Alderman Fnzenbacher reported an attempted rape
on Center Street on the South Side and suggested more
police patrolling of this section. The motion was made
by Alderman Huxmann and seconded by Anzenbacher to offer
a .150..00 reward for any information leading to the arrest
and conviction of the person attempting this rape. The roll
was called on the motion with the following results. Ayes;
Aldermen Ahbe, Collet, Pflughaupt, Dean, Huxmann, Bishop,
Friott, Frederick, Fnzenbacher and Meinshausen. Mays; none.
The Mayor thereupon declared the motion carried.
The motion was made by Alderman huxmann and
seconded by t'flughaupt to approve the minutes of the regular
meeting of August 21, 1933. The motion was voted upon by
acclamation, whereupon the Mayor declared the motion carried.
The motion was made by Alderman Huxmann and seconded
by Pflughaupt that anyone wishing access to the City's special
assessment records must first have consent of the Council.
The motion was voted upon by acclamation, whereupon the
Mayor declared the motion carried.
The motion was made by Alderman Ahbe and seconded
by Pflughaupt to adjourn until 800 P.M. monday, September
II, 1933. The motion was voted upon by acclamation whereupon
the Mayor declared the motion carried and the Council ad-
journed until September 11, 1933.

MINUTES OF THEADIOURNID MEETING OF THE
CITY COUNCIL OF THE CITY OF DES PLAINES
HELD IN THE COUNCIL CHAMBERS ON THE llth
DAY OF SEPTEMBER, A.D.1933 AT THE HOUR
OF 8:00
The meeting was called to order by Mayor
George W.Kinder, with Aldermen Ahbe, Collet, Pflughaupt,
Dean, Huxmann, Bishop, Friott, Frederick, Enzenbacher
and Meinshausen responding to the roll call.
Mayor Kinder then announced the hearing on
the contest of election of Hobart Ahbe as Alderman,
filed by Herman Peatchman, as the first order of business.
Mr. C.Wooster, counsel for Alderman Ahbe then
stated that he had filed with the Clerk written objections
on the point of jurisdiction, upon which the Clerk read
the following letter and formal objection.-

Ahbe to the jurisdiction of the Mayor and City
Council to hear the statement of Herman Peatschman
in accordance with the action of the City Council
on June 26th.

After some debate the motion was made by Alderman Huxmann
and seconded by Bishop that the above objections on the
point of jurisdiction be overruled by the Council. The
roll was called on the motion with the following results
Ayes; Aldermen Pflughaupt, Huxmann, Bishop, Friott,
Frederick and Meinshausen. Bays; Aldermen Ahbe, Collet
Dean and Enzenbacher. The Mayor thereupon declared the
motion carried and the objections overrules.
The oaths were then administered by the Clerk
for Herman Peatchman and A.Krull as witnesses for the
complainant. mr. Peatchman and Mr. Krull testified that
five (5) unmarked ballots were taken from the polling
place by the judges of election while the polls were open,
had them marked, and brought them back to polling place
and deposited them in the ballot box. Mr. Wooster, counsel
for the defendant objected to this allegation, unless
it be proved that these five (5) ballots would materially
change the result of the election.
Alderman Huxmann held that the best proof, as
to whether or not these five (5) ballots would change
the results of the election, are the ballots themselves.
The motion was therefore made by Alderman Huxmann and
seconded by Pflughaupt that the ballots of the first
precinct of the First Ward polled in the election held
April 18,1933 be re-counted. The motion was voted upon
by acclamation, whereupon the Mayor declared the motion
carried.
The motion was then made by Alderman Ahbe
and seconded by Dean that the Mayor appoint a committee
of three (3) aldermen to serve as judges of election in
this recount. The motion was voted upon by acclamation,
whereupon the Mayor declared the motion carried.
The motion was then made by Alderman Meinshausen
and seconded by Huxmann that the Mayor also appoint a
committee of two (2) aldermen to serve as clerks of
election in this recount. The motion was voted upon by
acclamation, whereupon the Mayor declared the motion
carried.
Mayor minder then announced the appointment of
Aldermen Huxmann, inzenbacher and .bishop as judges of
election, and Aldermen Pflughaupt and Dean as Clerks of
election in this recount.
Before opening the ballots mrs. lidnia Mahn and
Mr. Henry Weber, both judges of election at the polling
place of the first precinct of the First Ward, during

the election held on April 18, 1933 inspected the sealed
bag containing the ballots of the first precinct of the
First Ward and testified under oath that they found the
bag and seal to be in the same condition as when it was
turned over to the City Clerk on the day of the said
election. The committee of judges and clerks for the
recount then re-counted the ballots of the first precinct
of the First Ward, cast during the election held April
18th, 1933, upon which Alderman Huxmann, representing
the judges and clerks for the recount, announced the
following result:

The motion was made by Alderman Huxmann and
seconded by reinhausen to proceed to also re-count the
ballots cast in the second precinct of the First Ward
in the election held April 18, 1933. Mr. August Schroeder
judge of election, at the polling place of second precinct
of the First Ward, in the election held Apri1,18,1933 in-
spected the sealed bag containing the ballots of the
said election and testified under oath that he found the
bag and seal in the same condition as when it was delivered
to the City Clerk on the day of the said elecion. The
ballots were then taken from the bag and recounted by
the judges and clerks of the recount. Alderman Huxman
representing the committee of judges and clerks then
announced the following result:

The City attorney then presented the following resolution
which was read by the Clerk;
RESOLUTION
WHEREAS the City Council has heard the testimony
of witnesses in the matter of an election contest con-
ceiving the election of an alderman of the First Ward
of the City of Des Plaines on the 18th day of April,
1933, A.D,
WHEREAS a full hearing has been had in the matter,
THEREEDRE be it resolved by the City Council of the
City of Des Plaines that the following is schedule of
votes redeived by the candidates for alderman in said
First Ward at said election:

BE IT FURTHER RESOLVED that the petition of Henry
Peatchman be dismissed, and that the election of Hobart
Ahbe as alderman of the First Ward be and is hereby con-

BE IT FURTHER RESOLVED that the City Council
finds that the judgesof election in the 2nd Precinct
in the First Ward in the City of Des Plaines, Illinois
on the 18th day of Apri1,1933 permitted ballots to be
taken from the polling place for marking by electors
contrary to law.
The motion was made by Alderman Huxmann and seconded by
Enzenbacher to adopt this proposed resolution. The roll
was called on the motion with the following result: Ayes;
Aldermen Ahbe, Collet, Pflughaupt, Dean, Huxmann, Bishop, Friott,
Frederick, Enzenbacher and Meinshausen. Nays; None. The
Mayor thereupon declared the motion carried and the reso-
lution adopted.
The Clerk then announced that the sum of approxi-
mately $511.00 has been collected by the City as 2% for-
eign fire insurance tax, and that according to law, the
receipts from foreign insurance tax must be remitted to
the treasurer of the Volunteer Firemen/s organization.
The motion was made by Alderman Frederick and seconded by
Dean that the City Treasurer be instructed to issue the
proper check of $511.00 to the treasurer of the Volunteer
Firemen's organization. The roll was called on the motion
with the following result: Ayes; Aldermen Ahbe, Collet,
Pflughaupt, Dean, huxmann, Bishop, Friott, Frederick, En-
zenbacher and Meinshausen. Nays; none. The Mayor there-
upon declared the motion carried.
The Clerk then read the following letter:

Gentlemen:
I am inclosing water bill, received during
this past week. As you will note, the amount is $35.50
and covers the last three month period, June,•July,
and August.
£rs.Frisch, upon receipt of this bill,
visited your water department and protested this bil,
but all the satisfaction received was the remarks that
the bill was O.4:. and that our meter reads correctly
and that we must have used this amount of water.
As a matter of fact, mrs. Frisch and the
family wereaway for almost a month during this time.
She was in the Northwestern Hospital for two weeks
and for twelve days up in Wisconsin, so this bill is
for about a nine week period of time. It would be
impossible for one family to use $35.50 worth of water
in nine weeks, especially if that family was as care-
ful about using the water as we are. Furthermore,
your water -meter reader advised Ars. Frisch that she
had used $7.14 of water in the past two weeks, since
the meter was read.
I have been using the water coming through
this meter since 1931 and in the summer of 1931
having put new lawns in and sprinkled continually
every day for long periods, my water bill was more
than $10.00 less than this present bill.

The meeting was called to order by Mayor George W.
Kinder, with Aldermen Ahbe, Collet, Pflughaupt, Dean, Huxmann,
Bishop, Friott, Frederick, Enzenbacher and Meinshausen respond-
ing to the roll call.
Alderman Friott, chairman of the Judiciary and assess-
ment committee tken submitted the following report which was
read by the Clerk:
REGARDING the demand of Tolman,Chandler & Dickinson,
attorneys for the Bondholders of Special Assessment 09,
for the City to levy a supplemental assessment to [99;
matter referred to Judiciary & Assessment Committee who
report as follows:
Judiciary and Assessment Committee has investigated and
found that to levy a supplemental assessment at this time
would be of no substantial benefit to the bond holders
because the collection thereof would be largely delinquent
and have a depressing effect upon the payment of future
installments of the original assessment by the property
owners who have up to this time been able to keep up
their payments and who in large numbers would be dis-
couraged by such supplemental assessment from even keeping
up the payments that they have peen struggling to keep up.
We therefore recommend: that this view of the matter be
adopted by the City Council and that the attorneys for
the bond holders be advised thereof and requested to
urge upon their clients to refrain from any further action
until an improvement in conditions generally, made pay-
ment of the assessment by property owners, now unable
to pay, possible.

The motion was made by Alderman Huxmann and seconded by Pflug-
haupt to accept this report and concurr in its recommendations.
The motion was voted upon by acclamation, whereupon the Mayor
declared the motion carried.
Alderman Collet, chairman of the Streets and sidewalks
Committee submitted a request from the Purol Filling :station,
Miner and Pearson Streets, asking the city to mark "no parking t
on the streets at the entrances to the filling station. The
motion was made by Alderman Ahbe and seconded by Pflughaupt to
authorize the Street Committee to mark this portion of the streets
in question. according to the committee's best judgement. The
motion was voted upon by acclamation, whereupon the Mayor declared
the motion carried.
Upon the request of Alderman Collet, chairman of the
Streets Committee, Carter Jenkins, City Engineer reported that
upon instructions of the Council he has secured the following
estimates from Milburn Bros:
Grading 14 Blocks of streets in Riverview $300.00
Widening Prairie Ave.at laanteuffel corner 250.00
The motion was made by Alderman Enzenbacher and seconded by
Collet to authorize the Streets Committee to instruct Kilburn
Bros. to widen Prairie Ave. at Manteuffel's corner according to
the engineer's specification under the supervision of the Super-

In view of the foregoing, 1 am protesting this
bill and demand a new meter installation, at once
and I will pay this bill in proportion to what the
new meter shows over a 30 day period or longer
which you can determine.
I am not refusing to pay any just bills and
have paid my water bills promptly,vhenever rendered,
but this bill is so fat out of line and after check-
ing up with my neighbors, who I know have used their
sprinklers a great deal more this summer than I
have and whose bills are less than 1/2 and in some
cases 1(3 of my bill, I am convinced that there is
something wrong with the meter you installed and
that I have been overpaying the water department
for what 1 actuallyined since the installation.
Please advise me at once what you propose to do.
