THE CITY COUNCIL OF THE CITY OF DES
PLAINES, HELD IN THE COUNCIL CHAMBERS
ON THE list DAY OF MARCH A. D. 1932
AT THE HOUR OF 8:00 P. M.
The meeting was called to order ray mayor Charles
Hammerl with Alderman Anne, Collet, Suster, Pflugnaupt, tiuxmann,
Kinder, Lacey, wettin and Enzennacher anuwering to the roll call.

RDIiVAivCE-MAKING APPROPRIATIONS TO DEFRAY THE EXPENSES OF
THE CITY OF DES PLAINES FOR MUNICIPAL PURPOSES,
DESIGNATED THE '"ANNUAL APPROPRIATION HILL", FOR
THE FISCAL YEAR COMMENCING JANUARY 1, 1932 AND
ENDING DECEMBER 31, 1932.
The motion was made oy Alderman xnue and seconded oy Collet to
adopt tne proposed ordinance as read. Alderman riuxmann urged a
reduction in the appropriation for tne Police Department. The
roll was called on the motion with the following result: Ayes;
Aldermen Anbe, Collet, Suster, yacey, wettin and Enzenbaeher.

upon declared the motion carried, and the proposed ordinance ad-

We nand you herewith a petition
reflecting the sentiment of tne people who own
property and are being assessed for the, paving of
Spruce and other Streets in the south part of Des
Plaines.
A check of the assessment roll
against the petition will reveal that there are
signers on this petition who nave the sum of
$51,789.06 in assessment to pay, out of a total
assessment of 6b5,000. Of the remaining ik210.94
the sum of 401,151.25 is assessed against forfieted
property against which there are tax claims, the
owners of which cannot be located. The remaining
$2053.69 is assessed against property owners who
live out of twon, cannot be located or have not
been asked to sign, Not one single property owner
has boiced any sentiment in favor of tne improvement.

In view of the foregoing and the
petition, we ask tnat you give it serious considera-
tion and take vrnatever steps necessary to protect us
against a needless and unwanted improvement at this
very burdensom time.

City of Les dairies did not tne 13tH day of January 1930.
recommend to tne City Council of tne City of Les Plaines
the passage of ari ordinance contemplating the grading,
draining and paving of certain streets and avenues in tne
City of Les Plaines, and
WHEREAS, THE City Uouncil of the City of Les
Plaines did on the 20th day of vanuary 1930 pass said
ordinance and approve said recommendation under and by
virtue of said ordinance so passed as aforesaid, and
pursuant thereto proceedings were instituted in the
Superior Court of Cook County, known as `City of Des
Plaines vs Peoples Trust and savings hank of Chicago,
Trustee, "C se f512453, in whim matter a judgement
order of the confirmation was entered on may 3, 1.930
assessing tne cost of tne improvement against lands to
be benefited, and
WHEREAS, shortly tnereafter a contract was
entered into with tne noger E. Eilby Company of Evanstoh
for the construction of tne improvement provided for in
the above mentioned proceedings-, and
WHEREAS, the undersigned owners of the property

statements to be ture.
1. work on the construction of said improvement
has not been Commenced.

letting of said work.
3. In more settled times the improvement can
be constructed at less expense.

Maloney containing a copy of resolution tnat ne claims
was passed oy you or your hoard of local improvements.
We are very much surprised at your
action in this matter and tninK tnat aome of the members
of your Honorable hoard cannot be familiar with all of
the facts in connection witn our contasct.
The signing of our contract was veld
up for a long period of time oy us, pending a complete
understanding of tne tax situation in tne district
assessed. Tne original contract presented to us con-
tained a provision tnat tnere be no supplemental
assessments on this improvement. We oojected and finally
signed tnat contract only under tne express conditions
that the no supplemental provision oe stricken out and
that the City institute proceedings to place all tnat
property on a tax paying oasis. Also that it would not be
necessary to build the work until such time as the lots
were placed on a tax paying oasis. xne City started the
proceedings, ordered minutes of foreclosure, and for
some reason abandoned tne idea. we have been repeatedly
advised tnat it vias unnecessary for us to proceed with
the work until tne forfiedtured property was cleared up
oy you, and tnat you would soon carry out your end.
At recent conferences with Mr. Maloney
however, ne nas stated tnat tne City does not want to
proceed with the work, tnat the peopiy assessed are
opposed to it and tnat tne City was no longer interested
in placing these lots on a tax paying oasis. he also tells
us that tne cneapest and oest thing for us to do it to
settle with tne holders of voucners and auandon the work.
he states that ne and Mr. Jenkins will stiL meir voucners
to us for fifty cents on tne dollar and that we will nave
to make peace witn tree alderman of the Fifth Ward, .fir.
Entenbacner. iow our ideas are different. In the first
place we know or no legally issued vouchers outstanding
against that improvement that Were issued on account of
any action of ours.
The City of Des Plaines, by its refusal to carry
out the program of placing all of the property assessed on a tax
paying basis, and by other actions wnich have resulted in a
serious depreciation of its bond values, have made it absolutely
necessary for us to demand tnat tne City immediately proceed to
levy a supplemental assessment for a sum of money that will
produce sufficient reserve farm lots now paying taxes to retire
our bonds.
As an alternate, if it is true that the property
owners assessed no longer desire tnis improvement, we will consedt.
to the aoandonment of tne proceedings upon payment to us of the
amount of costs we have oeen put to.
Your action in passing tnis resolution seemes nurriec
in view of present weather concions and tne fact that we
have been holding repeated conferences with I.r. Maloney and
others on this matter. we believe that if the Council and
Board of Local Improvements were fully informed, they would
hesitate to plunge the City into needless litigation and the
attendant expense. We also believe that an extension of time

on this contract to enable us to confer direct with you will
bring about a sane and nappy conclusion' We oeileve this
situation would warrant tne calling of XX a special meeting
to consider the matter.
All other plans will only result iri expensive
litigation tnat will serve no purpose save to enrich far.

With this report i am including a copy of tne
notice of puoiic nearing; and a Clue-pring on wnieh
1 nave tried to indecate most of the information
wnicn 1 discovered. 1 oelieve that tne statements
and figures are largely self explanatory and will
indicate clearly the status of tree project at its
completion.
A searcn or tne records of tne xoard or Local
improvements reveals tnat the original resolution
was passed on Decemoer 17, 1923 In tne amount of
$67,916.2b.

1924 in tne same amount.
Tne improvement tneu dragged along for a year
or more, curing wnicn time various cnanges and alter-
ations were discussed and included.
On Octooer 19, 1925 olds were opened on the
revised project and rejected.

A petition was presented requesting tnat the

second lowest olaaer, as tne airrereikce vas very small.
On April i2, 1u26 tne State nignway Department re-
quested the amity to award tne contract to the Cnicago
iieignts Uoai Company. lnapite (if tris a motion was
made and carried to award tne work to the Michael Mc-
Illigott Company.
On June 14, 1926 a .letter was received from tne
Mclligott Company asking to oe released from tne con-
tract awarded to it for the remaining work on Miner
Street.
On June 28, 1c=26 icartriazauxxxiumbutzbcfm
bids were again received on this
improvement and tne work awarded to tne Chicago Heights
Coal Company, in tree amount of *21,450.80, this company
being tLe lowest responsible bidder.
Immediately, thereafter, tne Mate awarded their
portion of tne work to tne same firm in the amount,/ of
$12,782.09
On June 14, final estimates on .iectrical work
were issued to tne Michael McEiligott Company in the
Amount of *10,185.27.

Unicago heights Coal Company in tneamount of *26,475.90,
waking a total of *33,660.17 paid to tne contractors
for the City portions
In addttion to tnis, tne State ay Department
also paid tne Chicago neignts Coal Company tne sum of
$1.5,5:50.82 for work performed on its portion. Cement
tne sum of approximately *3251.00 was also rurnisned ray
tne State.
Tne total final cost of tne City portion of tnis
project as taken from tne voucner records appears to oe
$75,0:57.66. `i`ne cost as derived from final estimates
and otner sources oe.ine 075,022.06.
Adding to this tne work paid for oy State
Highway Department, we derive a total of *93,618.4$
or $94,804.58 depending upon which source of information
is considered.
To gigs for this improvement tne net amount of
tne roil was only 076,928.86 leaving a net deficit of
approximately *1'7,000.00 nad not the tate paid tor a
portion of tne work.
It appears tnat a project of much greater scope
was completed in place of tne project proposed in the
arfftinal resolution.

TO THE MAYOR AND CITY COUNCIL
of the City of Des }'1.aines,
COOK County, Illinois.
Gentlemen:
Your Finance Committee, to venom was referred tree communica-
tion of nonoraole alayor x ammerl for tne purpose of reporting
on the question as to wnether any surplus existed in the
levy of taxes made for tne years of 1929, 1960 and 1931, and
wnether there was any saving wnicn would permit any reduction
of taxes.
For the purpose of tnis report, your committee has examined
the levies of assessments for the said years and has obtained
information on the expenditures for the said years and the
amounts unexpended at the close of 1931. because of the
muddled tax situation in•Cootz County, it is impossible for
your Committee to arrive at any exact figures as to what
funds will be available to meet the expenses of the City.
Therefore, your Committee for dais purpose has calulated

The amounts which will be ootaiued on tne,basis of payments
of taxes for tne year of 1929 paid in 1961.
Approximately 75% of-tne taxes for the year 1929 were paid.
Of the remaining 25% your Committee extimates tnat in
excess of 50 of this amount was objected to-- that is,
objections were filed in the County Court. As to portion
of this amount, payments had peen made on account. Your
Committee therefore estimates as to tne property objected
for that collection will eventually be made of this amount
either oecause of the overauling of the oojections or because
of tne levy of tne tax on real and personal property to make
up this amount. Therefore, in tne statement wnich your
Committee submits herewith it has considered approximately
an% 85% collection of taxes for tne year of 1929.
For the years of 1930 and 1951 your Committee nas estimated
that 75% of tne taxes will be collected.
On the basis of tnese estimates, tne calulations made by
your Committee snow that there was left unexpended for the
taxes levied for tne years i929, 1930 and 1931 at the close
of tne ousiness on December 61, 19'61, tne sum of *60,483.62
which was available for use during tne year of 1932, the
statement oeing as follows;

Because of the fact that prior to may 1, 1929 there was
diverted special assessment funds in excess of *22,000.00
and that these funds have not been replaced up to thia
time, and because this contributes to thes erioue cohdi-
tion of the special assessment fund, it is considered best
by your Committee that portion of this unexpended fund 4,
used for tne purpose of making up tnis deficit.
Your Committee also feels that some reduction Can be made
in the taxes for the year 1931 and that the taxes for the

year 1932 can be proportionately reduced. however, con-
sideration of this reduction snoud oe postponed until
tne collection of tne 1930 tax nas progressed sufficiently
to determine wnetner or not enough money will oe collected
for the purpose of continuing operation of tne City
functions. in addition to this consideration, tnere is
a possibility tnat tne Legislature may provide relief for
the municipalities for tne uncollected portion of the
taxes for the yens of 1929, 1930 and 1931 by the issuing
of funding bonds. 1n tne event sucn relief is granted,
your committee is of the opinion tnat oy tne issuance of
these funding bonds for the uncollected portion of the
taxes for tne years of 1929, 1930 and 1931, a substantial
reduction could be made in tne taxes for tne years of 1UO
and 193k of in excess of 25%.
Inasmuch as tne 1931 taxes will not go into collection
no doubt until after the special session of the Legislature
adjourns and tne funding Bills have been disposed of, and
also the taxes for the year 1932 will net oe levied until
September, 1932, tnere is ample time for your Committee to
make further recommendation as to the reduction of tne
1931 and 1932 taxes when the situation is cleared up oy
the action of tne Le0islature and tne percentage of the
payment of 1960 taxes is determined.
in tne meantime, your Uommittee recommends that at least
the sum of *20,000.00 be provided in the year of 1932 for
the repayment of shortages in special assessment funds,
this to be accounted for out of the unexpended balances
in the levies on January 1, 1932.

RESOLUTION
WHEREAS, oy reason of economic conditions far above the
control of tne individual, tnere nas existed for some time
witnin tne City of Des Plaines, want and destitution which
has peen oeyond relief oy funds available to tne relief or-
ganization.
WHEREAS, by reason of such limited funds, the supplying of
adequate fuel for all requests nas peen impossible.
WHEREAS, tne State hignway Department, nad within its power
to provide additional relief tnru tne construction of needed
highways,
WHEREAS, the State hignway Department did award the contract
for the construction of Algonquin Road, State Bond Issue 62,
Section 117, lying largely witnin the -limits of the City of
Jes Plaines,
WHEREAS, by reason of tne award of the contract on said
Algonquin Road tnere was provided a large amount of fuel
in the trees removed for the construction- of the highway,
which fuel was at once used by families desperately needing
same,
WHEREAS, the construction of this n.ignway will add to employ-
ment in this vicinity,
BE IT, THEREFORE, RESOLvhD, that hiss Excellency, Honorable
Louis L. Emmerson, Governor of the State of Illinois be, and
he is hereby officially tendered the grateful thanks of the
City of Des Plaines in having used the powers of his great
office to expedite the award of this needed work.
BE IT.THEREBORE, FURTHER RESOLVED, tnat the Officials of the
State Highway Department be and tney are nereoy informed of
the deep appreciation of the City of Des Plaines for the
splendid assistance given it by nelpiug to relieve.distress-
ful conditions existing here.
And
BE IT FURTHER RESOLVED, -THAT this resolution oe spread upon
the records of the City of Des Plaines and that a copy of
same be sent to His 1.xcellency, the Governor of tne State

RESOLUT ION
WHEREAS, the Board of Commissioners of Cook County, thru
its highway Department, nas reconstructed the roadway on
the public nighway known as River Road, (Des Plaines
Avenue) lying within the City of Des Plaines,
WHEREAS, tne reconstruction of said nignway has required
the removal and replacement of mucn of tne existing pave-
ment, curos, gutters, and extensive cnanges in the water
supply system and in tne sewer system; togetner with tne
erection of a neavy retaining wail for a consideraole

WHEREAS, tne Highway iepartment of Cook County nas never
before moved or replaced utilities oelonging to the munici-
palities or oorne any expense otner tnan that directly per-
taining to tne construction of pavement, eartnwark and cer-
tain concrete structures, whicn policy nas caused large ex-
pense to tne municipalities.
WHEREAS, tne Board of Commissioners nas given ear to tne
plea of the citizens of Des Plaines, and nas so altered its
construction policy tnat tne incidental work required in tne
repontruction of said River Road was preformed and paid for
by the Board of Commissioners.
WHEREAS, tne Board of Commissioners, tnru certain of its
members, nas snown its great interest and regard for fair-
ness toward the City of Des Plaines, by constructing an im-
provement of sucn splendid anaracter and utility without
cost to tne residents along tne highway or to the municipality,
WHEREAS, the County Superintendent, and tne Engineers of
the Rignmay Department connected with this improvement, have
exhibited and unsurpassed degree of assistance and coopera•
tion with the municipal authorities,
BE IT THEREFORE RESOLVED, tnat the Board of Commissioners of
Cook County, be, and it is, hereby officially tendered the
grateful thanks of tne City of Des Plaines, for having, list-
ened to and, granted tne pleas of tne City of Des Plaines
for relief in the expense of tnis improvement.
BE IT THEREFORE FURTHER RESOLVED, that the County Superinten-
dent of Highways and Engineer employed on the project be,
and they are, Hereby informed of the great appreciation of
the City of Des Plaines for their valuable assistance and co-
operation shown the municipal officials.
AND BE IT FURTHER RESOLVED, that the resolution be spread
upon the records of tne City of Des Plaines and that a copy
of same oe sent to tne Board of Commissioners of Gook County
and to Major (ieorge A. quinlar,County Superintendent of
Highways.

Alderman n uxmann and seconded oy Alderman Ahbe to authorize Mr.
