The meeting was called to order by liayor George Hinder, with Alderman Ahbe, Collet, Pflughaupt, Dean, Huxmann, Friott, Frederick, Enzenbacher and leinshausen responding to the roll call. .The Clerk then read the following official's reports for the Calendar June 1933: The report of Chief of Police,Howard '.Becker The report of City Clerk, Edgar J.Friedrich The report of City Treasurer, Chas.M.Larson. Mayor Kinder then appointed "aldermen Pflughaupt, Collet and Leinshausen as a committee to canvass the vote of the special aldermanic election held June 29 in the Third t:ard, and declared a recess until the canvassing committee was ready to report. After the meeting was again called to order Alderman Pflughaupt, chairman of the canvassing committee submitted the following report: - To the Mayor and City Council of the City of Des 21aines Gentlemen: The following is a statement of the votes cast in a Special Aldermanic election held in the Third \arc: of the City of Des 'laines,in the County of Cook and :Mate of Illinois on the 29th day of June,A.D.1933: Chas. L.Bishop received 126 votes for Alderman Chas.Hausner received 1 vote for Alderman 144 1:e, the undersigned, Canvassing Board of the City above named, have this day canvassed the returns of the aforesaid Election, and the foregoing Abstract was made by us in the presence of the City .Council of the City of Des Plaines this 5th day of July A.D. The roll was called on the motion with the following result:Fr Ayes; Alderman Ahbe, Collet, Fflughaupt, Huxmann, 2riott, Frederick and r-einshausen. ?Jays; Aldermen .Jean and .i nzen- bacher. The Mayor thereupon declared the resolution adopted. Mr. Bishop then stepped to the front and his oath of office was administered by the Clerk, upon which .r. Bishop expressed his eagerness to be of real service to the City, and pledged himself to conduct his office fairly and honestly. The Judiciary and Assessment Committee had no report to offer. Alderman Collet, chairman of the Streets and Sidewalks Committee reported that Lee Street has been patched in many places, and that there are many Canada Thistles growing in parkways, which need cutting... Mayor Kinder then announced the appointment of .Albert Reck, as Commissioner of Canada Thistles. The motion was made by Alderman Huxmann and seconded by Collet to confirm this appointment. The motion was voted upon by acclamation, whereupon the Mayor declared the motion carried and the appointment confirmed. Alderman Ahbe, chairman of the Buildings Plats and 'Public Vorks Committee reported on the remodelling of the City Clerk's and Police quarters and asked the attorney for the opinion he was ordered to submit. Attorney Meyer thereupon reported orally from the following letter: KENNETH G .MEYER Attorney at Law June 26,1933 To the Mayor and 'City Council of the City of Des Plaines Des Plaines, Illinois Gentlemen: In accordance with your request for an opinion on the question on the right of the City of Des Plaines to make alterations in the City Hall, the cost of which will exceed ,�50d.CO, and upon which question two points were raised by the City Council, namely, first, the right to make such re- pairs without the necessity of advertising for bids, and second, the right to make said repairs without a sufficient specific appropriation therefor, I wish tdvise that assuming that a proper appropriation had been made, the City has the right to make the repairs in question without the necessity of advertising for bids, provided such work is authorized by tvo-thirds of the City Council. 146 This authority is given to the City Council under Section 50 of Article IX of the Cities and Vil- lages Act, which reads as follows: "Any work or other public improvement,ex- cept any work or public improvement to be }laid for in whole or in part by a special assessment shall, when the expense thereof shall exceed ti5CC, either be con- structed onstructed by contract let to the lowest responsible bidder in the manner prescribed by ordinance:.l'ro- vided,'h°awever, any such contract may be entered into by the ` )roper officers without advertising for bids, by a vote of two-thirds of all the aldermen or trustees elected; or such work or other public improvement shall be constructed in the following'fnanner, by a vote two-thirds of all the aldermen or trustees elected, to -wit: The commissioner of public v,orks or other proper officers to be designated by ordinance, shall superintend and cause to be carried out the construction of such work or other public improvement and shall employ for the performance of all manuel labor there- on, exclusively laborers and artisans whom the city or village shall pay by the day or hour, and all mat- erial of the value of $500. and upward using in the construction of such work or other public improvement, shall be purchased by contract let to the lowest responsible bidder in the manner to be prescribed by ordinance." Lith respect to the right of the City to lake these repairs without a specific appropriation, I wish to advise that under the appropriation ordinance for the year 1933, whichvas passed on march 30,1933, under the heading "Department of Public Works" the sum of X500.00 was appropriated for maintaining,cleaning and repairing the City Hall, which technically is all the City is authorized to spend for maintaining,clean- ing and repairing of the City Hall. The sum of -1,250.00 was appropriated under said 1933 appropriation ordinance for "as a con- tingent account for iaintanance, operation and capital outlay for corporate purposes arising from unusual and unforseen conditions, loss or damage. Said section of the appropriation ordinance is for the purpose of meeting the provisions of Section 3 of Article VII bf the Cities and villages Act. This provides among other things that "That neither the City Council nor the Board of Trustees nor any department or officer xx x x x x x shall add to the corporation expenditures in any one year, anything over and above the amount provided for in the annual appropriation bill x x x x provided, however, that nothing herein contained shall prevent the City Council by a two-thirds vote, making additional appropriations for the purpose of making any improvements or restorations, the necessity for which is caused by any casualty or accident hap- pening after such annual appropriation is made, nor from making expenditures nor incurring liabilities necessary to meet any emergency created by epidemic, happening after and unforeseen at the time of making the annual appropriation x x x x x x. 147 In my opinion it would be placing a very broad construction on section of the statute just quoted and the section of the appropriation ordinance withreference to contingent expenses to say that the repairs in question are charge able to the contingent account of the appropriation ordinance. Another techniasl question arises when you consider employing men who are irndebted to the water department by reason of .t3paid water bills and charging the Streets Department by employing men who owe for vehicle tax. 1f, tech- nicalities can be overlooked this question no doubt can be met without difficulty. However, in view of the foregoing statement of law, 1 am of the opinion that strictly and legally the City is not Whorized to proceed with the repairs of the City Hall without a sufficient appropri- ation therefor. The Sewer, Drainage and Sanitation Committee had no report to offer. The Committee of Water and water Mains had no report to offer. The Band Committee had no report to offer. The Finance Committee then submitted the follow - in report, which was x read by the Clerk: REG ARDI1 t The letter of Frank J.Nugent offering to examine the records of County Clerk's Office for the purpose of ascer- taining the amount of money on deposit with the County Clerk on account of redemptions from sales to the City of Des Plaines and on withdrawn specials and not paid over to the City of Des Plaines by the County Clerk, for a commission of 1C° of the, actual money received as the result of his services, We, your committee on Finance therefore recommend: that Yr. Larson, City Treasurer, be requested to see if this work cannot be done for less money. G.Walter Pflughaupt,Chairman This report was recomitted to the Finance Committee by the Mayor. Carter Jenkins, City Engineer, asked the Councils' authority to prepare a letter to be signed by the Clerk and addressed to the Soo Line Railroad asking the railroad's permission to cross under its right-of-way with the proposed 148 Keeney Avenue -Algonquin Road water main connection. The motion was made by Alderman Huxmann and seconded by Meinshausen that this be done. The motion was voted upon by acclamation, whereupon the Mayor declared the motion carried. Mr. Jenkins, City Engineer, also reported that a State Board has been formed for the purpose of distri- buting moneys provided by the Federal Government. He stated that in his opinion the Cater ',ell project might be financed easily with aid from this State Board. He stated that under this arrangement the City would receive an outright gift of 30% of the total price, and could borrow the remainder at 32% to beamortized over a 25 - year period. The motion was made by Alderman Huxmann and seconded by Meinshausen to instruct the Mayor to write to this board and in general begin the necessary preliminaries to the well project. The motion was voted upon by acclamation, whereupon the Mayor declared the motion carried. Carter Jenlins, City Engineer, then submitted the proposed contract with Jas.B.Clow & Sons for water pipe and recommended that the manhole frames and covers be eliminated from the contract because the City has enough of these on hand. The motion was made by Alderman Huxmann and seconded by Friott to authorize the Mayor and City Clerk to sign this contract with the manhole frames and covers eliminated. The roll was called on the motion with the following result: Alderman Ahbe, Collet, Pflughaupt, Dean, Huxmann, Bishop, Friott, Frederick, Fnzenbaccer and keinshausen. Nays; klone. The Mayor thereupon declared the motion carried. Alderman Ahbe, requested the council to post- pone the hearing on the .contest of his election for two weeks, because he will be out of town on his vacation. The motion was made by Alderman Huxrnann and seconded by Collet to postpone this hearing to September 11,1933. The motion was voted upon by acclamation, whereupon the "kayor declared the motion carried. The Clerk then reported that a written objection to the jurisdiction of the Council to hear the statement of Herman Peatchman contesting Alderman Ahbe's election, has been filed by ter. Ahbe's attorneys. The motion was then made by Alderman Frederick and seconded by Friott that the hearing on the objection on the point of juris- diction of the Council in Mr. Ahbe's case also be set for Sept.11,1933. The motion was voted upon by accla- mation, whereupon the Mayor declared the motion carried. The Clerk then read the following proposed ordinance for second reading. AN ORDINANCE AM=DING ARTICLE 2, ENTITIED "DOGS" OF CHAPTER 25 CF THE MUNICIPAL CODE OF THE CITY OF DES PLAINES OF THE YEAR 1928. We believe that this street could be marked off to permit parking on one side only at a very slight expense which would certainly remedy the present unsatisfactory conditions. Alderman Meinshausen then tendered his oral resig- nation as chairman of the Water Committee. The motion was made by Alderman Huxmann and seconded by Friott to accept 153 this resignation. Mayor 'Kinder then announced the appointment of Alderman Bishop as chairman of the Water Committee, to succeed Alderman Meir_shausen who resigned. The motion v;as made by Alderman Huxmann and seconded by Enzenbacher to confirm, this appointment. The motion was voted upon by acclamation, whereupon the Idayor declared the motion carried, and the appointment confirmed. The motion was made by Alderman Huxmann and seconded by Enzenbacher that in the future the signature of the chairman of the Yinance Committee be sufficient on all City vouchers and that the signatures of the rema=ining two members of the Finance Committee be not required. The motion was made by Alderman Enzenbacher and. seconded by :Ahbe that in the future the Treasurer furnish each Alderman and the Mayor a copy of the Treasurer's monthly report.
