MINUTES OP nOVREGULAR MEETING OF
THE CITY COUNCIL OF THE CITY OF DEs
PLAINES, HELD IN THE COUNCIL CgAlWaS -
ON MONDAY, NOVEMBER 2nd, A.D. l931
at 8:00 P. M.
The meeting was called to order by Mayor Charles
Hammerl with Aldermen Aylte, Collet, Pflughaupt, Kinder, Lacey,
Wettin, Ensenbacher and Meinshausen responding to roll call.
Aldermen Suster and Huxmann were absent.
The reports of Chief of Police C. A. Wegner, City
Clerk E. Z. Ftiedrieh, and City treasurer Otto itexaes were read
by the Clerk and referred to the Finance Co.mmittee by the Mayor.
The Judiciary and Assessment Committee had no report to
offer.
The Police and License Committee had no report to offer.
Alderman Collet Chairman of the Streets & Sidewalks
Committee reported that men are still at work repairing City
Streets.
Alderman Meinshausen chairman of the IittldiagaaAil Mat*
Committeereported that several tiers of document drawera were
necessary in order to properly file the numerous bonda on file
in the vault. The Mayor instructed Alderman Meinshausen to go
ahead and see what ia needed..
Alderman Wettin chairman of the aewer Drainage and
Sanitation_Committee reported that the two garbage drivera
have been re-routed. He explained that previously there was
considerable overlapping of territories and that the new routing
assigns a specific, territory to each driver, and makes him
entirely responsible for the service in hia territory.
At this point Alderman Suster came into the meeting.
Alderman Lacey Chairman of the Water Committee reported
that there is an old water bill against the Mmmanuel Lutheran School,
whiah dates back about a year, for water used while the Lutheran
School accupied the old high school building on Thacker St. He
stated that the bill is over $200.00 and seems unreasonable, and
should be adjusted. The motion was then made by AldermanLacey
and seconded by Meinshausen to accept the Lutheran School's offer
to settle the bill for #50.00. The motion was made by Alderman
Kinder and seconded by Ahbe to refer the bill to the water Com-
mittee for further investigation. Th motion -was however sup-
erseded by a motion by Alderman Kinder and seconded by Pflughaupt
to table the matter. The roll was called on the motion to table
with the following result: Ayes; Aldermen Ahbe, Collet, Suster,
Pflughaupt, Kinder, Lacey, Wettin and Meinshausen Nayes: Alta=
asme. The Mayor thereupon declared the motion carried. Alder-
man Enzenbaoher was temporarily absent during this roll call.
The Clerk then made second reading of the following
proposed ordinance:
AN ORDINANCE
AMENDING ARTICLE II/ OF CHAPTER 23 OF
THE MUNICIPAL CODE OF DES PLAINES OF
1928 BY AMENDING SECTION 1067 AND
AIMING SECTION 1067A.
The motion was made by Alderman Lacey and seconded by Wettin that
the above proposed ordinance adopted. The roll was called on the
motion with the following result; Ayes; Alderman Ahbe, Collet,
Suster, Pflughaupt, Kinder, Lacey, Wettin, and Meinshausen. Nays;

Alderman Kinder, The Mayor thereupon declared the motion carried
Alderman Enzenbacher was temporarily absent during this roll call.
• The Clerk then read the following proposed ordinance.
AN ORDINANCE;
PROVIDING FOR THE CONSTRUCTION OF A
SYSTEM OF PORTLAND CEMENT CONCRETE
SIDEWALKS ON DES PLAINES AVENUE IN
THE CITY OF DES PLAINES, COOK COUNTY,
ILLINOIS.
The motion was made by Alderman Collet and seconded by Lacey
that this.propsoed ordinance be passed. The roll was called
on the motion w ith following result: Ayes; Aldermen Ahbe,
Collet, Lacey and Enzenbacher Nays; Suster Pflughaupt, Minder,
Wettin and Meinshausen. The Mayor thereupon dedlared the motion
defeated and the ordinance not adopted.
The Clerk then read second reading of the following
proposed ordinance: •

PROVIDING FOR THE CONSTRUCTION OF A
SYSTEM OF PORTLAND CEMENT CONCRETE
SIDEWALKS .ON ELLINW00D STREET, IN THE
CITY OF DES PLAINES, COOK COUNTY,
ILLINOIS.

The motion was made by Alderman Collet and seconded by Lacey
to pass the above proposed ordinance. The roll was called on
the motion with the followingresult: Ayes: Alderman Ahbe, Callet,
Buster, Pflugahupt, Kinder, cey, Wettin, Enzenbacher and
Meinshausen. Nays; none. The Mayor thereupon declared the motion
carried and the ordinance adopted..
The Clerk then read the following petition:
To the Hornorable Mayor and the Aldermen of Fes Plaines

Gentlemen
Up to this date, we, the property owners on the
south side of Oakton Blvd. have not received any reimbursement
on Special assessment #101.
Will the city council please investigate and see
what can be done about the promised rebate on said #10I and
oblige
Edward Gerig, Charles Iuckholdt, Louis Moser,
John Blume. Maria lox. Edward C. Ladendorf.
The motion w as made by Alderman Ahbe and seconded by Alderman
• Pflughaupt to refer this matter to the City Attorney Maloney for
investigation and report. The motion was voted upon by acele-
, maion, whereupon the Mayor declared the motion carried.
The Clerk then read the following petition: -
THE HONORABLE MAYOR AND CITY COUNCIL
OF THE CITY OF DES PLAINES, ILLINOIS.
Gentlemen:
We,. the undersigned citizens and property owners of the
City of ,Des Plaines, County of Cook and State of Illinois,
this 26 day of October 1931, petition your honorable body
with reference to special assessment No. eighty-eight (8S) on
which there appears to be a shortage of some fourteen
thousand dollars ($14,D00.00) and which is now under con-
sideration for a supplimental a..ssessment. We are opposed
to any further supplemental assessment at this time when home
owners are all ready overloaded with taxes, special assess-
ments and other supplimentals, Car beyond their ability to pay.

We are certain that you are cognizent enough with the
distressing situation which prevails as to real-estate and
the revenues derived therefsmm at the present time.
We appeal to your sense of fairness to the property
owners and ask that you defer all action on the above
mentioned supplimental assessment until general conditions
becpme more stabelized.
Signed by 63 property owners.
The motion was made by Alderman Ahbe and seconded by Lacey to
refer this peation to the Judiciary and assessment Committee for
investigation and report. The motion was voted upon by acclamation
whereupon the Mayor declared the motion carried.
The Clerk then read the following letter:,

On September 26, 1931, we wrote you asking the
city of Des Plaines to commence proceedings immediately
for a supplemental special assessment to pay the amount of the
deficiency of $44,739.61 in the above entitled case. We
have not heard from you.

Inasmuch as the bonds are in default and the amount
of the deficiency has been, definitely determined, At is the
clear duty of the city to start the proceedings for a supplemental
special assessment.. This matter has been delayed long
enough and we must insist on prompt action on the part of
the City. Otherwise it will be necessary for us to start mcg_
mandamus proceedings to make the city perform its clear duty.
We must insist that the city take action in this matter at
its next council meeting.

There was considerable discussion as to whether to spread a
supplemental assessment at this time or not. The motion was
made by Alderman Lacey and seconded by Ahbe to pospone
further consideration of this matter until the next regular
meeting of the Council. The motion was voted upon by accla-
mation, whereupon the Mayor declared the motion carried. The
mayor then instructed the Clerk to notify Tolman, Chandler &
Dickinson of the Councilproceedtre in this matter.
The Clerk then read a resolution pertaining to the
nateral gas question, and billing on the term basis. The
Millen was made by Alderman 4nzenbacher and seconded by Lacey
to adopt the resolution mith,the exception of the last para-
graph. The roll was called 9n the resolution, with the following
result: Ayes, Aldermen Ahbe,,Collet, Suster, Pflughaupt, Kinder,
Lacey, Wettin, Enzcnbacher and Mienshausen. Nays: None, The
Mayor thereupon deOlared the motion carried. The resolution as
adopted is as follows;

WHEREAS, application has teen made by the Public Service
Company of Northern Illinois to the Illinois Commerce Com-
mission:

First- for permission to change customer's billing from
the cubic foot to the therm basis and to change the heating
value of the gas, and
Second- to change rates upon the introduction of natural
gas in the City of , Illinois, and
WHEREAS, a hearing .is now being held before the Illinois
Commerce Commission; viz., Docket No. 21170 (People's Gas, Light
& Coke Co.), which will .develop valuable information pertin-
ent to the said case of the Public Service Company of North-
ern Illinois and the City of , Illinois and
WHEREAS, by reason .of the size of the City of
Illinois, it is impossible for the City authorities of the said
city to plead a case at length before the Commission, now
THEREFORE BE IT RESDLVED, that the Council of the City of
, Illinois, respectfully request that. the
Illinois Commerce Comndssion:
First- Allow the change in heating value of the gas
delivered to the customers in said city, and
Second- do not allow the. change in billing said customers
from the cubic foot to the them basis.
BE IT FURTHER RESOLVED, that the City of •
Illinois respectfully protest against the schedule of rates
as filed by the Public Service Company of Northern Illinois
as being excessive and discriminatory.
BE IT FURTHER RESOLVED, that the City Council of the City
of , Illinois, respectfully request that hearing in
Docket No. 21227 (Public Service Company of Northern Illinois)
be deferred until such time as 21170 has been decided, and further
that pending such decision the Illinois Commerce Commission
investigate any inequalities in gas rates in the territory.

At this point Alderman Kinder stated that Alderman Huxmann
was unable to attend, this meeting because his father had been
injured in an accident, and that be therefore begs to be excused.
Alderman Enzenbacher chairman of the Finance Committee, reported
that the committee is not yet ready to report on the Auditing
bill for auditing the books of M. A. Behrens former City Tre
urer, referred to the committee in a previous meeting.

None. The Mayor thereupond eclared the motion carried and the
resolution adopted.
The motion was made by Alderman Laeey and sedonded by
Suster that the minutes of the regualr Council Meeting of October
19th, and the adjourned Council meeting of October 26, 1931, be
approved as written. The motion was voted upon by acclamation,
whereupon the Mayor declared the motion carried.
