12/21/1931472 MINUTES OF THE REGULAR MEETING OF THIS CITY COUNCIL OF DES PALINES-, HuLD IN THE COUNCIL CHAMBERS, ON .THE 21st, DAY OF DECEMBER 1931 AT 8 O'CLOCK P. M. The meeting was called to order by Mayor Charles Hammerl, with Aldermen Ahbe, Collet, Pflughaupt, Huxmann, Kinder, Lacey, Wettin, Enzenbacher and Meinshausen. responding to the roll call. Alderman Suster was absent. The Clerk. then read two reports of, waiter Tailant, City Collector, the f irst showing receipts of the City Collector's Office to December 8, 1931 as $7,88.35; second giving his receipts up to December 21, 1931 as $9,156.72. The reports were referred to the Finance Committee by the Mayor. The Clerk then read the following letter, explaining that the letter supplies the information requested from the American Legion regarding free peddler's licenses fro exservice men: - Feb. 25, 1931. Mr. Vincent T. Connor, Attorney at Law, 305 State Bank Building Des Plaines, Illinois. Dear Sir: I have your letter of February 18th, asking what licenses ex -service men are exempt from paying. In answer thereto, permit me to direct your attention to paragraphs 673 and 674 of chapter 24, •Smith-Hurd's Revised Statutes, 1929, page 489. These paragraphs answer the question you ask. The motion was voted upon by Acclamation, whereupon the Mayor declared the motion carried. The Clerk then read a letter received from the Consistory of the First Christian Refromed Church of Des Plaines, Rev. R. H. Hooker, Pastor thanking the Council for the free building permit granted the church for its new building, which is now completed. Thisletter was ordered placed on file by the Mayor. The Mayor then called upon the chairmen of the various standing Committees for reports: The Judiciary & Assessment Committee had no report t offer. The Police & License Committee had no report to offer. The Streets & Sidewalks Committee had no report to offer. Alderman Metnshausen of the Building and Plats Committee reported that in his opinion the boiler in the City Hall isusing entirely too much coal, he stated that everything possible is being done to reduce the coal consumption. The Sewer, Drainage and Sanitation Committee had no report to offer. The Water Committee had no report td offer. The Fire Committee had no report to offer. a 473 The Clerk then read the following letter: Mayor and City Council of the City of Des Plaines, Book County, Illinois. In Re: Books of the City Treasurer. December 17, 1931. Gentlemen: After taking office as City treasurer, you caused to be made an audit of the books and records of the City and installed a system of accounts for the pur- pose Qf providing a more accurate and complete system of municipal accounts. Owing to the condition of the finances of this City and the many different questions which present them- selves to the treasurer particularly at this time, I believe it would serve the best interests of the City if a periodical examinationvas made of the books of the Treasurer by an accountant. I am satis- fied that this would not only aid in the more accur- ate keeping of the books, but would also lessen the auditing expense at the end of the year. I`would, therefore, request your Honorable boder to consider the question of employing an auditor period- ically for the purpose of examining the books of the City Treasurer or such other officers as may be hand- ling money to see that the a cco3tnts are maintained in goad. aafciitlQ.,. Gentlemen: Dec. 19, 1931. I submit two letters pertaining to interest due on $46,000.00 issue of Corporate Bonds, self explanatory. Please advise. Awaiting your pleasure, I am, Respectfully yours, OTTO REXSES OR:GR City Treasurer Attorney Maloney suggested selling anticipation warrants to the Special Assessment Expense Fund, which he stated is in fair condition, and thus enable the City to pay the interest on $46,000.00 corporate Bond issue mentioned in the above letter. The motion was made by Alderman Kinder and seconded by Pflughaupt authorizing the Mayor and City Clerk to sell to the Special assessment Expense Fund, sufficient anticipation warrants to pay the interest coupons due January 1, 1J32 on the $46,000.00 of corporate Bonds of the City; and that Otto Rexses, City Treasurer be instructed and directed to purchase these anticipation warz'ants for the Special Assessment Expense fund; The roll was called on the motion with the following result:- Ayes; Aldermen Ahbe, 474 Collet, Pflughaupt, Huxmann, Kinder, Lacey, Wettin, and Meinshausen. Nays; None. The Mayor thereupon declared the motion carried, Alderman Enzenbacher left shortly before this roll call: Alderman huxman then read the, following resolution RESOLUT I Off? Whereas, An emergency exists in the financial affairs of the City of Des. Plaines, in that the said city is not able to meet its current obligations for general corporate purposes as w611 as special purposes, out of current revenues received during the year 1931, and WHEREAS, such emergency created by such deficiency in receipts will be further aggravated by increasing deficien- cies in receipts during the year 1932. and WHEREAS, As a method by which partially to meet the situation, so arising, the City Council has -heretofore, by an order in effect since the month cf September 1931, reduced the salaries of all City Employees, in a suns equal to 10% of the amount which was being paid to them at the time of such order, and 'HERLkS, Such order of reduction as to salaries of Municipal Employees did not, and has not been, applied to the salaries of officers of the City of Des Plaines, whose compen- sation is fixed by law, by action of the City Council, or by contract, and WHEREAS, the City Council has no lawful authority to order the reduction of the salaries or compensation of such City Officers during the respective terns of their office and therefore can only as to such officers of said City exercide its voice as to such salary and compensation by way of suggest- ion and request, and WHEREAS, The City Council of the City of Des Plaines deems it not only necessary but a matter of emergency that such City officers of said City consent to a similar reduction in their salaries and compensation as has been heretofore made as to employees of said City, and WHEREAS, SUCH similar reduction in salaries and compen- sation of said City Officers should be consented to by them in fairness to the other City Employees whose salaries have hereto% fore been reduced;�yy^ NOW, THEREFORE, BE IT AND IT IS HEREBY RESCLVED: By the City Council of the City of 1)es Plaines That all City Officers whose compensation is fixed in a definite sum or those whose compensation is fixed upon a fee or percentage basis, be and are hereby requested tit consent to a reduction of such salaries and corn- ' pensation in a sum equal to 105 of the amount thereof, such reduction to take effect as of January 1, 1932, and to be applied to all salaries and compensation paid after that date. The Mayor there- upcndeclared the motion carried. The Clerk then read the following letter: Mr. David B. Maloney, .4600- One North LaSalle, Chicago, Illinois. Dec. 15, 1931. Dear Sir: It has been some tie since I heard from you regarding my claim against the. City of Des Plaines for attorney's fees incurred in the opening of Ellinwood Street. Will you kindly let me know what progress has been made.? . Yours very truly, PP7:P Frank r. Zaleski Mayor Hammerl thereupon referred the matter to a special committee consisting of Alderman Huxmann, Pflughaupt, Ahbe and City Attorney Maleney with instructions to attempt to arrive at a settlement with Mr. Zaleski. City Attorney Maloney then raised the matter of settlement of the case. Mr. Frank Zaleski attorney for Mr. Quilici and City Attorney Maloney aggaged in a short debate. The motion was made by Alderman Huxmann and seconded by Meinshausen to refer the matter of settlement of this case to the special committee consis- ting of Alderman Huxmann, Pflughaupt, Ahbe and Attorney Maloney. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. The committee and Lr. Zaleski agreed to meet at Mr. Maloney's Office on Tuesday December 29, 1931 at 12o'clock noon. Alderman Huxmann then called the Councils attention to the fact tIat the City's two fire trucks carry liability insurance. He stated that the City is not liable for damage one by fire trucksand therefore needs no insurance and can save the premium of about 5640.00 for these two trucks. The motion was made by Alderman Huxmann and seconded by Pflughaupt to order the insurance companyto cancel the policies covering liability and property damage for the Cityfs two fire trucks, and order the insurance company further, to return the preimiums to the City. The roll was called on the motion with the following result: Ayes; Aldermen Ahbe, Collet, Pflughaupt, Huxmann, Kinder, Lacey,.,Jettin and Meinshausen. Nays; none. .The Mayor thereup- on declared the motion'carried. Alderman Collet stated that State stop signs had been removed from Miner Street at the Miner St. Lee St. intersection, and had been placed on Lee Street instead. He said this change would be dangerous. Alderman Ahbe called the t;ouncil's attention to dangerous condition existing at the Junction of Busse Highway and Miner Street. The motion was made by. Alderman Ahbe and seconded by Lacey to instruct the City Clerk towrite the State Highway department asking t=ia4 fence OV sign be provided to keep automobiles from running off the road at Busse Highway and Miner St, and that a fence provided at the foot of ellinwood Street, between the Des Plaines Ave. 476 retainer wall and the Northwestern Railroad track; and that City Engineer Jenkins be adked to exert his influence to have the State Highway Department provide this protection. The motion was voted. upon by acclamation,.whereupon the Mayor declared the -motion carried. The Clerk theca read the following. iSOLUTION BE IT RESOLVED by the,Mayor and City Council of the City of ] es Plaines, .Cock County, Illinois, that the .Mayor and City Clerk be and they.are hereby authorized and directed to execute a release, copy of which is hereto attached. BE IT FURTHER RESOLVED THAT this resolution shall be in full force and effect from and after its passage and approval according to law. PASSED this day of , A. Alderman Lacey and seconded by Collet to refer the resolution to the Finance Committee to report at the next regular Council Meeting. ORDER It is hereby ordained by the City Coucnil of the City of Des,Plaines, that the Chairman of all standing committees of the said City Council prepare and file with the City Clerk, on or before the next regular meeting of the City Council to be held on the 18th of January, 1932, a report as to the cost of operation of the respective municipal functions under the jurisdiction of the several committees, and submit definite suggestions as to ways and means to accomplish substantial reductions in the cost of the operation of the various municipal funcitons under the direction and control of said committees. The motion was made by alderman Huxmann and seconded by Pflughaujzt to adopt this resolution. The Mayor thereupon declared the motion carried. Alderman Kinder reported that Mr. Wm. Cater has inquired, why his water bills had not been paid for the past several months. Mayor Hammerl suggested that Mr. Cater be given anticipation Warrants for his past due bills. Alderman Lacey Chairman of the. Water Committee stated that the Water Committee would look into the matter and would submit for the Council's approval at its next meeting at least one month's bill for Mr. Cater. Upon the request of Alderman Pflughautpt.%to set a definite date for the meeting of the special committee tek affortion the City's work,_ -Mayor Hammerl anounced that the committee would meet on 'Jedensday, December 23, 1931 at 8:00 P. M.
