The meeting was called to order by Mayor Hammerl with
Aldermen Ahbe, Collet, Suster, Pflughaupt, Huxmann,,K}rider, Lacey and
Meinshausen responding to the roll call. Aldermen Wttin and Enzen-
backer arrived shortly after this roll call.
The Clerk then read the report of Waiter Tailant City Collector
covering moneys recieved by him up to April 16, 1932.
The'Clerk also read the following report of Otto Rexses,

Gentlemen:
For the past several years, I have been trying to
get a settlement for a claim arising out of an automobile acci-
dent in this city on the corner of Ellinwood & Pearson Strts.
This claim dates back to March 25-1926. The accident occurred about
5 days before on a Saj. Evening, the time of the Ellinwood St.
widening.
Several letters reoorted being received from my attorney
at that tine were.read but were always referred to the Streets &
Finance Committee by

About a year and a half ago I talked with Alderman
Heesch and gave him another statement covering the said claim. He
said he would look into the matter and that's the last I heard
of him. In April of last year (1931) I wrote a letter to Mayor
Hammerl telling him about the case, but he probably forgot it as
I have heard nothing.
The qlerk ,has in his possessisln a few dated notations,
which I have copied from the minutes of those certain meetings,
and they tell just what happened to the letters muattorney wrote.
I am not working and can not afford a lawyer therefore
I ask you gentlemen to see what you can .do for me,

In Re: Ellinwood Street
No. 52693..
Gentlemen:
This improvement is for the widenting and paving of Ellin -
wood Street from River Road to Lee Street. As near as I
can determine from the files and ordinance in this case,
the original improvement contemplated sidewalk., widening
and paving. There seems to be a considerable difference
of opinion between the contractor and the former City
officials as to what was the extent of this improvement.
A contract was let to Moore of Evanston. Before the issu-
ance of bonds, lein notices were served and a bill was filed
for the foreclosing of these liens. The mater it still
pending before Master in Chancery, but in accord had been
substantially arrived at by all of the various claimants
so that the matter can be disposed of in the near future.
There is still, however, a great difference between the
City of Des Plaines and the contractor, The final estimate
of Engineer Allen for this. work was something over $25,000.00,
the contractor is claiming more than $36,000.00--a difference
of approximately $11,000.00. The City has desposited with
the Clerk of the Circuit Court a voucher for $9,617.00 pay-
able out of all installments ixl this improvement. As nearly
as I can determine from a preliminary examination of this
improvement, it would seem that the improvement is already
short. In order to permit a disposition of this matter
between the lien claimants it will be necessary to take
up 'the voucher in this case and to issue bonds. No interest
has been paid on the voucher which has been there fore about
five years.
I have gone over the 4.a,ims, of Mr. Moore with both Mr. Moore
and his attorney and Mr. Paul Green, an engineer employed by
Mr. Moore. I have also discussed the matter with Mr.
Allen, former engineer for the City. While many of the

items claimed by Mr. Moore seem to me,to be without
merit, I feel that there are some items which should be
considered by the Council before entering into any
extended litigation on this matter.
I, therefore, recommend that the Council meet as a
Committee of the whole or at a special meeting for the
purpose of discussing this matter with Mr. Moore and
his engineer. I would also suggest that, if possible, Mr.
Allen be requested to attend the meeting; so that the
Council may have before it all of the facts relating to
this controversy. Any action that might be taken would,
of course, only increase the amount of the supplemental
against the property on Ellinwood Street. It might,
therefore, be fair to these property owners that they
be advised as to this meeting.

cerning the material benefits derived by me as, a member of the
Board of Health. Inasmuch as I have never received and salary
and accepted the appointment primarily as a civic duty, these s
statements have been very distasteful to me.
Therefore, I hereby tender my resignation as a member
of the Des Plaines Board of Health to take effect immediately.

The Mayor ordered the letter spread upon the minutes, and stated that
the suggestions contained in the letter would be taken into consider-
ation where the annual committee appointments are made.

April 18th, 1932.
We wish to enter a complaint before your honorable body
against the high water bill for the period from Dec. to Mar. 1932.
The bill in question amounts to •$878.70. Never before have we
had such a high charge. The Mater bill for .the same period
last year arounted, to. $423.41 gross; the year before .p334.06,
in 193, X168.57.
The City water is only used for the boilers and for drinking
purposes. The plants in the greenhouses are watered from the reservoir.
We have tested all .pipes and found them in good condition, no leaks
were discovered.
On April 12th, the meter was read for a 24 hour period by your
inspector as per enclosed merno. From A A. M. to 5 P. M. on Apr.
12th. 597 cu ft were consumed. Prom 5 P. M. to 8 A. Y. 502 cu ft was
used or a total of 1099 cu ft for 24 hrs. Useing this as an average
consumption the total for three months or 91 days will be 91x1099 or
5 times greater than the test shown for the 24 hr. period.
We are convinced that the meter did not register the water
consumption correctly and pray that your honorable body grant us
relief.

the Premier Rose Gardens Meter for a period of two or three weeks and

Whereas, Otto Rexses, City Treasurer of the City of Des Plaines
County of Cook and State of Illinois has pursuant to the terms of

asopted, and now in full force and effect, requested the City
Council of the City of Des P nines, Illinois, to designate the
First National Bank of Des Plaines•, Illinois' as despository in
which the funds and moneys received by him in the collection in
the ordinary course of business, may be deposited; and
Whereas, the First National :Bank, Des Plaines, Illinois, has
furnished copies of the last two sworn statements of resources
and liabilities as furnished to the Comptroller of the'Currency:

his announcement of.the recess.
Engineer Carter Jenkins reported that. the State Highway
Department has proceeded in accordance with his recommendation, to
encase in concrete, about 225 feet of the 30 inch vitrified tile
sewer in Algonquin Road, east of River Road. The encasement was
necessary because of the high fill to be placed. on the sewer. All of
the, work will be done without cost to the City. Huxmann further re-
ported that the state is making provisions to properly ,construct a
. opening thru the west abutment of the highwaybridge for the 42. inch Imilat
brick sewer in Algonquin Road, east of }giver Road so that thexewill
be no breaking of the sewer at the concrete wall. The Engineer -further
reported that the State had agreed to place at its expense sufficient
fill on River Drive to make a proper connection with Algonquin Road
Furthermore, signed easements, have been secured from adjacent pro-
perty owners permitting the ^lope of the fill to encroach on pri-
vate property, to {provide a roadway of 30 feet on said River Drive.
The Engineer stated that it would expedite construction work materially,
were the State and its contractor•permitted to temporarily divert
ail sewage into the tile sewer. This• would require the removal of a
concrete dam in one of the manholes. In view of the numerous favors
extended by the State, the engineer recommended that this permission
be granted, provided the dam is revoved without expense to the City.
The motion was made by Alderman Huxmann and seconded by Kinder to
concurr in the recommendations of Mr. Jenkins. The motion was voted
upon by acclamation, whereupon the Mayor declared the motion carried.
Engineer Jenkins recommended to replace the overhead street light
at the end of River Street, and at the end of Mill Street. The
motion was made by Alderman Huxmann and seconded byMeinshausen to
instruct Yr. Jenkins to see that the light at the end of River Street,
as well as the one at the end of Mill Street be replaced.' The motion
was voted upon by Acclamation whereupon the Mayor declared the motion
carried.

WHEREAS, tha annual City election was held on Tuesday,
the 19th day of April, A. D. 1932, in the City of Des Plaines,
Cook County, Illinois, for the purpose of electing one Alder-
man for each ward of the City oZ Des Plaines; and
WHEREAS, the Judges and Clerks of said election have
made their returns to the Mayor .and City Council within the
time and in the manner as provided by law, which said returns
including the poll books, ballot sheets, and clerk1' and
judges' returns, are now.before.this Council and have been
examined by said Council: and .
WHEREAS, the said returns for the said election show
that John Collet received the highest number of votes cast for
alderman .of the First Ward; that William H. Dean r eceived the
highwst number of voted cast for alderman of the Second ward;
that George Kinder received the bighast number of voted cast
for alderman of the Third Ward; .that Ernest Friott received
the highest. number of votes cast. for alderman of the Fourth
Ward; and that George Enzenbacher received the highest number
of votes cast for alderman of the Fifth Ward.; and
DE IT, THERCFORE, RESOLVED by the City Council of the
City of Des Plaines, Cook County., Illinois, that John Collet
be and he is hereby declared to be the duly elected alderman
of the Fist `Pard of the City of. Des Plaines; that William H.
Dean be and he is hereby declared to be the duly elected Alder-
man•of the Second Ward of the City of Des Plaines; that George
Kinder be and he is hereby declared to be the duly elected
alderman of the Third Ward; that Ernest Friott be and he is
hereby declared to be the duly elected alderman of the Fourth
Ward; and that George Enzenbacher be and. he is hereby declared
to be the duly elected alderman of the Fifth Ward.

that the resolution be a dopted. The roll was called on the motion
with the following result: Ayes; Ahbe, Collet, Suster, Pflughaupt,
Huxmann, Kinder, Lacey, ':Jettin, Enzenbacher and Meinshausen. Nays;
None. The Mayor thereupon declared the motion carried and the resolution
adopted.
Alderman Ahbe then presented the request of Mr. Fogelstrom
to assist him in securing a.state permit to tunnel under Miner Street
in order to make a connection to the Miner Street sewer. The motion
was made by Alderman Ahbe and seconded by Enzenbacher to instruct
City engineer Jenkins and the city Clerk to make proper application
to the State for this permit. The motion was voted upon by accla-
mation, whereupon the Mjayor declared the motion carried.
Alderman Ahbe also presented a request from the merchants
in the neighborhood of Des Plaines, for the services of two police o
officers in connection with a meeting of Merchants to be held at Maine

the City furnish him a correct survey of the property taken from him
in connection with the widening of Miner Street. The motion was made
