MINUTES OF THE REGUIAR MEETING OF THE
CITY COUNCIL CF THE CITY OF DES PLAIT +'S
HELD IN THE COUNCIL CHAMBERS ON THE 18th
DAY OF SEPTELTBER , A.D. ,1933 AT THE HOUR OF
8400 P.M.
The meeting was called to order by Mayor George ' V.
Kinder, with Aldermen Ahbe, Collet, Pflughaupt, Dean, Huxmann,
Bishop, Priott, Frederick, Enzenbacher and Meinshausen respond-
ing to the roll call.
Alderman Friott, chairman of the Judiciary and assess-
ment committee then submitted the following report which was
read by the Clerk:
REGARDING the demand of Tolman,Chandler & Dickinson,
attorneys for the Bondholders of Special Assessment ffGe,
for the City to levy a supplemental assessment to f99;
matter referred to Judiciary & Assessment Committee who
report as follows:
Judiciary and Assessment Committee has investigated and
found that to levy a supplemental assessment at this time
would be of no substantial benefit to the bond holders
because the collection thereof would be largely delinquent
and have a depressing effect upon the payment of future
installments of the original assessment by the property
owners who have up to this time been able to keep up
their payments and who in large numbers would be dis-
couraged by such supplemental assessment from even keeping
up the payments that they have been struggling to keep up.
4ae therefore recommend: that this view of the matter be
adopted by the City Council and that the attorneys for
the bond holders be advised thereof and requested to
urge upon their clients to refrain from any further action
until an improvement in conditions generally, made pay-
ment of the assessment by property owners, now unable
to pay, possible.

The motion was made by Alderman Huxmann and seconded by Pflug-
haupt to accept this report and concurr in its recommendations.
The motion was voted upon by acclamation, whereupon the Mayor
declared the motion carried.
Alderman Collet, chairman of the Streets and sidewalks
Committee submitted a request from the Purol Filling Station,
Miner and Pearson Streets, asking the city to mark "no parking t
on the streets at the entrances to the filling station. The
motion was made by Alderman Ahbe and seconded by Pflughaupt to
authorize the Street Committee to mark this portion of the streets
in question• according to the committee's best judgement. The
motion was voted upon by acclamation, whereupon the Mayor declared
the motion carried.
Upon the request of Alderman Collet, chairman of the
Streets Committee, Carter Jenkins, City Engineer reported that
upon instructions of the Council he has secured the following
estimates from Milburn Bros:
Grading 14 Blocks of streets in Riverview $300.00
Widening Prairie Ave.at manteuffel corner 250.00
The motion was made by Alderman Enzenbacher and seconded by
Collet to authorize the Streets Committee to instruct Kilburn
Bros. to widen Prairie Ave. at Manteuffel's corner according to
the engineer's specification under the supervision of the Super-

intendent of Public Works, at a cost of $250.00, with the
understanding that instead of the City paying cash for this
work, the City will credit the past due water account of
Milburn Bros. for the said amount of $250.00. The roll was
called on the motion with the following result: Ayes;
Aldermen Ahbe, Collet, P'flughaupt, Dean, Huxmann, Bishop,
Friott, Frederick, Enzenbacher and I"einshausen. Nays; None.
The Mayor thereupon declared the motion carried.
The motion was made by Alderman Enzenbacher and
seconded by Ahbe to authorize the Streets Committee to in-
struct Milburn Bros. to proceed with the grading of the
proposed 14 blocks of Riverview streets, under the supervision
of the Superintendent of Public Works, at a cost of $300.00,
according to the specifications of the City Engineer, with
the understanding that instead of the City paying this sum
in cash, the sum will be credited to the past due water
account of Milburn Bros. The motion was then made by Alderman
Bishop and seconded by Meinshausen to amend this motion by
adding the words "provict:d however, that in return for the
consideration shown them, Milburn Bros. agree to forthwith
pay the balance of their account due the City." The roll
was called on the amendment with the following result: Ayes;
Aldermen Ahbe, Collet, Pflughaupt, Dean, Huxmann, Bishop,
Friott, Frederick, Enzenbacher. and Meinshausen. Nays; none.
The Mayor thereupon declared the amendment carried. The roll
was then called on the main motion as amended with the follow-
ing result: Ayes; Alderman Ahbe, Collet, lflughaupt, Dean,
Huxmann, Bishop, Friott, Frederick, Enzenbacher and Meinshausen.
Nays; None. The Mayor thereupon declared the motion carried
and motion carried as amended.
Carter Jenkins, City Engineer, reported a leak
in the water main on Northwest highway at vefferson Street
and asked that he be permitted to secure the necessary permit
from the State. The motion was made by Alderman Bishop tnd
seconded by Meinshausen to instruct the Mayor, Clerk and
Engineer to apply for the necessary State permit to repair
this leak. The motion was voted upon by acclamation, where-
upon the Mayor declared the motion carried.
The Committee on Public Works and Buildings had
no report to offer.
The Fire Committee had no report to offer.
The Sewer Drainage & Sanitation Committee had no
report to offer.
Alderman Bishop, chairman of theW»ater Committee
reported he has received a price of $250.00 for "pulling"
the pump at the Norma Well in order to inspect it, and get
definite prices on repairing and reconditioning the same.
The motion was made by Alderman Huxmann and seconded by
Enzenbacher to recommit this matter to the Water Committee to
report in 60 days. The motion was voted upon by acclamation,
whereupon the Mayor declared the motion carried.
Alderman Bishop, chairman of the Water Committee,
reported that the water tower and sta*dpipe need re -painting
and that he has an estimate of 3470.00 to do this work .The
motion was made by Alderman Huxmann and seconded by Enzenbacher
to instruct the City engineer to prepare specifications, and
that Clerk advertise for bids to be returnable at the Council
meeting to be held October 2, 1933. The motion was voted upon
by acclamation whereupon the Mayor declared the motion carried.

Alderman Huxmann, chairman of the Police and
License Committee, then submitted the following report,
which was read by the Clerk:
REGARDING.THE request of the Des Plaines Recreation
Parlor to' amend the Beer Licensing Ordinance so as
to permit the City to license this place of business
to sell beer. A License was denied this corporation
because of the "200 foot" rule/
The, Police and License Committee has investigated
and has found that the application of the Des Plaines
Recreation Parlor, doing business in Des Plaines in
premises at Prairie Avenue and Pearson Street, for a
license to sell beer cannot be granted because of the
present provisions of the ordinance in force, which
prohibits such License where the premises is within
two hundred (200) feet of the church, which is the fact
in this case.
We therefore recommend: that a public hearing be
given to the question of amending this provision of
the ordinance before the City Council as a Committee
of the whole to which all persons interested be in-
vited and that if thereafter any member of the City
Council feels desircus of introducing an ordinance
for such amendment that the attorney prepare the
amendment for such introcuction to be made.

The motion was then made by Alderman Huxmann and
seconded by Dean to call a meeting of the Council, to sit as
a committee of the whole, for 8:00 P.M.Monda.y, September 25th,
1933 for the purpose Of holding the hearing on the application
for a beer license, submitted by the Des Plaines Recreation
Parlor, and discussing other matters. The notion was voted
upon by acclamation, whereupon the Mayor declared the motion
carried.
The Clerk then presented the application for a beer
licenses of:
THE RIVER.R ND INN, 495 Des Plaines Avenue.
The motion was made by Alderman Huxmann and seconded by
Meinshausen that this license be granted. The motion was
voted upon by acclamation, whereupon the Mayor declared the
motion carried.
THE ELK'S LODGE 11526, Masonic Temple Bldg.
The motion was made by Alderman Huxmann and seconded by
Dean that this license be granted. The motion was voted
upon by acclamation,'whereupon the Mayor declared the motion
carried.

Alderman Huxmann, chairman of the Police and
License Committee, reported that 120 out of approximately
194 business licenses are still outstanding. The motion «
was made by Alderman Huxmann and seconded by Frederick to
instruct the Chief of Police to file complaints and issue
summons against all persons, firms or corporations who
have failed to secure their business licenses. The roll
was called on the motion with the following result: Ayes;
Aldermen Ahbe, Collet, Pflughaupt, Dean, Huxmann, Bishop,
Friott,T Frederick, 2nzenbacher and Meinshausen. Bays; none.
The Mayor thereupon declared the notion carried.
The Clerk then read the following proposed ordi-
nance for second reading:
AN ORDINANCE
Be- it ordaile4 by the City Council of the City of
Des Plaines,in Cook County, in the State of Iilineist
(1) That Section 535 of Article Six of the Code of
General Ordiiunces known as the Municipal Code of
the City of Des Plaines of 1928, be and the same is
hereby amended by striking out of the first sentence
in said Section the words "Fifty ($50.00) and insert -
in in place thereof the words "Twenty-five ($25.00) .
(2i All ordinances and parts of ordinances in conflict
herewith are hereby repealed.
(3) This ordinance shall be in full force and effect
from and after its passage according to lave and shall
relate back as to said Section 535 as of January 1,
A.D. 1933.
Passed -by the City Council of the City of Des Plaines,
Cook County, Illinois this 18th day of September, A.D.

League, to hold a tag day in Des Plaines, the Police
and License Committee finds that"so far as our information
discloses the City of Des Plaines and its residents de-
rive from the Methodist Deaconess Orphanage at Lake
Bluff, we therefore recommend that the request for
permission to tag for the Children's Benefit League
in Des Plaines on October 16th,1933, be denied.

Frederick that the Council reconsider the matter of denying
persons the privilege of studying the City's special assess-
ment records without permission of the Council, and that the
City attorney be authorized to grant access to the City's
special assessment records provided it be shown that access is
desired for legitimate reasons. The motion was voted upon oy
acclamation, whereupon the Mayor declared the motion carried.
The motion was then made by Alderman Huxmann and
seconded by Pflughaupt to refer the above letter of Leonard C.
Mead, attorney, to the City Attorney. The motion was voted
upon by acclamation, whereupon the Mayor declared the motion

Honorable Mayor and Members of City Council
City of Des Plaines, Illinois
Gentlemen:
On November 29th,1932, a petition was turned over to
your board over fifty-one signatures of the residents'
of the first ward east of the river requesting that
something be done in the way of protection of pedest-
rians, and especially the school children, at the
east end of the bridge where Busse Highway and 'iner-
street intersect.
To this petition, we have had nothing but vague, ver-
bal information.
The commencement of the school year is almost upon
us and the citizens who signed this petition are now
asking what definite steps have been taken to insure
the protection of the lives of these childred as well
as the older folks.
The petition in question was accompanied by a suggestion
which was outlined on a blue print.
Will you please inform us what steps have been taken
to grant the request of these citizens.
The attached snapshot shown one of the conditions that
exist.

zenbacher to instruct the Clerk to write the County Board,
asking what has been done regarding the matter referred to
in the above letter; also to instruct the City Engineer
to inquire as to what can be done regarding the matter of
providing a guard rail on Miner Street, and to send a
copy of the Clerk's letter to both commissioners Wm.Busee,
and Homer Byrd. The motion was voted upon by acclamation,
whereupon the Mayor declared the motion carried.
The motion was made by Alderman Collet, and
seconded by Ahbe, to take out of service the street light
on the south-west corner of Center and Ellinwood Streets,
and to put back into service the light on Ellinwood Street
in front of Spiegler's Department Store. The motion was
voted upon by acclamation, whereupon the Mayor declared the
motion carried.
Carter Jenkins, City Engineer reported that it
appears that it will be necessary to prepare fairly de-
tailed plane of our proposed well and reservoir project
before we can hope to have the Government approve our
application for a loan. ne further reported that the cost
of preparing such plans would be about $800.00. The motion
was made by Alderman Huxmann and seconded by Bishop to
authorize the City Engineer to prepare plans of sufficient

detail to properly present our project to the govern-
ment. The roll was called on the motion with the follow-
ing result: Ayes; Aldermen Ahbe, Collet, Pflughaupt,
Dean, Huxmann, Bishop, Friott, Frederick, Enzenbacher,
and Meinshausen. Nays; Bone. The Mayor thereupon declared
the motion carried.

Gentlemen:
I wish to bring to the attention of your
honorable body, a serious violation of an ordinance
of the City of Des Plaines concerning the use of
firearms within the City limits.
A certain person, or persons, have been
using firearms to destroy private property by shoot-
ing and killing dogs in the neighborhood of Keeney
Ave. between Des Plaines Ave. and White at. This
destruction of other people's property, without
the permission of the police dept.is a violation.
Not only is the practice of using dogs
which are properly licensed) for target practice,
inhumane, but is also endangering lives of the
residents of this community if this practice
allowed to continue.
I believe that 1 voice the demands of
other citizens of this neighborhood, in asking
that steps be taken at once, by the proper officials,
to see that this condition be remedied and the
guilty person, or persons be apprehended.
This protection the citizens of Des Plaines
are entitled to.

As you probably know, House Bill
f553 as enacted by the 58th General Assembly, and
approved. June 30, 1933, is an act to amend certain
sections of the Motor Fuel Tax Law which provides
for the allotment of a portion of the Motor Fuel
Tax Funds to the various municipalities of the State.
in general their portion of the Motor
Fuel Tax Fund is to be expended by the municipality
for the construction and reconstruction of State High-
ways, or the construction, reconstruction and main-
tenance of a system of Arterial Streets or Thorough-
fares' within the municipality.
It is the intention of this Department
to send to all municipalities, as soon as possible
rules and regulations governing the use of these funds.
In the meantime, any inquiries concerning the adminis-
tration of this law should be directed to the under-
signed at 35 East Wacker Drive, Chicago.
