The meeting was called to order by the Mayor Hammerl, with Alderman Abbe, Uollet, rflugnaupt, rtuxwann, Hinder, Lacey, Wetting Enzenbacher and Meinshausen answering to roll call. Alder- man Suster was absent. The Judiciary and Assessment Committee, thru Alderman Hux- mann reported that the corn±a kitee and tar. Carter Jenkins had agreed on the terms of his contract, and that a copy of the final draft had been put into the hands of every Alderman.. The principal change, he explet wined, lies in the rate and basis of compensation. Alderman Huxmann then stated treat the Judiciary.Committee recommends the acceptance of the ordinance ap)ointing Mr. Jenkins city Engineer as well as the pro— posed contract of which each Alderman has a copy. The motion was ivade by- Alderman Anbe and seconded by Lacey that the committees re- commendation be accepted. Tae roll was called on this motion with -the following result: Ayes; Aldermen Anbe, Collet, rflughaupt, Aux.. mann, binder, Lacey, Wettin, Enzenbacher and meinshausen. Nayes; none. .The Mayor therefore declared the motion carried. SECTION 2: That the Mayor and City Clerk of the City of Des Plaines be and they are hereby authorized and empowered to execute contract to the said Carter Jenkins, copy of wzicn is hereto attached. SSECTION 3: That all ordinances or parts of ordi- nances in conflict herewith, be, and the same are hereby repe'tled. Tae Mayor thereupon declared the motion carried, and .the ordinance and contract adopted. 400 Alderman Anbe Chairman of the police & License Committee read a report of the Uneif of police Wegner stating that - a fire plug had been accidentally damaged by an auto driven by a Mrs. .riocourek of Chicago. xepairs amounted to *35.16 which amount has been paid by Mrs. Kocourek to the City Clerk. The matter was referred to the Finance Committee by the mayor. Alderman Collet Chairman of the Streets & Sidewalks Comm- itte reported, that all possible thistles and weeds in the parkways have been mowed, he also reported that'another notice should,be sent the alco Lighting Service with the order to remove the stop lights installed by them. <4 Alderman Wettin Crnfirrnan of tragi Sewer Drainage and San• itation Committee reported that the committee is trying out two ,gat#gge collections per week. he stated that tae committee riopes trrat the schedule of two garbage collections per week can be carried on tnru July and ,august. Alderman Lacey chairman of the Prater committee reported that the Water Department is running along nicely, but that the pump at the well will need a general repairing in tae near future. Alderman---inder of tae .ire Committee reported that inasmuch as the committee members were unable to arrange a meeting he had no report to offer on the matter of tie purchase of the 2000 ft of fire kanic hose for which bids were recently opendd. Tae Building and plats Committee had no report to render. The Clerk then read a letter from the Des inviting the City Ufficiais and their friends to Club meeting Tuesday July 23th, 1931 to hear Mr. Sftentific Crime Detection Dept. of Northwestern the Fire Arms, and .Fire Detector Remonstrations. was accepted. Dear Sirt- 1 ierewita enclose sopy of an opinion which 1 have just given to Otto Rexses, City treasurer of the City of Des Plaines. iir. Aexses recently requested me to give him an opinion as to his right to pay interest on bonds and coupons after maturity of tne bonds and coupons. Upon discussing this matter with Mr. Rexses and the jtolders of certain bonds and coupons and from the inves- tigation i nave made, as far as .1 am able to ascertain, all of tae coupons heretofore issued by the City of Des Plaines, for several years past in special assessment proceedings have provided for tie payment of interest on tine coupons after maturity. Owing to the fact that in most of tne improvements of the City of Des Plaines no sufficient fund is provided for deficiency thf interest, the additional drain of the payment of interest on 'coupons tends to increase the already astounding interest deficiency which exists in Des falmes special assessments. am of the opinion that the Local Improvement Act does not contemplate the paying of any interest on coupons. 1 am, therefore, recommending that in the future no such payments be made. I am writing this as 1 am advised triattne City of Des Plaines and some other municipalities have, in the past, followed the practice of making such payments. It is my opinion that such payments would only tend to increase the diversions form special asse ssmen s which may be in good standing. Very truly yours, DB1u: D. B. Alderman riuxmann inquired as to why the Council's order requesting the City Collector to submit a report to the clerk, showing his collections, -commissions and tie expenses necessary for conducting his office was not complied with. The Mayor ruled that after the comm- issionzmmmaxibummxplmammx is received by the collector,. it is his own private goods, and can spend it as he sees fit without having to report to tie council. The motion was made by Alderman Anbe and dedonded by Enzenbacher that the above proposed ordinance be tabled. Tne Clerk then read the report of the Finance Committee, which was read in meeting of July 6th, tie report follows: Mayor and City Council of tae City of Des Plaines Gentlemen: Your committee, to whom was referred the questipm of considering the ordinance providing for the decrease in the collector's salary to 1?o respectfully reports that it has carefully considered the said ordi- nance and in connection wita its investigation has con- (suited with the City Collector and from the said investi- gation, your Committee is of the opinion that for the next two years the compensation of tne City Collector should remain at 2%. it appears that the collections from special assessments for t3ae year of 1931 have sub- stantially decreased and that in all probability the amount which the CityCollector receives in commissions on the basis of 2% of the amount of moneys collected, will not equal the sum of 45000.00 per year. Your Com mittee is of the opinion that for the next two years tie duties and obligations of the City Collector, in order to receive the said amount of compen- sation, will require constant effort upon the part of the City Collector in the collection of assessments; that by reason of the amount of properties going delin- quent, the work of the City collector will be greatly increased not only in the endeavor to collect assessments, but in the returning of delinquent assessments; that in addition thereto, tne City Collector will be required to spend a very substantial amount of time in the County Collector's office and the County Treasurer's office in checking the return of delinquent assessments. in addi- tion to triis and effort spent, the City Collector will be required to have help in his office, both continuously and specially, in connection with the pre- paration of his delinquent returns and reports. It is tne opinion of your Committee that it is to tne best interests of the City of Des Plaines that the office of City Collector, for the time being, be left on a commission basis, but that your committee recommends that the ordinance :;overning said City Collector be amended so that the gross commissions wnicA the- City Collector shall receive for any one year snail not ex - deed the sum of 55000.00. Your Committee, therefore, recoxmnends.tnat an ordinance be drafted. providing for tne fixing of the cpmpensation for tae city Collector at the sum of 272 of the monies collected on account of special assessments in a. sum not to exceed 35000.00 per year, and that the passage of tae ordinance now before this Board be not recommended, 403 Respectfully submitted, G. 14. Tne supplemental report of tae .inance Committee was then read as fol.lows;- SUPS LEmRNTAL REPORT Your Committee further reports that it has considered the question of the expense to tae City of Des Plaines of maintaining the office of City Treasurer and the City Collector. it appears tnat the amount of collections in special assessment funds is decreasing annually and that the duties and obligations of City Treasurer are becoming more complicated and require the constant at- tention of one experienced in the handling of suet ac- counts. It appearing to this Committee that it would result in a substantial saving to tne City of Des Plaines if tne entire handling of the collection and disbursement of the monies were dandled under tne supervision of one inanacquainted with the handling and disposing of such funds, and would also tend to avoid possible liability of the City of Des Plaines in connection with the mishand- ling of such funds. This Committee, therefore, recommends that prior to the expiration of the present terms of the collector and tne Treasurer that an ordinance be passed providing for the combining of the duties of the Collector and Treasurer under one person to be appointed by the Mayor, with the the approval of the City Council, such person to have the assist- 404 ` ance of necessary clerks in his office. City Attorney Baloney then reported on tne petition submitted by some twenty four miner St. property owners asking_for a nearing on the matter of a promised rebate on the specialassess- ment for the improvement of widening Miner St. tie pointed out that there were being over drafts in tyle first installment, because not enough money had been provided for in the first installment to carry all char€ against it. Nb action was taken in the matter. however, and a rebate on this assessment seemed very 'improbable.
