THE HOUR OF 8 G'CLOCK P. M.
The meeting was called to order by Mayor Charles Hammerl,
with Aldermen Ahbe, Collet, Pflughaupt, Dean, Huxmann, Lacey, and
Meinshausen responding to the roll call. Aldermen Kinder, Friott
and Enzenbacher were absent.
None of the standing 'committees of the Council had reports to
offer, with the exception of the Police Committee which submitted the
following report.

The motion was made by Alderman Meinshausen and seconded by Collet to
postpone consideration of this report tillthe next meeting of the
Council. The motion was voted upon by acclamation, whereupdin the Mayor
declared the motion carried.
The Clerk then read the following proposed ordinance for
second reading:
'TAN ORDINANCE-
WHEREAS,
RDINANCE-
WHEREAS, the City of Des Plaines has been recently ad-
vised in writing by the County Treasurer that the tax sale of
delinquent special assessments will begin shortly; and
WHEREAS, said County Treasurer has requested instruc-
tions as to whether the City desires to buy or withdraw unl3aid
delinquent special assessments in default of other bidders;
NOW, THEREFORE, BE IT ORDAINED by the City Council of
the City of Des Plaines, County of Cook and State of Illinois;
SECTION 1: That the City Clerk be and he is hereby
authorized and directed t o notify the County 'Treasurer to with-
draw from collection at said tax sale all unpaid delinquent
special assessments in default of bidders, as provided by Section
72 of the Local Improvement Act, as amended. Said statute prop
vides among other things that said withdrawal from collection
shall not operate to cancel the assessments or impair the lien
of the said municipality so withdrawing it, and the same shall
be the remain delinquent and payable at the office of the County
Clerk, with all fees, costs, penalties, interest and charges
that have accrued thereon, and such lots, parcel of land or
property may be re -advertised and re -sold at any subsequent tax.

SECTION 2: That a certified copy of this ordingnce be
forwarded forthwith by the City Clerk to Joseph B. McDonough,
County Treasurer of Cook County.

The motion was made by Alderman Lacey and seconded by Collet that the
above proposed ordinance be passed. The roll was called on the motion

the supplemental assessment on No 9 for second reading:

TO THE MAYOR AND CITY COUNCIL
OF THE CITY OF DES PLAINTS:
We herewith submit an ordinance for a supplemental
assessment necessary to pay the 'cost of the work, engineering and
inspection, together withthe lawful expenses attending the making
of the igiprovement, together with the, amount estimated by the
Board of Local Improvements to pay -the deficiency of interest on
bonds issued in anticipation of the collection of the assessments
for the construction of a connection system of vitrified tile pipe
sewers in Lee Street, Walnut Street and other streets, in the City
of Des Plaines, Cook County, Illinois; together with an estimate
of the cost of said improvement and the deficiency, and the cost
of levying, making and collecting the supplemental assessment
therefor and all lawful expenses attending the same; and RECOMMEND,
the passage of said ordinance.

Dear Sir:

Undoubetedly the items included in the enclosed newspaper
clipping have come to your attention. As a citizen of the City of
Des Plaines I consider it my duty to register a spirit of dis-
atisfaction towards the protection afforded the motoring public
at the River'Road crossing. Our inactivity in connection with
said crossing makes us easily vulnerable to criticism such as
we find in these clippings. In the humble spirit of Youth may I
make the following suggestions despite the fact that I know, that
you have undoubtedly spent no inconsiderable amount of time trying
to find means of making "Death Crossing" fool- proof. If the City
does not take steps soon we may find ourselves involved in a dis-
astrous lawsuit, something which would be unfortunate in such times
as these.
• 1) Would it not be possible towarn motorists by the customary
lines /giiiq//)painted on the pavement some 100 yards from the crossing?
2 What objection is there to having a flasher at said crossing?
3 What objection is there to having a bell at said Crossing?
4 Would the installation of a bell and flasher be too much
to expect of the C. & N. W. ?
(5) 'Why don't we have a more modern sign warning motorists posted
south of the crossing, say at the end of the cement abutment, to this
effect: *R.R. 200 Yards". Now we have an antiquated sign ('Look
Out For The Cars') posted too high for the motorist to see it. Said
sign is also somewhat ,obscured by telephone posts.
(6) Would it be impossible to install an overhead warning signal?
Perhaps some of these may seem wholly impractical, but I believe
that the lines on the pavement could be very useful especially when
apprthaching from the South, The -stop sign by the Standard Oil Sta-
tion should slow down southbound motorists sufficiently to enable them
to recognize the fact that a railroad is there. The watchmen that
the Northwestern has posted are almost worthless as protection.
not entirely through fault of their own, but with so much.traffic
and a three -track crossing their efficiency is negligible. To
interpret their gestures is oftentimes very difficult.
The combination of a bridge, an doutment and a clump of trees
on the other side of the river makes it very difficult for the
parties driving northward through the city. With winter in the offing
the trees will be losing their leaves, which will diminish the danger
somewhat. But the present time is none too soon to prepare for next
summer's traffic and traffic in years to come: the hazard must be res
moved. Let us see if we cannot prevail upon the C. & N. W. to give
more adequate protection. 'If not, let us paint the lines and put up
some signs far enough back to give drivers a fifty-fifty chance of
neg'otiating the crossing with safety.
Sincerely hoping that measures have already been launched to
better the crossing; and, if not, that we can with dispatch find
means of doing so, I submit these suggestions for consideration.

MEMORANDUM Chicago, Oct. 15th, 1932.
At a meeting this morning attended by Mr. Collett, Alderman,
City of Des Plaines, Mr. Sheets, Signal Engineer, and Mr..Parish,
Assistant to General Manger, information was given Mr. Collett to the
effect that we are now working on a system of stop lights for Des
Plaines Avenue Crossing, River Road, Des Plaines, and have reason to
believe that our plans will be completed within a very short time,
'and submitted to the City Council at Des Plaines for their approval.
Mayor Hammerl instructed the City Clerk to make arrangements with the
C. & N. W. Railraod officials for a meeting with the Council to discuss
the matter of providing more adequate crossing protection at the C. & N.W.
tracks and Des Plaines Avenue.

As a properity owner we feel we have the same parking rights
as the property owners on the west side of Center Street. If
there is no change made in our present Parking system we are
going to lose our tenants, SD we feel it is up to the City Council
to change this system.

struct Mr. Maloney, attorney to prepare and submit to the Council anyi
ordinance making'Center Street a one-way street between Ellinwood Street
and Prairie Ave., and providing that only Southbound traffic be allowed
on said fortion of genter Street, and that parking parallel to the curb
be permitted on both sides of said street, with all vehicles facing
southward. The roll was called on the motion with thefollowing result:

Gentlemen:
October 13, 1932.
In accordance with your request, I have considered
the question of whether or not the City of Des
P1_.ines has�a right to shut off water in case of
failure of water users to pay for water furnished by
the City of Des Plaines.
I find from an examination of the ordinance of the
City of Des Plaines that the City reserves the right
to shut off water in case of the non-payment of water
rentals or for the violation of any other rules or
regulations provided by the City Code of the City of
Des Plaines governing the use of water furnished by
the City of Des rlaines.
It is my opinion that the City of Des Plaines, in the
operation of the water department and in the furnish-
ing ofwater to the user of the City of Des Plaines
is operating in its private capacity and not in its,
governmental capacity, and in its private capacity it
has the right to contract the same as any other individ-
ual has with reference to water, and it has the same
right to discontinue furnishing water in case of non-
payment as a private individual would have to refuse to
furnish water in case of non-payment.
It is, therefore, my' opinion that the City of Des Plaines
ha's a full right, in case of non-payment of a water bill,
to shut off water from any user who fails or refuses to
pay a water bill which is past due, and in so doing, the
City of Des' -Plaines or any of its officers assume any
liability.

violation of this Section. The hearing on this case is set
for Wednesday afternoon, Oct. 19th, at 3 P. M. Therefore 1 ask
that you inform the City Attorney to be present, to assist the
City of Police Dept, in the prosecution of this Violation, as
there will be representation present representing the other'party.

The City Council of Des Plaines

Gentlemen:
A Safety Council, made up of representative citizens of this
community, has been organized by the Lion's Club. The function
of the Safety Council will be to promote Safety in Des Plaines.
The Lion's Club would like your Honorable Council's support in
this new and worth while project. Men, such as Mayor Hammerl,
Alderman collet, Chairman of Streets and Sidewalks Committee,
City Engineer Jenkins, Chief of Police Wegner, and Fire Chief
Petterson, are five of the ten citizens serving on
this organization) The remaining five members have been
a ppointed by the Lion's Club as representative citizens of
this city. All of these men have the Safety movement at
heart and are eager to serve their community in this new way
to the best of their ability.
The City Council can, it is thought by the Lion's Club, give
the Safety Council an extra stimulus by sanctioning such a
movement, also it can request the above named members of the
Council and officers of the City of Des Plaines, to serve
on the Safety Council as their official representatives.
The Lion's Club, of course, would like your Council to know
that the Safety Council, being organized, can only act as an
advisory body to you in Safety matters that have to do with
the Streets and Sidewalks of Des Plaines, Their research into
some of your Safety problems should be a great help to you.
Des Plaines, and every organization in it will, without any
doubt, be,interested in every Safety movement which might make
Des Plaines a more safe place. in which to live and through
which to travel.
The Lion's Club would like to have you sanction this movement,
or if you care to make further suggestions along this line, they
will be more than glad to consider them.

Center Street and the Soo Line R. R. are asking to have
Street light which is about 150 ft east of the Soo Line on Keeney
turned on, to avoid serious mishap of residents of this block.

The Disabled American Veterans of the World War
would like to request permission to run their annual tag day
on Armistice Day, November 11, 1932. This event is a national
'ffair which s held all over the country for the purpose of
raising funds for relief of those men who were disabled by
reason of military service in the world war.
In the event that the weather will not permit us
to hold the drive on that day, we would like to have it for
the following day or the following Saturday, which would be
November 12th,

get an expression from the local post of the American Legion as to

The motion was made by Alderman Huxmann and seconded by Enzenbacher to
instruct Mr. Maloney, attorney, to prepare a resolution demanding a
sIatement from the County Clerk, and ordering him to remit such moneys
aeMay due the City. The motion was voted upon by acclamation, where-
upon the Mayor declared the motion carried.
Mr. Maloney then stated that he had prepared such a resolution
and submitted it to the clerk for reading. The resolution follows:
RESOLUTION
WHEREAS, on or about September 30, 1932, the
City Collector of the City of Des Plaines received from
the office of the County Clerk of Cook County information
to the. effect that the County Clerk of Cook County had
collected and had on hand to the credit of the City of
Des Plaines between $1500.00 and 4000.00, it also advised
the City that the money could be paid to the City only on
the condition that the matter be handled by some employee
of the Cibynty L'lerk's Office on some basis satisfactory to
them; and
WHEREAS, it is the duty of the County Clerk of
Cook County.to receive delinquent taxes in case of forfeitures
or sales and to remit the money collected, together with
interest on the taxes or assessments, to the City of Des
Plaines; and
WEEREAS,,THERE IS NO REASON WITHIN LEGAL OR EQUI7
able jurisdiction, why employees of the County Clerk'office,
employed by t he public and paid out of the public -treasury,
should receive and collect moneys from the City of Des Plaines
or any other municipality, in order to receive moneys col-
lected by the County Clerk's Office.
BE IT THEREFORE RESOLVED thict the City Clerk of the
City of Jies Plaines be and he is hereby authorized and directed
to make written demand upon Robert M. Sweitzer, County Clerk,
for all moneys on hand in the County Clerk's Office collected
by h.j.m in either general taxes or special assessments, and that
the money be turned over promptly and without the necessity

of paying any commissions or percentages to any one in the
County Clerk's Office.
The motion was made by Alderman Hu anann and seconded by Collet to
adopt the above proposed resolution. The motion was voted upon by
acclamation, whereupon the Mayor declared the motion carried.
The Clerk then read the following resolution:
RESOLUTIO
AREAS, there is located on Dempster Street,
near Potter- Road, the Maine Township High School which
affords educational facilities for the children of Maine
Township, particularly of the City of Des Plaines and
the City of Park Ridge; and
WEEP AS, the County of Cool has heretofore ac-
quired a 100 foot right of way along Dempster Street from
Milwaukee Avenue and Rand Road along the past the said
Maine Township High School, and has improved the said
highway by t he construction of & 20 foot avement to Rand
Road, and has also improved Miner Street (Dempster Street)
to the Des Plaines River bridge, and has widened the Des
Plaines River bridge; and
WHEREAS, there is at the present time no sidewalk
or other means of pedestrian travel which might provide for
the safety of children from the City of Des Plaines attending
the said Maine Township High School, and that there is suffi-
cient of the said right of way acquired and now in possession
of the County of Cook to provide ample room for the con-
striction of a sidwalks, and the construction of the said
sidewalk is necessary for the safety and welfare of the
children attending the said Maine Township High School from
the City of Des Plaines; and
AREAS, such a sidewalk could be constructed on
the North side of Dempster Street between the property of the
Maine Township High School and Rand -Road, and that all of the
said property on the North side of Dempster Street between the
said points is unsubdivided and is not within the boundaries
of any municipality, and that it is reasonable and proper that
the County of Cook or the State of Illinois, or the said
two bodies. jointly, shall provide a sidewalk along the
North side of Dempster Street between the said points.
BE IT THEREFORE RESOLVED by the Mayor and City
Council of the City of Des Plaines that the Baord of County
Commissioners of Cook County be and they are hereby petitioned
and requested to provide for the construction of the said
sidewalk between Rand Road and the property of the Maine
Township High School out of the gas tax, or that they take
such steps as may be necessary to obtain the construction. of
the said sidewalk by the State of Illinois.
BE IT FURTHER RESOLVED that a certified copy of
this resolution be forwarded to the Chairman of the Road and
Bridge Committee of the Board of County Commissioners of
Cook County, and that a certified copy be sent to the Superin-
tendent of Highways of the County of Cook.

The motion was made by Alderman Pflughaupt and seconded by Enzenbacher
to adopt the above proposed resolution. The motion was voted upon by
acclamation, whereupon the Mayor declared the motion carried, and the
resolution adopted.
The Clerk then read the following resolution:
RESOLUTION
WHEREAS, prior to the construction and opening
of Busse Avenue from Miner Street at the fOes Plaines River
to the Easterly limits of Des Plaines, there was constructed
and in place along -the South side of Miner Street a sidewalk
constructed by the City of Des Plaines suitable to pedestrian
travel, from the Des Plaines River Easterly to Rand Road; and.
WHEREAS, the construction of the intersection of
Busse Avenue with Miner Street required the destroying. of the
sidewalk at said point; and
WHEREAS Busse Avenue (State Bond Issue Route No. 19)
and Miner Street (Dempster Street) are diagonal streets which
intersect immediately East of the Des Plaines River bridge,
thereby creating along intersection and making an intersection
which'is extremely hazardous for pedestrians to cross; and.
WHEREAS, many of the children from the City of
Des Plaines desiring to attend. Maine Township High School are
required to walk to the high school at Potter Road and
Dempster Street, and are required to go Easterly on Miner
Street across the said intersection; and.
WHEREAS, the County of Cock has heretofore provided
for the widening of the b ridge across the Des Plaines River to
Miner 6treet, a nd has built a retaining wall from the bridge
Easterly along the bank of the Bes Plaines River, but that
the County of Cook did not at the time construct the sidewalk
and restore and sidewalk which was destroyed by the opaning of
Busse Avenue and the South side of Miner Street at said point;
and.
WEEREAS,-immediately North of Miner Street and for
300 feet East of the Des '1.aines River bridge, there is no
property North of Miner Street which receives any benefit
from such a sidewalk, but that the Des Plaines River flows in
a South Westerly Direction just North Westerly of Miner
Street; and.
WHEREAS, it is fair and reasonable that the
County of Cook should provide for the construction of a
sidewalk from the Des Plaines River Bridge to the Easterly
line of the sidewalk now in place approximately 900 feet
East of the Des Plaines River bridge in lieu of the side-
walk destroyed during the construction of the intersection at
Busse -Avenue (State Bond Issue Route No. 19) and Miner
• Street.
BE: IT THEREFORE ESOLVED that the Board of County
Commissioners of Cook County be and they are hereby petitioned
and requested to provide for the construction of a sidewalk
on the North side of Miner Street from the Des Plaines River
bridge Easterly a distance of approximately 900 feet Easterly
of the sidewalk now in place, and that the said sidewalk be
paid for out of the gas tak, or that the Board of County
Commissioners be requested to obtain the Construction of the
said sidewalk by the Department of Public Works and. Buildings
of the State of Illinois.
BE IT FURTHER RESOLVED that a certified copy of
this resolution be forwarded to the chairman of the Road and.

Mayor. Hammerl then introduced County Commissioner Wm. Busse,
who addressed the Council stating that if there is anything he can do
to get the Board of County Commissioners to lay a walk on Dempster Street
between Rand Road and the Maine Township High School for the safety of high
school puuilis, he will gladly do so. He also stated ( in reply to a letter
recently sent him by the City Clerk) that the labores hired in the Forest
Preserves, and transported to and from dhaicgo, are put to Work by. the
Emmerson Relief Commission, and axe not .paid in cash, but receive clothing
and groceries in lien of cash.
• At this point Mayor Hammerl reported briefly regarding. the
annual convention of the Illinois Municipal League, held at Rockford
Illinois, which he attended. '
• Mr. Maloney, attorney then reported that the attorney for the
bond holders on the opening and paving of Ellinwood SIreet, between Lee
Street and Graceland Avenue, has written him asking the City to sue the
bonding company of M. A. Behrens former City Treasures, because the bond-
holders ci.im that moneys were collected on this assessment, which not
properly accounted for. Mr. Maloney stated that he will submit a more
detailed report on thio matter in the near future.
The Clerk thenread the following resolution: -

BE IT RESOLVED by the Mayor and City Council.of the City
of Des Plaines, Cook County, Illinois, that the Mayor and City
Cierk'of the City of Des Plaines be and they are hereby author-
ized and directed'to Prepare and cause to be issued to David
B. Maloney, tax anticipation warrant in the sum of One Thousand
($1,000.00) Dollard, chargeable to the coporate funds of the
City of Des Plaines in anticipation of the collection of the
1932 taxes, and that the said warrant be delivered to David
B. Maloney on account of services rendered in connection with
the foreclosure of delinquent lots and properties in the City
of Des Plaines.
BE IT FURTIIER RESOLVED that this Reamlution shall be in
full force and effect from and after its passage and approval
according to law.

The motion was made by Alderman Dean and seconded by Collet to adopt

The motion was made by Alderman Lacey and seconded by Collet to
approve the minutes of the regular Council Meeting of October 3, 1932.
The motion was voted upon by acclamation, whereupon the Mayor declared
the motion carried, and the minutes approved.
Mr. Maloney, attorney, reported that he melt in conference
with Mr. Cater and Mr. Huebsch his attorney, and that Mr. Cater still
holds the price of the Cater Well at $85,000.00. Mr. Maloney furthur
reported that the R. F. C. loan interestcharge would probably be 5% instead
of 3% as previously reported.
Alderman Pflughaupt chairman of the Building and Plats Com-
mittee presented the following plat:

The motionwas made by Alderman Pflughaupt and 'seconded by Ahbe to a pprove
this plat. The roll was called on the motion with the following result:

and Meinshausen., Nays; None. The Mayor thereupon declared the motion
carried, and the plat approved.
Alderman Enzenbacher chairman of the Finance Committee then
reported that he has investigated the special assessment bills of Wm.
G. Wille referred to his committee at the last Council meeting, but that
he is not in a position to make a definite recommendation at this time.
Mr. Maloney, Attorney, reported that the court hearing was postpon-
ed till sometime in December.
The motion was made by Alderman Enzenbacher and seconded by
Collet that the Clerk instruct the Soo Line Railroad to repair the cross-
ing at Prospect Avenue. The motion was voted upon by acclamation, where-
upon.the Mayor declared the motion carried.
The motion was made by Alderman Enzenbacher and seconded by Dean
to instruct Mr. Jenkins, engineer to apply to the State of Illinois for a
permit to make a water tap approximately 60ft. south of the southerly line
of Wicke Ave. on Des Plaines Avenue. Tie motion was voted upon by accla-
mation, whereupon the Mayor declared the motion carried.
Alderman Pflughaupt then reported that Mr. Frank Woolensack,
has submitted a bit of $150.00 for painting the exterior of the City Hall,
and desires that this bid be made a matter'of record. The Mayor ordered that
the bid be recorded in the minutes of the Council, and referred the matter
to the.Building and Plats Committee.
The motion was made by Alderman Lacey and seconded by Collet to
adjourn. The motion was voted upon by acclamation, whereupon the Mayor
declared the motion carried, and the Council regularly adjourned.
