EDGAR J.FRIEDRICH,City Clerk 262 iINUTES OF THE REGULAR M RT TING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES HELD IN THE COUNCIL CHAMBERS ON THE 2nd DAY OF JANUARY,A-.D. 1934 AT THE HOUR OF 8:00 P.M. The meeting was called to order by Mayor George V.Kinder, with Aldermen Ahbe, Collet, Pflughaupt, Dean, Meinshausen,Huxmann, Bishop, Frederick and Bnzenbacher responding to the roll call. Alderman Friott was absent. The Clerk read the following reports: 1.Repirt of E.J.Friedrich,City Clerk,for the calendar month of December,1933. 2.Report of H.A.Becker,Chief of Police, for the Calendar month of December,193 3. The Judiciary and Assessment Committee had no report to offer. The Police and License Committee had no report to offer. The Streets and Sidewalks Committee had no report to offer. The Committee on Public Works, Buildings and Plats had no report to offer. Alderman Frederick, chairman of the Fire Committee, submitted the annual report of V.L.Spiegler, secretary of the Volunteer Fire Department, which was read by the Clerk. Mayor Kinder commended the Fire Department and its chief, Axel Petterson, for the splendid record for 1933. The motion was made by Alderman Huxmann and seconded by Dean to accept the report of V.L.Spiegler, secretary of the Fire Department, and to extend to the chief and members of the Fire Department the Council's thanks for the effective and efficient manner in which the Department functioned during the year 1933. The motion was voted upon by accla— mation, whereupon the Mayor declared the motion carried. The Sewer, Drainage and Sanitation Committee had no report to offer. The Water Committee had no report to offer. Alderman Pflughaupt, chairman of the Finance Committee reported on the matter of ascertaining the amount of Special Agsessment moneys being held by the County authorities. The motion was made by Alderman Huxmann and seconded by Frederick to instruct the City Treasurer to direct Mr. Joseph J.Feldman,3077 Davlin Ct., Chicago, Illinois, to make an audit as per his letter of December 11,1933, his remuneration to be 2% of the moneys received by the City as the result of his efforts. The roll was called on the motion with the following result: Ayes; Aldermen Ahbe, Collet, Pflughaupt, Dean, Huxmann, Bishop, Frederick, Enzenbacher and Aeinshausen. Nays; none. The Mayor thereupon declared the motion carried. The Clerk read the following letter: DEPARTMENT OF PUBLIC WORKS AND BUILDINGS Division of Highways December 26,1933 City Clerk: 263 Dear Sir: The attached four copies of the Agreement for Maintenance of City Streets, covers those portions of streets on State Bond Issue Routes within the City limits under your jurisdiction, where we may contract for maintenance. Before this agreement becomes operative, it must bear the corporate seal of the City and be signed by officials of both the City of Des Plaines and State Department of Public Works and puildings. Please have the City's seal affixed, and the Mayor andCity Clerk each sign the contract. The certi- fication on the bottom half of page two should be com- pleted and also signed by the City Clerk. After these signatures have been secured, return all four copies - of the agreement to this office so proper State signa- tures may be obtained. We will then return two copies of the agreement to you and accept bills for payment covering maintenance work. Please feel free to call upon our Mr. Norman Beggs who is Handling the City Maintenance Contract work in this District for any information you may wish on city maintenance, or to answer any questions you may have coneerning this contract. Carter Dinkins, City Engineer, then reported that he had interviewed the State Highway Department regarding the possible uses to which the City's portion of one cent of the State 3 cent gas tax, can be put. He reported the receipt of the following letter. DEPARTMENT OF PUBLIC WORKS AND BUILDINGS Division of Highways December 22,1933 City Streets Mr. Carter Jenkins 1484 Miner St. Des Plaines, Illinois Dear Sir: Replying to your letter of December 19, 1933, relative to a question regarding the installa- tion of traffic lights on Miner Street from the Busse to Graceland Avenue, I wish to advise that 1 believe 264 the installation of such lights would be approved subject to the following provisions& 1. Providing all Bond Issue Routes within the muni cipa.lity are in a satisfactory condition. 2. Providing all State Aid Routes within the muni- cipality are in satisfactory condition. 3. Providing a system of arterial streets other than State Bond Issue and State Aid Routes, approved by this department are in a satisfactory condition. 4. Providing there are no necessary extensions of the approved system of arterial streets out- side of the corporate limits of the municipality. In general it is the policy of this Depart- ment that the portion of the Motor Fuel Tax fund alloted to the municipality shall be expended, giving consideration and priority to the construct- ion and reconstruction of State Highways; the contrution, reconstruction and mai!tenance of a system of arterial streets and the construction, reconstruction and maintenance of extensions of such arterial streets outside the corporate limits of the municipality. I would suggest that before consideration be given to the installation of traffic lights, the Village officials should designate a system of arterial streets, sovering a four or five year program. A resolution should be passed by the City Council designating this as the arterial system, and this should be submitted with a map showing this system, to this Department for approval. The amendment was moved by Alderman Frederick and seconded by Enzenbacher to refer this letter to the Streets and Sidewalks Committee, together with the Council as a committee of the whole. The amendment was voted upon by acclamation, whereupon the Mayor declared the amendment carried. The main motion was then voted upon by eclamation, whereupon the Mayor declared the motion carried as amended, and announced that the Council will meet as a committee of the whole to discuss possible arterial highways in the City, on Monday night, 3anuary 8,1934. Carter Jenkins, City Engineer, reported on the matter of a storm sewer on East Miner Street. He stated that if the State will build this sewer at its own expense he will make a charge to the city of approximately $250.00 for his services; If the State will not pay for the construction of this pro- posed sewer Mr. Jenkins will make no charge for his services. The motion was made by Alderman Huxmann and seconded by Ahbe to accept Mr. renkin's offer, and to hereby instruct him to proceed with the pre paration of plans and specifications, for this sewer, as outlined to the Council. The roll was called on the motion with the following result: Ayes; Aldermen Ahbe, Collet, Pflughaupt, Dean, Huxmann, Bishop, Frederick, Enzenbabker and Meinshausen. Nays; Tone. 265 The Mayor thereupon declared the motion carried. The Clerk then read the following proposed resolution1 RESOLUTION WHEREAS, by the repeal of the Eighteenth Amendment to the United States Constitution, the prohibition of the manufacture and sale of intoxi- cating liquors and beverages, has no legal restraint or regulation under the existing laws of the State of Illinois; AND, WHEREAS, it Was represented to the people of the United States, by the proponents of the repeal of said Eighteenth Amendment, that under no circumstances would such repeal be permitted to authorize the operation of so called saloons; AND, WHEREAS, the declaration as to the prevention of the return of the saloon was a pledge to the people; AND, WHEREAS, the sale of intoxicating alcoholic liquors and beverages, excepting beer and light wines, to be consumed upon the premises where sold, inevitably constitutes such place of sale a saloon regardless by what name or character it may be designated or how otherwise regulated; AND, WHEREAS, it is considered by the City Council of the City of Des Plaines in Cook County, Illinois, that the large majority of its people are analterably opposed to the return of the saloon in any form or disguise; AND WHEREAS, the Legislature of the State of Illinois, about to be called into session, has before it certain bilis dealing with the regulation of the sale of intoxicating alcoholic liquors and beverages. NOW, THEREFORE, be it and it is hereby resolved by the City Council of the City of Des Plaines that the Legislature of the State of Illinois be and it is hereby respectfully urged to pass only such regulatory and licensing measures as may come before it, dealing with the sale of intoxicating alcoholic liquors and beverages,as shall keep the pledge to the people, and that no return of the saloon shall be permitted or authorized, and that as an essential part of any such law it is necessary that the sale of all liquors or beverages, excepting beer and light wines, must be prohibited exeept in original containers, and not to be consumed upon the premises where sold, and that each munici- pality in the State be given full and complete police and licensing powers, by which it will be enabled to regulate and control the sale of such products, to the full extent and the nec- essity of the public good. BE IT FURTHER RESOLVED, that a certified 266 copy of the above and foregoing resolution shall be immediately transmitted by the City Clerk to the Honorable Henry Horner, Governor of the State of Illinois, and to the Senator and Re- presentatives of the State Legislature for the Seventh District. Stemmerman the City HealihDepartment*s delegate to the Illinois Health Officers Conference held at Springfield, Illinois on the 14th and 15th of December,1933, who rendered a complete report on the conference. The motion was made by Alderman Huxmann and seconded by Bishop to place this report on file and thank �nrs. Stemmerman for the time and effort spent in attending this conference and preparing this report. The motion was voted upon by acclamation, whereupon the Mayor declared the motion carried. Mayor Kinder then submitted a letter pertaining to the President's Birthday Bali. The motion was made by Alderman Huxmann and seconded by Meinshausen to authorize the Mayor and City Clerk to interview the various fraternal organizations with a view toward promoting a "'President's Bali* in Des Plaines; and further give the Mayor and City Clerk power to act for the City in this matter. The motion was voted upon by acclamation, whereupon the Mayor declared the motion carried.
