The meeting was called to order by Mayor Charles
Hammerl with Aldermen Ahbe, Collet, Pflughaupt, Dean, Huxmann,
Kinder, Lacey,Friott and Meinshausen responding to the roll
call. Alderman Enzenbacher was absent.

The motion was made by Alderman Lacey and seconded
by Collet to approve the minutes of the regular meeting of April
17,1933, and of the adjourned regular meeting of April 19,1933,
as written. The motion was voted upon by acclamation, whereupon
the Mayor declared the motion carried.

In order that the City may be advised of the

matters now under my supervision, I am herewith
submitting report of cases now undisposed, together
with the condition of the same.
I am pleased to report that with one exception,
all of the matters originally turned over to me, have
been disposed of, and the only active suits pending
at this time against the City of Des Plaines are suits
for defaulted bonds and the Cater litigation. The
matters are as follows:
Mabel S.Purchase V. City of Des Plaines,Circuit Court

City of Des Plaines v. Mabel S. Purchase, Circuit Court
No .B-16'7908.
Both of these cases are at issue and should not
be tried unless Mabel S. Purchase urges trial.
Carleton'D.Beh v. City of Des Plaines, Superior Court
No. 574904. Suit filed by Carleton D. Beh for moneys
due on special assessment bonds received by former
treasurer of Des Plaines.
Bankers Life Insurance Co. V. City of Des Plaines,
Superior Court Fo.574905. Suit filed by Bankers Life
Insurance Company for moneys due on special assessment
bonds received by former treasurer of Des Plaines.
In both of the above cases answers to the bilis
of complaint are due to be filed on May 15th,1933.
Meyerstein v. City of Des Plaines, Circuit Court
No.B-266335. Bill for accounting against the City
of Des Plaines for moneys collected in Special Assess-
ment No.60. Appearance has been entered and answer
is due on the 7th day of May, 1933.
Cater v. City of Des Plaines, Circuit Court No.
B-235142. This case is pending upon bill and cross -
bill and answer thereto and upon exceptions filed
to the answer of the City of Des Plaines to the
amended and supplemental bill. The matter has been
referred to Master Miner.

I have applied to Mr. Frederick for permit to place
small portable wooden counter stand to be used for sale
of fruits, flowers, vegetables, eggs, etc. at inter
section of east side of Manheim Road and alley south
of Oakton St.(as per attached drawing). Mr.Frederick
has denied permit without your sanction.
This block has nothing on it except a large sign-
board of partly wooden construction, has grown up in
weeds and has been used as a ,.dumping ground for junk.
It is zoned for business.
This being a prominent corner at the entrance to the
city and as 1 have recently moved into the residence
across the alley 1 would be interested in cleaning it
up.
If you gentlemen see fit to grant me permit
small portable sales stand, on this property
I can arrange with the owner to improve the
of same.

The motion was made by .alderman Pflughaupt and seconded by
Meinshausen that the Mayor and City Clerk by authorized to
issue the proper warrants in payment of these bills and
salaries. The roll was called on the motion with the

Mayor thereupon declared the motion carried.
The motion was then made by Alderman Huxmann and
seconded by Pflughaupt to approve the Surety Bond of Mayor -
elect George W.Kinder. The roll was called on the motion
with the following result: Ayes; Aldermen Ahbe, Collet,
Pflughaupt, Dean, Huxmann, Lacey, Friott and keinshausen.
Nays; None. Mayor Hammerl thereupon declared the motion
carried and the bond approved.
The motion was then made by Alderman Lacey and
seconded by Ahbe that the Council adjourn sine die in order
to carry out the formality of seating the newly elected
officers. The motion was voted upon by acclamation, where-
upon Mayor Hammerl declared the motion carried and the
council adjourned sine die.
Following this adjournment, the various retiring
officers and the newly elected officers each briefly addressed
the assembly, and the oaths of office of the newly elected
officers were administered.
Mayor Hammerl then turned the gavel over to the
newly elected Mayor George W. Kinder who called the meeting
to order with the following Aldermen responding to the roll
call: Aldermen Ahbe, Collet, Pflughaupt, Dean, Huxmann,
Fredericks, Friott and £einshausen. Alderman Enzenbacher
was absent.
Alderman Ahbe presented an excuse for Alderman
Enzenbacher, stating that lir. Enzenbacher begs to be excused
because due to the heavy rain it was impossible for him to
reach the meeting.
Mayor Kinder then announced the appointment of the
following standing committees of the Council:

that the Council concurr in the foregoing appointments. The

The Clerk then read the following proposed ordi-
nance for first readings
AN ORDINANCE
PROVIDING FOR A SPECIAL ELECTION TO BE
HELD IN THE CITY OF DES PLAINES, COUNTY
OF COOK AND STATE OF ILLINOIS.
BE IT ORDAINED by the City Council of the City
of Des Plaines, Cook County, Illinois;
SECTION is That a special election be and the
same is hereby called to be held in the Third Ward of the
City of Des Plaines, County of Cook and State of Illinois,
on the day of July, A.D.1933, for the purpose
of electing an alderman for the Third Ward of the said
City of Des Plaines to fill the vacancy caused by the
resignation of Gefrge W.Kinder.
SECTION 2: That the polling place for the said
special election shall be at George Whitcomb's Garage,
Graceland Avenue, for the voters of the said ward.
SECTION 3: That the time for the opening and
closing of tae polls on the day of holding such special
election, the qualifications of voters, the preparations
of the ballots to be voted at such special election,
the manner of holding and conducting such special election,
the manner of counting the ballots cast at such election,
the making of the returns of such special election, and
all other requirements for the proper conduct of such special
election not herein otherwise provided for, shall conform
to and be in strict accordance with the laws of the State
of Illinois, which provide for the holding and conducting
of elections as above described.
SECTION 4: That the City Clerk of the City
of Des Plaines shall give forty (401 days' previous notice
of the time and place of holding such election by publication
and posting as is required by law, and shall specify in
the said notice the purpose of such election and other
requirements according to the laws of the State of Illinois.
SECTION 5: That the City Clerk shall prepare
all necessary ballots, books, papers and other supplies
necessary in and about the conducting of such election.
SECTION 6: That all ballots, books, papers,
tally sheets, poll books and other necessary papers
shall in all respects comply with the election laws of
the State of Illinois governing the holding of elections
for the purpose of electing an alderman for the Third
Ward of the City of Des Plaines to fill the vacancy
caused by the resignation of George W.Kinder.
SECTION 7; That

SECTION 8t That the judges and clerks of

and declare the result of such special election within five

The motion was made by Alderman Huxmann and seconded by
Pflughaupt to amend this proposed ordinance by striking from
it Section 7, pertaining to the appointment of judges and
clerks of election. The motion was voted upon by acclamation
whereupon the Mayor declared the motion carried and the
ordinance so amended.
The motion was then made by Alderman Huxmann and
seconded by Collet to put this proposed ordinance on passage
as amended. The roll was called on the motion "to put on
passage" with the following results Ayes; Aldermen Collet,
Pflughaupt, Huxmann, Fredericks, Friott and Meinshausen.
Mays; Aldermen Ahbe and Dean. The Mayor ruled a two -third
majority necessary for putting the ordinance on passage and
therefore ruled the motion defeated. The MAX proposed
ordinance was therefore filed for second reading.
Mayor Kinder then announced the appointment of
Kenneth G.Meyer to the office of City Attorney. The motion
rtes made by Alderman Huxmann and seconded by Pflughaupt to
confirm this appointment. The motion was voted upon by
acclamation, whereupon the Mayor declared the motion carried.
Mayor Kinder then announced the appointment of
Carter Jenkins as City Engineer. The motion was made by
Alderman Pflughaupt and seconded by Collet to confirm the
appointment of Carter Jenkins as City Engineer subject to the
acceptance of a contract between Mr. Jenkins and the City of
Des Plaines to be entered into. The motion was voted upon
by acclamation, whereupon the Mayor declared the motion carried.

Mayor Kinder then announced the employment of Howard
A.Becker as Chief of Police. The motion was made by Alderman
Huxmann and seconded by Fredericks that Howard A.Becker be
employed as Chief of Police until an ordinance covering his
employment is passed. The roll was called on the motion with
the following result: Ayes; Aldermen Ahbe, Collet, Pflughaupt
Dean, Huxmann, Fredericks, Friott and Meinshausen. Nays; None.
The Mayor thereupon delcared the motion carried.
The clerk then read the following proposed ordinance
for the first readings
An Ordinance Amending Section 39 of Article 1 of
Chapter 3 of the Revised Ordinances of the City of Des Plaines,
Illinois.
Be it Ordained by the City Council of the City of
Des Plaines, Cook County, Illinois.
Section 1. The City Attorney shall receive as com-
pensation a salary of $2,000. per annum, payable monthly.
Section 2. All ordinances and parts of ordinances
conflicting with the provisions of this Ordinance are 1Bre
by repealed so far as they conflict herewith.
Section 3. This Ordinance shall be in full force and
effect from and after its passage and approval.
