I."INUTES OF T REGULAR MEETING OF
TEE. CITY COUNCIL OF Tifl CITY OF DES
PLAINES, HELD IN THE COUNCIL CHAMBERS
ON THE 2nd, DAY OF MAY, 1932. AT THE
HOUR OF 8 0' CLOCK P. Y.
The meeting was called to order by Mayor 8harles Hammers
with Aldermen Ahbe, Collet, Suster, Pflughaupt, Huxmann, Kinder,
Lacey, Wettin,Enzenbacher and Meinshausen responding to the roll call.
,The Clerk read the following reports for the calendar month
of April 1931.
The report of C. A. Wegner, Cheif of Police
The report of Otto Rexses, City Treasurer
The report of E. J. Friedrich, City Clerk.
The reports were referred to the Finance Committee by the Mayor.
The Mayor then called upon the chairmen of the various stand-
ing committees of the Council for reports. None of the committees
however had a report to offer.
Alderman Enzenbacher Chairman of the Finance Committee, to
which the matter of designating a depository for Gity funds was re-
ferred at the last meeting, reported that the comrnittee.is working
on the matter and will be ready to report at the next regular meeting
of the Council.
Alderman .:Lacey protested against removing certain street
lights on Prairie Avenue west of the Soo Line Railroad tracks, Mayor
Hamner' suggested however, that the property owners petition the Council
to replace these lights if they consider them necessary.
The motion was md.de by Alderman Lacey and seconded by Suster
that the Council adjourn sine die in order to seat the newly elected
and re-elected aldermen. The roll was called on the motion with the
following result: Ayes; Aldermen Ahbe, Collet, Suster, Pflughaupt,
Huxmann, Kinder, Lacey, '.iettin, Enzenbacher and Meinshausen. Nays;lTone.
The Mayor thereupon declared the council adjourned sine die, and the
newly elected Aldermen Wrn. H. Dean and Ernest Friott as well as the
reZelected Aldermen J. B. Collet, George Kinder and George .Enzenbacher
took their oaths of office and were seated formally.
The Mayor then called the newly organized Council to order
with Aldermen Ahbe, Collet, Pflughaupt, Dean, Huxmann, Kinder, Lacey,
Friott, Enzenbacher and Meinshausen responding to the roll call:

The motion was made by Alderman Kinder and seconded by Enzenbacher
to confirm the above committee appointments: The roll was called
on the motion with the following result: Ayes; Aldermen Ahbe, Collet,
Pflughaupt, Dean, Huxmann, Kinder, Lacey, Friott, Enzenbacher and
Meinshausen Nays: None. The Mayor thereupon declared the motion carried
and the appointments confirmed.
The Clerk then read the following resolution:
B SOLUTION
WHEREAS, By ordinance of the City of Des Plaines, there has
heretofore been created the office of City Collector for the
City of Des Plaines, and, •
Whereas, It is not required as a matter of law that there be such
and office, and that the City Clerk of the City of Des Plaines
can legally ,and effectually perform all of the functions and
duties that the City Collector as defined in the ordinance, per-
taining to that office, and
WHEREAS, The abolition of the office of the City Collector, and
the performance of the duties thereof by the City Clerk will en-
able a saving of alarge sum of money not less than Twenty Five
Hundred ($2500.00) Dollars annually for the benefit of Special
Assessment Accounts of said City.
NOW THEREFORE, BE IT AND IT IS HEREBY RESOLVED.
That the City Attorney for the City of Des Plaines, be and is
hereby instructed to prepare and draft all necessary suitable
ordinances to effectually abolish the office of City Collector,
and to place under the jurisdiction of the City Clerk of Des
Plaines the performance of all such duties as heretofore devolved
upon the City Collector.
IT IS FURTHER RESOLVED,
Tha,t the City Attorney be ofdered to have such ordinances feady
for first reading at the regular meeting of the City Council on
May 16th, 1932.
IT IS FURTHER RESOLVED,
That such new ordinance shall provide that all necessary clerical
help.or assistants of the City Clerk shall be appointed by him
pursuant to the Statute of this State so made and provided.
The motion was made by Alderman Lacey and deconded by, Dean to refer the
resolution to the Judiciary and Assessment Committee. The roll was
called on the motion with the following result: Ayes; Aldermen Ahbe,
Collet, Pflughaupt, Dean, Lacey and Enzenbaeher. Nays; Aldermen Huxmanu4,
Kinder, Friott and Meinshausen. The Mayor thereupon d eclared the motion
carried. The motion was then made by Alderman Huxmann and seconded by
Kinder that the Judiciary Committee be instructed -to report on the
foregoing, resolution regatding the office of City Collector, at the
next regular meeting of the City Council. The roll was called on the
motion with the following result: Ayes, Aldermen Ahbe, Collet, Pflughaupt,
Dean, Huxmann, Kinder, Lacey, Friott, Enzenbacher and Meinshausen. Nays;
None. The Mayor thereupon declared the motion carried.
The Clerk then read the following letter:

The motion was made by Alderman Huxmann and seconded by Dean that the
request contained in the above letter be granted. The motion was voted
upon by acclamation, whereupon. te Mayor declared the motion carried
and the request granted!
The Clerk then read the following letter:

Dear Sir:
No doubt your.body is on the alert to reduce public
expenditures and it has been our policy to advocate such reductions
at all times. But being for it and setting an example is quite
another thing. Taxes must -be reduced.
In line with our policy we have decided to publish all
legal notices, including reports and accounts, which the law
requires published in some newspaper of general circulation in
your County, at the reduced rate of 5 cents per column line which
is a saving of from 50% to 7.5,E of what you have Naretofore paid.
Please read this letter at your next meeting.

this letter on file. The motion was voted upon by acclamation, where-
upon the Mayor declared the motion carried.
The Clerk then read the following resolution:
RE O LUT I ON
WHEREAS, there is now pending in the Circuit Court of
Cook County a suit filed by 7illiam H. Cater against the City
of Des Plaines, all of the aldermen of the City of Des Plaines
and the City Treasurer; and
WHEREAS, during January of this year instructions were
given David B. r loney,. Attorney for the City, to withhold
further action on the proceeding until discussion was hed. with
'Mr. Cater as to the matter; and
WHEREAS, the City of Des Plaines has never accepted the
offer made.bring the said matter to trail, and it is necessary
that motions and petitions b.e'presented in Court from time to
time as occasion may demand for the protection of the City of
Des Plaines and the officers thereof, all of which can not now
be determined.
BE IT, T ERZFOi E, RESOLVED that David B. Maloney, be and
he is hereby instructed to contest the said proceeding and to
take all necessary action to protect the City of Des Plaines
and the officers thereof.
BE IT FURTHER RESOLVED that the Mayor of the City of •
Des Plaines be and he is hereby authorized and directed to sign
any and all petitions, affidavits or papers, which may be
proper in this proceeding for the purpose of protecting the
interests of the City of Des Plaines and other defendants in
said proceeding, in behalf of the City of Des Plaines and other
defendants, provided that the pleadings be not amended without
the Consent of the City Council.
BX IT FURTHER RESOLED that this Resolution shall be in
full force and effect from and after its passage and approval •
according to law. ._

The motion was made by Alderman =nenbacher and seconded by Lacey to
adopt this resolution. The roll was called on the motion with the

The Clerk then read the following *Imposed ordinance for
first reading:

AN ORDNANCE
WHEREAS, there is now pending; in the Superior Court of
Cook County a proceeding between the Sandwich State Bank and
the City of Des ?laines and certain bondholders regardint the
setting aside of bonds overissued in Des Plaines No. 95: and
WHEREAS, the property owners affected by the said im-
provement have agreet to the levying of a supplemental assess-
ment and the City of Des Plaines has agreed to assume certain
portion of the bonds issued in this proceeding; and
WHEREAS, decree in this matter has been prepared in
accordance with the said agreements..
BE IT, THEREFORE, ORDAINED by the City Council of the
City of Des Plaines, Ccok County, Illinois;
• SECTION is That the .City of Des Plaines does hereby
consent to the entry of a decree.in the case pending in the
Superior Court of Cook County entitled, "The Sandwich State
Bank, et al. V. Gity of Des Plaines, et al. (Bill), City of
Des Plaines, et al.V. The Sandwich State Bank, Et al. (Cross -
bill)." No. 511690, coy of which decree is hereto attached.
\SECTION 2: That David B. Maloney, Attorney for the
City of Des Plaines, be and he is her by authorized and directed
to appear in Court and consent to the entry of the said decree.
SECTION 1: That this ordinance shall be in full force
and effect from and after its passage and approval according to
law.

WHEREAS, an• agreement between the City of Des Plaines
and David B. Maloney was entered into employing David B.
Maloney as Attorney for the period to and including April
30, 1932. to represent the City of Des Plaines and the
Municipal officers thereof; and
Whereas, it is to the best interests of the City. of
Des Plaines that said David B. Maloney be employed for the
ensuing year to represent the City of Des Plaines and the
present officers of the City.
BE IT, TITE+REFCL , RESOLVED that David E. Maloney be
and he is hereby employed as 'Attorney for the City of Des
Plaines and the present officers thereof for the year ending
April 30, 1933, subject to the same terms and conditions as
under the contract for the year ending April 30, 1932.
BE.IT FURTER RESOLVED that• the laid contract between -
the City of Des Plaines and David _B. Maloney• for• the year •
ending April 30, 1932 be extended to and including April 30,
1933.
BE IT FURTER RESOLVED that this .desolution shall be
in full force and effect from and after its passage and
approval accordina to law.

The motion was made by Alderman Ahbe and seconded by Dean to adopt
this resolution. Alderman Huxmann objected to the adoption of this
resolution, stating that in his opinion the City Code orders iie Mayor
to appoint a City Attorney, and inasmuch as this resolution employs
an attorney for the City, and not a City Attorney, it is not in accord
ance with the City Code. The roll was called on the motion with the
following result: Ayes; Aldermen A -be, Collet, Dean, Lacey, andnzen-
bacher. Nays; Pflughaupt, Huxmann, Kinder, Friott and i�einslausen.
There being a tie, Mayor Iamrnerl cast his vote as "aye", and declared
the notion carried and the resolution adopted.
Alderman Lacey stated that a very attractive price has been
obtained for the ten stop signs pr.opsoed for Prairie Ave., west of the
Soo Line Railroad tracks, and urged immediate installation of these
stop signs. The motion was made by Alderman Huxmann and seconded by
Pflughaupt to refer this matter to the Streets and Sidewalks Committee
With instructions to make a general survey and submit a recommendation
to the Council stating at what intersection stop litghts are. necessary.
The roll was called on the motion with the following result: Ayes;
Aldermen Ahbe, Collet, Dean, Pflughaupt, Huxmann, Kinder, Lacey,
Friott, Enzenbacher and Tieinshausen. Nays; None. The Mayor thereupon
declared the motion carried.
Alderman H. mann stated that there is no provision in the
City Code protecting local draymen against non-resident drayment who
come into the City for a day or two at a time. The motion was there-
fore made by Alderman Huxmann and seconded by Enzenbacher to instruct
the Police and.License Committee to investigate the matter of amending tk
the Code so as to enable the City to license these foreign draymen for
periods less than a year, as none provided by the Code. The roll was
called on the motion with the following result: Ayes; Aldermen Mite,
Collet, Dean, Pflughaupt, Huxmann, Kinder, Lacey, Friott, Enznebacher
and Lieinshausen. Nays. none. The Mayor thereupon declared the motion
carried.
The motion was made by Alderman Enzenbacher and seconded by .
Collet to instruct the City Clerk to write Gus. J. Spier that unless
the shapk and loose lumber is removed from his property near the
corner of M,anheim Road and Everett Street, within two weeks, the City -
will remove it. The motion was voted upon by Acclamation whereupon
the Mayor declared the motion carried.

Lacey to approve the minutes of the regular Council Meeting of April
18th, 4.932,.a7, well as of the adjourned Council Meeting of April 25,
1932 as written. The motion was voted upon by acclamation, whereupon
the L yor declared the motion carried, and the minutes approved.
The notion was then made by Alderman Lacey and seconded by
Ahbe'that the Council adjourn. The motion was voted upon by accla-
mation whereupon the Mayor declared the motion carried and Council
adjourned.
