06/14/1932 Adjourned MeetingMINUTES OF AN ADJOURNED MEETING OF THE CITY COUNCILOF THE CITY OF DES PLAINES, HELD IN TBE COUNCIL CHAS ON THE FOURTEENTH DAY OF ;UNE, 1932. AT THE HOUR OF 80tOLOCK P. M. ' The meeting was called to order by Mayor Hammerl, with Aldermen Ahbe, Collet, Pflughaupt, Dean, Huxrnann, Kander, Lacey, Triott, Enzenbacher and Neinshausen responding 'to the roll call. :reading. The Clerk then read the following ordinancefor second AN ORDINANCE ' CREATING A BOARD OF LOCAL IMPROVEMENTS FOR THE CITY OF DES PLAINES; COOK COUNTY ILLINOIS, AND DESIGNATING THE MEMBERS THEREOF. ' The motion was made by Alderman Enzenbacher and seconded, by Collet to adopt the ordinance as read. The toll was called on the Motion 'with the following result:* Ayes; Aldermen Ahbe, Collet, Pflughaupt, 'Dean, Huxmann, K1nd.er 1cey, Friott, lbzenbacher, and Meinshausen. Mays; none. The -Mayor theretipon declared the motion carried and the :ordinance adopted. The Clerk then read the following ordinance:' AN ORDINANCE WHEREAS, there is now pending iA the Superior Court of 'Cook County a proceeding between the Sandwich State Bank and the City of Des Plaines and certain bondholders regarding the setting aside of bonds overissued in Des Plaines No..95; and WHEREAS, the property owners affedted by the said im- provement have agreed to the levying of a supplemental assess- ment and the City of Des Plaines has agreed to assume certain portion of the bonds issued in this proceeding; and WEEMS, decree in this matter has been prepared in aeaordance with the said agreements. BE IT, THEREFORE, ORDAINED by the City Council of the City of Des Plaines, Cook County, Illinois; =19Tl: That the City of Des Plaines does hereby consent to the entry of a decree in the case pending in the Superior Court of Cook County entitled, "The SaAdwich State bank, et al. v. City of Des Plaines, et al. (Bi11), City of Des Plaines, et al. v. The Sandwich State Bank, et al. (Cross - till). *No. 511690, copy of whit& decree is hereto attached. SECTION 2: That David B. Maloney, Attorney for the aity of Des Plaines, be and he is hereby authorized and direoted to appear in Court and consent to the entry of the laid decree. The motion was made by Alderman Ahbe and seconded by Laoey to adopt • this proposed ordinance. The roll was called on the motion with the following result: Ayes; Aldermen Ahbe, Collet Pflughaupt, Dean, 583 Huxmann, Kinder, Lacey, Friott, Enzenbacher, and Meinahausen. Nays; None. The Mayor thereupon declared the motion carried and the ordinance adopted. The Clerk then read the following resoltuion: RESOLUT I ON ' AREAS, the Department of Public Works and Buildings of the State of Illinois have provided for the extension and widening of the pavement on Higgins Road in Cook County known 'as *State Bond Issue Highway No. 46" and WHEREAS, the said Highway crosses the tracks of the soo Railway at a point South 'of the City ]iif Des Plaines, and that the plans fdr the said highway call for a pavement of a width of forty(40) feet excepting at the near the'said - crossing of the tracks of the Soo Railway; and WHEREAS, the abrupt terminating of the two ten (10) foot slabs on either side of the existing twenty (20) foot pavement on the said street constitutes a derious hazard and constitutes a dangerous condition at the said crossing; and • WHEREAS, it is probable that the said crossing will not require a grade separation for some years to come and - that it is necessary for the safety of the public that the forty (40) foot pavement be extended across the said railway tracks. BE IT THEREFORERESOLVED by the Mayor and City Council of the City of Des Plaines, Cook County, Illinois, that the Department of Public Works and Buildings of the State of Illinois, H. H. Uleveland, Director of the Department of Public Works and Buildings, and Frank T. Sheets, Superintendent of Highways, be and they are hereby petitioned to take immediate steps to provide for the continuation of the forty. -(40) foot pavement provided to be constructed on Higgins Road in Gook County, across the tracks of the Soo Railway south of the city of Des Plaines. BE IT FURTHER RESOLVED that /Aka a copy of this Resolution be forwarded to H. R. Cleveland, Director of the Department of'Publia Works and Buildings of the State of Illinois, and i'ratnk T. Sheets, Superintendent of Highways of the State of 'Illinois. BE IT FURTHER RESOLVED that this Resolution shall be in full f orce and effect from and, after its passage and approval according to law. The Mayor thereupon declared the motion carried and the resolu- tion adopted. The Clerk then'read the following resignation: June 2, 1932. To the Mayor and City Council of the City of Des Plaines. Gentlemen 1 herewith tender my resignation as Chief of Police of the City of Des Plaines. / appreciate my pleasant relations under your direction in the past, and will be glad to be of service to you at any time in the future. The motion was made by Alderman Huxmann and seconded by Kinder to refer the resignation to the Police and License Committee* The roll was called on the motion with the following result: Ayes; Aldermen Pflughaupt, Huxmann, Kinder, Friott, and Enzenbacher. Bays; Aldermen Ahbe, Collet, Dean,&Iacey* Alderman Meinshausen did not vote on this motion. The Mayor thereupon declared the motion carried. The Clerk then read the following: To the Honorable Mayor and City council - City of Des Plaines-, Des Plaines, Illinoi June 14th, 1932. Your Committee on Police and. License had a meeting June 10th, with reference to the resignation submitted by the Chief of Pollee. Chief Wegner was'present at this meeting and informed the Committee that his resignation should be accepted for the good of the department. Inasmuch as there is more or less friction between Cheif Wegner and the State Police Officers, and whereas the State Police desire to make their headquarters in Des Plaines, and by so doing more State cases would be heard in Des Plaines, it would greatly be to our advantage to co-operate with them. Therefore, your Committee recommends that the resign- ation of Chief Wegner be accepted. hobart M. Ahbe. John B. Collet, L. F. "einshausen. Cotmittee The motion was made by Alderman Ahbe and sedonded by Collet to accept the recommendation ifttained in the above report. The motion was then made by Alderman Huxmann and seconded by Kinder to amend this motion 00 as toreferthe resignation of Chief of Police C. Wegner, as well as the report of the Police Committee to the Council as a committee of the whole.. The roll was called on the amendment with the following result: Ayes; Aldermen i'flughaupt, Huxmann, Lacey, driott, Enzenbacher and Meinshausen. Nays; Aldermen Ahbe, Collet, and Dean. The Mayor thereupon declared the amendment carried, and ammounced that the Council will meet as committee of the whole on Friday June 17, 1932 at 8:00 P. M. in the Council chambers. The Clerk then gave first reading to a revised draft of an ordinance refucing the price to be paid to Wn. H. Cater for Tatter taken from the Cater Well to 10 cents per thousand gallons less the price of pumping, and permitting the City to use water from sboth the Des Plaines Ave.'Well, and the Norma Well. The Clerk then read the following proposed ordinance for first reading: ORDINANCE. BE IT ORDAINED by the Mayor and. City Council of the City of Des Plaines, Cook County, Illinois; SECTION 1: That the Mayor be and he is hereby authorized and directed to execute a license granting to the Des Plaines Park District the right to care for the maintain certain parkways or unimproved tracts or streets in the City of Des Plaines. • SECTION 2: That the City Clerk he and he is hereby authorized and directed to attest the said license, copy of which license is hereto attached and made part hereof. MAI 1: That this ordinance shall be in full force and effect from and after its passage and the approval thereof according to law. PASSED this day of June, A. D. 1932. AYES:. The motion was made by Alderman Enzenbacher and seconded to put this proposed ordinance on passage. The motion was voted upon by acclamation, whereupon the Mayor declared the motion carried. The motion was then made by Alderman Huxmann and seconded by Lacey to adopt this ordinance. The roll was Dialled on the motion with the following result: Ayes; Aldermen Ahbe, Collet, Pglughaupt, Dean, Huxmann, Kinder, Lacey, .Friott, Enzenbacher and Meinshausen. Nays None. The Mayor thereupon declared the motion carried and the ord- inance adopted. Upon the suggestion of Attorney D. B. Maloney the motion was made by Alderman Kinder -and seconded by Lacey that the final certificate for the improvement known as the 'Widening and Paving of Ellinwood Street" be referred to the Finance Committee* The Motion was voted upon by acclamation, whereupon the Mayor declared the motion carried. The motion was made by Alderman Huxmann and seconded by Enzenbacher to refer the matter of removing the shack and lumber of Gus. J. Spier near Manheim Road and Everett Street to Attorney Maloney. The motion was voted upon by acclamation, whereupon the Mayor declared the motion carried. The motion was made by Alderman Huxmann and seconded by Meinshausen to adjourn. The motion was voted upon by acclamation, whereupon the Mayor declared the motion carried* and the Council adjourned.
