MINUTES OF THE REGULAR MEETING OF
THE CITY COUNCIL OF THE CITY OF DES
PLIES, HELD IN THE COUNCIL CHAMBERS
ON THE 15th DAY OF MAY, 1933. AT THE
HOUR OF 8 O'CLOCK F.M.
The meeting was called to order by Mayor George W.
Kinder, with Aldermen, Ahbe, Collet, Pflughaupt, Dean, Huxmann,
Friott, Frederick and Meinshausen responding to the roll call.
Alderman Enzenbaher was absent but arrived later in the evening.

The Judiciary and Assessment Committee had no report
The Police and License Committee through Alderman
Huxmann, its chairman, recommended the purchase of report and
record forms for the police department costing approximately
$ 60.00. The motion was made by Alderman Huxmann, and seconded
by Dean to authorize the Police Committee to expend not to
exceed $60.00 for these forms. The roll was called on the
motion with the following result: Ayes; Aldermen Ahbe, Collet,
Pflughaupt, Dean, Huxmann, Friott, Frederick and Meinshausen;
Nays: None. The Mayor thereupon declared the motion carried.
The Police and License Committee through Alderman
Huxmann, its chairman, recommended the purchase of a police
radio receiving set for the squad car. The motion was made
by Alderman Huxmann and seconded by Pflughaupt to authorize
the Police Committee to purchase such a radio receiving set
at a cost not to exceed $50.00. The roll was called on the
motion with the following result: Ayes; Aldermen Ahbe, Collet,
Pflughaupt, Dean, Huxmann, Friott, Frederick and leinshausen.
Kays; None. The Mayor thereupon declared the motion carried.

The committee on Building, Plats and Public Works
had no report to offer.
The Sewer, Drainage and Sanitation Committee had
no report to offer.
The Water Committee had no report to offer.
Note: At this point Alderman Enzenbacher entered
the meeting.
Alderman Collet, chairman of the Streets and Sidewalks
Committee then reported regarding the proposed stoning of streets
in "Riverview, and asked lir. Jenkins, engineer, to elaborate upon
the matter. Mr. Jenkins read the following letter:

Dear Sir:
At your suggestion and in accordance with
the directions of the Council on April 3rd, I am
submitting herewith an estimate of cost for surfacing
certain streets in the southerly part of Des Plaines,
"Riverview."
I have estimated the cost using crushed

as the surfacing material and also bank run gravel.
To the total costs given herewith, there should be
added about 3%' in order to cover the cost of engineering
and inspection.
A compacted depth of 8* of stone over a sur-
faced width of 20 feet has been used in determining the
quantities in the estimate, except on Illinois Street
where a compacted depth of 6" was used.
Two routes have been selected in preparing
the estimate, a verbal discussion of the merits of
each will be given if asked for.

The motion was made by Alderman Huxmann, and seconded by
Enzenbacher to refer this matter to the Council as a
committee of the whole. The motion was voted upon by
acclamation whereupon the Mayor declared the motion carried.
The Clerk then read the following proposed ordi-
nance for second reading: -
PROVIDING FOR A SPECIAL FT.FCTION TO BE
HELD IN THE CITY OF DES PLAINES , COUNTY
OF COOK AND STATE OF ILLINOIS.
The motion was made by Alderman Huxmann and seconded by
Meinshausen to amend this proposed ordinance so as to
set the date of the proposed special election for June 29,
1933. The roll was called on the amendment with the following
result: Ayes; Aldermen Pflughaupt, Huxmann, Friott, Frederick,
and Meinshausen. Nays; Aldermen, Ahbe, Collet, Dean and
Enzenbacher. The Mayor thereupon declared the Amendment carried.
The motion was then made by Alderman Huxmann and seconded by
Pflughaupt to amend this proposed ordinance by inserting the
following section,
SECTION 7: That Henry J.Kehe and Edw.Gerig be, and

they are hereby appointed judges of such election; and
that Elizabeth Hodgson and Mayme Haussner be and they
are hereby appointed clerks of such special election.
The roll was called on the motion to amend with the
following result; Ayes; Aldermen Pflughaupt, Huxmann,
Friott, Frederick andeinshausen. mays; Aldermen Ahbe,
Collet, Dean and Enzenbacher. The Mayor thereupon declared
the amendment carried. The motion was then made by Alderman
Huxmann and seconded by Meinshausen to adopt this proposed
ordinance as amended. The roll was called on the motion, to
adopt, with the following result: Ayes; Aldermen rflughaupt,
Huxmann, Friott, Frederick and Meinshausen. Nays; Aldermen
Ahbe, Collet, Dean and Enzenbacher. The Mayor thereupon
declared the motion defeated and the proposed ordinance not
passed.
Alderman Huxmann then presented the following
resolution which was read by the Clerk:
Resolution providing for the calling of a
Special Election in the Third Ward, City of Des Plaines,
to be held on the 29th day of June, A.D.1933.
WHEREAS, there is a vacancy in the office of
Alderman in the Third Ward in the City of Des Plaines
caused by the resignation of George W.Kinder, and,
WHEREAS, the law of the State of Illinois
requires that vacancies in the offices of Alderman
shall be filled by an Election.
NOW, THEREFORE, BE IT RESOLVED, by the City
Council of the City of Des Plaines that a Special
Election for one Alderman be Ailed in the Third Ward
in the City of Des Plaines to fill the vacancy caused
by the resignation of George W.Kinder.
IT FURTHER RESOLVED, that said Special
Election be held on the 29th day of June, A.D.1933 and
that the polling places for said election shall be a
Whitcomb's Garage, Graceland,Avenue, Des Plaines,Illinois,
and that the polls for sad election shall be opened at
6:00 o'clock A.M.(daylight saving time) on said date,
and shall close at 5:00 o'clock P.M. (daylight saving
time) on said date.
IT IS FURTHER RESOLVED that Henry J.Kehe and
Edward Gerig are appointed Judges of said election to
perform the duties of said office as provided by law, and
that Elizabeth Hodgson and Mayme Haussner be and are
appointed as clerks of said election to perform the duties
of said office as prescribed by law.
AND BE IT FURTHER RESOLVED that the City
Clerk publish a notice of the purpose, time and place of
said election as provided by law, and that said Special
Election shall in all respects be held according to law
and the ordinances of said City.
BE IT FURTHER RESOLVED that said Judges and
Clerks of election shall serve without compensation and
no rent be paid for polling place, and that the ballots
be furnished without expense to the City of Des Plaines.
The motion was made by Alderman Huxmann and seconded by
Pflughaupt to adopt this proposed resolution. The roll
was called on the motion with the following result: Ayes;

The Mayor thereupon declared the motion carried and the resolution

Alderman Enzenbacher then spoke on the resolution just/
adopted and was ruled out of order by the Mayor. Alderman Enzen-
bacher appealed from the decision of the Mayor on this point
of order. The motion was made by Alderman Huxmann and seconded
by Pflughaupt that the Council sustain the Mayor in his decision.
The roll was called on the motion with the following result:
Ayes; Aldermen Pflughaupt, Huxmann, Friott, Frederick and
Meinshausen. Nays; None. The Mayor thereupon declared the
motion carried and the ruling sustained.
The Clerk then read the following proposed ordinance
for second readings
AN ORDINANCE AMENDING SECTION 39 OF V
ARTICLE 1 OF CHAPTER 3 OF THE REVISED
ORDINANCES OF THE CITY OF DES PLAINES,
ILLINOIS- 1928.
Be it Ordained by the City Council of the
City of Des Plaines, Cook County, Illinois.
SECTION 1. That Section 39 of Article 1,
entitled "Salary" of Chapter 3, entitled "Other
City Officials" of the Reused Ordinances of the
City of Des Plaines, 1928, be and the same is
hereby amended to read as follows:
*SECTION 39, SALARY - That the City
Attorney shall receive as compensation
a salary of Two Thousand Dollars
02,000.00) per annum, payable in equal
monthly installments."
SECTION 2. All Ordinances and parts of
Ordinances conflicting with the provisions of this
Ordinance are hereby repealed so far as they conflict
herewith.
SECTION 3. This Ordinance shall be in force

to adopt this proposed ordinance. The motion was made by Alderman
Enzenbacher and seconded by Ahbe to defer action on this proposed
ordinance until the next regular meeting of the Council. The roll
was called on the motion to defer with the following result: Ayes;
Aldermen Ahbe, Collet, Dean and Enzenbacher; Nays; Aldermen
Pflughaupt, Huxmann, Friott, Frederick and Meinshausen. The Mayor
thereupon declared the motion to defer, defeated. The roll was
then called on the main motion to adopt, with the following
result: Ayes; Aldermen eflughaupt, Huxmann, Friott, Frederick
and Meinshausen. Nays; Aldermen Ahbe, Collet, Dean and Enzenbacher.
The Mayor thereupon declared the motion lost and the ordinance
defeated for want of a Council majority.

resolution:
RESOLUTION FIXING BOND OF CITY ATTORNEY
WHEREAS, the laws of the State of Illinois
require officials of cities, whether appointed or
elected to give bond for the faithful performance
of their duties, and
WHEREAS, the penal sum of the official bond
of the City Attorney of the City of Des Plaines has not
been fixed by ordinance or resolution;
THEREFORE, Be it Resolved by the City
Council of the City of Des Plaines that the official
bond with security of •the City Attorney of the City
of Des Plaines, Illinois, be fixed at Two Thousand
02,000.00) Dollars, and conditioned for the faithful
performance of the duties of the City Attorney and
payable to the City of Des Plaines.
The motion was made by Alderman Huxmann and seconded by
Meinshausen to adopt this proposed resolution. The roll
was called on the motion with the following result:

COOK COUNTY, ILLINOIS TO SERVE FOR THE
TERM BEGINNING MAY 1,1933 AND ENDING
MAY 1,1934.
The motion was made by Alderman Huxmann and seconded by
Meinshausen to put this proposed ordinance on passage.
The roll was called on the motion "to put on passage"
with the following result: Ayes; Aldermen Ahbe, Collet,
Pflughaupt, Dean, Huxmann, Friott, Frederick, Enzenbacher,
and Meinshausen. Nays; None. The Mayor thereupon declared
the motion carried. . The motion was then made by Alderman
Huxmann and seconded by Ahbe to adopt this proposed
ordinance. The roll was called on the motion to adopt,
with the following result: Ayes; Aldermen Ahbe, Collet,
Pflughaupt, Dean, Huxmann, Friott, Frederick, Enzenbacher
and Meinshausen. Nays; None. The Mayor thereupon declared
the motion carried and the ordinance passed.
The Clerk therf read the following proposed ordinance
for first reading'
ORDINANCE
BE IT ORDAINED by the Mayrand and City
Council of the City of Des Plaines, Cook County,Illinois;
SECTION 1: That Carter Jenkins be and he
is hereby employed and retained as engineer for the
City of Des Plaines under and subject to the Conditions
of a contract, copy of which is hereto attached and
made a part of this ordinance.
SECTION 2: That the kayor and City Clerk

authorized and empowered to execute contract to the
said Carter Jenkins, copy of which is hereto attached.
SECTION 3: That all ordinances or parts
of ordinances in conflict herewith, be, and the same

in full force and effect from and after its passage
and the approval according to law.

We started a beer and sandwich shop
at 1572 Miner Street on May 3rd and got our govern-
ment license for May and June at a monthly pro-
rated rate for the part of year ending June 30th,1933.
As the city license is $35.00 for April,
May and June we think it would be fair if you could
allow us to pay for the two months at the pro -rated
monthly rate of $11.67 per month instead of paying
the full $35.00.

I have been Special Policeman for the past four
years at the Des Plaines Incinerator without pay.
The chairmen of the previous years, have promised
me pay, but as yet have not received any.
Whenever 1 have seen a car pull in to dump,
I went down and had them dump in the right place.
However, if they were from you of town, 1 gave
them an arrest slip. This has all cost me gas and
oil; besides wear and tear of my car. I think
I am entitled to at least fifty dollars for my
time and expense during the past four years.

The motion was made by Alderman Huxmann and seconded by Dean
that these appointments be confirmed. The motion was voted
upon by acclamation, whereupon Mayor Kinder declared the
motion carried and the appointments to the Plan -Commission

The motion was made by Alderman Meinshausen and seconded by
Huxmann to adopt this resolution. The roll was called on the
motion with the following result; Ayes; Aldermen Ahbe, Collet,

Mays Kinder then recommitted to the Buildings and
Plats Committee, the letter of J.V.Neville dated May 1,1933
and spread upon the minutes of the Council Meeting of May 1,
1933.
The motion was made by Alderman Huxmann and seconded
by Frederick to defer approval of the minutes of the Council
meeting of May 1,1933, *till the next regular meeting.
Alderman Frederick of the Fourth Ward then read a
complaint, objecting to unsanitary conditions in connection
with a certain privy in his ward. The motion was made by
Alderman Huxmann and seconded by Frederick to refer this
complaint to the Police Committee for report at the next
regular council meeting. The motion was toted upon by
acclamation, whereupon the Mayor declared the motion carried.
The motion was made by Alderman Meinshausen and
seconded by Huxmann that the council regularly adjourn. The
motion was voted upon by acclamation, whereupon the Mayor
declared the Council regularly adjourned.
