The meeting was called to order by Mayor Charles hammerl,
with Aldermen Anoe, Pflugnaupt, tiunn, Lacey, :mnrenbaoner and
Meinshausen responding to the roll. call. Alderman Collet, Suster,
Kinder and Wettin being absent.
The motion was made by Alderman iiuxrnann and seconded oy

The motion was made by Aderman Huxmann and seconded by Meinshausen
that consideration of this matter oe postponed, and that the
Council meetas a committee of the whole to discuss this matter,
and look into the liability of the sureties of the various Treas-
urers involved in this matter. The motion was voted upon by Accla-
mation, whereupon the Mayor declared the motion carried.

RESOLUTION
WHEREAS, the City of Des Plains had heretofore made
claim against the Aetna Casualty Company on bond executed by
it for Martin Behrens growing out of the default of Fayette
0. Merrill and also the alleged failure to keep books and
records in accordance with the ordinances of the City of Des
Plaines; and
WHEREAS, the City no longer makes calim by readon of
the said Fayette 0, Merrill matter and has made settlement
as to the books and records.
BE IT, THEREFORE, RESOLVED THAT THE Mayor and City
Clerk be and they are hereby authorized and empowered to make
the execute a release of the Aetna Casualty CoYrtpany on the
said bond of Martin Behrens, copy of which is hereto attached.
Be IT FURTHER RESOLVED that this Resolution shall be
in full force and effect from and after its passage and
approval thereof according to law.

claim against the AETNA CASUALTY COMPANY on bond executed oy

The motion was made oy Alderman Enzenoscner ands econded by Ahbe
to adopt the proposed resolution. The roll was tailed on the
motion with the Following results Ayes; Aldermen Aloe, water,
Pflughaupt and 'nzenbacner. hays; Aldermen Huxmann, Lacey, Wettin,
and Mein°shausen. There oeing a tie, mayor Hammerl cast a deciding
vote of *Nay*, and declared tne motion defeated.
The motion was made by Alderman Huxmann and seconded by
Wettin, that the Council instruct Attorney Maloney to' draft and
present to the Council a resolution setting up as a fact, that M. A.
Behrens has accounted for all moneys he received, as City Treasurer
of the City of Des Plaines. ihe.motion was voted upon by accla-
mation whereupon the Mayor declared the motion carried.

Gentlemen:
January 22, 1932.
In accordance with the instructions- of the city Council,
I appeared in Court on Monday, January 18th, and con
rented to a judgment oeing entered against the City of
Des Plaines in favor of 'rantc.Zaleski for the sum of
$750.00.
Concurrently with the execution of the judgment, 1 ob-
tained froom Zaleski & Zaleski a joint and several
release of all claims excepting this judgment. The
release is hereto attached and should be filed with
the City Cleric.

We nave again approacned tne time wnen it oecomes nee*
essary to prepare tne annual appropriation ordinance-providiAg for
funds for tne pperation of tne City during tne present fiscal
year. By reason of tne fact tne taxes for the years of 1960
and 1931 nave not peen collected, an unusual condition nas
arisen wnicn requires special consideration oy this Council.
During approximately two and one-haif years of my administration
in the City of Des Plaines, we nave been faced witn tne most
trying conditions. hot only was tails orougnt anout oy tne
fact tnat at tne time of my taking office tnere were no cor-
porate funds on nand and tne large sums nad oeen diverted from
the special assessment funds and a suostantiai overdraft exited
in tne special funds of tne City.
On May 1, 1931, tne finances of the City snowed an over-
draft of, all funds, *34,265.SO. in addition to tnis over-
draft of *54,2a3.?0, tnere were outstanding current odic
owing of 407,955.72. The taxes for the year of i928 had not
as yet oeen coliected. The City, however, had coliected,during
the early part of the year 1929 4;80-8I.O0 in venicle licenses
out of the total receipt for tne year of 1929 of 4,1111228.b0.
Tnere was collected in ousiness licenses #0,1,4b7.O0 and misceiianeous
items of *1,430.00 also otner items.
A suostantial portion of tne taxes for the year of 1928
still remains uppaid. We nave, nowever, paid all of tne
anticipation warrants issued against tnose taxes. A number
of anticipation warrants nave oeen issued against tne taxes
for tne year of 1930. Tne tax anticipation warrants issued,
nowever, snouid not equal tne amount of taxes wnicn might
reasonaoly be expected to be paid. Yew tax anticipation
warrants nave been issued against tne 1931 Taxes.
It has only oeen through the most careful and economical
management that we have oeen able to furnish the City with
the service wnich has been rendered. At tne same time, we
have, by the services rendered all times, given the taxpayers
the protection and service to wnicn taxpayers are entitled.
i am advised tnat tne legislature will probaoly provide -
eitner for tne collection or tne funding of tne past due taxes.
in the event sucn an arrangement can be worked out, tne City -
can provide for tne liquidation of its tax anticipation
warrants and any outstanding ooligations.
in view of tne conditions of tne titles, I believe it
best that the Citisens of the City be given the benefit of
the saving made during tne past two years. 1, tnerefore,
request the zinance Committee to prepare as soon as possiole
a statement of tne anticipated revenues tne City is to receive
oy taxes levied for the years of 1930 and 1961, and also any
ooligations wnicn the City may nave for tae said period, also
to report to tnis Council any surplus over and abate tne amount
necessary, so tnat tne Council may eitner take tnis into con-
sideration in tne reduction of tne 1962 taxes or tnat a re-
duction may be made for tne year 1930, or 1931 taxes.

Cnapter 8i, Section 5, of the Library Laws of tne
State of Illinois, in force July 1, 1Y31, contains the follow-
ing with reference to tne powers of the directors of a city.

of work increased and the salaries not, is entitled to an
increase rather than a reduction in compensation.

due the first of tne year, pernaps you can somewhat `imag ine
wnat a great source of comfort and nelp it was to us to nave
our regular check coming in. it surely made his burden of
suffering much easier to pear and he never failed to speak of
how wonderful all tne noys were oeing to nim.
It is a orient spot in my nreat sorrow and days of

in doing so much for us.

cittn which to pay to such persons the various amounts due
them.
NOW, THEREFORE
BE IT AND IT IS HEREBY RESOLVED:
That the City Clerk of the City of Des Plaines
is hereoy autriorized to issue any City License
which may oe applied for by such persons to 'Shom
