MINUTES OF THE REGULAR MF'.F,TINC
OF THE CITY COt7NCIL OF THE CITY
OF DES PLAINES, HELD IN THE COUN-
CHAMBERS, TUESDAY SEPTEMBER 8th,
1931. At 8:00 *lo ck P. M.
The meeting was called to order by Mayor Hammerl, with
Aldermen Ahbe, Collet, Suster, Kinder, Huxmann, Lacey, Wettin, and
Meinshausen answering the roll call. Alderman Pflughaupt and Enzen-
bacher were absent.
The Clerk then read the report of the Chief of Police for
the calendar month of August 1931. The motion was then made by
Alderman Huxmann and seconded by Kinder that the Chief of Police be
ordered to state in his report how each arrest case was disposed of,
as ordered recentlyby the Council. The roll was called on the
motion with the following result:. Ayes; Aldermen Huxmann and Kinder.
Nays; Aldermen Ahbe, Collet, Suster, Lacey, Wettin and Meinshausen.
The Mayor thereupon declared the motion lost.
The Clerk then read the City Clerks report as well as the
City Treasurers,repo rt for the calendar month of August.
The Judiciary and assessment Committee had no report to
offer.
The Police and License Committee had no report to offer.
Alderman Collet, Chairman of the Streets and Sidewalks
Committee, reported that more stop signs are needed for street inter-
sections. He therefpea asked the City Clerk to apply to the Chicago
Motor Club for a dozen stop signs.
The motion was made by Alderman Lacey and seconded by Collet
to instruct City Attorney Maloney to draft an ordinance to enforce
stopping at stop signs. The discussion which followed showed that a
survey of street intersections should really be made before drafting
such an ordinance. The Mayor therefore referred the matter to the
Council as a committee of the whole, and instructed each alderman to
suggest the number and,locations of stop lights needed in his respect-
ive ward.
City Attorney Maloney then reported thatthe'present petit-
ioners for the sidewalk on South Des Ph ines Avenue, do not repre-
sent the majority of the frontage involved. The motion was made by
Alderman Lacey and seconded by Ahbe that City Attorney Maloney be
instructed to start proceedings to lay this walk. The roll was
called on the motion with the following result; Ayes; Alderman Ahbe,
Collet, Suster, Lacey, Wettin, and Meinshausen.- Nays: Alderman Kinder.

The Buildings & Plats Committee had no report to offer.
Alderman Wettin Chairman of the Sewer, Drainage and San-
itation Committee reported, That the ledger of the garbage depart-
ment has been poorly kept, and reported instances in which garbage
has been collected,for a year without charge because the account has
been discontinued, but the driver failed to discontinue service. He
further reported that it will be necessary to install new files to
facilitate the proper handling of garbage accounts. Alderman Wettin
also stated that he had raised the garbage service rate for several
business houses who require more frequent service than the regular
schedule.

Gentlemen:
gots vire committee begs leave to reportthat upon
notice duly published for the receiving of bids for the require-
ments of our fire department for fire hose to the extent of
two hose and have since carefully considered with consulation
with representatives of our fire department the question of place-
ing orders for hose under the bids as received.
Our fine department recommends and their recommendation
to the committee is in writing that this committee recommend the
purchase of fire hose known as Sparton brand. the bid on which
was submitted by the Eureka Fire Hose Company with a price of
4,1.05 a foot in fifty foot lengths. couplings included. The
recommendation of the f ire department is based upon their satis-
factory experience with this brand, of fire, hose which has been in
use in our fire department for s, number of years.
The recommendation of the fire department, however, is
for the purchase of hose at a price twentypfive cents a foot in
excess of the price quoted in two other bids for hose of which
samples were submitted and which it is claimed and guaranteed by
the manufacturers to be equal to the Eureka Sparton brand. The
fire department was unwilling to express an opinion that the two
brands quoted at eighty cents per foot where inferior to the
Eureka Sparton hose but based their preference solely upon their
heretofore satisfactory experience with that brand.
The manufacturers of the two hoses quoted at eighty
cents a foot are both concerns which have been manufacturing hose
over a long period of years and have established themselves
among the leaders in the industry through out the United States.
Your committee is therefore of the opinion that a
fair test should be inaugurated to determine the relative merits
of at least one of the two brands of hose quoted at the eighty
cents a foot price as compared with the brand preferred by the
fire department at the higher cost, and, therefore, your committee
recommends that the City purchase five hundred foot of Eureka
Sparton hose at $1.05 and five hundred feet of Hewitt Gutta Per-
cha Rub. Co. 1st Grade hose at eighty cents a foot so that both
may be placed in service at the same time. and over the period
of their use by a fair test a determination can be made as to the 4.
relative merits.
In connection with the bid of the Eureka Sparton hose
at $1.Q5 a foot, the committee is informed that there will be a
rebate of ten cents per foot paid into the funds of the fire
department on all hose purchased on this brand. The reason of
this manufacturer for making its bid in this manner are perhaps
sufficient to it, but your committee feels that this method of
making bids for public purchases is not good practice and should
be censured.

The motion was then made by Alderman Suster and seconded by Hhxm nn
that the above recommendation of the Fire Committee be accepted and
that the hose be purchased in accordance with the recommendation.
The roll was called on the motion with the following result: Ayes;
Aldermen Ahbe, Collet, Suster, Huxmann, Kinder, Lacey, Wettn, and

Meinshausen. Nays; None.-Tbs. Mayor thereupon declared the motion
carried.
Alderman Lacey chairman of the Water Committee reported
that the doors on the water works have been changed, and that the job
will be completed within about a week.
Alderman Huxmann chairman of the Band Committee reported
that the members of the band are carrying on rehearsals without pay,
in an attempt to keep the bald intact. He praised the members of
the band for their fine spirit, and commended them for their willing
cooperation.
Mayor Hammerl informed the Council that the Public Service
da. of Northern Illinois, is about to pay the City a check'of $1,852.
11 for tranchise rights, and requests that this amount be turned back
to the Public Service Co.k in part payment of lighting bills due form
the City. The motion was made by Alderman Kinder and seconded by
Suster to issue acheck to the Public Service Co. of Morthe.rn Illinois
equal to the franchise check received by the City. The roll was
called on the motion with the following result: Ayes; Aldermen Ahbe,
Collet, Suster, Huxnann, Kinder, Lacey, Wettin and Meinshausen; Nays;
None. The Mayor &hereupon declared the motion carried.
Alderman Wettin requested the City Clerk to again send the
at. Paul, Minneapolis & Saulte Ste. Marie R. R. a copy of the Citys
ordinance prohibiting excessive whistling within the city limits,
and ask them to comply with this ordinance.
The following proposed ordinance was given sedond reading
by the Clerk:
AN ORDINANCE
AMENDING AN ORDINANCE ENTITLED MAN ORDINANCE TO
CLASSIFY, REGULATE A1'ID RESTRICT THE LOCATIONS
OF TRADES AND INDUSTRIES AND THELOCATIONS OF
BUILDINGS DESIGNED FOR SPECIFIED USES: TO REGULATE
AND LIMIT THE INTENSITY OF THE USE OF LOT AREAS
AND TO REGULATE AND DETERMINETHE AREA OF YARDS,
COURTS AND OTHER OPEN SPACES WITHIN AND SURROUNDING
SUCH BUILDINGS, .AND TO ESTABLISH THE BOUND ARIES OF
DISTRICTS FOR THE SAID PURP08E8 AND PRESCRIBING
PENALTIES FOR THE VIOLATION OF ITS PROVISIONS* OF
THE CITY OF DES PLAINES, COOT{ COUNTY, ILLINOIS.
The motion was made by Alderman Huxmann and seconded by Meinshausen
to adopt the above proposed ordinance. The roll was called on the
motion with the following result: Ayes; Alderman Ahbe, Collet, Suster,
Huxmann,.Kinder, Lacey, Wettin and Meinshammen. Nays; None. The Mayor
thereupon declared the motion carried and•the ordinance adopted.
The Clerk then read a letter from Postmaster, Otto W. J.
Henrich; informing the Council that unless the dog owned by the Pur-
ves family, 733 Lee Street, is properly muzzled or tied, it will
be necessary to discontinue mail service at this address.
• The Clerk then read aletter from City Attorney Maloney
giving an opinion on the liability of City Officers in connection
with the shortage of Fayette 0. Merrill, former city Clerk. The
motion was made by Alderman Suster and seconded by Collet to place
this opinion on file. The motion was voted upon by acclamation,
whereupon the Mayor declared the motion carried.
The Clerk then stated that Mr. Christ Moeller has paid taxed
for the ).and upon which the Cater well is located for several years..
He is now seeking to be reimbursed. by the City, as the City is to pay
the taxes, according to the Cater water. contract. The matter was
referred to City Attorney Maloney for action by the Mayor.

The Clerk then read a letter from the Illinois Municipal
Leauge, announcing its convention at Waukegan Oct. 22 and 23rd, and
asking remittance of the City's membership dues totalling $82.00.
The matter was referred to the Finance Committee by the Mayor.
The Clerk then read resignation from the Libary Board of
the following:' Dorothy L. A041en, A. L. Webster,.'Mary B. Talcott,
and. Thos. R. Foulkes. The motion was made by Alderman Ahbe and
seconded by Lacey to accept these resignations. The motion was
voted upon by acclamation„whereupon the Mayor declared the motion
carried and the resignationsaccepted.
The Mayor thereupon appointed the following to the Library
Board: Kenneth Downing term to expire in 1932, Mrs. Ed. Garland
term to expire in 1933, Mrs. Walter Poyer term to expire in 1934,
and Mrs. H. Ture Wilson term to expire in 1934. The motion was made
by Alderman Ahbe and seconded by Lacey to confirm these appointments.
The roll was called on the motion with the following result: Ayes;
Aldermen Ahbe, Collet, Suster, Kinder, Huxmann, Lacey, Wettin and
Meinshausen. Nays; None. The Mayor thereupon declared the motion
carried and the appointments confirmed.
City Attorney Maloney then reported upon the audit of the
treasurers books of M. A. Behrens made by Charles 3. Anderson account-
ants. He reported that Mr. Behrens has accounted for all moneys receiso.
ved, but that there is an overdraft of approximately $94,000.00 in the
interest fund. The motion was made by Alderman Wettin and.' seconded by
Suster tp instruct City Attorney Maloney to give an opinion at the
next regular Council meeting regarding the extent of the liability of
M. A. Behrens former City Treasurer, and to take steps to prevent
reoceurrance of such shortages. Ile roll was called on the motion with
the following result: Ayes; Alderman Collet, Ahbe, Suster, Huxmann,
Kinder, Lacey, Wettin, and Meinsbausen. Nays; None. The Mayor therep
upon declared the motion carried.

The motion was made by Alderman Wettin and seconded by Alderman Collet
to adopt the resolution and pay these bills. The roll was called on
the motionwith the following result: Ayes; Alderman Ahbe, Collet,
Suster, Huxmann, Kinder, Lacey, Wettin and Meinshausen. Nays; None.
The Mayor thereupon declared the motion carried.
Alderman Wettin Chairman of the Sanitation Committee asked
that the Council grant the committee permission to change the fence
at the Incinerator Plant in order to facilitate handling the dump -
at the City 1?. The motionwas made by Alderman Suster and seconded
by Lacey to grant the Sanitation Committee this request. The motion
was voted upon by acclamation, whereupon the Mayor declared the motion
carried.
At this point Otto Rexses, City Treasurer addrgssed the
Council. He stated that inasmuch as about 60 out of the 82 special
assessment accounts are overdrawn be is at a loss to know what to do
when bond holders present bonds for payment where the account is over-
drawn. He asked the Council whether be is justified in pacifying bond
holders by telling them that supplemental assessments will be spread to
reimburse these shortages. City Attorney Maloney advised Mr. Rexses
to, merely inform such bond holders that the matter of taking care of
shortages in special a ssessment accounts is being given due consid-
eratiqn by the Council.
The motion w as made by Alderman Lacey and seconded by
Collet to approve the minutes of the regular meeting of August 17th,
and the adjourned meeting of August 21, 1931 as written. The motion
was voted upon by acclamation, whereupon the Mayor declared the motion
carried, and the minutes approved.,

The Mayor then announced that the Council will meet as
a committee of the whole on Thursday, Sept. 10, at 8:00 o'clock P. M.
and also in an ajourned meeting on Monday September 14, at 8:00
o f clo ck, P. M. in order to draft and pass the annual tax Coy ordin-
ance which must be filed with the County Clerk, on or before Tuesday,
September 15,. 1931.
The motion was made by Alderman Collet and seconded by
Lacey to adjourn. The motion was voted upon by acclamation,
whereupon the Mayor declared the motion carried and the Council ad-
journed.
