The meeting was called to order by Mayor iiammerl, with Aldermen Collet, Suster, Pflughaupt, Huxmann, hinder, Lacey, Vetting Enzenbacher and Meiushau,seu- responding to the roll cell. The .Tudiciary and Assessment Committee had no report to offer. The Police & License Committee had no report to Offer. The Buildings and Plate Committee had no repott to offer. The Sewer, Drainage and Sanitation Committee had no report to offer. ordinance. The eater Committee had no report to offer. The Fire Committee had no report ao offer. The Clerk made first reading of the following proposed AN ORDINANCE AMENDING ARTICLE III OF CHAPTER 23 O7 THE MEIN I C IPAL CODE OF DES PLAINES OF 1928 BY AMENDING SECTION 1067 AND ADDING SECTION 106/14‘ The Clerk then read the following proposed resolutions RESOLUTION SAS, there is now pending in the Circuit Court of Cook County a wait entitled "A. C'uilici V. City of Des Plaines," and the said case will be reaEhed for trial with. in a short time; BE IT RESOLVED that D*vid B. Maloney be and he is hereby directed to proceed to tr#al in the said case for the City of Des Plaines; that he be, authorized to employ court reporter and witnesses and to incur snail expenses as in his opinion may be necessary to protect the interests of the Citi of Les Plaines. The Clerk Also gave the following proposed ordinance first reading: AN ORDINANCE PORVIDING FOR THE CONSTRUCTION OF A SYSTEM OF PROTLAND CEMENT CONCRETE SIDEWALKS ON ELLINWOOD STREET, IN THE CITY OF DES PLAINES, COOK COUNTY ILLINOIS. The following letter was then read by the Clerk. To the Mayor and City Council of the City of Des Plaines, Illinois. Oct. 16th, 1931. Gentlemen: We hereby certify that we have examined the pro- ceedings in reference to the tax levies of the City of Des Plaines for the year 1930. We find that the tax levies hereinafter mentioned have been properly made under the laws of the State of Illinois. We find that the Tex levies of Said city of the year 1930 for public benefits, for fire protection, for p:ub- iic library purposes, for collecting and disposing of garbage and 'for bond indebtedness and interest thereon total the sum of #30,240.00 and that tax anticipation% warrants may be issued in anticipation of said levies in the aggregate sum of *22,680.00 in the proportion that each of said tax levies bears to the total of said tax levies. Gentlemen: 4 shoat time ago I was requested by the City Council to ascertain whether or not the City of Des Plaines was required to pay t axes on the property upon which the well and pump house are situated. The contract between the City of Des Plaines and William Cater provides that the City of Des Plaines shall pay t axes upon this property. It would, there- fore, appear that the obligation rests upon the City in this case to pay taxes upon this property or to refund to the person who paid the taxes the amount so paid. RESPECTFULLY SUBMITTED, D. B. Maloney, 442 This letter was referred to the Finance Committee by the mayor. The ClerK then read the following letter. Mayor and City Council of the City of Des Plaines, Uook County, Illinois, Gentlemen: Oct.14th, 1931. In Ret Des Plaines ho. 88 South side Slower/ I enclose herewith a letter which 1 received from the First Trust Company of Appleton, Wisconsin, in which deman0 is made for the payment of bonds maturing December 31, 1929 and December 31, 1930, also coupons of $696.00. The owners of these bonds are threatening immediate suit against the City by reason of the fact that the City has in the past paid portion of the bonds in this improvement in full without paying any part of the bonds held by this Company. A short time ago I recieved other communications from holders of other bonds in thee same improvement. i have examined the improvement and find that there is at the present time on hand $1075.00 with an overdraft or deficiency created by ehortage in interest of $4588.58. The information concerning this improvement is as follows* Original roll, *68,405.70 Reductions, 4,829.54 Net roll confirmed, *63,576.16 Bonds and vouchers issued, 63,493.00 Surplus, 83.16 Bonds past duet 1928 - $100.00 - 1929 - *1500.00 1930 - $2000.00 Also portion of the 929 and 1930. The Amount of bonds outstanding is $26,000.00 The amount of assessments receivable is 417,819.24. Interest deficiency already existing, #4586.58 therefore existing at the present time a deficiency to $14,000.00 There is of Close 4th Installment 5th installment 6th Installment4 coupons for the years 1928, The assessments past due are 4th Installment - 5th Installment 6th Installment - It appears in full in amounts; 4th lith 6th as follows: #412.77 726.60 1212.11 that prior to December 31, 1931, bonds has been paid installments numbers 4, 5 and 6 in the following Installment out Installment out Installment out $5500.00 worth of bonds paid of total issue of #5600.00 #4100.00 worth of bonds paid of total issue of $5600.00 $5600.00 worth of bonispaid of total issue of #5600.00 I would recommend that the Council take some action timard pro- viding some means of paying these bondS. The motion was made by Alderman Pflughaupt and seconded by Kinder. to refer the matter to the Judiciary and assessment Com- mittee for investigation and report. The motion was voted upon oy acclamation whereupon the Mayor declared the motion carried. The Clerk read the following letter* October 16th, 1931. Mayor & City Council of the City of Des Plaines, Cook County, Illinois. In Hes Des Plaines too. 60, Pawing Ira Brown's Addition. Gentlemen t In the a Bove matter I have had frequent requests from the holders of bonds as to information concerning the time of payment of their bonds, also treats of liti- gation unless some action is taken. in this proceed- ing, 1 find the following conditions amount of roil as confirmed, 164,926.44 Bonds and vouchers issued, 63,067.25 Surplus, 1,859.19 It further appears that there maturing December 31, 1925 - December 31, 1926 December 31, 1929 - December 31, 1930 - 1 are now past 12500.00 *2600.00 63350.00 14000.00 due oonds There is at the present time cash in some of the install- ments as shown by the recent audit. In the lith install- ment of which bonds of 12000.00 are outstanding, there appears to be 150.5.59 to the credit of tnis instalment; 7th installment, a deficit of $1121.56; '8th installment, on hand 11651.75; 9th installment, $2159.91; 10th in- stallment, $1941.86: There is , however, in this proceeding a deficit or over- draft caused chiefly by deficiency of interest of approxi- mately 19000.00. It further would seem that for some years past, the treasurers nave paid in full some bonds out of these installments and retained the balance of the money to apply on the overdraft caused by the excess pay- ment of interest. It appears twat in the (th installment, in which some of the bonds are unpaid, the assessments confirmed were 15976.18; assessments now unpaid, $891.56; collected 15084.62. J-onds were issued of 15500.00 of which 13500.00 were paid in full, leaving unpaid 12000.00 which are now threatening suit. Approximately tine same condition is true as to the 4th installment. A11 of the installments of this proceeding are now past due. The total bonds outstanding and past due are $15,850.00 and interest coupons. I believe the circumstances of this improvement warrant some action being taken by the City to prevent unnecessary litigation. Very truly yours, D. B. Maloney. The motion was made by alderman mnzenbacher and seconded by Abbe to refer this matter to -the Juciciary and Assessment Committee for 444 investigation and report. The lotion was voted upon Dy Acclamation whereupon the Mayor declared the motioncurried. Alderman Lacey inquired as to the success of tne citizens com- mittee recently appointed by Mayor Liammerl to attend a hearing before the Board of Assessors on tax valuations. The Mayor stated that the valuation placed on residence property in Des Plaines seemed to be fair and correct, but that there is same question as to the val- uations placed on business property. Alderman Buxmann suggested that Township Assessor Wm. Lewerenz he asked to give the assembly his views on the matter, upon which the Mayor announced that Mr. Lewerenz would be given an apportunity to a ddrbss the assembly immediately after adjournment of the council. Alderman %etti* suggested that an overhead light ae placed at the junction of Bussse Highway and Miner. The motion was made by Alderman Wtttin and seconded by Suster to refer the matter of placing street lights at the junction of Busse highway & Miner St., an the Camp Grounds goad, at the intersection of Prairie Ave. & Sixth Ave. to the streets and Sidewalks Committee. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. After considerable discussion as to the advisability of removing the *stop* signs on Miner St. arnd Ellinwood gt. at Pearson St., the motion was made by Alderman Huxmann and seconded by Suster to cover theeStoOsigns for a period of two weeks as an experiment, and have the chief of Police report on the matter. The motionfts made by Alderman Kinder and seconded by Lacey to table this matter. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried and the matter (tabled. Alderman Enzenbacher reported that the roof of the River- view hall needs repairing. The mattes was then made by Alderman Enzenbacher and seconded by Wettin to authorise the buildings & Plats Committee to buy the needed amount of roffing paper and see that the necessary reppairs are made. The roll was called on the motion with the following results Ayes; Aldermen Atibe, Collet, Suster, Pflughaupt, Huxmann, Kinder, Lacey, Wettin, Enzenbacher and Meinshausen. Lays: none. The Mayor thereupon declared the motion carried. City attorney Maloney reported that a $2000.00 check haass been received from the Aetna Casualty Gol and in turn they have been given release for the Bond of Fayette 0. Merrill. he also stated that two checks totalling 025.00 have been received from Mr. Merrill, and that a release for 0625.00 has been for salary due timmailU Mr. Merrill has been signed. Mr. Maloney reported further that Mr. Merrill agrees to pay the City *100.00 per month until paid in full, the first payment to be made on or Oefore April 1, 1932. The motion was made by Alderman Lacey and seconded by Collet to accept the checks totalling ;2528.00 and order t.nem turned over to the City Treasurer. The motionwas voted upon by acclamation whereupon the Mayor declared the motion carried. Carter Jenkins, City Engineer stated that the proposed agreement of the State Highway Department with the City regarding state aid in maintaining state routes through the City has been received in its corrected from. He then proceeded to outline the terms of the agreement. The motion was made by Alderman rflughaupt seconded by Collet toaccept the Mates proposal for local maintain- ance with reimbursement by tne state, and to authorise the Mayor and City Clerk to sign the agreement. Catter Jenkins City Engineer then reported that he and Mayor Hammers had attended a meeting of deligates of a number of Municipalities of Illinois called for tne purpose of °ringing anout united action in the matter of gas rates. Be explained that in 445 order to have the municipalities properly represented, a enarge of about 2 cents per capita would be asked from each municipality. The motion was made by Alderman 1,nzenbacner seconded by wettin that Des Plaines affiliate with these other citjes in the gas fight, and if necessary agree to pay 2: cents per capita to fight tne case.
