MINUTES OF THE REGULAR MRFTING OF
THE CITY COUNCIL OF THE CITY OF DES
PLAINS, HELD IN THE COtl2TCIL CHAMBERS
ON THE 18th DAY OF JULY, 1932. AT THE
HOUR OF 8 O'CLOCK'P. M.
The meeting was called to order by Mayor Charles Hammerl,
with Alderman Ahbe, Collet, Pflughaupt; Huxmann, Dean, Kinder, Lacey,
Enz¢nbacher and Meinshausen responding'to the roll call. Alderman
Friott was absent.
The Clerk then read`a report of Fritz Wettin, City Collector
Covering collections from June 1, 1932'to July 2, 1932.
The Clerk also read the following report of Chiefof Police
C. A. Wegner:

Attached find copy of vlydict rendered by the Coroner's
Jury upon the death of Officer Richard Knabb, inquest held at
Des Plaines City Hall, on July 14th, 1932.

•
An inquisition was taken for the People of the
State of Illinois, at Oehler's Undertaking Establish-
, ment, Lee & Perry Sts., Des Plaines, Illinois, and
City Hall, Des Plaines, Illinois, in the City of
,Des Plaines, in said County of Cook, on the 2nd and
14th, day of July, A. D., 1932. before me, Frank J.
Walsh, Coroner, in Ahd for said County, upon view
of the body of Richard A. Knabb, then and there
lying dead upon the oaths of six good and lawful
men of said County, who, being duly sworn to
inquire on the part of the People of the State of
Illinois into all circumstances attending the
death of said dead' body and how and in what manner,
and.by whom or what, and when and where the said
dead body came to its death, do say, upon their
oaths•,as aforesaid, that the said dead body now
or then lying dead at Oehler's Undertaking Estab-
lishment, Des Plaines, Illinois, in said City of
Des Plaines, County of Cook, State of Illinois,
came to its death an the 2nd day of July, Z. D.
1132, in his home located at 1545 Perry Avt.
Des Plaines, Illinois, from multiple pulmonary
infarction resultant of thrombosis of the veins
of the left lower extremity probably traumatic
in origin.
From the testimony presented to us we the
jury are informed that on May 12th, A. D., 1932,
the deceased was engaged in the regular performance
of his duties at about 7:45 A. M. employed by the
said City of Des Plaines as a motorcycle Policeman,
and that while so employed for said City and at-
tempting to arrest one William Hurt and one Louis
Serapiglia, alias Cornell, who were traveling
northwest on the Northwest Highway in said city,
at, a fast rate of speed, stated to be 80 miles
per hour, in Nash sedan, license No. 543-604
Illinois 1932, was swerved into and struck by
the rear left side of said Nash sedan auto while
said deceased was riding his motorcycle, employed
as above described, causing the said deceased to

be thrown from his said motorcycle onto the left
side of said Htighway at a point on said Northwest
Highway at about the north edge of the City limits
of the said City of Des Plaines, and are further
informed that the said William Hurt and said
Louis Serapiglia, alias Cornell, had previous to
the time of the above described occurrence stolen
the said Nash sedan auto from its owner, one Edward
Connelly, of 5239 North Leamington Avenue, Chicago.
We the jury therefore recommend that the said
William Hurt and the said Louis Serapiglia, alias
Cornell, now in custody and in jail, be held to
the Grand Jury on the charges of murder and ac-
cessory to murder before and after the fact to
murder: 1. e.:- that one Louis Serapiglia, alias
Cornell, be held to the Grand Jury on the charge
of murder, and that said William Hurt be held to
the grand Jury on the charge of accessory to
murder of the said deceased, before and after the
fact of murder, until discharged by due process/
of the law.
None of the standing Committies of the Council had reports to offer.
The Clerk then read the following letter and resolution: -

Des Plaines, Illinois.
Gentlemen:
July 15, 1932.
It has been called to our attention that a certain
company, called the Station and Lake Bus Line,
requested your honorable body to pass a resolution.,
stating that you feel that such a .4ne as they
propose, in addition to the present line, would be
a public convenience to your community.
We feel that our line has served the communities
througlik which we travel very satisfactory in the past,
and hope to do so in the future.
If, at the present time, our company is not serving the
public convenience or could better serve it, we
would gladly welcome any constructive criticism, or
• suggestion.
When this matter is again before you, we feel that
it would be contrary to sound economic principles
for your body to sanction the application of the
proposed new line.

RESOLUTION
BE IT RESOLVED by the City of Des Plaines
Illinois, that the City Attorney be and he is hereby authori-
zed to enter the appearance of the City of Des Plaines in
the matter of the application of the atation to Lake Bus Line
for a certificate of convenience and necessity to operate as
a motor carrier of passengers between the City of Crystal Lake
and the City of Chicago, and intermediate points, said action
being pending before the Illinois Commerce Commission:
BE IT FURTHER RESOLVED that the City of Des
Plaines is opposed to the granting of this application for
the following reasons, among others:
That the operation of buses over the streets
of its city will be dangerous to theiesidents of the City;
That the City of Des Plaines now has adequate
and sufficient passenger trains running between Des Plaines
and Chicago, to take care of passengers residing insaid. City;
That public necessity and convenience of the
City of Des Plaines does not require the operation of buses
for the transpor$ation of persons between Des Plaines and.
Chicago and intermediate points.
The motion was made by Alderman Ahbe and 2econded by Dean to put this =mace
resolution on passage. The motion was voted upon by acclamation,
whereupon the Mayor declared the motion carried. The motion was then
made by Alderman Ahbe and secondedby Meinshausen to adopt the resolu-
tion. The roll was called on the motion with the following result:
Ayes; Aldermen Ahbe, Collet, Pflughaupt, Dean, Huxmann,' Kinder, Lacey,
Enzenbacher and Meinshausen. Nays None. The Mayor thereupon declared
the motion carried and the resolution adopted.
The Clerk then read the following letter: -

Des Plaines, Ill.
Gentlemen:
Suly 11, 1932.
There has been considerable discussion recently relative
to the complaints coming to us from various parts of the Fourth
Ward espedially as to the *Bund Car*.menace existing on the side
track of the Belt Line R. R. at Fourth AvenueNorth Avenue and in
view of the many protests by the residents of this community.we
believe immediate action should be taken to eliminate this condition
at once for the welfare of all concerned.
Wehavereal red blooded American Citizens and Tax
Payers in the locality in question who no doubt have gone through
consideraibe hardship and privation in order to be owners of homes
and to think that they are being given such little consideration
as to permit the Raiaroad Companies to impose on their good
nature by switching these Bunk Cara almos directly in frontof
their homes, this is indeed disgraceful to say the least especially
as tp sanitary conditions, where is this so called Health Dept.
whose duties it is to look after such matters in order to pre-
vent epidemics. Even though given switch track privelidges
at this point we do is of believe that the Railroad. Company should
force this condition onto the residents of this community such
as they have done in so far as causing those using this R. R.
crossing as a thorough fare being subject to insUlts by employees
of this Railroad Company.
We therefore make this request of your Honorable
Mayor and City Council members to take immediate steps in remedying
this situation by insisting that none of these *Bunk Cars* be
permitted within one mile of the residential section of this
community.

adopt the following resolution:\

RESOLUTION
WHEREAS, Ira for some time past the Belt Line and Chicago
and North Western Railway Company have permitted bunk cars to be
stoted along the Belt Line Tracks at and near Fourth Avenue and
North Avenue in the City of Des Plaines: and
WHEREAS, the said cars are used for the living quarters of
workmen employed. along the right of way of the said Railway
Company; and
AREAS, the said cars are not provided with any sanitary
facilitied and there are no sanitary facilities along the right
of way of the railroad; that the said cars- are being used for
living quarters within the City limits of the City of Des Plaines
in violation of the ordinances of the City.of Des Plaines, and by
reason of the -lack of sanitary facilities, the said condition
results in a nuisance and a dangerous condition in the residential
district in which the said railroad is located; and
WHEREAS, in addition thereto) many of the said employees
have been insulting to women residents of the community, and that
the conditions generally surrounding the neighborhood where the
said bunk cars 'are located, are dangerous to the safety of the
community and contrary to public morals.
BE IT, THEREFORE, RESOLVED by the Mayor and City Council
of the -City of Des Plaines that the said Chicago and North Western
Railway Company be and it is hereby requested to move the said
bunk cars outside of the City limits of the City of Des Plaines
and to hereafter refrain from storing or maintaining any bunk
cars within one (1) mile of the City limits of the City of
Des Plaines.
BE IT FURTHER RESOLVED that this Resolution shall be
in full force and effect from and after its passage and approval
according to law.

rezoning of property located on the N. E. corner of
River Rd. and Algonquin Rd., known as the So. 150 Ft.
• of Lots 5 in Whitcombs Subdivision for the purpose of
erecting a Gasoline Filling Station to comply with
your building requirements and to which the under
signed property owners are agreeable.
Mr. Warhus•however requested permission to with draw this petition,
stating that a more complete petition laxI ligxkkK xx will be filed at
at a later date. The motion was made by Alderman Huxmann and seconded
by Meinshausen. to the permit Mr. Warhus to withdraw this petition.
The motion was voted upon by acclamation whereupon the Mayor declared
.the motion carried, and the petition withdrawn.

cutting the weeds and. Grass in our subdivision
known as Des Plaines Villas, the parkways in this
subdivision is full of weeds and thistles which
we would kindly ask you to have the City of
Des Plaines cut.
The work thich was done by Mr.
Schimka was very 'attitfactory to us and thought
that you could give him the job of cutting the
parkways for the City of Des Plaines.

The motion was made by Alderman Huxmann and sectInded by Dean to author-
ize the Streets and Sidewalks Committee to expend not to exceed $25.00
for mowing the parkways -in Des Plaines Villas. The motion was voted
upon by acclamation whereupon the Mayor declared the, motion carried.
The motion was made by Alderman Enzenbacher and seconded by
Ahbe to instruct Mr. Maloney, Attorney to Check the books of the County
Treasurer to acertain how mtch money due the City for general taxes,
and special AssesseMents is being held by the County Treasurer; and
to make a formal demand for such moneys due the City. The. roll was
called on the motion with the following result: Ayes; Aldermen Ahbe,
Collet, Pflughaupt, Dean,Huxmann, Kinder, Lacey, Enzenbacher and
Meinshausen. Nays; None-.. The Mayor thereupon declared the motion
carried.
The Maloney attorney for the dity, presented a court summons
for case of the Des Plaines Building & Loan Ass'a. against a Wm. G.
Fischer in which the City is also named
The motion was made by Alderman Hann and seconded by Ahbe
to instruct Mr. Maloney, attorney to enter an appearance for the City
and report on the case atthe next regular meeting of the Council.
The roll was called on the motion with the 'following result: Ayes;
Aldermen Ahbe, Collet, l'flughaupt, Dean, Huxinann, Kinder, Lacey,
Enzenbacher and Meinshausen. Nays; None. The Mayor thereupon declared
the motion carried.
Frank Haan of Linden Street then addressed the Council,
requesting that several loads of gravel or crushed stone be spread
on Linden Street in order to eliminate several had Mud holes on this
street. The motion was Made by Alderman Hausmann and seconded by
Menshausen to authorize the Streets and. Sidewalks Committee to buy
whatever stone is necessary for Linden Street at not to exceed, $1.00
per cubic yard. The motion was voted upon by acclamation, whereupon
the Mayor declared the motion carried.

Phillip Gatto 730 Graceland Avenue, desirps appointment
as special police officer,especially to fill in where necessary
on motorcycle work.

The motion was made by Alderman Enzenbacher and seconded by Ahbe
that Phillip Gatto be commissioned as Special Police as requested
in the above letter. The motion was voted upon by acclamation, '
whereupon• the Mayor declared the motion carried.
• Mayor Hammerl then presented the request of Alderman Dean to
commission Art. Flentge and Carl Manz as Spetial Police. This request
was referred to the Police & License Committee by the Mayor for
consideration and report.

of the Death of Officer Richard Knabb while discharging his official
duty. The:motion was' voted upon by acclamation, whereupon the Mayor
declared the motion carried.

The motion was made by Alderman Enzenbacher and seconded by Collet
to adopt the resolution, exceptinghowever, the $57.34 due G. Bullis.
The roll was called bn the motion with the following result: Ayes;
Aldermen Ahbe, Collet, Pflughaupt, Dean, Huxmann, Kinder, Lacey,
Enzenbachei. and. Meinshausen. Nays; None. The Mayor thereupon
declared the motion carried.

The motion was made by Alderman Kinder and seconded by
Ahbe to correct the mihutes of the special Council Meeting of June
29, 1932 by inserting the following after the fourth paragraph of
said minutes: •
"The motion was made by Alderman Huxmann and
seconded by Pflughaupt that the said ordinance
be amended by striking out all those portions
contained on pages 1, 2, 3, and the first
paragraph of page 4, and by striking out the
word "THEREFORE" inthe first line of the
second paragraph on page 4 thereof. The r311
was called on the amendment with the following_
result: Ayes, Aldermen Pflug haupt, Huxmann,
Kinder, Friott and Meinshausen. Nays; Aldermen
Ahbe,-Collet, Lacey, Dean and Enzenbacher.
There being a tie, the Mayor cast his vote
as "Nay" and declared the amendment defeated.*
and to approve the minutes of the Special Meeting of June 29, 1932
as corrected, and also to approve the minutes of the Regular Meeting
of July 5, 1932 as written. The motion was voted upon by acclamation
whereupon the Mayor declared the motion carried.
Alderman Huxmann •suggested that the matter of •employing
a mechanic to keep the equipment of the Citrin repair, be given
consideration by the Council. The matter was referred to the
Council. The mater was referred to the Council as a committee of
the whole, by the Mayor for study and report.
Mayor Hammerl then announced that' the Council will meet
as a committee of the whole, on Tuesday July 26, 1932, at the City Hall.
The motion was made by Alderman Enzenbahher and seconded by
Ahbe that the Council adjourn. The motionwas voted upon by accla—
mation, whereupon the Mayor declared the motion carried, and the
Council regularly adjourned.
