THE CITY COUNCIL OF THE CITY OF DES
PLAIIES, HELD IN THE COUNCIL CHAMBERS
ON THE 3rd, DAY OF OCTOBER, 1932. AT
THE HOUR OF 8t O'CLOC= P. M.
The meeting was called to order by Mayor Hammer', with
Aldermen Abbe, Collet, Pflughaupt, Dean, Kinder, Lacey,`Friott, Enaen-
bacher and Meinshausen responding to the roll call. Alderman Humana
was absent.
The Oity Clerk then read the following officers' reports
covering the calendar month of September 1932:

The report of City Treasurer, Otto Rexses.
These reports were referred to the Finance Committee by the Mayor.
The Judiciary and Assessment Committee had no report eo offer.
Alderman Ahbe Chairman of the Police and License Committee
reported that several bids have been received for the proposed new squad
car. The bidds `vere opened by the klerk. The bids follow:

The -motion was made by Alderman Kinder and seconded by Pflugbaupt to
refer these bids to the Police and License Committee for tabulation
and report. The motion was voted upon by acclamation, whereupon the
= declared the motion carried.
The Streets and Sidewalks Uommittee had no report to offer.
Alderman Pflughaupt then submitted a plat of the following descrip-

of The City of Des Plaines.
Gentlemen:
The constant decline of balance in cash in the
Water Fund has caused me to pay particular attention to
the recdpts and disbursements of this Department;
'About April, 1932 the ledger' showed about $6,000.00
delinquent water bills, while on October 1, 1932 the
delinquent amount has shown as 17353.02 This means
that the delinquent amount has grown about $1300.00
in a comparatively short time, and that this Fund, bears
watching.
I am taking the liberty of calling this matter
to your attentidn, .in order that you may know the true
condition of the Water und. Perhaps the Council
deems it riecessary to take some action to curb the
mounting of delinquent water accounts, and the constant
decrease of cash on hand, for at the present time there
is not sufficient cash in the account to meet the current
bills.

6th, 1932. The roll was called on the motion with the following

bonds issued in anticipation of the collection of the assessments
for the construction of a connected system of vitrified tile pipe
sewers in Lee Street, walnut Street and other streets, in the City
of Des Plaines, Gook County Illinois; together with an estimate

PROVIDING FOR A SUPPLEMENTAL ASSESSMENT NECESSARY

AMOUNT ESTIMATED BY THE BOARD OF LOCAL IMPROVEMENTS
TO PAY THE•DEFIC"IENCY OF'INTEREST ON BONDS ISSOED
IN ANTICIPATION OF THE COLLECTION OF THE ASSESS-
MENTS FOR THE CONSTRUCTING -OF A CONNECTED SYSTEM
OF VITRIFIED TILE PIPE SEWERS IN LFR STREETS,
WALNUT STREET AND OTHER STREETS IN THE CITY OF

The Clerk then read the following proposed ordinance for
first reading
• AN ORDINANCE
WHEREAS, the Uity of Des Plaines has been recently ad-
vised in writing by the County Treasurer that the tax sale of
delinquent special assessments will begin shortly; and
WHEREAS, said County Treasurer has requested instruc-
tions as to whether the City desires to b&y or withdraw unpaid
delinquent special assessments in default of other bidders;
NOW, THEREFORE, BE IT ORDAINED by the City Council of
the City of Des Plaines, County of Cook and State of Illinois;
SECTION 1: That the City Ulerk be and he is hereby
authorized and directed to notify the County Treasurer to with-
draw from collection at said tax sale all unpaid delinquent
special assessments in default of bidders, as provided by Section
72 of the Local Improvement act, as amended. Said Statute pro-
vides among other things that said withdrawal from collection
shall not operate to cancel the assessments or impair the lien
of the said municipality so withdravaduktrimmaddbuddmating it,
and the same shall be and remain delinquent and payable at the
office of the County Clerk, with all fees, costs, penalties,
interest and charges that have occsued thereon, and such lot,
parcel of land or property may be re -advertised and re -sold at

any subsequent tax sale for such delinquent special assessments
or installments thereof.
SECTION 2: That a certified copy of this ordinance be
forwarded forthwith by the City Clerk to Joseph B. McDonough,
County Treasurer of Cook County.
SECTION 1: That this ordinance shall be in full force
and effect from and after its passage and approval as provided
by law.

Re: Statement of Account with County
Treasurer of Gook County
Gentlemen:
Some time ago there was referred to me the question
of moneys retained by the County Treasurer from re-
demptions made to the City Treasurer of the City of
Des Plaines.
We have been unable to get any statement from the
County Treasurer as to the Condition of these redemp-
tions. However, it does appear that the County
Treasurer has retained from special assessments nearly
$80o0.00 for the years 1929,1930 and 1931. This is
made up of 504 items charged on lots returned delinquent,
a large part of which is not represented by moneys
collected by the County treasurer on the lots returned
delinquent.
It is my opinion that the County Treasurer has no right
either to charge the general tax account of the City
of Des Plaines with these obligations, or to charge the
same against the special assessment funds collected.
I await further instructions as to w hat steps you desire
taken in regard to the moneys retained by the County
Treasurer.

RESOLUTION
WHEREAS, the County Treasurer of Cook County has
retained various sums of money from the special assessment
funds of the City of Des Plaines, and collected by the `'aunty
Tredsurer for the years of 1929, 1930 and 1931, to cover -
alleged costs and fees of the county Treasurer; and
WHEREAS, that City of Des Plaines has been unable
to get a statement of the moneys collected on the general
taxes together with a statement of redemptions to the City
of Des Plaines, so that the City of Des Plaines is unable to
determine whether moneys are retained from the general taxes

paid the County Treasurer.,and due the City of Des Plaines.

BE IT THEREFORE ESOLVED that the City Clerk of
the City of Des Plaines be and he is hereby directed to make
demand upon the County Treasurer of Cook County, that he
forthwith turn over and pay to the City Treasurer all moneys
retained by the County Treasurer from special assessment funds
and commonly known as the 50% items and charged against the
City of Des Plaines in all cases in which the County treasurer
has not collected the said 54 item from lots returned delinquent,
and that demand be made upon the County Treasurer for a state-
ment of general taxes collected for the years of 1928, 1929 and
1930 and of redemptions made by the City Treasurer of the City
of Des Plaines.
BE IT FURTHER RESOLVED that the resolution bilin.
full force and effect from and after its adoption as required
by law.

The motion was made by Alderman Pflughaupt and seconded by Collet to
adopt this resolution. The motion was voted upon by acclamation,
whereupon the Mayor declared the motion carried and the resolution

RESOLUTION
WHEREAS, the City of Des Plaines had heretofore
provided for the levying of a special assessment to pay the
cost of curbing, grading and paving certain streets in
Cumberland Subdivision, and the issuance of bonds to anticipate
the collection 9f the said assessment; and
WHEREAS, certain bonds were issued and delivered
to MILBURN BROTHERS COMPANY,,who were the contractors in the
said work, and during the year 1930 the books of the City
Treasurer of the City of Des Plaines showed certain moneys to
be on hand in each installment of the said improvement, and
that the City Treasurer of the City of Des Plaines did then
and there take up and pay the following bonds, to -wit:

and di then and there cancel the said bonds; and
7 REAS, the fact if that the said moneys which
the said treasurer had on hand in said fund was interest
and was not applicable to the payment of the said bonds, and
that by reason of the said bonds having been paid, coupons
maturing during the year of 1930 and subsequent years have
been and are still in default, and that the said money should
have been used to pay coupons maturing December 31, 1930, and
that Milburn Brothers Company desire that coupons be surrendered
to the amount of the bonds paid on the said date, and that
the said bonds be re -issued.
BE IT THEREFORE RESOLVED by the Mayor and City
*Council of the City of Des Plaines, that the Mayor and City
Clerk of the City of Des Plaines be and they are hereby authorized
and directed to prepare and to issue to Milburn Brothers Company
bonds payable out of the following series and amounts as were
originally issued and that the said bonds be dated January 1,
1932.
BE IT FURTHER RESOLVED THAT the said bonds be delivered
to Milburn Brothers Company upon the surrender by Milburn Brothers
%ompany of coupons in the said improvement maturing December 31,
1930, of an amount equal to the said bonds, to -wit, $9000.00
BE IT FURTHER RESOLVED that this resolution shall be in full
force and effect from and after its adoption as provided
by law.

Dear Sir: -
Your letter of September 14th with reference to the
order of the City Council of the City of Des Plaines Calling
attention to the recommendation of Coroner's Jury in connection
with the Death of Walter Herbert Rolfe,Jr. and Lawrence Howard
Abbott, killed at the COW Railroad tracks and River Road in Des
Plaines on August 13th, 1932.
The Suggestion of the Coroner's Jury that the North Western
be -required to immediately install safety gates and bells at this :but
dangerous intersection to avert further accidents at this point
can hardly be taken as direct evidence that the crossing protect-
ion is not adequate at this point.
While we appreciate, to the fullest extent, that suggestions
sometimes bear out definite facts, still in all, after a very
careful survey from an Engineering standpoint, this railroad believes
that it would be a serious mistake to install gates at a crossing
like River Road crossing.in Des Plaines, Illinois, and from the
experiences that we are having every day, where gate crossing pro-
tection is provided, indicates that there would be a kreater poss-
ibility of more accidents resulting if such an installation were
provided and the gates themselves would create a bigger hazard
than the City Council now considers exists at this point.
It is our experience that high speed, heavy automobile traffic
cannot be properly handled and protected with gates. We have had
to take gates. We have had to take gates out on such important
highways as the Lincoln Highway, and therefore, we could not rea-
sonably be expected to consider a recommendation for the install-
ation of gates at this River Road crossing.
We have already taken steps to immediately install additional
protection for this crossing by providing the flagmen with an-
nunciators to give warning of the approach of trains these to be
connected up with the track circuits, so that proper and further
protection canbe provided in foggy or inclement weather. Further-,
as you are aware, the North Western provided additional flagmen
on this crossing when traffic is heavy.
We have willingly cooperated with the city of Des Plaines, in
the past, in their proposed palns for the installation of *Stop"
and "Go" signals for the protection of automobile traffic at the
highway intersections adjacent to the North Western Tracks and
have practically agreed that wheneter the City of Des Plaines
makes such an installation the COW will cooperate by installing
the same kind of apparatus at the railroad intersection and
provide proper manual supervision.
We presume that you are continuing your studies with
reference to providing for a complete installation of "Stop" and
"Go" signals, and if so, we would appreciate if you would give us
the opportunity towork with you to the end that the railroad inter
sections be provided with some protection that will not only be
safe and visible to automobile djrivers but will also hold them.

Gentlemen:
Complaint has been made to me by the attorneys for
William G. Wille for a refund of the sum of $146.42
being moneys paid by mistake in Special Assessment
No. 60.
Upon examination'of the records of the City of Des
Plaines I find that on September 16, 1929, a motion
was made by Alderman Heeschthad a warrant be issued
to William G. for refund of this amount from the
funds in 'Special Assessment No. 60.
further examination shows a cash book entry showing
that on December 29, 1924, Installment Nos. 4 to 10,
both inclusive, were paid, together with interest.
The records further show that on various dates, parti-
cularly on January 1, 1926, December 31, 1926, December
31, 1927 and December 31, 1928 Installment Nos. 5, 6, 7
and 8 were paid, together with interest. The principal
sum of these installments amounted to $119.52, I
have not verified the amount of the interest. I assume
that the balance of the claim of $146.42 consisted of
interest.

Enclosed you will find copy of minutes
of proceedings of a meeting of the City Council
of Des Plaines, held on March 16, 1932, in which
certain action was taken on several bonds issued
on assessments 81 and 83.
I represent the owner of a $1000.00 bond
issued on Assessment No. 95, and my client has re-
quested me to undertake to obtain some action on
this bond described in the enclosed resolution.
Will you kindly call this to the attention
of the Mayor and Board of Aldermen at the next council
meeting.

It•was pointed out that Mr. L. C. Schnake is the bondholder referred
to in the above letter. Mr. Maloney, attorney, stated that the City
Treasurer is forbidden by court order to redeem any bonds in Special
Assessment No. 95 Mayor Hammerl therefore instructed Mr. Maloney
attorney, to confer with Mr. Fischer, attorney for the bond holders
in an attempt to get Mr. Schnakets bond paid.

Gentlemen:.
This office would appreciate your consideration in the
adoption of a city ordinance which would prevent the use of mail
receptacles for the receipt of merchants bills etc.
This practice is almost a daily occurence and we find
that it not only delays the delivery of mail but pievents mail
from being placed in receptacle securely.
Barrington, Ill. a neighboring town has adopted this
ordinance and find it quite satisfactory.

The matter of delivering Fater bills by messenger instead .of
by U. S. Mail. The motion was made by Alderman Lacey and seconded by
Enzenbacher to try delivering Water bills by messenger for three months,
and to authorize the'City Clerk to purchase the necessary evenvelopes
required. The motion was voted upon by acclamation, whereupon the
Mayor declared the motion'carried.
The Clerk then read the following letter:

Dear Sir:
We have under contract at this time the construction
of Wolf Road, known as Section 016-3134-15D, for the Cook County
Highway Department, At one point of this work in the immediate
vicinity of Rose Avenue, which is approcimately'at the City
Limits, we are in need of some dirt with Which to construct a
fill for the new road.
We are anxious to determine whether you, together with
the City Council of Des Plaines, will grant your approval and
authority for our taking whateVer dirt may be avdkilable within
the roadway lines of Rose 'Avenue at the intersection of same With
Wolf Road. Upon investigation there appears to be a great surplus
of dirt in this roadway, same beidg considerably higher than
surrounding property.
If permitted to take this dirt for the purpose stated
above, we agree to take only such material as may be determined
from stakes set by you, and immediately upon sompletion of work,

we further agree to grade and blade up the roadway of Rose Avenue
in such a manner as to leave same passable and with proper drain-
age.

To the Mayer and City Council of the (city of Des Plaines:
Gentlemen: •
• . On Saturday,' October 1, 1932, I received the case of
Harold McClarey on a change of Venue from Wm. R. Hayes, Police
Magistrate. Mr. McClarey had previously been arrested for
a Traffice Violation by a Des Plaines Police Officer.
The Defendant asked for a trial by Jury of Twelve
men, and pursuant to Statute, a Jury was sworn and impannelled
to try _the case. The Jury found the defendant Not Guilty"'
of one of the Charges, tw-wit:"Going thru a stop light".
Under the Law, it is the duty of the Complainant, in
the event the prosecution of his suit or action fails: to pay
all costs incurred as a result of the action. In this case
The City of Des Plaines was the complainant thru the arrest
made by the Les 2laines Police Officer. The Constable who
summonjled the Jury, and I have agreed to waive all costs,
but the Jury men who receive only 50 cents each and who sat for
over 2 hours on the case should be paid. The names of the
Jurours are as follows:

THE SECOND WARD IMMPROVEMENT ASSOCIATION desires to take
this opportunity to thank the City Council for their action regarding
conditions as originally prevailing at the water tank tower as re-
ferred to in our communication of two weeks ago. We certainly do
appreciate this.
Also desire to call your attention to the following extracts
from the minutes of our meeting of September 20th:
*ORDERED: That the Secretary communicate with the City
Council recommending that Traffic Officers be sta-
tioned at the corner of Lee and Ellinwood Sts. and
Lee and Miner Sts. on Saturday afternoon and evening
and on, Sunday evenings when traffic conditions so
warrant.*
Several of our members reported having consideralbe troutle

In accordance with your request, I have considered the
question of the construction of sidewalks on Dempster
Street from Rand Raod East to the Maine Township High
School, and considering this question, one of the
things dig importance is whether the sidewalks are to
be laid'on a street within a municipality or whether
the street is outside of a mun4cipality.
Frani an examination of the records, and from my acquain-
tance with the matter, 1 think the only municipality.
which touches Dempster Street between Rand Road and Maine
Township High School, is a small portion of Park Ridge
which extends North to Dempster Street, just East of .
Rand Road. The property on the North side and 244 adjoining
Dempster Street is entirely uni,ncorporated between these
points. I would, therefore, s4ggest that if the matter
is to be taken into considerat,on, it be taken into con-
sideration as on the North side of Dempster Stteet from
Rand Road to the .wine Township High school, or to what
other avenues may be disired.
I further find that the County of Cook acquired a.luO foot
right of way from Milwaukee Avenue to nand Road on Dempster
• Street. This was paved by the,County and then turned over
• to the State for maintenance. ,It is my opinion that either
• the State or the County has the Power to construct sidewalks
in this highway. I am acquainted with the fact that the
opposite contention is maintained by some authorities.
Ir is my opinion that the right to maintain highways and .to
construct highways and,to construct other devices for the
safety of the public and for the public travel on these
highways not only includes vehicular travel and the safety
of passengers in vehicles, but also pedestrian travel and
p• edestrian safety. A different story -would apply inside.of.
the corporate limits of some municipality.
My suggestion would be that a petitionbeprepared asking
the County Hoard of Cook County, to provide for the con-
structioh of this sidewalks on the North side of Dempster
• Street from Rand Road to the ,property of the. Maine Township
• HiE;h School, and that the cost pf the sidewalks be paid by
• Cook County our to the gas tax,, with the approval and consent
of the State of Illinois. If yob desire such a resolution,
I will be gald to prepare the sp.me, a nd also. to use such .
efforts as I may in obtaining the approval of such resolution
by the Board of County Commissioners of Cook County.

Upon request of Mayor lammerl, engineer Carter Jenkins reported
to the Council tha4 Wm. Cater has offered to sell the Cater well to
the City far the sum of $85,000.00. He also gave some facts concerning
the Reconstruction Finance Corporation, and its method of operation.
Mayor Hammerl then announced that the members of the Council will be
called upon in the near future to meet as a "committee of the whole"
to discuss the adv.sability of buying the Cater Well.
The'motion was°made by Alderman Collet and seconded by
Meinshausen to instruct the Clerk to notify the property cwhers.on
the west side of white Street, south of Oakton Street, to lay sidewalk
in front of their property. The motion was voted upon ,by Acclamation,

Attorney, D. B. Maloney reported briefly on the case of Mrs.
Knabb, widow of former Motorcycle police, Richard Knabb agtinst the in-
surance'company. Mr. Maloney reported that he is handling the case of
Mrs. Knabb for the City, inasmuch as Officer Knabb was covered by an
insurance policy as an employee of the City.
The motion was made by Alderman Pflughaupt'and seconded by
Lacey to adjourn. The motion was.voted upon by acclamation, whereupon
