month of March,1934.
2.The report of E. J.Friedrich,City Clerk, for the calendar
month of March,Ie34.
3.The report of C.M.Larson,City Treasurer,for the calendar
month of M'arch,n34.
(The Mayor and each of the Aldermen was supplied with
copies of the Treasurer's report.)
Alderman Friott, chairman of the Judiciary and
Assessment Committee then submitted the following report,which
was read by the Clerk:
TUDICIARY & ASSESSMENT COMMITTEE report regarding the
letter from Robt.N.Erskine attorney for the Bondholders
on Several Special Assessments. The latter is dated March
Igth,1G34 and copy of same attached. The committee has
investigated and recommends that the matter be referred to
City Attorney to take up with Attorney for landholders.

The motion made by Alderman Meinshausen and seconded by
Cullet that the Council concur in. this report. The motion
was voted upon by acclamation whereupon the Mayor declared
the motion carried.
Alderman Huxmann,.chairman of the Police and License
Committee reported several complaints from Parent -Teachers
Associations as well as parents, objecting to children play-
ing punch boards, marble games and similar devices. The
motion was made by Alderman .bishop and seconded by geins-
hausen to refer this matter to the Judiciary Committee with
instructions to study the matter and present to the Council
anam.endment to the present ordinance so as to permit certain
such games, but barring children from participating in any
such games. The motion was voted.upon by acclamation,
whereupon the Mayor declared the motion carried.
The Streets and Sidewalks Committee had no report
to offer.
The Committee on Public 'works, nuildings and Plats
had no report to offer.
Alderman Meilshausen, chairman of the Sewer, Drainage
and Sanitation Committee again reported that there would be
a free "clean-up week* collection of rubbish and tin cans during
the week of April 23 to April 28,1934.
Alderman geinshausen, chairman of the Sewer, Drainage
& Sanitation Committee then submitted the following letter
whichvas read by the Clerk:

Mr.Mayor and City Council
Des Plaines,allinois
Gentlemen:
We, the undersigned residents of Des Plaines, have
been employed under the CWA for the past two and one-
half months in the preparing and drafting of an atlass
for the City of Des Plaines, covering house numbers,
water mains, valves, sewers and other underground work.
The termination of the C.W.A.at this time leaves the
sewer atlas about one-half completed, and we estimate
it will take us about three weeks to complete it.
We feel that this atlas should be completed and being
familiar with the remaining work to be done, offer to
do this work for the City of Des Plaines for the sum
of $160.00.
An early decision would be appreciated while we are
still free to do this work.

The motion was made by Alderman Meinshausen and seconded
by Frederick to refer this letter to the Committee on
Public Works, Buildings & Plats. The motion was voted
upon by acclamation, whereupon the Mayor declared the
motion carried.
The Water Committee had no report to offer.
Mayor Kinder then called the Council's attention
to the necessity of providing a stop light or stop sign on
Miner Street at Pearson Street. The motion was made by
alderman Frederick and seconded by Collet to refer this
matter tothe Streets and Sidewalks Committee and to instruct
the City Lngineer to demand such stop light or stop sign
at this intersection. The motion was voted upon by accla-
mation, whereupon the Mayor declared the motion carried.
Alderman Pflughaupt, chairman of the Yinance
Committee then presented the following proposed resolution
of which the Mayor and each of the Aldermen had been furnished
a copy: RESOLUTION
RESOLVED THAT THE FOLLOWING BILLS ARE DUE
AND PAYABLE AND THAT THE MAYOR AND CITY CLERK
BE INSTRUCTED TO ISSUE PROPER TOUCHER -WARRANTS
IN PAYMENT OF SAME. SAID WARRANTS TO BE RELEASED
UPON ORDER OF THE FINANCE COMMITTEE WHEN FUNDS

The motion was made by Alderman Pflughaupt and
seconded by Collet to approve the minutes of the regular
Council Meeting of March 19,1934 as written. The motion
was voted upon by acclamation, whereupon the Mayor declared
the motion carried, and the minutes approved.
Alderman Pflughaupt, chairman of the Finance Committee
announced that there would be a meeting of the .Finance Committee
together with the City Treasurer, City Clerk and City Attorney
on Monday, April 9th, at 8:00 P.M. in the City Clerk's office.
The Clerk then read the following proposed resolution:
RESOLUTION
WHEREAS, employment for unempl.oyed persons in
Des Plaines has been provided under the Civil Vorks
Administration; and
WHEREAS, it is reported that the furnishing of
employment under the Uivil Works Administration is to
be discontinued and that the matter of providing for
employment is to be controlled by the Federal Emergency
Relief; and
WHEREAS, many persons in the City of Des Plaines are
not on the relief rolls, although in dire need of employ-
ment and have registered for employment under the Rival
Works Administration and have failed to find employment;
and
T EREAS, the City Council of the City of Des Plaines
believes it is to the best interests of those citizens
of Des Plaines in need of work, that the employment to be
provided under the Federal Emergency Relief be given to
those persons in need of employment although not on the
relief rolls, as well as to those persons on the relief
rolls.
THEREBORE,BE IT RESOLVED, by the City Council of the
City of Des Plaines that it is deemed to be to the best
interests of the citizens of Des Plaines in need of employ—
ment, that work be provided not only for persons on the
relief rolls but also to persons in stressing financial
circumstances and in need of employment, who have registered
or who do register for employment.
BE IT EUJI(THER RESOLVED that the City Clerk of the City
forward a copy of this resolution to the proper authorities.

to adopt this proposed resolution. The roll was called on the

Gentlemen:
In accordance with your request to be ad-

vised.as to.the_propriety of changing the polling
place in the Second l'recinct, First Ward, after
the polling place has been fixed by the Council
and due notice thereof given, I wish to advise
that in my opinion it would be illegal to change
the polling place by action of the Council.
The Supreme Court has held, however, in a
case where the judges and clerks learned on election
day that the polling place designated was not avail-
able and they held the election in a building
fifty to one hundred feet away from and on the same
street from the place originally designated, that
in the absence of fraud or improper motive being
proven the election was valid.
In the Rules and Regulations compiled by the
election commissioners, the following instruction
is given:
"The Dolling place must remain where it has been
officially located by th'enTOard of Election Commissioners
When this is absolutely impossible it must then be
moved to the nearest possible location within the
Precinct. Post notices of any change."
With respect to locations for polling places,
the statute provides that:
"The said polling places shall in all cases be
upon the ground floor in the front room, the entrance
to which is in a highway or public street which is
at least forty feet wide and is as near the center of
the voting population of the district or precinct as
is possiblexxxxx;and in -no case shall anelection
be held in any room used or occupied as a saloon, dram
shop, bowling alley or as a place of resort for
idlers and disreputable persons, billiard hall or in
any room connected therewith by doors or hallways."

The City Council of the City of Des Plaines,
Cook -County, Illinois now assembled, has taken
action in the form of a resolution which we
respectfully submit for your attention and consid-
eration:
WHEREAS, upwards of One Hundred Fifteen
Millions of Dollars have been diverted or authorized
for diversion from highway funds to other than
road and street purposes, and
WHEREAS the -Federal Government has used to
stimulation of construction as the preferable
means of bringing us out of the present depression,
and
WHEREAS, it is our firm conviction that the
interests of both the unemployed and society at
large are best served by providing honorable employ-
ment, and
WHEREAS, at the time the motor Fuel Tax Law
was enacted, the Legislature made a solemn promise
that motor fuel tax collections would be used
solely for preservation and extension of our high-
way transportation system,
BE IT THEREFORE RESOLVED, that no further
legislation should be introduced or enacted having
for its objective the use of highway funds for
any purpose except maintenance and extension of
our highway and street systems.

(three hundred) feet of chemical hose, which he stated would
cost about 35 (thirty-five) cents per foot. The motion was
made by Alderman Huxmann and seconded by Friott to authorize
the Fire Committee to get bids and purchase not to exceed
three hundred feet of chemical hose.The roll was called.
