The meeting was called to order by Mayor Charles Hammerl with Pflughaupt, Alder-
men Ahbe, Collet, � p
PfluDean, H uxrnann, 'finder, Lacey, Friott,
Enzenbacher and Meinshausen responding to the roll call.
The Clerk read a report of Chief of Police C. A. Wegner,
reporting on the Beer Licenses issued to date. Tis report was referred
to the Finance Committee by the Mayor.
None of the various standing committees of the Council had
reports to offer.
The Clerk then read the following letter:

In reply to your letter of April 5th. in vch the
collecting of old clothes, furniture, ect., by the Salvation
Army was discussed; we wish to state that, since one of their
attorneys made the statement to Mrs. =-iller, that we might at
any time`examine their trucks and select any thing that may
be of benifit to us in qur own v e]rfare work, we can see no rea-
son for not allowing them to cintinue with their work in Des -
Plaines.

The motion was made by Alderman Huxmann and seconded by :pie inshausen
to instruct the Police Department not to interfere with the Salvation
Army trucks in the future. The motion was voted upon by acclamation,
whereupon the Mayor declared the motion carried.
Mr. Maloney, attorney, then read the following letter:

Gentlemen:
In this matter there is a voucher still outstanding
held b1--- Barney Lagerhausen for balance of principal of
"460.00 and interest amounting to approximately $550.00.
There are also in this proceeding some unpaid assessments.
These unpaid assessments, I think, are without exception
assessments which were erroneously levied; that is,
there appears to be an assessment against school property
which is erroneous insofar as it includes as the chief
part of the property assessed the street which was taken
in addition to the fact that there are other properties
which are assessed double in this improvement.
In order to remove the clouds from title, some of the
property owners have agreed to contribute toward the pay-
ment of this voucher. The book records show that the City
should have on hand in this improvement $460.00. I have
been able to obtain the consent of property owners to make
up sufficient balance.to take care of this voucher. Unfort-
unately the City does not have the cash available to meet
this obligation.
• I would suggest, however, that in order to permit the
closing of this :natter so that the City can receive the ben-
efit -of the offer made by the property owners, portion of
this $460.00 be paid by the City at this time. I feel that
I can then arrange to•have one of the property owners, whose
property is affected, purchase this voucher and await further
payment by the City.
I, therefore, recommend that the City, out of this
Special Assessment Contingent Fund, pay on account of the
principal of this voucher, the sum of :150.00 to be ap-
plied on account. I submit herewith resolution.

BE IT RESOLVED by the City Council of the City of Des
Plaines, Cook County, Illinois.
SECTION 1: That Otto Rexses, City Treasurer of the
City of Des Plaines be and he is hereby directed to pay to
Barney Lagerhausen, holder of voucher in Special Assessment
No. 52590, out of the 3pecia1 Assessment Contigent Fund, the
sum of One hundred Fifty ($150.00) Dollars to apply on account
of the balance due on the said voucher.
SECTION 2: That this Resolution shall be in full force
and effect from and after its passage and approval according
to law.

Gentlemen:
A short time ago we had up for consideration the
question of supplemental assessment to pay the voucher of
19617.00 issued in this improvement approximately 5 years
a;o. The Master has made his report in this case and I
have filed exceptions to the master's report, the master
having found that the City was required to account to the
master for funds collected in this improvement.
The controversy now arises over the fact that the
voucher which was issued to the Clerk of the Circuit Court
provides for payment of the voucher out of all installments
of the improvement. Unfortunately, at the time this voucher
Tas issued,,bonds,had then been issued against portion of
the installments and consequently other bonds were issued
against portion of the installments. We therefore have the
question of bonds which have been issued against specific
installments and paid in conflict with this voucher which
is now unpaid. This, growing out of the fact that the vou-
cher improperly ,provided for payment out of all installments.
I have endeavored to induce the elaiinants in 'this case
to accept such bonds as we have power to issue, and other
vouchers for the balance. There are, however, costs of
suit which are complicating the situation. There is some
margin at the present time .so that some bonds may be issued.
There are also past due assessments so that the vouchers
could be issued payable out of installments where all obli-
gations have been paid.
I also find in this assessment that there a.ppe::yrs to be
on hand in cash, 1433.00. in interest and 1494.00 in principal.
In addition to these sures, there should be on handap_,roxima-
tely ;;`1266.00 which was shown by the books to have been on
hand at the time Otto ?exses took office. This amount, of
course, vas not on nand in this improvement.
I recommend, however, that the Treasurer be instructed
to py over to the Master in Chancery, William A. Doyle, the
sum of ,x300.00 cut of the interest now on hand, which will
leave sufficient balance to meet interest to accrue this year,
and that jfne Treasurer also pay an additional sum of : 300.00,
fro:n the funds received from Kr. .Dehrens, to William A. Doyle,
_,_seer in chancery, and that the Mayor and City Clerk be auth-
orized to issue, execute and deliver ends or vouchers Which
may be reque.ted by me for the balance of the said 19617.00

due the Eureka Fire Hose Co, with Edgar J. Schoen attorney, and that
a part payment of 5O' would no doubt be acceptable to, the Eureka .Pire
Hose Co. at this time. Ho action was taken regarding this :.atter however.

I am submitting herewith blue prints of a de-
tailed design for the water main connection between Lee
Street and Keeney Avenue on AlLonquin Road, together °Jth
an estimate of the approximate cost of same.
The design has been prepared .:ter considerable
study and I relieve represents the most deir:ble method
of constructing; this much needed water main connection.
The estimate of the cost has been prepared with
the idea of usin, hand labor entirely in the construction
of this improvement and I see no reason why deserving oxen
indebted to the 7ater Department should not be used prin-
cipally. The estimate follows:

This estimate is approximately " 70.00 hiher than
the one submitted to you on July 2nd, 1532, but this estimate
includes the installation of the fire hydrant, the reconnection
of the 4" line on Keeney Avenue, and the installation of the
4" valves and valve chambers.
Permit me to suggest that either favorable or un-
favorable action be taken en this matter shortly, as State
HiGh1°:ay construction work will begin • ithin a few weeks. •

• Mayor Hamrnerl then suggested tiat the Council transfer enough
funds from the Vehicle Fund to five a months pay to such City em-
ployees as are Mack in their pay. The motion was rade by Alderman
Pflyghaupt and seconded by 'Collet to prepare a 193 General Corporate

Vehicle Fund. This warrant to state en its face that it is to be the
last 1932 'aux Warrant to be redeemed. And further, that all City
employees who are behind in their pay, be given a months salary.
