MINUTES OF THE ADJOURNED MEETING OF THE
CITY COUNCIL OF THE CITY OF DES PLAINES
HELD IN THE CITY CLERK'S. OFFICE ON THE
24th DAY OF NOVEMBER,A.D.1933 AT THE
HOUR OF 8:00 P.M.
The meeting was called to order by Mayor
George W.Kinder, with Alderman Ahbe, Collet, Pflughaupt,
Dean, Huxmann, 1ishop, Frederick and Meinshausen respond-
ing to the roll call. Alderman Friott and Enzenbacher
were absent.
City Attorney,Meyer read the legaldraft of
the application for a loan to the Public Works Adminis-
tration for financing the proposed well and reservoir
project, while Carter Jenkins, engineer, outlined the
technical data to be included in this application.
The motion was made by Alderman liuxmann and
seconded by Frederick to authorize and instruct the
Mayor to secure options on several sights suitable
for the proposed reservoir. The relives called on the
motion with the following result: Ayes; Aldermen Ahbe,
Collet, Pflughaupt, Dean, Huxmann, Bishop, Frederick and
Meinshausen. Bays; Aone. The Mayor thereupon d eclared
the motion carried.
The members of the Council then proceeded to
prepare applications for projects to be carried on under
the Civil Works Administration, in order to file theta' at the
earliest possible date and get the city's unemployed to
work.
The motion was made by Alderman liuxmann and
seconded by rflughaupt to adjourn. The motionw as voted
Upon by acclamation, whereupon the Mayor declared the
motion carried and the Councillegularly adjourned.

viLEVUTES OF THE REGULAR MEETING OF THE CITY
COUNCIL OF THE CITY OF DES PLAINES HELD IN
THE COUNCIL CHAMBERS ON THE 4th DAY OF
DECEMaER, A.D.1933. AT THE HOUR OF 8;00 P.M.
The meeting was called to order by Mayor George
W.E.inder, with Aldermen Ahbe, Collet, Pflughaupt, Dean,
Huxmann, Bishop, Priott, Frederick and Meinshausen res-
ponding to the roll call. Alderman Enzenbacher arrived
later during the meeting.
The Clerk then read the following reports:
1. Report of noward Becker, Chief of rolice for aov.1933
2. Re.port of E.J.Friedrich,City Clerk for blovembertlg36.
The Mayor and each of the Aldermen were furnished with a
copy of the report of Chas. Y.Larson, City Treasurer for
November,1933.
Alderman Friott, chairman of the *Judiciary and
Assessment Committeetreported that the lot for which
Frank Zaleski, attorney, bid ;20.CC for a clear title several
weeks ago, involved various taxes and special assessments dating
back over 2C years, and that because of the complexity of
the situation he is not able to submit a recommendation.
The motion was made by Alderman Huxmann and
seconded by Ahbe to refer to the attention of the Finance
Committee, the maUrr of securing pay iii1114 the members of the
Police Department. The motion was voted upon by accla-
mation, whereupon the Mayor Declared the motion carried.
Alderman Collet, chairman of the Streets and
Sidewalks Committee reported that since so many street
lights have been discontinued,it may be necessary to
change the lighting in some places to pet the best results
without adding more lights.
The committee of Public Works, Buildings and Piats
had no report to offer.
The Sewer Drainage and Sanitation Committee had
no report to offer.
The Fire Committee had no report to offer.
The Water Committee had no report to offer.
Aldermanhuxmann, reported that the insurance
company carrying the city's insurance for public liability
and property damage on the automobiles for all City Depart-
ments, served notice that unless arrangements are made to
pay the 115C.00 premium now due, the insurance will be
cancelled. The motion was made by Alderman Huxmann and
seconded by Dean to refer this matter to the Judiciary and
Assessment Committee with power to act. The motion was
voted upon by acclamation, whereupon the MayOr declared the
motion -carried.

City Attorney Meyer, reported that the City has no defense
in this matter. The motion was made by Alderman Pflughaupt
and seconded by Meinshausen to let this matter go by default
and attempt no defense in this case. The motion was voted
upon by acclamation, whereupon the Mayor declared ;he
motion carried.
The Clerk then presented the bank statements of
the First National Bank of Des Plaines, and the Northern
Trust Co. of Chicago as of October 25,1933 together with
a proposed resolution resolving to retain them as deposi-
tories for the funds of the City of Des Plaines. The
statements together withythe proposed resolution were
referred to the Finance Committee by the Mayor for exam-
ination and recommendation.
Mayor Kinder reported that the State Highway
Department has signified its willingness to grade and
level the park between the C & N W tracks and Ellinwood
Street, between Lee Street and Graceland Avenue, praviddd
the City will request that this work be done, and direct
such request to Mr. Campbell, Superintendent of the Wis-
consin Division of the Chicago&forth Western Railway Co.
The motionwas made by Alderman Huxrnann and seconded by
Frederick to instruct the Clerk to write Mr. Campbell such
a letter. The motionwas voted upon by acclamation, where-
upon the Mayor declared the motion carried.
Alderman Pflughaupt, chairman of the :Finance
Committee then submitted the following resolution of which
the Mayor and each alderman had been supplied with a copy:

The motion was made by Alderman Auxmanaand seconded by
Bishop to adopt this resolution. The roll was called on
the motion with the following result: Ayes; Aldermen Ahbe,
Collet, Pflughaupt, Dean, Huxmann, Bishop, Friott, Frederick,
Enzenbacher and Meinshausen. "nays; _None. The Mayor thereppon
declared the motion carried and the resolution adopted.
The motion was made by Alderman Bishop and
seconded by Collet to approve the minutes of the regular
Council meeting held november 20,1933 and of the adjourned
Council meeting November 24th,1933 as. written. The motion
was voted upon by acclamation, whereupon the Mayor declared
the motion carried and the aforesaid minutes approved.

adopted by our association at its meeting of
November 27th, will you Kindly present this
matter to the City Council at its meeting to-
night and oblige.

RESOLUTION
WHEREAS: The City of Des Plaines ha,s chosen to
institute suit against 14 of the Business Men of
this City for the collection of their delinquint
1933 licenses, and such legal proceedings having
been postponed until December 6th. , the business
men of Des Plaines who are concerned in this matter,
realizing the City's dire need of funds are further
attempting to bring this matter to a quick and
amiable settlement through further negotiations
direct with the City Council. The Business men
concerned have organized as Association named the
Des Plaines business Mens Association and stand
ready to defend themselves in Court, but knowing
that this litigation will forstall the collection
of any licenses for some time and will also be
expensive to both parties, and will defeat the
very purpose of the City's intentions, this
Assiciation desires to endeavor to settle this
matter amicably to the mutual benefit of all
concerned, and
WHEREAS: The City has not forced the collection
of Business licenses from contractors, although
they are covered by the same ordinance as the
Store Keepers and merchants and the City has at
various times during this year accepted settlement
of licenses fees at a reduction under the amount
called for in the ordinance andfurther our attorney
advises us that in a number of cases it would be
impossible for the City to collect any fee under
any circumstance, and
WHEREAS: The Retail Merchants feel that they have
always helped the community, to the best of their
ability, and as an example, we call your attention
to our unselfish extension of credits, during this
period of depression, to people who would otherwise
be a burden to the City. Today they find themselves
in a very percarious position, unable to meet their
obligations. We feel that we are willing to pay

a license fee commensurate with our ability to earn,
but under existing conditions we think the fees are
exorbitant and add a further burden to an already
to large overhead. it is our belief that the interests
of every one concerned (The City, '.2he Councii and
The Business Man) would be better served by a settle-
ment of this question in a neighborly manner, and.
WHEREAS: At the last meeting of the Des Plaines
Business mens Association it was suggested and adopted
that we make an offer of settlement to the City of
Des Plaines covering the delinquint business licenses.
Now therefore on behalf of the members of the Des
Plaines Business Mens Association who are delinquint
in their license fees to the City of Des Plaines
we hereby offer to the said City of Des Plaines the
sum of $450.00 in full settlement of all delinquint
license fees of the members of this Association
and further that the said City of Des Plaines will
agree to the dismissal of all suits pending and are
on call for trial December 6,1933, and
WHEREAS: The Des Plaines Business Mens Association
is anxious to be of service to the City of Des Plaines
we hereby offer our assistance in the framing of a
new ordinance to cover license fees, which could be
•
made agreeable to all concerned.

The motion was made by Alderman Bishop and seconded
by Collet to refer this letter and resolution to the
Police and License Committee for report. The roll
was called on the motion with the following result:
Ayes; Aldermen Collet, Pflughaupt, Huxmann, Bishop,
Friott, Frederick ad .einshausen. Na Ys; Aldermen
Ahbe, Dean and Enzenbacher. The Mayorthereupon
declared the motion carried. Alderman Huxmann, chair-
man of the Police and License Committee then announced
that his committee will meet with a committee of the
Des Plaines Business Men's Association -to consider the
above resolution, on Wednesday evening December 6,1933
at 8:0C P.M. at the City Hall.
The motion was made by Alderman Ahbe and
seconded by Huxmann to instruct the City Attorney to
ask for a continuance in the suit filed against
several business men for non-payment of business li-
censes. The motion was voted upon by acclamation,
whereupon the Mayor declared the motion carried.
The Clerk then read the foilowing.proposed
ordinance for first reading;
AN ORDINANCE AMENDING AN ORDINANCE ENTITLRD
"AN ORDINANCE PROVIDING FOR THE ISSUANCE OF
TAX ANTICIPATION WARRANTS AGAINST THE TAXES
LEVIED FOR THE FISCAL YEAR OF 1933 FOR GENi
ERAL CORPORATE FUND, PUBLIC BENEFITS, FIRE
PROTECTION, PUBLIC LIBRARY, GARBAGE AND BONDS
FUNDS", DULY ADOPTED September b,1933.
The motion was made by Alderman Huxmann and seconded
by Frederick to put this proposed ordinance on passage.
The rolls called on the motion with the following re-
Ayes; Aldermen Ahbe, Collet, Pflughaupt, Lean, Huxmann,
Bishop, Friott, Frederick, 1nzenbacher and £einahausen.
Nays; None. The Mayor thereupon declared the motion
carried and the ordinance on passage. The motion was then
made by Alderman Pflughaupt and seconded by nuxmann that
the proposed ordinance be passed. The roll was called on
the motion with the following result: Ayes; Aldermen Ahbe,
Collet, Pflughaupt, Dean, Huxmann, Bishop, Friott, Frederick,
Enzenbacher and Meinshausen. nays; none. The mayor there-
upon declared the motion carried, and the ordinance passed.
Mr. H.Mazur addressed the Council inquiring as to
whether or not he and others may sell and despense alchohoi
in the City of Des Plaines. City Attorney Meyer gave an
oral opinion stating that under the present laws of the
State the City has no power to license or regulate the sale
of alcoholic beverages having an alcoholic content of more
than 3.2%. The motion was made by Alderman Bishop and
seconded by Ahbe to instruct the City Attorney to draft,
and present to the Council an ordinance to control the sale
of alcoholic beverages in the City. The roll was called on
the motion with the following result; Ayes; Aldermen
Ahbe, Collet, Pflughaupt, Dean, huxmann,Dishop, Friott,
Frederick, Enzenbacher and Meinshausen. ways; Alone. The
Mayor thereupon declared the motion carried.
The motion was made by Alderman Huxmann and seconded
by Frederick that pursuant to the oral opinion rendered by
City Attorney Meyer, the Council instruct the Police Depart-
ment to take no recognition of the sale of any beverage
with alcoholiconntent until such a time as the Council passes
a proper regulatory City Ordinance with r espect to same.
The roll was called on the motion with the following result:
Ayes; Aldermen Ahbe, Collet, Pflughaupt, Dean, Huxmann,
Bishop, Friott, Frederick, Enzenbacher and einshausen. nays;
None. The Mayor thereupon declared the motion carried.

The meeting was called to order by Mayor George
W.Kinder, with .Aldermen Ahbe, Collet, rflughaupt, Dean,
Huxmann, Bishop, Friott, Frederick and Meinshausen res-
ponding to the roll call. Aldermannzenbacher arrived
later during the meeting.
The Judiciary and Assessment Committee had no
report to offer.
Alderman Huxmann, chairman of the Police and
License Committee proposed that the minimum fine for
failure to buy a dog license be reduced and presented
the following proposed ordinance for first reading:
AN ORDINANCE
MENDING SECTION 1137 OF ARTICLE 2
OF CHAPTER 25 OF THE MUNICIPAL CODE
OF THE CITY OF DES PLAINES OF 1928
BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF DES PLAINES, COUNTY OF C00K, STATE
OF ILLINOIS:
SECTION 1. That Section 1137 of Article 2,
Chapter 25 of the municipal Code of the City of
Des Plaines of 1928, be and the same is hereby
amended as follows:
Section 1137 PENALTY. Any person or
persons who shall violate or fail, neglect or
refuse to comply with any of the foregoing pro-
visions of this article where no other penalty
is prescribed, shall on conviction be fined in
a sum not less than one dollar - nor more than
two hundred dollars for each and every offense.
Any dog for which the license fee has not been
paid or which does not carry a tag may be im-
pounded as a stray as provided in the preceding
article.
SECTION 2. All Ordinances or parts of ordi-
nances conflicting with the provisions of this
ordinance are hereby repealed sofa as they conflict
herewith.
SECTION 3. This Ordinance shall take effect
and be in full force from and after its passage and
approval according to law.
