MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF DES PLAINES
HELD IN THE COUNCIL CHA243ERS ON THE
THIRD DAY OF AUGUS1T , 1931. A. D.
Tne meeting was called to order uy Mayor hammerl,
witn Alderman Ahbe, Collet, buster, Pflugnaupt, huxmann,
Kinder, Lacey, Wettiri, Enzenoacher and Meitisnaueen respond-
ing to tne roll. call.
The Clerk then read the reports of C. A. Wegner,
Cheif of Police, Otto . exses Treasurer and .idgar J. Eriedricn
City Clerk, covering the calandarmontn of July. The reports
were referred to the Finance Committee oy Mayor Hammed.
Alderman Buster chairman or tne Judiciary Committee,
nriefly reported on the matter of tne agreement for restitu-
tion of the shortage of Fayette C. Merriii former City Clerk,
and requested Alderman H uxmann to eiauorate upon his report,
Alderman H uxmann reviewed tne gist of tne proposed ordinance.
Then suggesting that the judgement rote mentioned, oear the
date on wnicn tne shortage was first noticed, and tnat tne
agreement include an assignment of wages to tree city. Alder-
man buster tnen stated tnat tne Judiciary Committee recommends
the acceptance of the agreement as outlined oy Alderman .nux-
mann. Tne motion was tneu made uy Alderman buster and seconded
by Enzenoacner tnat tne Judiciary Committees recommendation

City of Des Plaines, Cook County, L.linois:
SECTION$: That tyle Mayor and CityClerk be and they
are nereoy authorized and directed to execute ail necess-
ary documents for tile purpose of consumating tne agreements
for tne ontaining of moneys and securities to apply to
the liquidation or ouligation of r'ayette O..Merrill to the
city of Des Plaines, ana tnat the Mayor,arid City Clerk be
and nereoy autnorized and directed to execute in behalf of
the City of Les Plaines, contract and agreement copies
of wnicn are nereto attached and made part herein, includ-
ing trust agreement and deed of trust attached hereto,
and that tne City of Des Plaines accept from tne said
Fayette 0. Merrill as additional security for the said
obligation, judgment note, copy of which is hereto
attacned.
SECTION 2: 'that tne Mayor and the City of Des Plaines
be and he is nereoy authorized to select a trustee to hold
the property to be placed in trust and to mane agreement
witn sucn trustee for compensation for services of said
trustee.
SECTION 3: That this ordinance snail be in full force
and effect from ana after its passage and tne approval
tnereof according to law.

WHEREAS a shortage in tne moneys of tne City of Des
Plaines in tne sum of seven Thousand Night riuudred Ninety one
and 18/100 Dollars paid to tne former City Cleric Payette 0.
Merrill, due to the mis appropriation or said moneys in said
sum, occured during tne years 1960 and 1u31:and
WHEREAS partial restitution only of such defalcations
bas been made or is to be made at tris time uy said .Fayette 0.
Merrill; and
WHEREAS, it appears that other offices of the City of Des
Plaines during the period of such defalcations are or mayoe
iiaole to tne City or Des Plaines, for negligence or neglect of
duty, for an:' loss sustained oy said City due to such defalcations

It was moved by Alderman tuxmanu and seconded oy uettin to
adopt tnis resolution. It was tnen moved oy Alderman Lacey and
seconded oy Enzenoacner to amend tne resolution so as to-iu-
clude an opinion regarding tne liability of any or ail City
officials during tne past five years. ine roil was called on
tne amendment with tne following result: Ayes; Ahbe, Collet ,
Buster, and Lacey. Hayes: Pflugnaupt, tuxmann, Kinder, wettin
Enaenbacher and Meinsnausen. Tne Mayor tnerefore declared tne
amendment 'lost. ine roll was then called on tne main motion
witn tne following result: Ayes; Aiderman Anoe, Collet, buster,
Pflugnaupt, hinder, tiuxmanu, Lacey, wettlu, linzenoacner and Mein-
snausen. Tne mayor tnereupon declared tne motion carried, and t
the resolution adopted.
The Cleric then rendered second reading of tree following

The motion was made oy Alderman Collet and seconded oy Wettin
that the proposed ordinance oy passed. Tne roll was called on
the motion with tne following result: Ayes Alderman Anne, Collet
Sust.er, rflughaupt, Huxmann, hinder, yacey, Wettin, Enzenbacner,
and Meinshausen. The Mayor tnereupon declared the motion carries
and the ordinance adopted.
Alderman Ahbe Chairman of the Police & License comm-
ittee reported that ne nad no report to render.
Alderman Collet cnairman of tne Streets a sidewalks
Committee reported that ne had no report to render.
Alderman Huxmann however called the Council's atten-
tion to the fact tnat on tne stop signs on our streets are not
clearly visible. Tne matter was referred to tne streets & side-
walks Committee for investigation aha correction.
Alderman meinsanusen chairman of tne nuilaing and
Plats Committee expressed dessatisfaction over tne tact tnat
non-resident teamsters are employed on tne xiverview school
job, and suggested tnat the contractors on tne jot be app-
roached in an effort to employ local lapor.
Alderman Wettin Chairman of tne sewer, Drainage and
Sanitation Committee reported that tne matter of thenacker
Street Sewer is oeing taken care of.
Upon tne request of Alderman Lacey cnairman of tne
Water Committee, the Clerk read a letter sent to Major George
A. 6 uinian, County Supt of highways, requesting the County to
replace tne 12" truck water main on Les rlaines Ave. which has
peen damaged while excavating for tree retainer wall oetween
ilinwood and Miner 'street. Tne motion was made oy Alderman
Lacey and seconded oy collet to refer tne matter to tne Supt.
of .ub11C works. Tne motion was vated upon uy acclamation,
whereupon the .payor declared tr_& moon carried.
The Clerk tnen read tne following report of tne
Water Committees
II- The water is riot of a good domestic quality -Contains
too much sulphur, iron aha Sand.
2- The quantity of sand wnicn is ueing pumped into the
mains is dangerous to tne water system.
3- Tne quantity of water is reaucea to a corrslderaoie ex-
tent.
4- Tne price of water is exoroltant in tnat it exceeds the
reasonable cnarge for water. in any adjoining communi-
ties.

Alderman Lacey suggested tnat some action oe taken to remedy
these conditions. Alderman tiuxmaun inquired wnetner tne owner
of tne well is delivering water of tne quality specified in
his contract. It was moved uy Alderman n uxmann and seconded oy
Collet tnat tne recommendation OS tne Water Committee be
concerned in,.and tnat tne Water committee, the City Attorney
and tne City Lngineer ue instructed to furtner investigate this
matter. Tne motion was voted upon uy acclamation, whereupon
the iayor declared the motion carried.
Alderman nuxmann chairman of the nand Committee re-
ported tnat regular weekly oand Concerts nave peen given during
the Summer, and that next week's concert will oe neld in itiver-
v iew.
Alderman Hinder chairman of tne Fire Commttee stated
teat he nad no report to render.
Tne motion was tnen made oy Alderman riinder and second-
ed by Lnzenbacner that the Alco Ligating Service be ordered to
remove the "stop" lights installed oy tnem and that Aleo Light-
ing service be billed for the expense of replacing the Chicago
Motor Club signs. The roll was called with the following results,
Ayes; Alderman Ahbe, Collet, duster, rfiaugnaupt, kinder, tiux-
mann, Lacey, Wettin, 1nzenoacner and Meinsanusen. Jays; none.

OF THE MUNICIPAL CODE OF DES PLAINES OF 1928.
The Clerk tnen read a letter irom butler, Foster
Pope & Ballard, attorney for Mrs. Wm. A. Limo who crasned into
a curbing on Golf Road damaging ner car to the extend of 4135.80
The letter asks tnat Mrs. Lamb be reimoursed oy the City. The
motion was made by Alderman minder aha seconaea oy Collet to
refer the matter ttt tne Judiciary Committee. `rne motion was
voted upon oy acclamation, wnereupon tne mayor declared the
motion carried.
The Clerk then read a letter from City Attorney David
-b. Maloney dated July :51, 1901. regarding Assessment i4o . 99 in
wnicn Mr. Jaioney makes tne foiiowiug recommendations
1, tnerer'ore, recommend tuat tne City Contest tne attempt
of tne bona no.iaers to restore all of mese assessments to
the assessment roil but tnat the order should be corrected

A motion was made by Alderman Enzenbacner and seconded by Collet
to comply with tne recommendation of Mr. Maloney, and authorize
nim to proceed to restore tne order excepting as to tne State
Aid. The roil was called with tree following result: Ayes;
Alderman Anoe, Collet, buster, rfluanaupt, riuxmann, Lacey,
Wettin, Enzenoacner and Meinsnausen. Nays; Alderman minder. the
Mayor tnereupon declared the motion carried.
The Clerk tnen read a letter from :add. R. Schiagel,
dated Aug. 3rd, 1931 in wnicn Mr. Shclagel adked tne Louncii to
see that the Eliinwood Qt. paving oetween Lee and uraceland Ave.
is finished oerore winter. he also urged tne Council to take
immediate steps toward laying a walk along the south side of Ell*
inwood St. City Engineer Carter Jenkins explained tnat tne
Ellinwood St. paving will oe completed in the near future as tne
contractor is anxious to finish tne job. The motion was then
made by Alderman Huxmann and seconded by Enzenbacner to refer
the matter of laying tne sidewalk along tne south side of Ellin -
wood St. to tne otteets and Sidewalks Committee. The motion
was voted upon by acclamation, wnereupon the Mayor declared tne
motion carried.
The Clerk read a letter from George M. Sundheim
chairman of the Public Relations committee of the village of
LaGrange ill. asking the Councils support in a movement to
change the name of Manneim Road to LaGrange noad. The motion
was made by Alderman H uxmann and seconded by Suster that the
Ciera inform Mr. Sundheim tnat it is the sense the Council
that the name of Manheim road be not changed. Lie motion was x
voted upon by acclamation, whereupon the Mayor declared the
motion carried.

R E S O L U T 1 O!
WHEREAS, tne City Council of tne City of Des Plaines has
'heretofore passed an ordinance authorizing tne issuance of
tax anticipation warrants by the City of Des Plaines in an
amount not to exceed seventy-five per cent (75%) of the total
taxes levied for the year of 1930, payable in 1931;,,and
WHEREAS, it it necessary tnat the City of Des rlaines
issue tax anticipation warrants authorized oy tne said ord-
inance.
BE IT, THEREFORE, RESOLVED that the Mayor of the City of
Des Plaines, be and they are hereby autnorized and directed to
execute Three (a) tax anticipation warrants, Two (2) for the
sum of Two Thousand Dollars, ($2,000.00) each for the General
CORPORATE FUND, and One (1) for the Sum of Two Thousand Doll-
ars, ($2,000.00) for tne SPECIAL PURPOSE FUND dated ,
A. D. 1951, bearing interest at the rate of six per cent (6%)
per annum, copies of which anticipation warrants are Hereto
attached, and tnat tney be autnoriz•ed to sel.i and dispose
of the said warrants for a sum not less tnan par, plus accrued
interest.
The roll was called with the following result: Ayes4 Ahbe,
Collet, Suster, Pflugnaupt, huxmann, Kinder, Lacey, Westin
Enzenbacher and Meinsnausen. ways : ,lone. The Mayor thereupon
declared the motion and resolution adopted
The motion was made by Alderman Wettin and seconded
by Lacey to approve the minutes of tne regular meeting held
June 20, 1931, as written. Tne motion was voted upon by acc-
lamation, wnereupon the Mayor declared the motion carried, and
the minutes approved.
The Mayor tnen announced the appointment of George
Meyer to the office of Special Police. The motion was made
by Alderman Enzenbacher and seconded by Wettin that the council
confirm this appointment. The motion was vated upon by acc-
lamation, whereupon tne Mayor declared tne motion aarried, and
the appointment confirmed.
Alderman Ahbe requested the Cleric to ask F. E. Heid-
eman, contractor to remove his equipment from the Miner St.
Bridge as soon as possible so as to clear the bridge for traffic.
The motion was made by Alderman Suster and seconded
by Pflughaupt to adjourn. The motionvas voted upon by accla-
mation whereupon the Mayor declared the motion carried and
Council regularly adjourned.
