MINUTES OF ADJOURNED REGULAR MEETING
OF THE CITY COUNCIL OF THE CITY OF DES
PLAINTS, HELD IN THE COUNCIL CHAMBERS -
ON THE 12th DAY OF JUNE, 1933 AT THE HOUR
OF 8 O'CLOCK P.M«
The meeting was called to order by Mayor George
Kinder with -Aldermen Ahbe, Collet, flughaupt, Dean,Huxmann,
Friott, Frederick, Lnzenbacher ,and Meinshausen responding
to the roll call.
As the first order of business, Mayor :Hinder
called upon the Council to set the time for hearing of
evidence in the matter of the contest of the election
of Alderman Hobart Ahbe, filed by Mx. Herman Peatchrnan,
The motion was made -.by Alderman z'flugnaupt,ana seconded"
by Huxmann . to set 'Monday, Jure 26,1933, -at 8:CO P.M. as -
the time for the hearing to bQ held in the Council Chambers.
The roll was called on the motion with the following result:
Ayes; Aldermen Collet, Pflughaupt, Dean, Huxmann,'FriOtt,
Frederick and Meinshausen. Nays; Alderman Enzenbacher.
Alderman Ahbe declined to vote. The Mayor thereupon declared
the motion carried.
The motion was then made by alderman Enzenbacher
and seconded by Collet that Alderman Ahbe be permitted to
have an attorney represent him at the hearing on the contest
of his election and that his attorney's fees be paid by
the city. The roll was called on the motion with the follow-
ing result: Ayes; Aldermen Ahbe, Collet, Dean and .6nzenbacher.
Nays; Aldermen Pflughaupt, Huxmann, Friott, r'rederick and
Meinshausen. The Mayor thereupon declared the motion defeated.
The Mayor then presented the matter of purchasing
materials for the Algonquin Rd. -Keeney Ave. water main
connection. The Clerk presented a number of bids. The
motion was made by Alderman Huxmann and seconded by Mixxx-
Meinshausen to buy the pipe and necessary material for
this job from. Jas.B.Clow & Sons. s payor Kinder however
ruled the motion out of order, ruling that the City did not
properly advertise for bids for this material. The motion
was then made by Alderman Huxmann and seconded by Meins-
hausen to instruct Carter tienkins, engineer, to prepare
specifications for the materials required; and to instruct
the Clerk to advertise for bids on the material in the next
issue of the Des Plaines Suburban Times. The bids to be
in the Clerk's hands not later than 8:00 P.I. Monday,June
26,1933, and to state that a credit extension of at least
six months is granted. The motion was voted upon by
acclamation, whereupon the Mayor declared the motion carried.

Dear Sir:
I beg to submit the following recommendation:
That the Garbage Department buy from the rittsburgh
_..Des Moines Steel Company, Bond #11 in the incinerator
account, Due Jan.lst,1932 for $1000.00 in order to
save paying interest on same.
The Treasurer has funds on hand to ioay the interest on
d's18,8C0.0C and also to retire Bond /#10 for 4800.00.
The Garbage Department has on hand a cash balance of
2,132.06. In addition to this the Village of Park
Ridge is in arrears for the months of February, Iuarch,
April and May, approximately 1,000.CO.
Therefore, 1 consider that there is sufficient money
to operate the Garbage Department.

The motion was made by Alderman huxmann and seconded by
Collet to accept this check, and instruct the Clerk to
acknowledge receipt of the check and place the letter on
file. The motion was voted upon by acclamation, whereupon
the Mayor declared the motion carried.

We have an amount ..of $64.00 due the City
for Vehicle Tax for equipment We hold a $50.00
City Warrant. We*took this from one of your em-
ployees for coal and .we would like to turn this
in in part payment for our Vehicle lax. We also
have an open account of $114.00. We would like to
turn in this warrant on the Tax and take the _bal-
ance out on the open account.
Kindly let us know if this is satisfactory
and we will make arrangements with the City Clerk
for same.

I have been patiently waiting to hear as to what
you are going to do regarding this account. If
nothing is done, the only thing left for us to do
is to start a law suit against the City of Des Plaines,
and it can -all be avoided by our getting together and
agreeing to some kind of a proposition.

The motion was made by Alderman Huxmann and seconded
by Collet to refer this letter to the Finance Committee.
The motion was voted upon by acclamation, whereupon the
Mayor declared the motion carried.
The Clerk then reported that the Des Plaines
Realty Co. is making a strenuous effort to collect from
the City, a bill of rf.15.74 for premiums on compensation
insurance on city employees. The motion was made by
Alderman Huxmann and seconded by Dean to refer this
bill to the Judiciary Committee. The motion was voted
upon by acclamation, whereupon the Mayor declared the
motion carried.
City Attorney, Kenneth Meyer, reported that
Mr. Maloney, former attorney for the city, .has the
new assessment roll on Special Assessment #100 completed,
and that it will be necessary to re -type the roll, which
requires considerable work. The motion was glade by
Alderman Huxmann and seconded by Meinshausen to instruct
Mr. Meyer, attorney, to present an estimate of the cost
of this typing, at the next Council Meeting. The motion
was voted upon by acclamation, whereupon the mayor declared
the motion carried.
The Clerk then reported thsit he is receiving
an increased number of complaints regarding thistles. The
matter of ridding the City of thistles was discussed and
finally referred to the Judiciary Committee by the Mayor.
The City Treasurer, hr. Chas.Larson, then addressed
the council and urged to make a formal demand upon the
County Clerk to remit to the City such Special Assessment
funds or General Tax funds as he may have in his possession,
and which may be due the City. The motion was made by
Alderman Huxmann and seconded by Friott to refer this matter
to the Finance Committee. The motion was voted upon by
acclamation, whereupon the Mayor declared the motion carried.
Alderman Huxmann then reported that he has been
informed that a former City employee has started an inde-
pendent garbage and ash collection service, and is robbing
the city of some of its customers. Alderman Frederick read
Section 5, of the Garbage Ordinance adopted August 6,1928,
and contended that starting an independent garbage collection
service is a violation of this section. The motion was made
by Alderman Huxmann and seconded by Frederick to refer this
question to Mr. Beyer, attorney, for an opinion as to
whether an individual has the right to start an independent
garbage collection business in the city, and if so whether
the city has a right to license such a business. The motion
was voted upon by acclamation, whereupon the Mayor declared
the motion carried.
The motion was made by Alderman Pflughaupt and
seconded by Meinshausen to adjourn. The motion was voted
upon by acclamation, whereupon the tviayor declared the
motion carried,and the Council regularly adjourned.
