Mr. B.Mazur addressed the Council inquiring as to whether or not he and others may sell and despense alchohol in the City of Des Plaines. City Attorney Meyer gave an oral opinion stating that under the present laws of the State the City has no power to license or regulate the sale of alcoholic beverages having an alcoholic content of more than 3.2%. The motion was made by Alderman Bishop and seconded by Ahbe to instruct the City Attorney to draft, and present to the Council an ordinance to control the &Le of alcoholic beverages in the City. Alderman 1,nzenbacher arrived later during the meeting. The Judiciary and Assessment Committee had no report to offer. Alderman huxmann, chairman of the Police and License Committee proposed that the minimum fine for failure to buy a dog license be reduced and presented the following proposed ordinance for first reading: AN ORDINANCE AMENDING SECTION 1137 OF ARTICLE 2 OF CHAPTER 25 OF THE MUNICIPAL CODE OF THE CITY OF DES PLAINES OF 1928 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES, COUNTY OF COOK, STATE OF ILLINOIS: SECTION 1. That Section 1137 of Article 2, Chapter 25 of the launicipal Code of the City of Des Plaines of 1928, be and the same is hereby amended as follows: Section 1137 PENALTY. Any person or persons who shallidolate or fail, neglect or refuse to comply with any of the foregoing pro- visions of this article where no other penalty is prescribed, shall on conviction be fined in a sum not less than one dollar nor more than two hundred dollars for each and every offense. Any dog for which the license fee has not been paid or which does not carry a tag may be im- pounded as a stray as provided in the preceding article. SECTION 2. All Ordinances or parts of ordi- nances conflicting with the provisions of this ordinance are hereby repealed sofa' as they conflict herewith. SECTION 3. This Ordinance shall take effect and be in full force from and after its passage and approval according to law. The Sewer, Drainage and Sanitation Committee had no report to offer. ilderman Bishop, chairman of the Water Committee, reported the request of the Park Board asking the City to furnish water for three skating ponds at cost. Alderman Bishop, chairman of the Water Committee, reported that the proposed alarm system for t water tank overflow was not installed because instead of a rental price of $2.00 per month as quoted for the telephone line, a rate of $7.55 per month was demanded. This Alderman Bishop said was prohibitive. The Clerk then read the following letter: DEPT .OF PUBLIC WORKS AND BUILDINGS DIVISION OF HIGHWAYS December 11,1933 Mr. Edgar J.Friedrich City Clerk, City of Des Plaines Des Plaines,illinois Dear Sir: On October 30,1233, you forwarded to me a copy of a resolution adopted by the City Council of the City of Des Plaines on October 16,1933, re- questing this Department to construct a curb and gutter along the edges of our new improvement on Keeney Avenue east of Mannheim Road in your City. 256 This matter has been carefully considered by this Department and 1 regret to inform you that the Department does not feel justified in contructing this curb and gutter at this time. It is felt that the pavement in its present condition is not dangerous, and that the curb and gutter will not add especially to its use - fullness. The present method. of drainage appears satisfactory. The curb and gutter was not planned in the original improvement and would have to be constr- ucted now at cost plus fifteen per cent, which is not an econimical method and which would add considerably to the total cost of our improvement, and we believe the expenditure not to be justified. The State advised us that before this resolution could be considered for approval it would be necessary to re- route Dempster Street, State Aid Route #125, over Miner Street. We have prepared a new State Aid resolution making this change in the location of Dempster St. and passed same at the meeting of the County Board held yesterday, November 23rd, We are now proceeding with plans for this improvement and they will be finished within a month. As well as the following letter: DEPARTMENT OF PUBLIC WORKS AND BUILDINGS DIVISION OF HIGHWAYS December 14,1933 • Traffic Signs Mr.Carter Jenkins City Engineer of Des Plaines 1484 Miner Street Des Plaines,Illinois 257 Dear Sirs We are about to proceed with the rehabili- tation of signs along Route 19 through the business area of Des Plaines, in accordance with the plan sub- mitted to you last year and in lieu of which the City Council passed a resolution December 5th,1932, approv- ing the proposed plan. We have made several changes in the original plan. These changes were discussed with Mr. ..J .Fried- rich, City Clerk and Chief of Police, H.k.Becker. The changes consist of removing the present illuminated stop signs at Lee Street and replacing the same with our Standard Reflector Stop Signs. 1 was in- formed that the present signs were not electrically connected and that all lighting is -turned off at 1:00 A.M. Chief Becker thought that reflector stop signs would better serve the purpose than the existing signs. We would also place a reflector stop sign on the north side of Route 19 on Pearson Street. Chief Becker informed us that he would restrict parking for a distance of about fifty feet in front of this sign. We will, also, paint the word "Stop" in six foot letters on the pavement at the intersection of Northwest Highway and Graceland Avenue and rearson Street. This painting will be done on the south approach to these intersections where there is no possibility of erecting a stop sign back of the curb. "Business Zone Drive Slowly" signs will be placed at either end of the busi- ness district. Our sign forces are now engaged in making Route 62 (Keeney Street) through Des Plaines. We have erected reflector stop signs on Route 62 at River Road and at Mannheim Road. We will erect our city type stop signs on all intersection streets as well as place re- flector stops on Center Street at its intersection with Keeney Street. In Addition to this we will designate, by means of signs, the entire portion of Route 62 between River Road and the Soo Line _Railroad as a residential zone and request motorists to drive. carefully. We will direct the foreman of the crew assigned to make the changes along Route 19, to get in touch with the official designated by you to disconnect the present illuminated stop signs on the l"orthe4est nighway at Pear- son Street.
