REGARDING THE MATTER of securing bids to repair
and paint the City's Water Tank, we, the Water Committee
have investigated the above and have found that Hanlon
& Cons rere the successful low bidder on this work and
we have thereby authorized the City Clerk to instruct
them to proceed with the work on presentation of a
proper completion bond and submit to us his compensation
insurance policy showing that they are insured with a
reliable company. The amount of this contract called
for the sum of Two Hundred and Eighty Five Dollars(285.00)
and is covered by specifications furnished by our engineer.
We recommend that the action of this committee be approved
by this council.

reported that in response to a letter from Mr. Frank
A.Frisch, 216 Stratford Rd., dated September 9th,1933,
a test meter was installed togeher with Mr. Frisch's
meter and tested for 36 days and that the test showed
Yr. Frisch's meter to be reasonably accurate. The motion
was made by Alderman Bishop and seconded by Dean to instruct
the Clerk to write Mr. Frisch informing him of the result
of the test and asking that the bill be paid. The motion
was voted upon by acclamation, whereupon the Mayor declared
the motion carried.

from the City of Des Plaines. Inasmuch as 1 seem to
receive no disposition of these matters, I am taking
this method of bringing this matter to a conclusion.
411 of the bills submitted by me have been
^pprovel, with the single exception of the Cater matter
and the balance due for the rebate roll on 1vo.100 which
was in accordance with my agreement with the council.
I have felt that some of these matters should be paid
out of the proper channels to which they should be
chargeable.
In order to bring the matter to a conclusion
at this time, 1 am.w illing to accept tax antici2atii
warrants payable out of the 1532 and 7.33 taxes for
the balance due me. 1 desire, however, that this pro-
position be disposed of without any such delay as has
occurred up to this time, in connection vith the moneys
due me.
I would appreciate it if the matter could be

need of a sidewalk on Miner Street and Derpster Street.
Mr. T.B.Gray addressed the Council regarding the import—
ance of protection of high school students and other
pedestrians on Miner Street just east of the Miner Street
Bridge, and proposed a guardrail outside the present
crushed stone walk east of the said bridge. The motion

to instruct Carter Jenkins, engineer to ask the proper
Cook County officials to install, and bear the expense
of such a guard rail, and report his progress in the

In accordance with the request of the
City Council for a report on the status of the
Fayette C.Merrill matter, 1 beg to advise that
I received. the files in this matter from Mr.
David B.aloney, and 1 have in my possession
the following papers:
Settlement Agreement executed by the
City of Des Plaines and Fayctte 0.Merrill, wherein
it is set forth that Lr. Merrill was short in
his account in the sum of /7801.18, and that the
surety on Mr. Merrill's official bond has agreed
to pay $20CC.CC to the City of Des Plaines on
account of said shortage, and that Mr. Merrill
has agreed to pay to the City of Des Plaines
375.CC on the date of the execution of said
agreement, and to assign to the City of Des Plaines,
all claims for unpaid salary amounting to $625..0C.
Said agreement also sets forth that Yr. Merrill
agrees to pay to the City of Des 'Plaines a further
sum of 1625.CC to be used for the payment of any
obligations against the property placed in trust,
and that Mr. Merrill willexecute promissory notes
in the sum of _' 4801..18. I am informed by Mr.
Maloney that the ` 625..CC that Yr. Merrill was to
pay for the purpose of taking care of the obligations
against the property, never was paid.
Deed of Trust executed by Mr. and Yrs.
Merrill, however, no trustee was finally agreed
upon for the reason that two of the banks considered
as trustee were closed by the State Auditor at
about the time the Merrill Matter was up for
disposition.
Trust Agreement executed by mr. and
Mrs.Merrill, which will also have to signed by
the trustee yet to be designated.
Assignment of Wages, Release of
unpaid salary and Assignment of all interets
under the trust agreement signed by sir. and Mrs.
Merrill.

trustee has been designated to hold the title to
the Merrill property for the benefit of the City
of Des Plaines, nor has any conveyance been filed
of record in this matter.
if this matter is to be concluded in
accordance with the terms of the agreement
previously mentioned herein, it will be necess-
ary to aesignate some person or company to act
as trustee and then to file for record the deed
in trust. Naturally, if a bank or trust company
is designated as trustee, there will be the
customary charges for acting as trustee.

WHEREAS, The City Council of the City
of Des Plaines has duly adopted. an ordinance
authorizing the issuance of tax anticipation
warrants against and in anticipation of the
collection of the tax for city purposes levied for
the year 1g33; and
WHEREAS, it is deemed to be to the
best interest of the employees and officials
of this city who will receive Tax Anticipation
Warrants in payment of wages or salary that said
Anticipation warrants given in payment of wages
or salary be issued in denominations of 41.00 and
5.CC, and bear no interest.
THEREFORE, be it resolved by the City
Council of the City of Des Plaines that the City
Clerk be authorized and instructed to purchase
6000 Tax Anticipation Warrant forms in denomin-
ations of `: 1.00 and 15.0C, and to expend there-
fore, not to exceed115.CC.
BE IT FURTHER Rh3OLVED, that said Tax
Anticipation Warrants. of 31.00 and $5.00 denominations
shell bear no interest and the gross amount thereof
shall not exceed 35C00.00.

Committee reported that the Public Service Co. of
Northern Illinois has agreed to settle the past due
street lighting bill of approximately 7i15,0CC.CC by
accepting 1033 Tax Anticipation Warrants for part of
the bill, and by entering a friendly judgement for the
balance. The motion was made by Alderman Lnzenbacher
and seconded by Collet to instruct the City Attorney
to meet with. the proper officials of the Public Service
Co. and prepare an agreement to be presented at the
next meeting of the Council. The motion was voted
upon by acclamation, whereupon the Mayor declared the
motion carried.
The motion was made by Alderman Ahbe and
seconded by Collet to correct the minutes of October
16tri,1933 so as to instruct the Clerk to write the
County Board "on or about November 1,1933 instead of

The motion was made by Alderman Pflughaupt and seconded by
Meinshausen to adopt this resolution. The roll was called on
the motion, with the following result: Ayes; Aldermen Ahbe,
Collet, Pflughaupt, Dean, N uxmann, Bishop, Friott, Frederick,
Efzenbacher and £einshausen. The Mayor thereupon declared the
motion carried and the resolution adopted.
Alderman Friott cAl €c. attention to the dumping of
coal on parkways and on the streets, especially where coal is
being supplied by relief organizations. This matter was referred
to the Streets Committee by the Mayor.
The motion was made by .Alderman Huxmann and seconded
by Bishop to authorize the Streets Committee to employ such
as owe water bills, to repair the cracks which have opened on
several streets. The notion was voted upon by acclamation,
whereupon the Mayor declared the motion carried.
Alderman Pflughaupt, chairman of the Finance Committee,
reported that the First ?National Bank of Des Plaines has signi-
fied its willingness to loan tae City ' 5,000.00 provided the
City will pledge vehicle license receipts as security for the
loan. The motion was made by Alderman Ahbe and seconded by
Collet to refer this matter to the Finance Committee for recom-

mendation. The motion was voted upon by acclamation
whereupon the Mayor declared the motion carried.
Upon the request of Mayor Kinder the Council retired
to the City Clerk's office for the remainder of the
meetirg.
The Mayor then gesented several tentative plans
for affecting a reduction in the cost of street lighting.
The motion was made by Alderman Huxmann and seconded by
Pflughaupt to adopt the plan reducing the number of
lamps 20% to 25% and setting the period of burning "from
dusk to 1 A.M.N. The roll was called on the motion with
the following result: Ayes; Aldermen Ahbe, Collet, Pflug-
haupt, Dean, Huxmann, Bishop, Friott, Frederick , Enzenbacher
and Meinshausen. Nays; none. The Mayor thereupon declared
the motion carried.
Alderman Huxmann, chairman of the Police Committee
asked Sergeant Hammerl to report on the O'Aces,1575 Ellin -
wood Street. Sergeant Hammerl reported unsanitary conditions
drunkenness, and an accident due to improper conduct. The
motion was made by Alderman Frederick and seconded 'oy Dean
to adopt the following resolution:
RESOLUTIC N
WHEREAS, a Malt and Vinous Beverage license
was heretofore granted to Gus Palmquist as a retail
dealer Class "A",a t 1575 Ellinwood Street, Des Plaines
Illinois, and
WHEREAS, it has been reported to the City
Council that there has been violations of the Ordinance
under which said license was granted, at the address
for which said license was granted; and
WHEREAS, the City Council has duly considered
said violations;
THEREFORE, Be it Resolved, by the City Council
of the City of Des Plaines that retail dealer Class
"A", License No. 136 , heretofore issued to Gus Palm-
quist, under the provisions of Chapter 28 of the Muni-
cipal Code of the City of Des Plaines as amended, be and
the same is hereby revoked.
It is further Resolved that the City Clerk
notify the Department of Finance of the State of Illinois
of said revocation, as provided by law and that the City
Clerk also notify the said Gus Palmquist of said revo-
cation.
The roll was called on the motion with the following result:
Ayes; Aldermen Ahbe, Collet, Pflughaupt, Dean, Huxmann, Bishop,
Friott, Frederick, Enzenbacher and Meinshausen. Nays; one.
The Mayor thereupon declared the motion carried.
Mayor Kinder then presented the matter of purchas-
ing the Cater Well for consideration. Mr. tm.Cater addressed
the Council and outlined the matter stating that he mould
nave :o realize $85,00C.00 cash on the sale of the well,
and then introduced Mr. Bacone and Mr. J .McRoberts. Mr. Mc-
Roberts offered to take $93,50C.CC in water bonds. These
bonds to cover the purbhase of the well, the printing of
the bonds, the cost of a Chapman & Cutler opinion and the
sale of the bonds. The motion was made by Alderman Frederick
and seconded by Pflughaupt to instruct the City Attorney to
prepare an ordinance proposing to purchase the Cater Well
with a water revenue bond issue of ,vg3,5C0.0C, said ordinance
to be presented to the Council at an adjourned meeting of
the Council to be held Tuesday, November 14,1933 at 8:CC P.M.
at the 'amity Hall of the City of Des Plaines. The roll was
called on the motion, with the following result: Ayes; Alder-
men Ahee, Collet, Pflughaupt, Dean, Huxmann, Bishop, Friott,

Frederick, Enzenbacher and Meinshausen. Nays; one.
The Mayor thereupon declared the motion carried.
Alderman Pflughaupt, chairman of the Finance
Committee reported on the matter of the proposed ;5,000.00
loan from the First National Bank of Des Plaines,. for
which it is proposed to pledge vehicle license receipts
as security, and to then loan this $54CCO.CC from the
Veh5cle F and to the General Corporate Fund and taking
a 1e33 General Corporate -Fund Tax Anticipation Varrant
of $5,00C.00as security. The motion was made by
Alderman'iiuxmann and seconded by lileinshausen to refer
this matter to the Finance Committee vvith power to act.
The motion was voted upon by acclamation, whereupon

arrived later during the meeting; , nhile Alderman Dean
was absent from the entire session.

the First National Bank of Des Plaines and presented the
following proposed ordinance, which was read by the Clerk;
