03/20/193356 MINUTES OF THE REGULAR =TING OF THE CITY COUNCIL CF THE CITY CF DES PLAINES, HELD IN THE COUT;'CIL CHANTERS ON THE 20th DAY CF flARCH, 1933. At THE HOUR OF 8 O'CLOCK P. M. The meeting was called to order by Mayor Charles Hwnmerl, with Aldermen Ahbe, Collet, Pflughaupt, Dean, Huxmann, Kinder, Lacey, Friott and Meinshausen responding to the roll call. Alderman Enzen- bacher was absent during the roll call but came into the meeting later`in the evening. The Clerk read t he fdllowing letter:- Marci 20th, 1933. Mayor and City Council of the City of Des Plaines, Cook County, Illinois Gentlemen: For some time past we have been making an effort to obtain data concerning the amount of fire insurance written in the City of Des Plaines. As far as we have been able to ascer- tain, there are no public records from which this information can be obtained and we have received no cooperation from the companies in this respect. In order that the City may have such information available as will enable it to properly determine the amount of tax due the City, I am herewith submitting an ordinance which I recommend be passed. The ordinance should be published and insurance agents in the City notified to comply therewith. In order that we may be able, if possible, to deter- mine what, if any, foreign fire insurance tax is now due, I would suggest that the Board cause to be published iri the papers in Des Plaines a coupon requesting the owners of property in the City of Des Plaines tb forward to the City Clerk data concerning their insurance, which will enable us to determine what, if any, tax is now payable or has been payable in the past. I would suggest that the coupon request the information for at least three years back. The coupons should request the name of the owner description of the property assessed, the name of the company in which it is insured, the amount of premium paid, the length of the policy, and the time the policy was issued. I submit herewith form of coupon which I would suggest using. At this time it would be impossible to determine whether or'not the amount of foreign insurance tax paid is the proper amount. However, if we receive the desired cooperation from the people of the City, I believe that a tabulation of this information will give us the'information we desire. 'Upon receipt of this information, a suit can be filed against the insurance companies concerned and the taxes collected. Respectfully submitted, • DBM:CL D.B. Maloney, and then read the following proposed ordinance for first reading: AN ORDINANCE BE IT ORDAINED BY the City council of the City of Des Plaines, Cook County, Illinois; SECTION 1: That every person, firm or corporation in the City of Des Plaines who has acted since June 30, 1932, or who shall hereafter act for or in behalf of any foreign fire insurance company, whether as agent or as otherwise, in the sale or negotiation for sale of fire insurance or for the collection of premiums for fire insurance, shall, on or before July lst, 1933, and annually thereafter on or before the said date, file with the City Clerk of the City of Des Pia ines a true and correct statement and account of all fire insurance sold in the City of Des Plaines during the preceding year, with a statement of the amount of each policy and the rate of premium on each policy, and also a true statement of all premiums collected by such perscn, firm or corporation, or premiums collected on be- half of such person, firm or corporation. Such statement or account shall be sworn to by such person, or in the case of a firm or corporation,, by some officer or agent thereof resident in the City of Des Plaines. If, any person or corporation shall fail to file such report on or before July lst, 1933 or of any year hereafter, it shall be unlawful for such person, firm or corporation to hereafter transact any insurance business in the City of Des Plaines. SECTION 2: Any person, firm.or corporation, who violates any of the providiens of this ordinance, upon conviction thereof, shall be fined a sum of not less than Two Dollars ($2.00) nor more than Two Hundred Dollars ($200.00) for each offense. In case such violation is by a corporation, the operators or representatives of such corporation, resident in the City of Des Plaines, shall be deemed to have violated such ordinance within the terms of this section. The payment of any such find shall not relieve any such foreign insurance company, nor such person or corporation as agent or representative, form any of their liability for any license fee. which may be due accord- ing to law. Gentlemen: In. accordance with the request of the City Collector, the assessments returned delinquent in the above improvement have been withdrawn from collection. That is, all assess- ments,which were restored in this improvement at the request of the bondholders have been returned to the City Collector. for Collection in order that additional time be given to the owners of property in this assessment. The Council.has heretofore discussed the question of paying; the past due installments in three payments. However, no specific inptructions have been given to the collector. I am submitting herewith a resolution direetting the collector to accept payments of deferred installments in three payments. March 17, 1933. liespectfully submitted, DBM:CL D.B. MALONEY RESOLUTI0 N BE IT RESOLVED by the Mayor and City Council of the 58 City of -es Plaines, Cook County, Illinois, that as to all lots and parcels of property assessed in Des Plaines No. 99 against which the assessments were restored in part by the order of October , 1931, that the City Collector of the City of Des Plaines be and he is hereby requested and directed to accept the said past due installments of assessments in three annual installments. Provided,. that the payments may be, as nearly as possible, equal installments paid in addition to the current installment which may be due. BE IT FURTHER RESOLVED that the City Collector be and he is hereby directed to refrain from returning delinquent any property which shall pay annually ones -third of the delinquent assessment plus the current assessment. The Clerk reported that some 21 dog licenses had been sold for 1933 and asked the Council's orders as to whether or not to refund the difference between the olf fee and the new fee. The motion was made by Alderman Huxmann and seconded by Ahbe to instruct the Clerk to refund the difference between the old fee and the new fee for dog licenses to such people as purchased their 1933 dog licenses prior to the establishment of the new fee. The Clerk then read the following proposed ordinance for second reading: • AN ORDINANCE REGULATING THE OPERATION OF COFFEE HOUSES AND ORDINARIES The motion was made by Alderman Huxmann and seconded by Meinshausen that this proposed ordinance be passed. The Clerk then read the follaing proposed ordinance for second reading: AN ORDINANCE REgUIRII G A LICENSE FEE OF RETAIL BEVERAGE DEALERS IN THE CITY OF DES PALIlES, COOK COUNTY, ILLINOIS, AND PROVIDING A PENALTY FOR TEE VIOLATION THEREOF. Alderman Kinder asked the opinion of Mr. Maloney, Attorney, as to whether or not the local option laws were still in force. Yr. Maloney thereupon stated that while there is a difference of opinion on the question, he feels that local option laws have been repealed by the recent amendment to the Federal Constitution and the Prohibition Act of the State of Illinois. The motion was made by Alderman Huxmann and seconded by Meinshausen to refer this question to the Police and License Committee. The motion was*voted upon by acclamation, whereupon the Mayor declared the motion carried. The Clerk then read the following proposed ordinance for second reading: A N ORDINANCE AMENDING ORDINANCES RELATING TO LICENSES The motion was made by Alderman Meinshausen and seconded by Ahbe that this ordinance be passed. The roll was called on the motion with the following result: Ayes; Aldermen Ahbe, Collet, Pflughaupt, Huxmann, Dean,.Kinder, Lacey, Friott, and Meinshausen, Nays; None. The Mayor thereupon declared the motion carried and the ordinance passed. The Clerk then read the following proposed ordinance for secon reading: AN ORDI NAN CE REPEALING ARTICLE III. AND ASNDING • • ARTICLE IV. OF CHAPTER 3 OF THE M®NI- CIPAL CODE OF DES PLAINES OF 1928. The motion was made by Alderman Ahbe and seconded by Collet to pass this Ordinance as read. The motion was then made by Alderman Exumann and seconded by Pflughaupt to amend this proposed ordinance by striking out the words "be furnished", and inserting the Word "appoint" in place thereof, so as to make the first sentence of Section 68-D read:"Assistants. The City Treasurer shall appoint two absistants to be paid by the City." AN ORDINANCE BE IT ORDAINED by the City Council of the City of Des Plaines, Cook County, Illinois; 60 • SECTION 1: That en and after April 30, 1933, at the expiration of the term of the present treasurer of the City of Des Plaines, the salary and compensation to be, after the said date, paid to the City Treasurer of the City of•Des Plaines, shall be and sump of Eighteen Hundred Dollars ($1800.00) per annum, payable monthly, and the City of Des Plaines shall -oay the cost of the official bond of the Treasurer. SECTION2: That fifty per cent (50%) of the said compensation paid to the said treasurer and also all'of the salary paid to one assistant to the treasurer, whose duty shall be the handling of the collection of special assessments, shall be charged by the City 46 the special assessment fund, and there shall be paid out of the special a$s*ssment funds to the corporate funds, for the purpose of reimbursing the salary paid to the said treasurer and to one assistant to the treasurer, salaries paid to the said treasurer and assistant to the treasurer: Provided, however, that the amount charged ,to the said special assessment funds shall not exceed two per cent (2%) of the moneys collected on account of special assess- ments in any one year; and Provided, however, that no money shall be paid from the 4413e -dial Assessment funds to the corporate funds of the City unless such funds shall be available in the special assessment fund. SECTION 1: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 4: That this ordinance shall be in full force and effect from and after its passage and approval according to law. PASSED this day of March, A. The motion was then made by Alderman Pflughaupt and seconded by Meinshausen to amend this ordinance so as to set the salary of the City Treasurer*at $2400.00 instead of $1800.00. The. roll was called on the amendment with the following Result: Ayes; Aldermen Pflughaupt, Huxmann, .'tinder, Friott, and Meinshausen. Nays; Aldermen Ahbe, Collet, Dean, and Lacey. The Mayor thereupon declared,---- the amendment carried. The motion was then made by Alderman Pflughaupt. and seconded by Meinshausen to adopt this ordinance as amended. The Clerk announced the result of the roll call as 6 ayes, and 4 nays. The Mayor however ruled the motion defeated for want of a Council majority. The :notion was made by Alderman Ahbe and seconded by Lacey that this proposed apprmpriation ordinance be passed as read. The motion was then made by Alderman Pflughaupt and seconded by Huxmann that the proposed ordinance be amended so as to make Article I, Section III, Item 1, read, *Salary of City Treasurer $24.00.00* instead of $1800.00 The roll was called on thip q.mendement with the following result: Aldermen Pflugha;upt. Huxmann, Kinder, Fkiott, and Meinshausen. Nays; Aldermen Ahbe, Collet, Dean, Lacey, and Enzenbacher. The Clerk reported a 5 to 5 tie, whereupon the Mayor cast his vote as *nay" and declared the amendment defeated. The motion was then made by Alderman Huxmann and seconded by Pflughaupt to amend Article I, Section VI, Item 1, to read„ Fees for Attorney and assistants $1800.00*, instead of $2750.00, and to strike out the additional paragraph of Item 1. The roll was called on this amendment with the following Result: Ayes; Aldermen, Pflughaupt, Huxmann, Kinder, Friott and Meinshausen. Nays; Aldermeh Ahbe, Collet, Dean, Lacey, and Enzenbacher. The Clerk reported a 5 to 5 tie, whereupon the Mayor cast his vote as *nay" and declared the amendment defeated. 'At this point the Mayor arose to address the Council. Alderman Huxmann hoyvever objected to theMayor's speaking on a point or order. The Mayor then vacated the chair and called upon Alderman Ahbe to act as Mayor protem. The motion was thereupon made by Alderman Enzenbacher and seconded by Collet to grant the Mayor the privilege o'f addressing the Council. The roll was called on the motion with the following result: Ayes; Aldermen Ahbe, Collet, Dean, Lacey and Enzenbacher. Nays; Aldermen Pflughaupt, Huxmann, Kinder, Firott and Meinshausen. The Clerk reported a 5 to 5 tie, whereupon the Mayor cast his vote as "aye" and Alderman Ahbe Maypr protem, declared the motion carried. The Mayor however addressed the Council in only a brief manner. Alderman Ahbe Mayor protem, then vacated the cahir in favor of Mayor Hammnerl who presided for the re- mainder of the meeting. The roll was then called on the main motion, to pass the 1933 Appropriation Ordinance as read, with the following result: Ayes; Aldermen Ahbe, Collet, Dean, Kinder, Lacey, Friott, 62 Enzenbacher and Meinshausen. Nays; Aldermen Pflughaupt, and. Huxmann. The Mayor thereupon declared,the motion carried and the ordinance passed. The motion was then made by Alderman Aube and seconded by Collet to instruct the Clerk to publish the 1933 Appropriation Ordinance in the Suburban Times. The roll was called on the motion with the following result; Ayes; Aldermen Ahbe, Collet, Pflughaupt, Dean, Huxmann, Kinder, Lacey, Friott, Enzenbacher and Meinshausen. Nays; None. The Mayor thereupon declared the motion carried. The motion was then made by Alderman Lacey to reconsider the proposed ordinance seeking to fix the City Treasurers salary, (or- iginally at $1300.00 but amended to $2400.00 annually). Alderman Huxmann however objedted th the motion stating that Alderman Lacey voted negative on the passage of this proposed orctinarice, and that the motion to reconsider can be made.only by such as voted with the affirmative. The Mayor thereupon ruled the motion out of order. The motion was then made by Alderman Ahbe and seconded by Collet to ptt the following street lights back into service: 1-250 C.P.- Post Light at West end of Willow St. W. of Graceland Ave. Dusk to Dawn. 1-100 C. The Mayor thereupon declared the motion carried. - The motion was then made by Alderman Huxmann and seconded by iittk Pfaughaupt to instruct Mr. Jenkins, engineer, to make a survey with the object in view of somewhere eliminating enough lights to compensate for those to be put back into service. The motion was voted upon by acclamation, whereupon the Mayor declared the motion carried. Alderman Huxmani chairman of the Band Committee then stated that he has an invoice from the Band for $300.00 for Summer concerts rendered by the Band. The motion was 'made by Alderman Huxmann and seconded by Pflughaupt to refer this invoice and voucher covering same to`the Council as a committee of the whole. The motion was voted upon by 'acclamation, whereupon the Mayor declared the motion carried Alderman Lacey chairman of the Water Committee, reparted th<:'t the City has received a 1 1 real estate tax bill of $164.00 for the Cater :`:ell property. Thi ' ldermen believed to be exhorbitant The' motion' was made by Alderman Huxmann and seconded by Pflughaupt to refer this tax bill to Mr. Maloney, attorney, with instructions to file the proper complaint, with a view of getting a reduction. Alderman Ahbe then suggested that the Council consider rais- ing the salaries of the Motorcycle police about $25.00 per month and make each officer maintain and repair his own motorcycle, instead of haying the City provide the maintainance.
